Secretary Palin announced that the appointment of Bruce Greer to the Planning Commission had been with- drawn by Councilman Thomas. CONSENT CALENDAR: ON MOTION BY SCHUMACHER AND SECOND BY WINCHELL THE CONSENT CALEN- DAR, CONSISTING OF THE MINUTES OF THE REGULAR MEETING OF MARCH 3, 1981 AND CONFORMANCE WITH GENERAL PLAN NO. 81-1, WAS APPROVED BY THE FOLLOWING VOTE: AYES: Bannister, Kenefick, Winchell, Schumacher, Bauer NOES: None ABSENT: Porter ABSTAIN: None ORAL COMMUNICATIONS: Mr. Martin Springfield, 17191 Golden View, Huntington Beach, ad- dressed the Commission in regard to the possibility of establishing a small beauty care shop in a mixed use development at Heil Avenue and Gothard Street. He asked for some amelioration of what he termed the excessive number of parking spaces required for such an operation. Savoy Bellavia explained that the three chair shop as proposed would require 9 spaces and only 4 are available to handle the use; furthermore, the beauty shop is not included in the list of approved uses for this development and the project would also require a request to expand the Commission's resolution under which the mixed use development was approved. After discussion, the applicant was cautioned that it is unlikely that the Commission Minutes, Huntington Beach Planning Commission March 17, 1981 Page 2 would be willing to amend the resolution; he was, however, informed of the application procedure in the event he chooses to pursue the matter. Larry Anderson, attorney representing homeowners' associations in the area of his concern, addressed the Commission to discuss the pending proposals for highrise development at Beach Boulevard and Warner Avenue as they may affect traffic in the immediate vicinity. He also discussed the possibility of a traffic signal at Beach and Terry and the impacts which recent developments have had on that intersection. Mr. Anderson pointed out that there had been a recom- mendation made in 1977 that this particular intersection be provided with a traffic signal, and asked that the matter be investigated and a report made to residents of the area. REGULAR AGENDA ITEMS: CONDITIONAL USE PERMIT NO. 79-23/TENTATIVE TRACT NO. 10853 Applicant: Mola Development Company Operations plan for the excavation of an existing landfill located southeast of the intersection of Bolsa Chica Street and Warner Avenue to permit construction of a 224-unit condominium project. Jim Barnes gave a brief review of the project and the conditions im- posed on its approval and introduced the consultant whose firm had prepared the plan before the Commission for adoption. Jim Crisp of BCL, consultant, reviewed the plan as presented and re- sponded to questions from the Commission in regard to specific areas such as noise generation, hours of operation, and methods of air quality monitoring. He noted that changes in the monitoring plan which were suggested by the South Coast Air Quality Management District have been addressed and included in the plan; he also informed the Commission that West Covina has deemed the EIR accurate and adequate for its purpose. The State Health Department has submitted a letter of certification at the request of the City of West Covina; that jurisdiction has not yet had time to evaluate the letter, but Mr. Crisp indicated that he anticipates it will be found to satisfy the city's concerns. The operations plan was reviewed and discussed at length by the Com- mission and staff. ON MOTION BY KENEFICK AND SECOND BY BANNISTER THE PLANNING COMMISSION APPROVED THE OPERATION PLAN FOR THE EXCAVATION PHASE OF TENTATIVE TRACT 10853 AND CONDITIONAL USE PERMIT NO. 79-23, BY THE FOLLOWING VOTE: AYES: Bannister, Kenefick, Winchell, Schumacher, Bauer NOES: None ABSENT: Porter ABSTAIN: None 1 -2- 3-17-81 - P.C. Minutes, H.B. Planning Commission March 17, 1981 Page 3 ZONE CHANGE NO. 81-1 (Cont. from 3-3-81) Applicant: William J. Scott To permit a change of zone from R2 to R2-0 on property located at the northeast corner of Clay Avenue and Holly Street. Savoy Bellavia pointed out that the staff recommendation on this application has been modified to reflect the designation of the "0" suffix on the area around the existing oil tanks as well as on the originally recommended 25 x 60 foot areas around each onsite well. Chairman Winchell, noting that the public hearing had been opened and closed on March 3 and that Commissioners Kenefick and Bauer, who were absent from that meeting, have not listened to the tape of the hearing, inquired of legal counsel what the correct pro- cedure would be. Jim Georges of the City Attorney's office responded that legally to vote or abstain in such a case is at the discretion of the individual commissioner; however, it is con- sidered improper to vote on a matter which one has not heard and he would recommend that a vote not be cast by anyone not present at the hearing unless he has subsequently listened to the tape of the meeting. He noted that it would be permissible to reopen the public hearing on this matter. Commissioner Kenefick noted that, although the staff report,is quite thorough, she would per- sonally prefer that the applicant have another opportunity to speak. The public hearing was reopened. William Scott, applicant, discussed the uses adjoining his re- quested zone change and said that he feels the "0" designation would be compatible with those uses. Don Weir, 401 20th Street, cited other zone change requests of the same nature which had been granted by the City Council on appeal from the Commission's denial or from the decrease in the area allotted for the "0" designation, and urged that the Com- mission grant the request for the total acreage as desired by the applicant. There were no other persons to speak for or against the proposal and the public hearing was closed. The Commission discussed the comparative circumstances surround- ing each of the recent zoning requests, the changing energy situation in the City and the country, and the intent of staff in making its recommendation for the smaller "O"-designated areas. This denial may be appealed to the City Council. The Commission recessed at 8:10 p.m. and reconvened at 8:15. CONDITIONAL EXCEPTION NO. 81-01 (Cont. from 3-3-81) Applicant: Pacific Design & Development To permit a reduction in parking stall size for a project located on the east side of Gothard Street south of Heil Avenue. Chairman Winchell observed that the Commission finds itself in the same position on this request as on the previous one, in that two members were not present at the prior public hearing. A MOTION WAS MADE BY BANNISTER AND SECONDED BY WINCHELL THAT CONDI- TIONAL EXCEPTION NO. 80-01 BE APPROVED WITH THE FINDINGS AND CONDITIONS OUTLINED IN THE STAFF REPORT. In the ensuing review the Commission discussed the parking management program developed for the original construction of this mixed use project, the commercial parking standards, and the location of the spaces requested to be reduced in relation to the commercial portions of the development. Commissioner Bannister asked if Mr. Springfield's proposed use which had been discussed earlier in the meeting should happen to have been located in this particular project could the re- duced spaces have been used to provide the adequate required number of parking. Upon being informed by staff that this could have been so interpreted, he noted that in that case the Planning Commission would be'granting an exception for undersized spaces to satisfy code require- L -4- 3-17-81 - P.C. 11 1 Minutes, H.B. Planning Commission March 17, 1981 Page 5 ments, and withdrew his motion for approval. Winchell thereupon withdrew her second. Commissioner Bauer cautioned the Commission on permitting the continued spread of commercial uses into the industrial districts. ON MOTION BY BAUER AND SECOND BY BANNISTER CONDITIONAL EXCEPTION NO. 81-01 WAS DENIED WITH A FINDING OF NO SUBSTANTIAL HARDSHIP, BY THE FOLLOWING VOTE: AYES: Bannister, NOES: Kenefick ABSENT: Porter ABSTAIN: None Winchell, Schumacher, Bauer CONDITIONAL USE PERMIT NO. 80-28/TENTATIVE TRACT NO. 11272 Applicant: Donald B. Ayres Jr./Roger DeYoung (Cont. from 12-2-80) To permit a one -lot subdivision of 5.24 gross acres on the north- west corner of Atlanta Avenue and Delaware Street to allow the construction of a 76-unit condominium development. Jim Barnes described the aspects of the project for which a special permit has been requested: Building bulk, roof variation and four -foot offset, and decreased recreation opan space area. He noted that in the opinion of the staff other amenities have been incorporated into the project which offset those areas in which the plan is still short of compliance, and the staff is recommending approval. The public hearing was opened. Ren Newcomb, representing the applicants, addressed the Commis- sion to describe the changes made to the project since its last hearing in an attempt to bring the project closer to code compli- ance, given the constraint of the slabs already being in place. There were no other persons present to address the proposal, and the public hearing was closed. -5- 3-17-81 - P.C. Minutes, H.B. Planning Commission March 17, 1981 Page 6 The project was extensively reviewed by the Commission, and it was the consensus that, although it was apparent that the developer had done all he could do to bring this particular project closer to code compliance, the Commission was not happy with the design of the project and did not wish it to establish a precedent under which future developers will come to them with pads already in place for apartments and expect to construct condominiums thereon in the name o.f providing affordable housing. Chairman Winchell asked that the conditions of approval address the continued affordability of the low-cost units to be included in the project. Steve Kohler, Senior Housing and Community Development Specialist, reported that the Orange County Housing Authority usually provides a condition for 30-year continued affordability in the grant deeds, allowing the price to rise through the Cost of Living Index plus value of improvements. Also, its requirements usually contain an automatic first right of refusal to the Housing Authority. Also discussed were storage space and the location and screening of trash receptacles on the site. THE MOTION PREVIOUSLY MADE BY KENEFICK AND SECONDED BY WINCHELL WAS AMENDED BY BOTH MAKER AND SECOND TO STATE APPROVAL OF CONDI- TIONAL USE PERMIT NO. 80-28 AND TENTATIVE TRACT NO. 11272, WITH THE APPROVAL OF THE SPECIAL PERMIT REQUESTS, WITH THE FOLLOWING FINDINGS AND CONDITIONS. THE AMENDED MOTION TO APPROVE CARRIED BY THE FOLLOWING VOTE: AYES: Bannister, Kenefick, Winchell, Bauer NOES: Schumacher ABSENT: Porter ABSTAIN: None FINDINGS FOR SPECIAL PERMIT: Special Permit approval encompasses the following: 1) Building bulk; 2) Roof variation and four -foot offset; and 3) Decreased recreational open space area. 1. Through modifications of the original site plan and elevations, the applicant has made substantial progress toward conforming with standards in Article 936 of the ordinance code pertaining to building bulk. 2. The proposed project will not be detrimental to the general welfare and convenience of the neighborhood or the City, in that it substantially exhibits the special treatment mandated in Article 936 of the ordinance code to distinguish planned residential developments from apartment developments. FINDINGS - CONDITIONAL USE PERMIT NO. $0-28/TENTATIVE TRACT 11272 1. The proposed subdivision of this 5.24 gross acre parcel of land zoned R2 (Medium Density Residential) is proposed to be con- structed having 14.5 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for this type of housing. 3. The property was previously studied for this intensity of land use at the time the land was designated medium density and the R2 zoning designation was placed on the subject property. 4. The lot size, depth, frontage, street width, and, through the use of a special permit, all other design and implementa- tion features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifica- tions on file with the City as well as in compliance with the State Subdivision Map Act and supplementary City Subdivision Ordinances. -7- 3-17-81 - P.C. Minutes, H.B. Planning Commission March 17, 1981 Page 8 CONDITIONS OF APPROVAL: CONDITIONAL USE PERMIT NO. 80-28 1. The site plan, floor plan, and elevations received and dated February 23, 1981, shall be the approved layout. 2. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 3. Natural gas shall be stubbed in at the location of cooking facili- ties and central heating units. 4. Low -volume heads shall be used on all showers. 5. All building spoils such as unusable lumber, wire, pipe, and other surplus or unusable material shall be disposed of at an offsite facility equipped to handle them. 6. Energy efficient lighting, such as high-pressure sodium vapor lamps, shall be used in parking lots and/or recreation areas. 7. All dwellings on the subject property shall be constructed in com- pliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report prepared under the supervision of a person experienced in the field of acoustical engineering with the application for a building permit. 8. An engineering geologist shall be engaged to submit a report indi- cating the ground surface acceleration from earth movement from the subject property. All structures within this development shall be constructed in compliance with the g-factor as indicated by the geologist's report. Calculations for footings and structural mem- bers to withstand anticipated g-factors shall be submitted to the City for review prior to issuance of a building permit. 9. A solar hot water heating system acceptable to the Department of Development Services shall be incorporated into the development. 10. The covenants, conditions, and restrictions shall contain a provi- sion that will prohibit storage of boats, trailers, and recreational vehicles on site, unless an area that is specifically designated for such storage and which is in compliance with the provisions of Article 936 is provided in the project. 11. If at any time an entry gate is proposed at the main entrance loca- tion, the design shall be reviewed and approved by the Department of Development Services and the Fire Department. 12. Provisions for the continued affordability of the affordable hous- ing units provided for in the project shall be included as defined -8- 3-17-81 - P.C. Minutes, H.B. Planning Commission March 17, 1981 Page 9 by the Orange County Housing Authority. 13. The developer shall submit a plan for the enclosure and land- scaping of the trash areas to the Department of Development Services for review and approval. CONDITIONS OF APPROVAL - TENTATIVE TRACT 11272 1. The tentative tract received and dated March 13, 1981, shall be the approved layout. 2. The water system shall be in accordance with Public Works Department standards. 3. Sewer, drainage, and street improvements shall be in accord- ance with Public Works Department standards. 4. Fire hydrants shall be located in accordance with Fire Depart- ment standards. 5. An erosion and siltation control plan shall be submitted to the Department of Public Works prior to construction of the project. 6. Vehicular access rights, except at the location of approved curb cuts and the intersection of the private street and Delaware Street, shall be dedicated to the City of Huntington Beach. CONDITIONAL EXCEPTION NO. 81-7 - APPEAL FROM BZA DECISION Applicant: Cole Construction Corporation To permit a second floor of an Rl dwelling to encroach five (5) feet into the required front yard setback on property located on the south side of Venture Drive approximately 800 feet east of Typhoon Lane. The public hearing was opened. James Cole, president of Cole Construction, addressed the Com- mission. He submitted photographs of other residences in Hunting- ton Harbour for which he said similar variances had been granted; in the ensuing discussion he said these were all on Trinidad Island, the same location of the subject request. (Commissioner Bauer left the meeting at this point, 9:30 p.m.) Mr. Cole informed the Commission that the encroachment has been discussed with the immediate neighbors and none had any objec- tion. -9- 3-17-81 - P.C. Savoy Bellavia informed the Commission that some of the construc- tion which encroaches into the setbacks in Huntington Harbour had been accomplished without conditional exceptions; he noted that some of the islands had been conditioned for 10-foot setbacks, but Trinidad Island was not one of these. Secretary Palin also said that apparently there had at some time in the past been a different interpretation of the code in this regard and perhaps the better means of addressing the problem would be by a code amendment. A MOTION WAS MADE BY KENEFICK AND SECONDED BY SCHUMACHER THAT CON- DITIONAL EXCEPTION NO. 81-7 BE DENIED WITH THE FINDINGS AS OUTLINED IN THE STAFF REPORT. ON MOTION BY KENEFICK AND SECOND BY WINCHELL THE STAFF WAS DIRECTED TO LOOK INTO THE EXISTING CODE SETBACK REQUIREMENTS WITHIN THE CITY AND REPORT BACK TO THE COMMISSION ON THE POSSIBILITY OF AMENDING THE CODE IF NECESSARY, BY THE FOLLOWING VOTE: AYES: Bannister, Kenefick, Winchell, Schumacher NOES: None ABSENT: Porter, Bauer ABSTAIN: None Commissioner Schumacher indicated that this investigation should also include research into the open space dimensions and square foot- age requirements as discussed by a developer at a previous meeting. CONDITIONAL EXCEPTION NO. 81-02 Applicant: American Balboa Properties A request for the waiver of the requirement for dedication of street right-of-way for Banning Avenue on property located north of Banning Avenue between Brookhurst Street and the Santa Ana River. June Catalano reported that there is a communication from the Depart- ment of Public Works outlining its position on this dedication which has been distributed to the Commission at this meeting. The public hearing was opened. Dan Schonville, applicant, addressed the Commission to ask for waiver of the dedication, describing the dilemma he faces in being asked to -10- 3-17-81 - P.C. Minutes, H.B. Planning Commission March 17, 1981 Page 11 dedicate property which is not under his ownership. He also informed the Commission that the Sanitation District, from which he leases the subject site, has refused to make the dedication. He further stated that at no time during the lengthy processing of his requested zone change and entitlement application on the project had any mention been made of the need for dedication of the proposed Banning Avenue extension until it was applied as a condition of approval for his use. He outlined the terms of his lease and the projected time schedule for the completion of Banning, and stated that granting of a temporary waiver would not be harmful given the two time frames described. Michael Golan, also of American Balboa Properties, also spoke in favor of granting the exception. There were no other persons to speak for or against the subject proposal, and the public hearing was closed. George Tindall explained that if the waiver is granted and con- struction allowed in its proposed configuration the City, when it did acquire dedication from the Sanitation District, would probably have to relocate the drive at its own expense in order to construct the right-of-way. Extensive discussion took place between the Commission and the staff; the Development Services staff was directed to ask the City Attorney to research the question of obtaining dedication from another governmental entity. ON MOTION BY BANNISTER AND SECOND BY KENEFICK CONDITIONAL EXCEP- TION NO. 81-02 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOL- LOWING VOTE: FINDINGS FOR DENIAL: 1. There are no exceptional circumstances that apply to this property that deprive the subject property of privileges en- joyed on other properties in the vicinity and under identical zone classification because the requirement to dedicate real property for streets and alleys is required for all proper- ties prior to issuance of building permits. 2. The approval of this conditional exception would be a grant of special privilege inconsistent with limitations upon other properties in the vicinity and under identical zone classifi- cation because the requirement to dedicate land for streets and alleys applies generally to all properties requesting permits for development. 3. The approval of Conditional Exception No. 81-02 would be materially detrimental to the public welfare because dedica- -11- 3-17-81 - P.C. Minutes, H.B. Planning Commission March 17, 1981 Page 12 tion of Banning Avenue is necessary at this time to relieve traffic congestion in south Huntington Beach and west Costa Mesa. AYES: Bannister, Kenefick, Winchell, Schumacher NOES: None ABSENT: Porter, Bauer ABSTAIN: None Commissioner Bannister informed the Commission that he would have to leave the meeting shortly and asked that items be taken out of order so that any persons present on a subject might have an oppor- tunity to be heard by a quorum of the Commission. DISCUSSION ITEMS: CONDITIONAL USE PERMIT NO. 80-11 Applicant: The William B. Lyon Company Revised Plans and Request for Extension of Time for a proposed senior citizens complex to be located at the Old Civic Center Site.. Steve Kohler, Senior Housing and Community Development Specialist, announced that the California Housing Finance Agency Loan Committee has met and approved the mortgage commitment for this project and the preparation of working drawings can now begin. He described the changes to the plan as follows: 155 units are now provided instead of 157 (within the same building); the 4,000 square feet of commercial use has been eliminated; an additional elevator has been provided in the wing adjacent to 6th Street; the configuration of the interior community spaces has been amended; and the east wing has been shortened to offer a more generous setback between this facility and the recrea- tion center. The Commission reviewed the proposal. ON MOTION BY BANNISTER AND SECOND BY KENEFICK THE REVISED PLAN WAS APPROVED AS FOLLOWS, BY THE FOLLOWING VOTE: 1. Revised site plan received and dated March 4, 1981 shall be the approved layout. 2. A one-year extension of time to expire on May 6, 1982, was granted.
