REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 81-27
Applicant: R.E. Briggs
To permit a portion of building to encroach three (3) feet into
required ten (10) foot exterior side yard setback, located at
17012 Sandra Lee (Sandra Lee and Warner).
This request is a Categorical Exemption Class 5, California
Environmental Quality Act, 1970.
IN CONJUNCTION WITH:
USE PERMIT NO. 81-22
Applicant: R.E. Briggs
To permit dwelling units abutting an arterial highway, located at
17012 Sandra Lee Lane.
This request is a Categorical Exemption Class 3, California
Environmental Quality Act, 1970.
Mr. R.E. Briggs and Mr. Tom Salkin were present to represent the
applications. Chairman Tindall introduced the applications to the
Board. Secretary Spencer briefly outlined the proposals. He
noted that the parcel is of an irregular shape, further, the encroach-
ment is basically architectural. He stated that the subject site
is located at the cul-de-sac of Sandra Lee Lane.
Chairman Tindall opened the public hearing. Mr. Salkin stated that
he was pursuing approval from the City for a pedestrian easement
between Sandra Lee and Warner Avenue. He stated he was working with
the Department of Public Works on the easement.

Chairman Tindall expressed concern regarding adequate guest parking.
Secretary Spencer stated that four (4) spaces were provided on site,
and additional parking would be accommodated at the cul-de-sac.
Fire Representative Kelly expressed concern regarding water
availability. He requested that the applicant contact the Fire
Department regarding location of hydrants.
Chairman Tindall stated that alley improvements would_be__requuired,
and completed prior to occupancy of the building.
Chairman Tindall closed the public hearing. Conditions of Approval
were discussed with the applicant:
ON MOTION BY SPENCER AND SECOND BY KELLY, CONDITIONAL EXCEPTION
NO. 81-27 WAS APPROVED WITH THE FINDINGS, REASONS AND CONDITIONS
OF APPROVAL AS FOLLOWS, BY THE FOLLOWING VOTE:
REASON:
As subject parcel is highly irregular in shape, and in order to
preserve the architectural integrity of the proposed building,
the requested encroachment of approximately forty-five (45) sq.
ft. is justifiable.
FINDINGS:
1. The granting of the conditional exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.
2. Because of special circumstances applicable to the subject
property, including size, shape, topography, location or sur-
roundings, the strict application of the zoning ordinance is found
to deprive the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone classifications.
3. The granting of a conditional exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
4. The granting of a conditional exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classifications.
5. The granting of the conditional exception will not adversely
affect the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS.
1. The conceptual plot plan and elevations received
April 16, 1981 shall be the approved layout.

In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to
property and improvements in the immediate vicinity;
- Past administrative action regarding this property
B. GENERAL CONDITIONS:
1. Applicant shall comply with all Conditions of Approval
imposed upon Use Permit No. 81-22

FINDINGS:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a, The general welfare of persons residing or working
in the vicinity;
b. Property and improvements in the vicinity of such
use or building.
2. The granting of a use permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan
of Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received
April 16, 1981 shall be the approved layout, subject
to the modification described herein:
a. A plan showing alley treatment at its terminus with
Warner Avenue, shall be submitted prior to issuance
of building permits.

A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modifications outlined by the Board, said plan shall be
approved and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property
and improvements in the immediate vicinity;
- Past administrative action regarding this property.
2. The following plans shall be submitted to the
Secretary of the Board:
a. Landscape and irrigation plan complying with
Article 979 of the Huntington Beach Ordinance
Code and landscaping specifications on file in
the Department of Public Works.
b. Rooftop mechanical equipment screening plan.
Said plan shall indicate screening of all roof-
top mechanical equipment and shall delineate
the type of material proposed to screen said
equipment.
B. GENERAL CONDITIONS:
1. Applicant shall pursue approval of easement for foot
traffic between the cul-de-sac portion of Sandra Lee
and Warner Avenue.
2. Dedication of alley and alley improvements shall be
completed per Department of Public Works standards
prior to issuance of building permits.
3. Applicant shall meet all fire protection requirements
to the standard of the Huntington Beach Fire Department
prior to issuance of occupancy permits.

To permit an automotive restoration business located on the west side
of Redondo Circle, south of Talbert Avenue.

Mr. John Mitchell and Mr. De la Cuesta were present to represent
the application.
Secretary Spencer briefly outlined the application, stating that
several like requests had been approved in the immediate vicinity.
Chairman Tindall opened the public hearing. Secretary Spencer
informed the applicant that no outside storage of vehicles, parts,
etc., would be allowed. All activity is confined inside the
building.
Fire Representative Kelly questioned the applicant regarding flammable
materials. Mr. Mitchell stated that a gas torch would be used for
repair work. Kelly informed the applicant that one (1) hour fire
walls would be required. He recommended that the applicant contact
the Fire Department reqarding requirements.
Conditions of Approval were discussed with the applicant. Chairman
Tindall closed the public hearing.

WAS APPROVED BY THE FOLLOWING VOTE, WITH FINDINGS AND CONDITIONS
OF APPROVAL AS STATED HEREIN:

LOT LINE ADJUSTMENT NO. 81-3
Applicant: Hartge Engineering Company
To permit adjustment of the lot line between Parcels 2 and 3 of
Tract 10648, located on the north side of Talbert Avenue east
of the Southern Pacific Railroad right-of-way.
This request is a Categorical Exemption Class 5, California Environ-
mental Quality Act, 1970.
Secretary Spencer introduced the application, stating that the
proposal was within substantial ordinance code compliance.
Further, the approval of a lot line adjustment was an imposed
Condition of Approval of Administrative Review No. 81-23 and
Administrative Review No. 81-24.
ON MOTION BY TINDALL AND SECOND BY KELLY, LOT LINE ADJUSTMENT NO.
81-3 WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL
AS NOTED HEREIN:
FINDINGS:
1. The amendment does not constitute a substantial change.
2. The existing use of the property remains the same.

CONDITIONS OF APPROVAL:

shall be the approved layout.
B. GENERAL CONDITIONS:
1. Lot Line Adjustment No. 81-3 shall comply with all
criteria as set forth in Section 9811.3 of the
Huntington Beach Ordinance Code.

Applicant: Howard/Leslie Fennel
To permit a twenty (20) foot property line to garage in lieu of
twenty-two (22) feet, in order to relocate garage door and add
to existing dwelling. Subject property is located at 6641 Walton
Drive (Tract 4324).
Secretary Spencer introduced the application to the Board. He noted
that prior to 1969, front -on garages at twenty (20) feet were allowed.
(60%.of the homes in the subject tract have twenty (20) foot drives.
Chairman Tindall opened the public hearing. Mr. Tony Brun was
present to represent the application.
Secretary Spencer noted that several comparable requests were under
construction in the immediate area. Chairman Tindall stated that
full curb and gutters would be required to replace the existing
drive approach. He recommended that the applicant contact the
Department of Public Works for specifications.
Chairman Tindall closed the public hearing. Conditions of Approval
were discussed with the applicant.
ON MOTION BY TINDALL AND SECOND BY SPENCER, CONDITIONAL EXCEPTION
NO. 81-30 WAS APPROVED BY THE FOLLOWING VOTE, WITH FINDINGS, REASONS
AND CONDITIONS OF APPROVAL AS NOTED HEREIN:
FINDINGS:
1. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.

2. Because of special circumstances applicable to the subject proper
including size, shape, topography, location, or surroundings, the
strict application of the zoning ordinance is found to deprive
the subject property of privileges enjoyed by other properties
in the vicinity and under identical zone classifications.
3. The granting of the Conditional Exception is necessary in order
to preserve the enjoyment of one or more substantial property
rights.
4. The granting of a conditional exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classifications.
5. The granting of the conditional exception will not adversely
affect the General Plan of the City of Huntington Beach.
REASON:
Subject property is located within a tract constructed under
pre-1969 standards which allowed front entry garages at twenty
(20) feet. Approximately 60% of the homes within tract have
front entry garages.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received
April 28, 1981 shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property
and improvements in the immediate vicinity;
- Past administrative action regarding this property.
B. GENERAL CONDITIONS:
1. Existing drive approach shall be removed and replaced with
full curb and gutter, per Huntington Beach Department of
Public Works.

ADMINISTRATIVE REVIEW NO. 81-27
Applicant: Seaborg Construction, Inc.
To permit the construction of six multi -tenant (condo) industrial
buildings (7,620 sq. ft. 6,920 sq. ft., 6,920 sq. ft., 7,200 sq. ft.,
6,920 sq._ft._and 7,200 sq. ft.). Subject property is located at
the southwest corner of Nichols Street and Slater Avenue.
Chairman Tindall introduced the application to the Board. Secretary
Spencer stated that the proposal was substantially within Ordinance
Code compliance.
Chairman Tindall expressed concern regarding the grading plan. He
recommended that the plan be submitted the the Department of Public
Works for review and approval. He also noted that dedication and
physical street improvements would be required to be completed prior
to occupancy of the building. He informed the applicant that drive
approaches would be required to meet Public Works standards.
Conditions of Approval were discussed with Mr. Roy Hintz and Mr.
Ray Miller, applicants.
ON MOTION BY SPENCER AND SECOND BY KELLY, ADMINISTRATIVE REVIEW NO.
81-27 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL BY
THE FOLLOWING VOTE:
