Applicant: Moustafa Riad Al-Dib
To permit the construction of a seven (7) unit apartment building
located on the west side of Elm Street, approximately 190 feet south
of Cypress (17181 Elm: Street) .
This request is covered by Negative Declaration No. 81-15.
ON MOTION BY SPENCER AND SECOND BY HOSMER, THE BOARD HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT
ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 81-15
WITH THE MITIGATING MEASURES CONTAINED IN USE PERMIT NO. 81-17 GENERAL
CONDITIONS #2 THRU 5, IMPOSED ON THE USE PERMIT APPLICATION, BY
THE FOLLOWING VOTE:

Mr. Moustafa Riad Al-Dib was present to represent the application.
Secretary Spencer breifly outlined the application, noting that a
use permit application was necessary, as proposal exceeds five (5)

units in the R-2 zone. He further noted that a tentative parcel
map (TPM 81-557) had been approved previously for this site.
Chairman Tindall opened the public hearing. Mr. Al-Dib was advised
that a revised site plan would be necessary, reflecting proper
dedication on Elm Street (as required on TPM 81-557).
Conditions of Approval were discussed with the applicant. Chairman
Tindall closed the public hearing.
ON MOTION BY SPENCER AND SECOND BY TINDALL, USE PERMIT NO. 81-17
WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL, BY THE
FOLLOWING VOTE:
FINDINGS:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use
or building.
2. The granting of a Use Permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan
of Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received March
19, 1981 shall be the approved layout.
2. Tentative Parcel Map No. 81-557 shall be recorded by
the Orange County Recorder and a copy filed with the
Department of Development Services prior to issuance of
building permits.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property and improvements in the
immediate vicinity;
- Past administrative action regarding this property.
3. The following plans shall be submitted to the Secretary
of the Board:
a. Revised site plan showing proper dedication of
seven (7) feet on Elm Street shall be submitted
to the Secretary of the Board of Zoning Adjustments
prior to issuance of building permits.
B. GENERAL CONDITIONS:
1.
Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers.
2.
Low volume heads shall be used on all showers.
3.
Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
4.
The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the state
acoustical standards set forth for units that lie within the
60 CNEL contours of the property. The interior noise levels
of all dwelling units shall not exceed the California insulation
standards of 45 dba CNEL. Evidence of compliance shall consist
of submittal of an acoustical analysis report, prepared under
the supervision of a person experienced in the field of
acoustical engineering, with the application for building permits -
All measures recommended to mitigate noise to acceptable levels
shall be incorporated into the design of the project.

TENTATIVE PARCEL MAP NO. 81-559
Applicant: Donald Simons
To permit the consolidation of lots located on the north side of
Warner, approximately 170 feet west of center line Beach Boulevard
(7943 Warner).
This request is a Categorical Exemption Class 15, California Environ-
mental Quality Act, 1970.

Mr. Lowell Romberg acknowledged receipt of suggested Conditions of
Approval.
Secretary Spencer stated the tentative parcel map was filed in
compliance with Conditions of Approval imposed upon Use Permit No.
81-8, previously approved.
ON MOTION BY TINDALL AND SECOND BY SPENCER, TENTATIVE PARCEL MAP
NO. 81-559 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL, BY THE FOLLOWING VOTE: -
FINDINGS:
1. The proposed -consolidation of lots for the purposes of a
commercial use (self-service car wash) is in compliance with the
size and shape of property necessary for that type of development.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of use.
3. The property was.previously studied for.this intensity of land
use at -the time the land use designation for C-4 uses, which allo
for self-service car wash facilities was placed on the subject
property.
4. The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are proposed to
be constructed in compliance with standard plans and specifications
on file with the City as well as in compliance with the State Map
Act and supplemental,City Subdivision Ordinances.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR -OCCUPANCY -OF SAID PARCELS FOR
ANY PURPOSE.-
1. The tentative parcel map received by the Department of
Development Services on March 20, 1981 shall be the approved
layout.
2. A parcel map shall be filed with and approved by the Department
of Public Works and recorded with the Orange County Recorder.
3. Warner Avenue shall be dedicated to City standards.
4. A copy of the recorded parcel map shall be filed with the
Department of Development Services.

CONDITIONAL EXCEPTION NO. 81-21
Applicant: G.P. Building Enterprises, Inc.
To permit the reduction of minimum dimension for recreation area.
This request is a Categorical Exemption Class 5, California Environ-
mental duality Act, 1970.
IN CONJUNCTION WITH:
USE PERMIT NO. 81-11
Applicant: G.P. Building Enterprises, Inc.
To permit the construction of a six (6) unit apartment building
located at 17108 Ash Street.
This request is a Categorical Exemption Class 3,

Secretary Spencer introduced the application to
the Board.

Chairman Tindall opened the public hearing. It was noted that the
applicant was not present. Chairman Tindall closed the public hearing.
Chairman Tindall expressed concern regarding the turning radius. He
recommended that the turning radius be reduced from thirty (30) feet
to twenty-eight (28) feet. Additionally, that a planter be constructed
along the north property line, adjacent to the parallel parking area.
Board members discussed Conditions of Approval.
ON MOTION BY SPENCER AND SECOND BY COOPER, CONDITIONAL EXCEPTION
NO. 81-21 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL BY THE FOLLOWING VOTE:
FINDINGS:
1. The size of the lot and its ratio of depth to width are such
to impose physical restraint upon its development. The applicant
has provided a total square footage of open space greater than
that required by ordinance code.

2. Precedence for exception of open space requirements has been
established in this neighborhood.
3. The granting of a conditional exception is necessary in order
to preserve the enjoyment of one or more substantial property
rights.
4. The granting of a conditional exception will not be materially
detrimental to the public welfare or injurious to property in
the same zone classification.
5. The granting of the conditional exception will not adversely
affect the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received March
19, 1981 shall be the approved layout, subject to the
modification described herein:
a. A plan showing a turning radius of twenty-eight (28)
feet (in lieu of thirty (30) feet as shown) shall be
submitted prior to issuance of building permits.
A plan delineating said modification shall be submitted to the
Secretary of the Board. If such plan complies with the modification
outlined by the Board, said plan shall be approved and made a
permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Type of use and its relation to property and improvements in the
immediate vicinity;
- Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary
of the Board:
a. A plan reflecting a two (2) foot landscaping planter
along the north property line adjacent to parallel
parking area.
B. GENERAL CONDITIONS:
1. Applicant shall dedicate and provide street improvements
on Ash Street prior to framing of buildings.

APPROVED BY THE FOLLOWING VOTE, WITH FINDINGS AND CONDITIONS OF
APPROVAL AS STATED HEREIN:
