Subject property is located on the northeast corner of Warner Ave. and Green St. This request is a categorical exemption Class 15, California Environmental Quality Act, 1970. ON MOTION BY SPENCER AND SECOND BY CROSBY, TENTATIVE PARCEL MAP NO. 81-570 WAS CONTINUED TO THE AUGUST 26 MEETING, BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, Kelly NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 81-3 Applicant: Huntington Intercommunity Hospital To permit a 12 ft x 60 ft modular office structure. Subject property is located at 17772 Beach Blvd., Huntington Beach. This request is a categorical exemption Class 3, California Environmental Quality Act, 1970. Michael B. McAllister was present to represent the application. Acting Chairman Crosby outlined the application and opened the public hearing. Secretary Spencer informed the Board that he had some concerns with the application, which he found confusing. Apparently, the plan showed the building to be to be 60 ft. x 60 ft. and the application had indicated a 12 ft x 60 ft. building. He stated that the plot plan would have to be readvertized in order to be heard with the correct dimension of 60 ft. x 60 ft. Fire Chief Kelly informed the applicant that the building was too close to the oxygen system and suggested that he contact Fire Protection Specialist Larry Marshburn. Subject property is located on the south side of Warner Ave., 660 ft. from Gothard Street. This request is a categorical exemption Class 3, California Exemption Class 3, California Environmental Quality Act, 1970. Secretary Spencer informed the Board that at the request of the applicant, Administrative Review No. 81-53 had been con- tinued to November 18, 1981. ADMINISTRATIVE REVIEW NO. 81-58 Applicant: Stan Smith To permit additional parking for approximately two years. Subject property is located at 5352 Research Drive, H.B. This request is a categorical exemption Class II, California Environmental Quality Act, 1970. Stan Smith, applicant, was present., The Secretary of the Board referred to the storage problem in this area. He stated that the request has been pre-empted by an amendment which prohibits outside storage in the M1-A zone. Without a variance, he informed the Board, it would be impossible to process the application. The Secretary of the Board explained the procedure for applying for a Conditional Exception, however, he believed there would be a difficulty in demonstrating hardship. He also explained the revision to the code. The applicant informed the Board that he leased two or three lots on Research Drive which he believed should be called Industrial Drive. BOARD OF ZONING ADJUSTMENTS August 19, 1981 Page 4 ADMINISTRATIVE REVIEW NO. 81-60 Applicant: James R. Johnson To permit a 48,335 sq. ft. office/professional building. Subject property is located at 17381 Beach Blvd. This request is covered finder Negative Declaration No. 78-23 previously covered by the Board. James R. Johnson, applicant, was present. A request wus made by the Secretary of the Board to continue the matter'until_the applicant had•had the.opportunity to meet with the Fire Department to revise his plan: -He outlined the application. Fire Chief Kelly referred to the plot plan and a potential problem with archway going over the rear parking lot. He believed it would be impossible to get extinguishing equipment to the area in case of a fire. He suggested that the canopy go only to 13.6 ft. and also that on -site hydrants would be required. Mr. Johnson responded that it would be impossible to get the canopy to go to only 13.6 ft. and suggested that perhaps it could just meet fire requirements. Discussion was held on the matter. ON MOTION BY SPENCER AND SECOND BY KELLY, ADMINISTRATIVE REVIEW NO. 81-60 WAS APPROVED, WITH FINDINGS AND CONDITIONS OF APPROVAL AS FOLLOWS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received Auciust 3, 1.981 shall be the approved .payout, subject to the modification described herein: a) Access to rear parking compound be approved by the Fire Department. A plan delineating said-modifications_shall be submitted to the Secretary of the Board- if such plan complies with the modifications outlined by the Board, said plan shall he approved and made a permanent part of the Administration file rn its approval action, the Board of. Subject property is located on the northeast corner of Gothard Street and Center Drive. John Cottor, Director of Facility Planning was present to represent the application. Discussion was held on the temporary parking arrangements at the college. ON MOTION BY CROSBY AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 81-571 WAS APPROVED, WITH FINDINGS AND CONDITIONS OF APPROVAL AS FOLLOWS, BY THE FOLLOWING VOTE: BINDINGS: 1. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implemen- tation of this type of use. 2. The property was previously studied for this intensity of land use at the time the land use designation for Public Use was placed on the subject property. -5- 8/19/81 BZA MINUTES: H.B. The size, depth, frontage, street width and other design and improvements features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The tentative parcel map received by the Department of Develop- ment Services on July 20, 1981 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Depart- ment of Public Works and recorded with the Orange County Recorder. 3. Gothard Street and Center Drive shall be dedicated to City standards. 4. A copy of the recorded parcel map shall be filed with the Department of Development Services. Reynolds To permit (1) Room addition to encroach five (5) ft. into rear yard setback; (2) Garage addition to encroach fourteen (14) ft. into front yard, and (3) a five (5) ft. high wall to encroach into front yard setback. Subject property is located at 9421 Leilani Dr., H.B. This request is a categorical Exemption Class 5, California Environmental Quality Act, 1970. At the request of the applicant, Conditional Exception No. 81-49 was continued to September 16, 1981. CONDITIONAL EXCEPTION NO. 81-56 Applicant: Allan R. White To permit reduction in open space dimension. Subject property is located at 18042 Freshwater Circle, H.B. Discussion was held by the Board in regard to open space and dimension. There being no one further to speak on the matter, the hearing was closed. ON MOTION BY SPENCER AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 81-56 WAS APPROVED WITH REASONS, FINDINGS AND CONDITIONS OF APPROVAL AS FOLLOWS, BY THE FOLLOWING VOTE: REASONS FOR APPROVAL: The chanting of Conditional Exception No. 81.-56, permitting a reduction in open space dimension is justifiable in order to: 1. Grant parity with similar requests granted previously by the Board; 2. The total square footage of open space meets the ordinance code requirements with the only deficiency being the reduced open space dimension; 3. There is no detriment to the surrounding properties created by the addition to the dwelling. FINDINGS: 1. The granting of the conditional exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under identical zone classifi- cations. 2. necause of special circumstances applicable to the subject property, including size, shave, topography, location, or surroundings, the strict application of the zoninq ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights 4. The conceptual plot plan and elevations received Auqust 3, 1981 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the f.ol.lowing issues relating to the conceptual plan: - Lot width and lot depth; - Tvpe of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. AYES: Spencer, Crosby, Kelly NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 81-57 (UP NO 81-9) Applicant: James L. Foxx To permit six parking spaces with two compact car spaces and one tandem parking space. Subject property is located at 305 17th Street, Huntington Beach. Dan Foxx, applicant's representative, was present. Chairman Crosby opened the public hearing. Mr. Foxx addressed the Board in support of the requests, noting that the filing satisfied one of the conditions of approval imposed when the qualified zoning was established on the prop- erty. He cited the requirement for dedication of access rights on 17th Street to the City as justification of hardship for the conditional exception request, saying that this re- quirement makes it impossible to meet the parking requirements for his use in any other fashion. There were no other persons present to speak for or against the proposals, and the public hearing was closed. The Board discussed extensively the history of the property and the parking problems on the site. Included in the Board's review was the need for a parcel map to consolidate the two 25-foot parcels which presently constitute the subject site, the desirability of upgrading the property, and the fact that the Planning Commission has approved an code amendment which would allow compact car parking spaces in certain commercial developments. It was the consensus of the Board that, in addi- tion to the requirement of the "Q" zoning, it would be appropriate to condition the tentative parcel map for the pro- ject with the dedication of 17th Street access rights. -8- 8-19-81 - BZA Minutes, H.B. Board of Zoning Adjustments August 19, 1981 Page 9 ON MOTION BY CROSBY AND SECOND BY KELLY CONDITIONAL EXCEPTION NO. 81-57 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: REASONS FOR APPROVAL: 1. The proposed tandem parking and one (1) compact parking space was found not to be detrimental to the surrounding properties or community. 2. Requested parking considerations would result in both the use and huilding being more compatible with the community and neighborhood. 3. Requested parking consideration would eliminate an existing hazardous condition where automobiles are allowed to back onto an arterial highway (17th Street). FTNDINGS: 1. The granting of the conditional exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity. 2. Because of special circumstances applicable to the subject propertv, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity. 3. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property .rights. 4. The qranting of a conditional exception will not be materially detrimental to the public welfare of injurious to property in the same zone classifications. 5. The granting of the conditional exception will not adversely affect the General Plan of the City of iluntington Beach. CONDITIONS OF APPROVAL: A. Application is found to meet conditions .imposed through the properties previous zoning considerations. FINDINGS: 1. Proposed modifications were found not to be detrimental to: a) the general welfare of persons residing or working in the vicinity; b) injurious to property and improvements in the vicinity of subject building, c) and does not adversely affect the Ci-ty's General plan. CONDITION'S OF APPROVAL: A. TO BE COMPLETED PRIOR TO %SSUANCE OF BUILDING PERMITS: 1.. Cheatham, Jr. A request to permit an outside sale on August 22 and 23, on property located at 8909 Adams Avenue. The Board reviewed the application. ON MOTION BY KELLY AND SECOND BY CROSBY SPECIAL EVENT NO. 81-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received August 11, 1981 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An onsite inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shal be filed in the Finance Department five (5) days prior to the event.
