BOARD MEMBERS PRESENT: Spencer, Cooper, Tindall
MINUTES: MINUTES OF THE REGULAR MEETINGS OF FEBRUARY 25,
AND MARCH 4, 1981 WERE DEFERRED.
REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 81-15
Applicant: Falzon Construction, Inc.
To permit a reduction of 252 sq. ft. of minimum open space located
at 9542 Caithness. This request is a Categorical Exemption Class
5, California Environmental Quality Act, 1970.
Charles Falzon was present to represent the application. Secretary
Spencer briefly outlined the application, noting that a reduction
in the required open space was necessary to accommodate an addition
to the existing structure.
Chairman Tindall opened the public hearing. Secretary Spencer stated
that approximately 1,140 sq. ft. of total open space would be remaining
after the addition was built.
It was noted that the addition will not be projecting beyond the
existing structure.
Chairman Tindall closed the public hearing. Conditions of Approval
were discussed.
ON MOTION BY TINDALL AND SECOND BY COOPER, CONDITIONAL EXCEPTION NO.
81-15 WAS APPROVED BY THE FOLLOWING VOTE, WITH REASONS, FINDINGS AND
CONDITIONS OF APPROVAL AS NOTED HEREIN:
FINDINGS:
1. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity.
2. The granting of a Conditional Exception is necessary in order
to preserve the enjoyment of one or more substantial property
rights.

3. The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property
in the same zone classifications.
4. The granting of the Conditional Exception will not adversely
affect the General Plan of the City of Huntington Beach.
REASON FOR APPROVAL:
Because the encroachment into the required open space is minimal
and the remaining area of open space exceeds minimum of total
open space requirements, the Board of Zoning Adjustments granted
approval.
In addition, the proposed structure will not extend beyond the rear
of the existing building, and will not substantially impact the
remaining open space.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received
March 18, 1981 shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property and improvements in the
immediate vicinity;
- Past administrative action regarding this property.

TENTATIVE PARCEL MAP NO. 81-556
Applicant: James A. Cavalier
To permit the consolidation of three (3) parcels into one (1)
located at 16271 Beach Blvd.
Secretary Spencer introduced the application to the Board, stating
that the request was a requirement of Use Permit No. 78-55, previousl
approved and was substantially within Huntington Beach Ordinance
Code compliance.

ON MOTION BY TINDALL AND SECOND BY SPENCER, TENTATIVE PARCEL MAP
NO. 81-556 WAS APPROVED BY -THE FOLLOWING VOTE WITH CONDITIONS OF
APPROVAL AND FINDINGS AS FOLLOWS:
FINDINGS:
1. The proposed consolidation of three (3) parcels into one
for the purposes of C4 zoning is in compliance with the size
and shape of property necessary for that type of development.
2. The General Plan has set forth provisions for this type of
land use as well as setting forth objectives for implemention
of this type of use.
3. The property was previously studied for this intensity of land
use at the time the land use designation for commercial buildings
was placed on the subject property.
4. The size, depth, frontage, street width, and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standard plans and specif-
ications on file with the City as well as in compliance with the
State Map Act and supplemental City Subdivision Ordinances.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS
FOR ANY PURPOSE:
1. The tentative parcel map received by the Department of
Development Services on March 5, 1981 shall be the approved
layout.
2. A parcel map shall be filed with and approved by the
Department of Public Works and recorded with the Orange
County Recorder.
2. A copy of the recorded parcel map shall be filed with
the Department of Development Services.

SPECIAL EVENT NO. 81-3
Applicant: Janet Matis
To permit a one day parking lot rummage sale April 4, 1981
(alternate date, April 11, 1981). Subject property is located
at 7672 Edinger Avenue.
Secretary Spencer stated that previous parking lot sales had
been approved for this site, and had been no problem. He
recommended approval. Conditions of Approval were discussed.
ON MOTION BY TINDALL AND SECOND BY SPENCER, SPECIAL EVENT NO.
81-3 WAS APPROVED BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The plot plan received March 9, 1981 shall be the approved
layout.
2. A certificate of insurance form shall be filed in the Finance
Department five (5) days prior to the event.
3. Signs shall be prohibited within the public right-of-way area.
