Mayor Bailey called the adjourned regular meeting of the City Council of the
City of Huntington Beach to order at 7:30 P.M. The Mayor announced that the
meeting had been called for the purpose of meeting jointly with the Planning
Commission to study a condominium conversion ordinance.

Mayor Bailey introduced members of the Condominium Conversion Ordinance
Committee.
CONDOMINIUM CONVERSION ORDINANCE
June Catalano, Deputy Director of the Planning Division, reviewed the purpose
of the Study Session and presented background information relative to the
history of the condominium conversion ordinance.
Mike Adams, Assistant Planner, distributed copies of Article 932, of Division
9 of the Ordinance Code, pertaining to Apartment Standards. He gave an over-
view of the proposed condominium ordinance and its purpose. .
General Discussion
Discussion was held regarding the number of apartments in -the City and the
effects condominium conversion might have on available rental housing. It
was ascertained that there are approximately 8600 apartments in.the City.
The Director of Development Services presented a map depicting apartments,
condominium and planned developments within the City. Discussion was held
regarding the rationale for disallowing conversion of duplexes, tri-plexes and
four-plexes.
Intent and Purpose
Following discussion it was the consensus of Council that the section entitled
"Intent and Purpose" was acceptable as written.

Definitions
The section entitled "Definitions" was discussed. It was the consensus of
Council that the definition of "affordable unit" be amended and that the
County definition of affordable units be used.
Discussion was held regarding the term "as is." It was decided to leave the
term in the ordinance.
Councilman MacAllister recommended that terms describing condominiums, stock
cooperatives, etc. be grouped together, rather than listed alphabetically.
General Provisions Reauired by the Cit
Discussion was held regarding the section entitled "General Provisions Required
by the City." The Assistant City Attorney informed Council that the key
word governing their requirements should be "reasonable. He stated that if the.
requirements seemed reasonable to Council they would probably seem reasonable
to the court.
Discussion was held regarding Item No. 4 under "General Provision Required by
the City" pertaining to additional buyer speculation control measures. The
rental base in the City was also discussed. Further discussion was held re-
garding Item No. 4 and it was the consensus of Council that the words "the City"
be deleted. It was also decided that the "In Lieu Fee" would be set by resolu-
tion.
Development Standards
Discussion was held regarding Article 932 of Section 9 of the Ordinance Code
pertaining to Apartment Standards. It was the consensus of Council that
Section 9320.2 pertaining to density would be deleted from the condominium
conversion ordinance; however, the remainder of Article 932 would be incor-
porated bodily into the condominium conversion ordinance.
The City Administrator questioned the Director of Development Services regard-
ing what would happen if the interior wiring or plumbing of a proposed'con-
version project were deficient due to deterioration. Mr. Palin stated that
the project would have to be brought up to code.
The section entitled "Development Standards" was discussed. It was the con-
sensus of Council to delete Item No. 2 pertaining to television antennas.
Item No. 3 pertaining to deviation from parking and open space requirements was
discussed and it was the.consensus of Council that it be referred to staff for
alternate wording.
Discussion was held regarding requirements pertaining to fire walls and sound
containment. It was the consensus of Council that fire break, sound and
security requirements would be governed by state law and included in this
section of the ordinance.

The Deputy Director of the Planning Division thanked the Condominium Conver-
sion Ordinance Committee for their participation. Mayor Bailey thanked the
Committee and staff and stated that they would meet again to review the
draft ordinance before holding public hearings regarding the matter.
