ROLL CALL Present: Thomas, Pattinson, Finley, Bailey, Mandic, Kelly Absent: MacAllister EXECUTIVE SESSION Mayor Finley called an Executive Session of Council for the purpose of dis- cussing litigation and/or personnel matters. RECESS - RECONVENE The Mayor called a recess of Council at 6:30 P.M. The meeting was reconvened at 7:30 P.M. PUBLIC HEARING - COASTAL ELEMENT The Mayor announced that this was the day and hour set for a public hearing for the purpose of considering only those proposed changes to the Coastal Element of the General. Plan based on the Regional Coastal Commission's findings of denial and the realignment of visitor -serving designations to coincide with proposed traffic signals. June Catalano, Deputy Director, Development Services Department, presented in- formation relative to proposed changes to the Huntington Beach Coastal Element. Mayor Finley allowed Council time to read new material pertaining to the Coastal Element. Extensive discussion was held regarding the proposed changes, particularly regard- ing the wetland issue. The City Clerk announced that all legal requirements four publication and posting had been met and that:.she had received no communications or writtenproteststo the matter. The Mayor declared the hearing open. Page #2 - Council Minutes - 6/29/81 Jim Knowles stated that he was a resident of Huntington Shores Mobilehome Park and spoke regarding protection of mobilehome parks in the coastal zone. Ellen Trent stated that she was a resident of Huntington by the Sea Mobilehome Park and spoke regarding low and moderate income housing in the coastal zone. Ed Chowdowski stated that he was a resident of Huntington by the Sea Mobilehome arc. He opposed further development near the beach and urged that Council compromise with the State regarding the Coastal Element. Robert Moore stated that he was the Property Manager for Mills Land and Water Company. He spoke on the issue of the wetlands and requested that Council designate their property Visitor Serving as originally designated in the plan. Natalie Coach requested clarification regarding zoning to which June Catalano responded. Ms. Coach then requested that Council consider the landowner when making decisions regarding the coastal plan. There being no one present to speak further on the matter and there being no further protests filed, either oral or written, the hearing was closed by the Mayor. Extensive discussion was held regarding the action Council should now take re- garding the Coastal Element. A motion was made by Bailey, seconded by Mandic, to delete the area from Beach Boulevard to the Santa Ana River from the Local Coastal Plan. The motion failed by the following tie vote: AYES: Finley, Bailey, Mandic NOES: Thomas, Pattinson, Kelly ABSENT: MacAllister A motion was made by Mandic, seconded by Bailey, recommending approval of certair proposed changes to the Coastal Element as they appear on pages a, b and c of the attachment to the memorandum from the Deputy Director, Development Services De- partment dated June 22, 1981, excluding Section 6 regarding a change in the wet- lands definition. The motion failed by the following tie vote: AYES: Finley, Bailey, Mandic NOES: Thomas, Pattinson, Kelly ABSENT: MacAllister RECESS - RECONVENE The Mayor called a recess of the City Council at 9:18 P.M. The meeting was reconvened at 9:25 P.M. REPLACEMENT OF DESK CHAIRS --APPROVED The City Clerk presented a communication from the Chief of Police regarding the replacement of desk chairs in the Police Department. Page #3 - Council Minutes - 6/29/81 On motion by Mandic, second Kelly, Council approved .the purchase of 150 desk chairs for the Police Department by the following roll call vote AYES: Thomas, Pattinson, Finley, Bailey, Mandic, Kelly NOES: None ABSENT: MacAllister URGENCY ORDINANCE NO 2496 - ADOPTED - FOUR MONTH MORATORIUM - CONVERSION OF MOBILEHOME PARKS The City Clerk presented Urgency Ordinance No. 2496 for Council consideration - "AN URGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH IMPOSING A FOUR MONTH, MORATORIUM ON THE CONVERSION OF MOBILEHOME PARKS TO OTHER USES." On motion by Bailey, second Thomas, Council adopted Urgency Ordinance No. 2496, after reading by title, by the following roll call vote: AYES: Thomas, Pattinson, Finley, Bailey, Mandic, Kelly NOES: None ABSENT: MacAllister FAIR HOUSING COUNCIL OF ORANGE COUNTY - CONTRACT FOR SERVICES - APPROVED The City Clerk presented a transmittal from the Development Services Department, HCD Division, of an agreement between the City and the Fair Housing Council of Orange County as part of the Seventh Year Housing and Community Development Block Grant Program. On motion by Mandic, second Kelly, Council approved and authorized execution of an agreement between the City and the Fair Housing Council of Orange County and authorized immediate disbursement of the $15,000 payment. The motion carried by the following roll call vote: AYES: Thomas, Pattinson, Finley, Bailey, Mandic, Kelly NOES: None ABSENT: MacAllister VENDOR CONTRACT FOR AUTOMATED RECORDS SYSTEM - APPROVED - ALTA ASSOCIATES The City Clerk presented a transmittal from the Chief of Police of a contract between the City and Alta Associates for the provision of software and hardware for the Automated Reporting System. On motion by Pattinson, second Kelly, Council approved a contract between the City and Alta Associates for the provision of software and hardware for the Automated Reporting System for the Police Department. The motion carried by the following roll call vote: AYES: Thomas, Pattinson, Finley, Bailey, Mandic, Kelly NOES: Done ABSENT: MacAllister Page #4 - Council Minutes - 6/29/81 RELOCATION OF COMMUNITY CLINIC - DISCUSSED The City Clerk presented a communication from the City Administrator regarding the Council's motion at the dune 1, 1981 Council meeting relating to the relo- cation of the Community Clinic as follows: "A motion was made by Bailey, seconded by Thomas, to study the feasibility of relocating the Community Clinic to the corner of 5th and Main Streets." Mayor Finley stated that she would allow public comments regarding the matter. Doris Hicks stated her objections to relocating the Community Clinic on Main Street and offered her services as a real estate broker to find a location for the Clinic outside the downtown business district. John Parnakian stated that he had conducted a.poll of property owners in the area and that they unanimously objected to relocating the Community Clinic on Main Street. Robert Smith stated his opposition to relocating the Community Clinic on Main Street. Mayor Finley asked Councilwoman Bailey what the intention was on the motion she made at the meeting of June lst. Councilwoman Bailey stated that the in- tent of her motion was a study of the feasibility of relocating the Clinic to that area which meant that the matter was to come back before Council with a recommendation so that it would go through the proper process. John Parnakian stated that there was a vacant medical building on Orange Avenue and suggeste that it be used for the Community Clinic. Discussion was held regarding relocation of the Clinic. A motion was made by Pattinson, seconded by Kelly, to relocate the Community Clinic to 5th Street, south of Orange Avenue, on a parking lot at that location. Natalie Coach urged Council to defer relocation of the Clinic as she was certain an a ternate location could be secured. The City Administrator suggested that Council authorize him to investigate al- ternative solutions regarding the location of the Community Clinic, communica- ting with Council via memorandum, and if he failed to find an acceptable perma- nent site the alternative site at 5th Street, south of Orange Avenue, could be utilized as a temporary relocation site. The motion made by Pattinson, seconded by Kelly, was amended to authorize the City Administrator to use his discretion to find a suitable site for the Community Clinic and if an acceptable site could not be found the parking lot on 5th Street, south of Orange Avenue would be utilized as a temporary reloca- tion site for the Clinic, and further directed the City Administrator to bring the matter back before Council at the July 6, 1981 meeting. The motion carried by the following roll call vote: AYES: Pattinson, Finley, Bailey, Mandic, Kelly NOES: Thomas ABSENT: MacAllister Page #5 - Council Minutes - 6/29/81 PIER CLOSURE FOR 4TH OF JULY - APPROVED The City Administrator informed Council that the Police Department requested permission to close the pier from 6:00 P.M. to 5:00 A.M. on the 4th of July. A motion was made by Pattinson, seconded by Thomas, to close the pier ❑n the 4th of July from 6:00 P.M. to 5:00 A.M. The motion carried unanimously. HELIPORT LAND ACQUISITION - APPROVED The City Administrator presented a communication from the Chief of Police recommending that the City acquire 4.85 acres of land on Gothard Street directly south of the Fire Department Training Center which is presently owned by Sully -Miller Company; the westerly 2.5 acres of land to be used for a permanent heliport and helicopter maintenance center, and the remaining 2.35 acre frontage to be sold to offset purchase costs. On motion by Bailey, second Kelly, Council approved the recommendation of the Police Chief by the following roll call vote: AYES: Thomas, Pattinson, Finley, Bailey, Mandic, Kelly NOES: None ABSENT: MacAllister COASTAL ELEMENT - MINOR CHANGES APPROVED The City Administrator requested that Council again consider the proposed changes to the Huntington Beach Coastal Element. Following discussion, a motion was made by Mandic, seconded by Bailey, to approve the following changes to the Huntington Beach Coastal Element: Section 2 divider, "Definitions" Add the following de inn tions: CONCESSION STAND A small-scale, one-story structure used for sales of refreshments and beach -related sundries. Pg. 110, 5th paragraph, "High Density" Delete the following sentence: "The adoption of a new zoning district or specific plan would be necessary to allow residential development in excess of 35 units per acre." Pg. 133, add at end of paragraph 5 The least tern nesting site on Huntington State Beach is designated "Conservation". Pg. 133, add at end of paragraph 5 New buildings on the pier shall not exceed 35 feet in height measured from the surface of the pier. Public access shall be required around the entire perimeter of the pier. S Page #6 - Council Minutes - 6/29/81 Pg 143, Policy 8f Change as follows: Limit diking, dredging, and filling of coastal waters, wetlands, and estuaries to the specific activities outlined in Section 30233 and 30607.1 of the Coastal Act and to those activities required for the restoration, maintenance, and/or repair of the Municipal Pier; conduct any diking, dredging, and filling activities in a manner that is consistent with Section 30233 and 30607.1 of the Coastal Act. Pg. 144, Add Policy 9e Prohibit all uses within the Least Tern nesting site on Huntington State Beach except those related to habitat restoration. Pg. 146, Policy 12b Change as follows: As part of the permit process, require the mitigation of adverse impacts from new technologies employed in electricity generation to the maximum extent feasible. Pq.144,_ Policy 12c Change as follows: Encourage unitization and consolidation of existing oil operations and require the consolidation of new or expanded operations in accordance with policy Da to the maximum extent feasible and legally permissible when such activities (1) reduce the area used for oil facilities, (2) are not more environmentally disruptive than existing arrangements and (3) do not jeopardize public health, safety or welfare. Pg. 1472 Policy 12d Change as follows: Utilize the (oil) suffixes to ensure that coastal dependent energy extraction is accommodated in areas designated other than "resource production," except for environmentally sensitive habitat areas. Pg_. 149, Policy 13g Change as follows: As part of the permit process, require that a survey be conducted along the route of any new pipeline in the coastal zone to determine what, if any, coastal resources may be impacted by construction and operation of pipeline. Pg. 149, Policy 13h Change as follow: Require the routes of new pipelines and transmission lines to avoid important coastal resources, including recreation areas and sensitive habitats, to the maximum extent feasible; pipelines which cannot be routed to avoid such areas shall be constructed and maintained in ways that minimize the impacts from spills or leaks to the maximum extent feasible; appropriate cleanup and spill prevention measures shall be included in a spill contingency plan. P . 149, Polic 131 Change as follows: Encourage new transmission line corridors to be consolidated with existing electrical transmission corridors, where feasible, unless there are overriding technical constraints or significant social, aesthetic, environmental or economic concerns. Pg. 149, Add Policy 13m Require new pipelines including offshore to onshore lines to be consolidated in existing pipeline corridors, where feasible, unless there are overriding technical constraints or significant social, aesthetic, environmental or economic concerns. Pg. 149, Policy 13n Change as follows: As part of the permit process, require mitigation measures to re- pair scarring, grading or other vegetative removal resulting from transmission line or pipeline installation or maintenance through methods including but not limited to spreading topsoil removed in pipeline trenching over the surface of the construction area; affected areas are to be revegetated with plants similar to those in the area. Pg. 153, Add Policy 161 Ensure -that adequate parking is provided in all new development in the coastal zone utilizing one or a combination of the following: Apply the City's parking standards at a minimum Develop parking assessment districts to build off -site parking structures Utilize new parking standards specific to the Coastal Zone in conjunction with the development of off -site parking strategies. Pg. 153, Add Section on Hazards: 10.5.9 H Policy 17 "Incorporate the policies of the City's Seismic -Safety Element as the major component of the L.C.P. addressing hazards in the Coastal zone." Pg. 153, Change Section numbering in "ADMINISTRATION" from 10.5.9 to 10.5,10• and change number 17 to 18. Additional policy: 16L. Promote the increased capacity of PCH if necessary to improve circulation and safety in the coastal zone. Page #8 - Council Minutes - 6/29/81 The motion carried by the following roll call vote: AYES: Pattinson, Finley, Bailey, Mandic, Kelly NOES: Thomas ABSENT: MacAllister REBUILDING OF HELICOPTER - APPROVED The City Administrator presented a communication from the Chief of Police re- questing that Council authorize funds, in the amount of $21,700, to complete the rebuilding of a helicopter. On motion by Pattinson, second Mandic, Council authorized the expenditure of $21,700 to complete the rebuilding of a helicopter by the following roll call vote: AYES: Thomas, Pattinson, Finley, Bailey, Mandic, Kelly NOES: None ABSENT: MacAllister TRANSPORTATION COMMISSION Mayor Finley appointed Councilmembers Pattinson and Bailey as liaison to the Transportation Commission and requested recommendations for appointments to that Commission. COMMITTEE ON AFFORDABLE HOUSING Mayor Finley requested recommendations for appointments to the Committee on Affordable Housing. She stated that the Huntington Beach/Fountain Valley Board of Realtors are the lead agency for that Committee. PERMISSION TO BE ABSENT 7120181 - FINLEY - GRANTED Mayor Finley requested permission to be absent from the July 20, 1981 Council meeting. On motion by Bailey, second Kelly, Council granted Mayor Finley permission to be absent from the July 20, 1981 Council meeting unanimously. SB 493 - RE COASTAL ZONE - OPPOSED Councilman Kelly spoke regarding SB 493 introduced by Senator Paul Carpenter relative to the California Coastal Zone. On motion by Kelly, second Bailey, Council opposed SB 493 and directed that Minute Action be forwarded to the State Legislators by the following roll call vote: AYES: Finley, Bailey, Mandic, Kelly NOES: Thomas, Pattinson ABSENT: MacAllister A Page #9 - Council Minutes - 6/29/81 ADJOURNMI IT The Mayor adjourned the adjourned regular meeting of the City Council of the City of Huntington Beach to 6:30 P.M., Monday, July 6, 1981' in the Council Chamber.
