BOARD MEMBERS PRESENT: Spencer, Tindall, Kelly MINUTES: ON MOTION BY SPENCER AND SECOND BY TINDALL, THE MINUTES OF THE REGULAR MEETING OF JULY 1, 1981 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Tindall NOES: None ABSENT: None ABSTAIN: Kelly AGENDA ITEMS TO BE CONTINUED: 1. ADMINISTRATIVE REVIEW NO. 81-41 Applicant: Western Athletic Club Administrative Review No. 81-41 was continued, to be heard in conjunction with a Conditional Exception to be filed by the applicant. REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 81-46 Applicant: Ronald L. Webb To permit a patio cover (structure) to be located within the twenty foot setback from a public street. Subject property is located at 6952 Beachcomber, Huntington Beach. The applicant was not present. ON MOTION BY SPENCER AND SECOND BY KELLY, CONDITIONAL EXCEPTION NO. 81-46 WAS CONTINUED TO THE JULY 29 MEETING, IN ORDER TO GIVE THE APPLICANT THE OPPORTUNITY OF BEING PRESENT, BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 81-47 Applicant: Daniel J. Fink To permit a reduction in required turning radius and an encroach- ment into the rear yard setback. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS July 15, 1981 Page 2 Subject property is located at 415 Crest Avenue, Huntington Beach. This request is a Categorical Exeption Class 5, California Environmental Quality Act, 1970. Secretary Spencer gave a brief description of the application and code requirements pertaining to the proposed garage and carport structures. Daniel Fink was present to represent the application, together with Stirling Vozenilek who had sold him the property. Chairman Tindall opened the public hearing. Secretary Spencer pointed out that the reduction in turning radius requested by the applicant was enjoyed by other residents in the area. In his opinion, the property would accommodate another garage structure at the required setback. Discussion was held by the board on the matter. Secretary Spencer informed the Board that the same request had been made by the previous owner and denied one year ago. The reason given by the Board at that time being that the applicant failed to demonstrate hardship. Stirling Vozenilek agreed with the applicant, that in her opinion the structure would not look good if built to code. Following considerable discussion, the Board agreed to view the site with a view to finding acceptible hardship. ON MOTION BY KELLY AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 81-47 WAS CONTINUED TO THE JULY 22, 1981 MEETING IN ORDER TO GIVE THE BOARD THE OPPORTUNITY TO VIEW THE SITE, BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 81-49 Applicant: Superior Cable Construction Inc. To permit a contractors storage yard. Subject property is located on the west side of Crystal Street, Huntington Beach. This request is a categorical exemption Class IIb, California Environmental Quality Act, 1970. LJI 1 MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS July 15, 1981 Page 3 Secretary Spencer briefly explained the application. He informed the Board that he did not believe there was any problem with the application other than the applicant's obli- gation for the required improvements. Kathie Crabtree was present to represent the application. She explained that the building was being leased,and the proposed contractor's storage yard would be used for the purpose of over- night parking onlv and not for storage. Considerable discussion was held by the Board. It was ascertained that although the request for the storage yard was for a temporary yard for one year only since the property was being leased, it could not be granted without applicable code requirements being met in regard to landscaping, curbs, gutters, steet dedication and improvements. Secretary Spencer explained that whilst Gothard Street was being realigned, bonds would be posted on any improve- ments to Crystal Street until the right-of-way had been established. ON MOTION BY SPENCER AND SECOND BY KELLY, ADMINISTRATIVE REVIEW NO 81-49 WAS APPROVED, SUBJECT TO ALL APPLICABLE CODE REQUIREMENTS AND DEDICATIONS,. BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 18, 1981 shall be the approved layout, subject to the modifications described herein: a. Revised plan submitted to Board reflecting screening wall, landscaping, parking per Ordinance Code requirements. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. Applicant shall post bond in lieu of street improve- ments to the approval of the Department of Public Works. MINUTES: H.B. Applicant shall enter into irrevocable offer of dedication of 40 ft. from center line of Crystal St. and improvements of Crystal Street adjacent to property. All applicable code requirements pertaining to street dedi- cation and improvements and landscaping shall be complied with per Department of Public Works' standards. The Department of Development Services will perform a comprehensive lan check relating to all Ordinance Code requirements upon submittal of your completed structural drawings. Code requirements for the area were discussed and the applicant informed the Board that more than likely, Superior Cable Construc- tion would be forced to vacate the premises in view of the code requirements. VOTE: Spencer, Tindall, Kelly NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 81-50 Applicant: Bela Peller To permit a restaurant conversion at 411 Olive Avenue, Huntington Beach. This request is a categorical exemption Class 2, California En- vironmental Act, 1970 Secretary Spencer gave a brief description of the application. Bela Peller, the applicant, was present and explained his request. Secretary Spencer informed the applicant that the Board had sug- gested that the proposed driveway be moved over with perpendicular parking with six parking stalls; the driveway approach being moved a little further down the street. He stated that physical improve- ments pertaining to landscaping and parking would have to be met as required by the Huntington Beach Ordinance Code, Section 979. Various alternatives to moving the City's parking meter in the immediate area were discussed. ON MOTION BY SPENCER AND SECOND BY KELLY, ADMINISTRATIVE REVIEW NO. 81-50 WAS APPROVED WITH SITE PLAN DATED JUNE 10, 1981 BEING THE CONDITIONALLY APPROVED PLAN WITH REVISED PLAN SUBMITTED BACK TO THE BOARD REFLECTING THE PARKING, STRIPING, LANDSCAPING AND NEW DRIVEWAY LOCATION, BY THE FOLLOWING VOTE: MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS July 15, 1981 Page 5 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 17, 1981 shall be the approved layout, subject to the modifications described herein: a. Applicant shall submit revised plans reflecting a relocation of 5th Street drive approach, on -site parking, layout and striping and landscaping, per Section 979 of the Huntington Beach Municipal Code. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the ad- ministrative file. In its approval action, the Board of Zoning Adjustments con- sidered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material pro- posed to screen said equipment. B. GENERAL CONDITIONS: 1. Relocation or removal of existing parking meter and necessary cars marking per Public Works specifications. Board member Cooper explained the action of the Board and the procedure involved thereafter to Mr. Peller. MINUTES: H.B.
