The granting of the Conditional Exception will not constitute A grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by -other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception dill not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 5. The granting of the Conditional Excepti i will not adversely affect the General Plan of the City of .iantington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 14, 1981 shall be the approved layout. In its approval action, the _B_Qard of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. A tentative parcel map shall be recorded by the Orange County Recorders office and filed with the Department of Development Services, to incorporate the entire development. 2. In the event of a change of ownership, a separation wall shall be reconstructed. -This Condition shall become a part of the recorded deed. BOARD OF ZONING ADJUSTMENTS April 29, 1981 Page 4 ON MOTION BY SPENCER AND SECOND BY TINDALL, ADMINISTRATIVE REVIEW NO. 80-59 WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL AS FOLLOWS: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 14, 1981 shall be the approved layout, subject to the modifications described herein: a. Applicant shall submit revised plan to the Board of Zoning Adjustments showing proper parking layout, landscaping and circulation pattern prior to issuance of building permits. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall b( approved and made a permanent part of the administrative fil . In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. A plan reflecting twenty-seven (27) foot aisle widths to the Department of Public Works standards prior to issuance of building permits. MINUTES: H.B. Two (2) parking spaces at the southeast corner closest to Beach Boulevard shall be eliminated and replaced with land- scaping. 2. Applicant shall meet all applicable local, state and federal ordinances and standards. 3. Low volume heads shall be used on all showers. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material shall be disposed of at an offstie facility equipped to handle them. 5. The structures on the subject property, whether attached or detached shall be constructed in compliance with the state acoustical standards set forth -f units that lie within the 60 CNEL contours of the property. The interior noise levels of all dwelling units shall not exce( the California insulation standards for 45 dba CNEL. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permits. All measures recommended to mitigate noise to acceptable levels shall be inforporated into the design of the project. Burr Dilday To permit the construction of a crematory and refrigeration storage area located on the west side of Beach Boulevard. This request is covered by Negative Declaration No. 81-21. ON MOTION BY SPENCER AND SECOND BY COOPER, THE BOARD HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 81-21 WITH THE MITIGATING MEASURES CONTAINED IN USE PERMIT NO. 81-20 GENERAL CONDITIONS #3,#4,#5, IMPOSED ON THE USE PERMIT APPLICATION BY THE FOLLOWING VOTE: Chairman Tindall introduced the application to the Board. Secretary Spencer briefly outlined the proposal. Mr. D. Dilday was present to represent the application. Mr. Don Jone, Mr. Don Bonfa and Mr. Dave Kirscher were present as interested adjacent property owners. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS April 29, 1981 Page 6 Mr. Dilday briefly explained the request, stating that with the addition of the new structure, there would not be a significant increase in the traffic coming and going. All deliveries would be made inside the new building. Mr. Jones expressed concern regarding overflow of parking which occurs periodically now, and could become much worse. Mr. Dilday stated that most services last thirty (30) to forty (40) minutes, in addition the furniture store adjacent to the site has given permission to use their parking lot. He further stated that the addition of the new service would not create any additional traffic. Mr. Bonfa stated that the windows of his office building look dawn into the area proposed for the addition. He felt that there should be some type of screening, as the nature of the facility is unappealing to his tenants. Secretary Spencer recommended that a block 1 11 with landscaped screening be constructed from the canopy area back to Lhe alley. There was some concern expressed regarding smoke and odor which might occur from the facility. Mr. Dilday stated that the facility is govern by strict state regulations, and must be throughly inspected by the state. He stated that he will contact the city and county for further regulations There being no other parties wishing to speak on the application, Chairman Tindall closed the public hearing. ON MOTION BY SPENCER AND SECOND BY COOPER, USE PERMIT NO. 81-20 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVALS BY THE FOLLOWING VOTE: FINDINGS: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or buildinq 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 1, 1981 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Combination of landscaping and block wall along the south property line shall be constructed from canopy area back to within ten (10) feet of alley line. B. GENERAL CONDITIONS: 1. Proposed crematory shall comply with all state and county regulations prior to use of facility. 2. All delivery and loading operations shall take place within the proposed facility. 3. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS April 29, 1981 Page 8 5. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soils sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets and utilities. AYES: Spencer, Cooper, Tindall NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 81-2 Applicant: Coastline Builders To permit the elimination of lake located at 7715 Newman (Tract 1088). IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 81-25 Applicant: Coastline Builders, Inc. To permit a ten (10) foot high fence for tennis courts at zero (0) property line, located at 7715-35 Newman (Tract 1088). Secretary Spencer breifly outlined the proposal. He stated that the applicant is requesting that a proposed lake be eliminated and replaced with tennis courts. The applicant spoke, stating that the addition of tennis courts would provide more recreational area, would be easier maintained and save energy. The request for a ten (10) foot fence would be necessary to the tennis area. Secretary Spencer stated that the impact of the tennis courts would be minimal on the adjacent industrial project. ON MOTION BY SPENCER AND SECOND BY TINDALL, PLOT PLAN AMENDMENT NO. 81-2 WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL AS NOTED: REASON FOR APPROVAL: Proposed amendment provides additional recreation facilities by eliminating lake and will conserve energy. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received April 6, 1981 shall be the approved layout. BOARD OF ZONING ADJUSTMENTS April 29, 1981 Page 9 ON MOTION BY COOPER AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 81-25 WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL REASONS AND FINDINGS AS NOTED: REASON FOR APPROVAL: Zero property line is common with an industrial subdivision (Ml) and therefore, it is felt to have a minimal impact upon that complex, FINDINGS: 1. BOARD OF ZONING ADJUSTMENTS April 29, 1981 Page 10 TENTATIVE PARCEL MAP NO. 81-562 Applicant: Billy Neal Lavinger To permit the creation of one residential lot from two existing lots located on the east side of Pacific Coast Highway, approximately 449 feet south of Admiralty. This request is a Categorical Exemption Class 15, California Environ- mens4� Quality Act'' 1970. Secretary Spencer recommended that Tentative Parcel Map No. 81-562 be referred to the Planning Commission to be heard in conjunction with Conditional Exception No. 81-05. ON MOTION BY COOPER AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 81-562 WAS REFERRED TO THE PLANNING COMMISSION MEETING OF MAY 19, 1981 TO BE HEARD IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 81-05.
