MINUTES: MINUTES OF THE APRIL 29, 1981 MEETING WERE DEFERRED
REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 81-28
Applicant: Arnold Warshaw
To permit a reduction of minimum open space dimension from 25'
to 22'6", located at 20381 Mansard Lane.
This request is a Categorical Exemption Class 5, California Environ-
mental Quality Act, 1970.
Mr. Warshaw was present to represent the application. Secretary
Spencer introduced the application, stating that the remaining total
open space would exceed code requirements. He further noted that
the lot is of an irregular shape as are most of the lots in this
particular tract.
Chairman Tindall opened the public hearing. Mr. Warshaw stated that
the owner of the tract, Signal Landmark, which holds a land lease
on the property until 1999, has given permission for the reduction.
Conditions of Approval were discussed. Chairman Tindall closed
the public hearing.
ON MOTION BY SPENCER AND SECOND BY COOPER, CONDITIONAL'EXCEPTION WAS
APPROVED FOR THE FOLLOWING REASON, WITH CONDITIONS OF APPROVAL AND
FINDINGS AS NOTED, BY THE FOLLOWING VOTE:
REASONS:
Due to the irregular shape of the lot and placement of existing
structure on said lot, the Board found that a reasonably sized
addition could not be placed on subject parcel.

FINDINGS:
1. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.
2. Because of special circumstances applicable to the subject property,
including side, shape, topography, location, or surroundings,
the strict application of the zoning ordinance is found to
deprive the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone classifications.
3. The granting of a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
4. The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classification.
5. The granting of the Conditional Exception will not adversely affect
the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received April
16, 1981 shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Type of use and its relation to property
and improvements in the immediate vicinity;
- Lot area;
- Lot depth and lot width;
- Past administrative action regarding this property.

To permit a one day public auction - June 27, 1981, located at
17101 Nichols Street.

Mr. Vince Solorzano was present to represent U.S. Rentals, Inc.
Secretary Spencer stated that the event was basically the same
as held latt year. The adjacent church parking lot would accommodate
parking for the auction, as Mast year.
Chairman Tindall requested that the applicant meet with traffic
division of Public Works and the Police Department to review the
proposal.
Secretary Spencer recommended approval, based on the Conditions of
Approval granted in Special Event No. 80-10 and 80-11, previously
approved.
ON MOTION BY SPENCER AND SECOND BY COOPER, SPECIAL EVENT NO. 81-10
WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL AS
STATED HEREIN:
CONDITIONS OF APPROVAL:
1. The plot plan received April 28, 1981 shall be the approved
layout.
2. An on -site inspection by the Fire Department shall be required
prior to the event.
3. Applicant shall provide a certificate of insurance in the
amount of one (1) million dollars to defend and hold harmless
the City of Huntington Beach in the event of legal action. Said
certificate shall be submitted to the Secretary of the Board of
Zoning Adjustments five (5) days prior to the event.

Applicant: Ambrosino & Brown
To permit the construction of a 9,000 sq. ft. industrial/office
building, located on the east side of Talbert, two blocks west
of Beach Boulevard.
This request was previously assessed under Negative Declaration
No. 80-46.

IN CONJUNCTION WITH:
ADMINISTRATIVE REVIEW NO. 81-24
Applicant: Ambrosino & Brown
To permit the construction of a 9,000 sq. ft. industrial office
building located on the north side of Talbert, west side of
Beach Boulevard, Lot 2, Tract 10648.
This request was previously assessed under Negative Declaration No.
80-46.
Mr. Ambrosino, Mr. Brown and Mr. Dail and Mr. Hartge were present
to represent the application.
Chairman Tindall introduced the application to the Board. Secretary
Spencer noted that the applicant had filed a Lot Line Adjustment
application in conjunction with the subject applications.
The Board expressed concern regarding the location of trash enclosures
in relation to the development. It was recommended that a -plan be
submitted to the Secretary of the Board for review and approval.
The location and size of the landscaped islands were of concern.
It was felt that potential illegal.iparking could be eliminated if
the islands were reduced in size.
Fire Representative,Qooper expressed concern regarding the on -site
water plan (hydrants). Mr. Hartge stated that the plan is basidally
the same as approved previously for Tract 10648. Although, buildings
have been redesigned and moved forward toward Talbert, the water
plan is the same.
Chairman Tindall recommended that access from Brookshire be
completed prior to occupancy of the building to ensure better
traffic circulation.
The Board discussed Conditions of Approval with the applicants.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:

April 21, 1981 shall be the approved layout, subject
to the modifications described herein:
a. Applicant shall submit a revised plan reflecting
trash enclosures and locations, and modification
of landscape islands prior to issuance of building
permits.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with
the modifications outlined by the Board, said plan shall be
approved and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
- Lot width and lot depth;
Type of use and its relation to property
and improvements in the immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary
of the Board:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scape specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan. Said
plan shall indicate screening of all rooftop mechanical
equipment and shall delineate the type of material proposed
to screen said equipment.
B. GENERAL CONDITIONS:
1. Prior to issuance of building permit, approval of pending
Lot Line Adjustment No. 81-3 shall be approved. In addition,
Lot Line Adjustment No. 81-3 shall be recorded prior to
occupancy with the Orange County Recorder and a copy filed
with the Department of Development Services.

2. Vehicle access from Brookshire shall be completed per
Huntington Beach Department of Public Works and Fire Departit
standards prior to occupancy of facility.
3. Applicant shall submit for review a copy of the CC&R's,and
shall become a part of the administrative file.

ADMINISTRATIVE REVIEW NO. 81-26
Applicant: S eaborg Construction, Inc.
To permit the construction of three (3) tilt -up industrial buildings
(19,680 sq. ft. , 22,750 sq. ft., 19,680 sq. ft.) , located at the
southwest corner of Nichols and Slater Avenue.
Mr. -Ray Miller and Mr. Roy Hintz were present to represent the
applicant.
Secretary Spencer introduced the application to the Board, stating
that the proposal was substantially within Ordinance Code compliance.
Further, a tentative parcel map (TPM 80-560) was approved previously
on this site. He noted some on -site descrepancies in regard to
Sat dimensions, and recommended that the applicant submit a fully
dimensioned site plan.

Proposed drive approaches were discussed. Chairman Tindall
informed the applicant that twenty-seven (27) ,foot approaches
were required.
Mr. Miller stated that all street improvements have been approved
and are under construction. He expects that all tract improvements
will be completed before construction begins.
Conditions of Approval were discussed with the applicants.

plan prior to issuance of building permits.

modifications outlined by the Board, said plan shall be approved
and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property and
improvements in the immediate vicinity;
- Past administrative action regarding this property.
