BOARD OF ZONING ADJUSTMENTS May 20, 1981 Page 2 ON MOTION BY SPENCER AND SECOND BY KELLY, THE BOARD HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 81-27, WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NO. 81-25 GENERAL CONDITIONS #5 THRU #8, IMPOSED ON THE ADMINISTRATIVE REVIEW APPLICATION BY THE FOLLOWING VOTE: AYES: Tindall, NOES: None ABSENT: None Kelly, Spencer Chairman -Tindall introduced the application to the Board. Mr. Ken Thompson was present to represent the application. Secretary -Spencer briefly outlined the proposal, noting that parking ratios in regard to the amount of warehouse/storage space and office area did not meet code requirements. He stated that the.,plan was deficient by approximately eight spaces (8). He recommended that the applicant make some revisions in the areas allocated for office/ warehousing. Chairman Tindall informed the applicant that drive approaches would have to meet the Department of Public Works standards regarding drive approach widths. Also, that,street,)improvements must be completed prior to occupancy of the facility. ii Secretary Spencer stated that a Tentative Parcel Map had been approved for this particular site (TPM 79-573). He recommended that a copy of recordation be submitted to the Department of Development Services. Further discussion followed. Conditions of Approval were discussed with the applicant. ON MOTION BY SPENCER AND SECOND BY KELLY, ADMINISTRATIVE REVIEW NO. 81-25 WAS APPROVED BY THE BOARD, WITH'CONDITIONS OF APPROVAL AS NOTED, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceputal plot plan and elevations received April 21, 1981 shall be the approved layout, subject to the modifications described herein: a. Site plan shall comply with provisions of the Huntington Beach Ordinance Code regarding parking ratios and landscaping requirements. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS May 20, 1981 Page 3 In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot depth and lot width; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. A plan reflecting revised parking layout shall be submitted to the Secretary of the Board, prior to issuance of building permits. B. GENERAL CONDITIONS: 1. Drive approaches shall be a minimum of twenty-seven (27) feet in width per Department of Public Works Standard Plan 212 A & B. 2. Applicant shall meet all applicable local, state and federal fire codes, ordinances and standards. 3. Proof of recordation of Tentative Parcel Map No. 79-573 shall be submitted to the Department of Development Services. 4. Dedication and Street improvements shall be completed per Department of Public Works standards, prior to issuance of occupancy permits. 5. All building spoils such as unusable lumber, wire, pipe and other surplus or unusable material shall be disposed of at an offsite facility equipped to handle them. MINUTES: H.B. If lighting is included in the parking lot and/or recreation area, energy efficient lamps shall be used (e.g. high pressur sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 7. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site sampling and laboratory testing of materials to provide detailed recom- mendations regarding grading, chemical and fill properties, --_foundations,-retaining.walls and streets and utilities. 8. If foil -type insulation is to be used, a fire retardant type shall:be-installed-as approved by the -Building Department. AYES: Spencer, Tindall, Kelly NOES- None ABSENT:- None CONDITIONAL EXCEPTION_NO. 81-33 Applicant: Ron Hix To permit an. encroachment of fifteen (15) feet into required sight angle, located on the north side of Warner Avenue, approximately 235 feet west of Beach Boulevard. This request is --a Categorical_ Exemption Class 5, (California Environ- mental Quality Act, 1970. IN CONJUNCTION -WITH: USE PERMIT N0. 81-24 Applicant: Ron Hix To permit thee -construction of a 7,412 sq. ft. commercial/office building, located -,on --the north side of Warner, approximately 235 feet west of Beach Boulevard (7923 Warner). This -request -was previously assessed under Negative Declaration No. 7-9-14. - Secretary Spencer introduced the application to the Board. He briefly_explained that the approval of sight angle encroachments are -usually -_to__. -protect the exposure of adjacent properties. He stated that no correspondence had been received from the surrounding property_ owners in relation to this proposal (immediate adjacent property uses consist of'a car wash and a retail business). BOARD OF ZONING ADJUSTMENTS May 20, 1981 Page 5 He further noted that there are not sight angle requirements in the C-4 zone, however, because the proposed building will have a C-2 -use as well as C-4 uses, a conditional exception is necessary. Chairman Tindall opened the public hearing. Mr. Ron Hix was present to represent the application. Chairman Tindall expressed concern regarding the westerly drive approach. He stated that a common drive approach would be necessary, in order to avoid traffic hazards on Warner Avenue He further stated that two separate drives would not be acceptable, as it would create confusion for drivers coming off of Warner. Chairman Tindall stated that if the applicant could not get approval for the common drive on Warner, he would recommend that the building be "flip-flopped" to take access from the east. It was recommended that the applicant meet with the adjacent property owner (retail business) for agreement of a common drive approach. The Board recommended continuing Use Permit No. 81-24 for one week. Chairman Tindall closed the public hearing. ON MOTION BY SPENCER AND SECOND BY KELLY, CONDITIONAL EXCEPTION NO. 81-33 WAS APPROVED WITH THE FOLLOWING REASONS, FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: REASON FOR APPROVAL: Due to placement of existing building on adjacent lots, encroachment into required site angle was determined not to adversely impact those adjacent properties. FINDINGS: 1. The granting of the conditional exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under identical zone classifications. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The granting of a conditional exception is necessary in order -to preserve the.enjoyment of one or more substantial property :rights. 4. The.granting_of a conditional exception will not be materially detrimental to the public welfare or injurious to property in the -same zone classifications. - 5. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 24, 1981 shall be the approvel layout. Chow To permit the construction of a seven (7) unit apartment building abutting an arterial highway, located at the intersection of Sandra Lee and Warner Avenue. Secretary Spencer briefly outlined the proposal. Chairman Tindall opened the public hearing. Mr. Chow was present to represent the application. Chairman Tindall expressed concern regarding the proposed security gate, particulary access to the property. Mr. Chow stated that the gate would be a key type security gate. Chairman Tindall recommended that the Board review the type of gate prior to occupancy of the building. He also expressed concern regarding grades of the drive out to'.1the public right-of-way. He noted a grade differential of approximately 1 1/3 ft, between the drive and the public right-of-way. He expressed his concern regarding the visability which maybe obstructed. Conditions of Approval were discussed with the applicant. The applicant was informed that all drive approaches would be required to be twenty-seven (27) feet in width. Also, that all public improvements shall be completed and dedicated prior to occupancy. Chairman Tindall closed the public hearing. ON MOTION BY TINDALL AND SECOND BY SPENCER, USE PERMIT NO. 81-21 WAS APPROVED WITH THE FOLLOWING FINDINGS, WITH CONDITIONS OF APPROVAL AS NOTED HEREIN: FINDINGS: 1. The establishment, maintenance and operation of the use will not be detrimental to; a. The general welfare of persons residing or working in the vicinity; b. The granting of a use permit will not adversely affect -the General Plan of -the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A.- TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received May 18, 1981 shall be the approved layout, subject to the modifications described herein: a. A plan --reflecting the proposed security gate shall be submitted for review and approval by the Board of Zoning Adjustments. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Applicant shall meet all applicable local, state and federal fire codes, ordinances and standards. 4. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. 5. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 6. Low volume heads shall be used on all showers. 7. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the state acoustical standards set forth for units that lie within the 60 CNEL contours of the property. The interior noise levels of all dwelling units shall not exceed the California insulation standards of 45 bda CNEL. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permits. All measurers recommended to mitigate noise to acceptable levels shall be incorporated into the design of the project. 8. To permit the consolidation of two (2) lots into one (1) lot, located on the east side of Huntington Avenue, at the end of cul-de-sac of Commodore Circle (7631 Commodore Circle- Lots A and 10 of Tract 4026). The applicant ackowledged receipt of suggested Conditions of Approval. Chairman Tindall introduced the application to the Board. Secretary Spencer briefly explained the proposal, noting that the consolidation of the lots would eliminate one lot designated as recreational. MINUTES: H.B. Secretary Spencer noted that access would be taken from the alley, which would necessitate modification of the structures (building and garages) on lot 10. The applicant spoke stating that two (2) essential parking spaces would be eliminated if a modification to the buildings were required. Further discussion ensued. Conditions of Approval were discussed with the applicant. ON MOTION BY TINDALL AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 81-563 WAS APPROVED WITH THE FOLLOWING FINDINGS, AND CONDITIONS OF APPROVAL, BY -THE FOLLOWING VOTE: FINDINGS: 1. The proposed consolidation of lots for the purposes of multiple type dwelling units is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this land use. 3. The property was previously studied for this intensity of land use at the time the land use designation for multiple dwelling units was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinances. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Development Services on May 7, 1981 shall be the approved layout. 2. Vehicular access rights to Huntington Street and Commodore Circle shall be dedicated to the City of Huntington Beach. 4. AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 81-32 Applicant: James Maddux To permit a reduction in minimum open space dimension from twenty- five (25) feet to twenty (20) feet, located at 8402 Millbridge Circle. This request is a Categorical Exemption Class 15, California Environ- mental Quality Act, 1970. Mr. Maddux was present to represent the application. Chairman Tindall opened the public hearing. Secretary Spencer briefly outlined the application, noting that lot size is larger than standard, and remaining open space would exceed Ordinance Code requirements. Chairman Tindall opened the public hearing. Mr. Maddux stated that several homes in the area had added on, in fact, immediate neighbor has the same type of addition. The addition would not go beyond the existing structure. Secretary Spencer stated that the plan fits well with the existing home, and will meet existing code requirements regarding open space dimensions. Also, will supply adequate recreational area. Chairman Tinall closed the public hearing. ON MOTION BY SPENCER AND SECOND BY KELLY, CONDITIONAL EXCEPTION NO. 81-32 WAS APPROVED WITH THE FOLLOWING FINDINGS, REASONS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: REASON FOR APPROVAL: As the remaining yard area will exceed minimum open space, the five (5) foot reduction in one dimension was determined to be minimal and would cause no adverse impact to adjacent properties. FINDINGS: 1. The granting of the conditional exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under identical zone classifications.
