COMMISSIONERS PRESENT: Bannister, Kenefick, Paone, Winchell, Porter,

Chairman Winchell opened the study session on Land Use Element
Amendment 81-2. Brief presentations were made by Carol Inge, re-
capping the highlights of each section. Discussion ensued by the
Commission on the appeal process in general and the Planning
Commission's role in relation to the City Council.
Commissioner Porter requested the following addition to,P�ge 5,
of Section 2.3 "Modification of the General Plan Amendment Process"
to read as follows:
. it shall be forwarded to the City Council, with that
recommendation, along with the rest of the items in the
amendment. The -resolution forwarded to the City Council
shall plainly set apart those items recommended for approval
from those items recommended for denial."

To permit a one lot subdivision and the construction of 40/48
air space condominiums on property located at the northeast corner
of Warner Avenue and Algonquin Street.
Commissioner Paone stated he would be unable to vote on this item
as he had an associate who was an interested party.
The public hearing was opened. Richard Harlow spoke on behalf of
approval of the applications, preferrably "Alternative 2" which is
for the 48-unit planned development. The public hearing was closed.
Commission discussion took place with regards to two surrounding
pieces of property. One triangular lot is presently owned by the
County of Orange; the other is a single house immediately east
of the proposed project. Staff informed the Commission that either
the access easement would have to be approved or the property
abandoned and sold before any map could be recorded. Chairman
Winchell questioned the intent of Article 936 which speaks to build-
ing bulk in a Planned Residential District.

\1. Promote better living environment, insofar as this project has
been designed to minimize vehicular traffic adjacent to the
units while integrating large open space area for the resi-
dents' enjoyment.
2. Promote better land planning techniques with maximum use of
aesthetically pleasing types of architecture,, landscaping,
site layout and design, of which this plan has incorporated
architecture that has created interesting shapes, plains and
areas, and which has incorporated landscaping in order to
soften and enhance the hard scape design of the buildings
and which has utilized land planning techniques that reduce
conflicts between the vehicular and pedestrian traffic.
3.. Not be detrimental to the.general health, welfare, safety and
convenience of the neighborhood or City in general, nor.detri-
mental or injurious to the values of the property or improvements
of the neighborhood or the City in general. This project has
been designed in accordance with the provisions set forth in
the planned residential development,ordinance and is compatible
with surrounding architecture and design.
4. Be consistent with the objectives of the planned unit stan-
dards in achieving 'a development adapted to the terrain and
compatible with the surrounding environment. This project has
been designed to maximize features of the natural terrain and
to mitigate the majority of environmental effects on the
surrounding property.
FINDINGS OF APPROVAL FOR CONDITIONAL USE PERMIT 81-11 "ALTERNATIVE 211:
1. The proposed subdivision of this 2.06 acre parcel of land zoned
R3 is proposed to be constructed having less than 25 units per
gross acre.
2. The General Plan has set forth provisions,for this type of
land use as well as setting forth objectives for the imple-
mentation of this type of housing. Therefore, the project as
proposed (Alternative 2 when complied with conditions for
abandonment of right-of-way) complies with the City' s I General
Plan,.
3.- The 'property was previously studied for this intensi.ty.of land
use at the time the Land Use designation for high density
residential was placed on the property.
4. The lot size, depth, frontage, street width, and through the
use"of a special permit. -all other design and implementation
features of -the -proposed subdivision are proposed to be -con-
structed in compliance with standard plans and specificiations
on file with the City as well as in compliance with the State_
Map Act and Supplemental City Subdivision Ordinance.

CONDITIONS FOR APPROVAL CONDITIONAL USE PERMIT 81-11 "ALTERNATIVE 2":
1. The site plan received on August 31, 1981.shall be the approved
conceptual plan. All items not addressed by the approval of a
special permit for the proposed projects must comply with all
provisions of Article 936 and any other applicable provisions
of the Huntington Beach Ordinance Code. The driveway and parking
located along the north property line shall be deleted and the
main structure shall be relocated to the north. Six additional
parking spaces shall be relocated on site.
2. Natural gas -and 220V electrical shall.be stubbed in at the
location of clothes dryers.
3. Natural gas shall be stubbed in at the location of cooking
facilities, -water heaters, and central heating units.
4. Low volume head shall be used in all showers.
5. All building spoils such as unused lumber, wire, pipe, and
other surplus and other unusable materials, shall be disposed
of at an off -site facility equipped to handle them.
6. Energy -efficient lighting such as high pressure sodium vaper
lamps shall be used in parking lots to prevent spillage onto
adjacent areas and for energy conservation.
7. All approved drives shall be considered fire lanes and shall
comply with minimum Fire Department standards, and be signed
as such to the approval of the Huntington Beach Fire Department.
8. *A fire sprinkler system, stand pipe system, and fire alarm
system shall be designed and installed in those structures
deemed necessary by the Huntington Beach Fire Department and
shall be in compliance with all applicable provisions.
9. All structures on the subject property whether attached or de-
tached, shall be constructed in compliance with State acoustical
standards set forth for units within the 60 CNEL contours of
the property. Evidence of compliance shall consist of sub-
mittal of acoustical analysis report prepared under the super-
vision of,a person experienced in the field of acoustical
engineering with the application for a building permit.
10. If at any time an entrance gate is proposed at the main en-
trance, location and design shall be reviewed and approved
by the Department of Development Services and by the Fire
- Department.
11. The covenants, conditions and restrictions shall contain a
provision which will prohibit storage of boats, trailers,
and recreational vehicles"on site, unless an,area that is
specifically designed for such storage and is in compliance

with the provisions of Article 936 is provided for the project.
12. Prior to recordation of a map for Alternative 2, the 48-unit
project, Old Warner Avenue shall be abandoned and the applicant•
shall show proof of ownership for the entire right-of-way
and for the triangular parcel of property located south of
Old Warner Avenue and north of the new Warner alignment, and
shall provide a permanent easement for access to the property
to the east. This easement shall_ exist until the property
to the east is developed and has permanent access to Warner
Avenue.

AND FINDINGS, BY THE FOLLOWING VOTE:

and to provide cross sections of all public and private streets
adjacent to or within the project.

2. The water system shall be through the Huntington Beach's water
system.
3. The sewer, water, and fire hydrant systems shall be designed
to City standards.
4. The property shall participate in all local drainage easement
district requirements and fees.
5. Drainage for the subject subdivision shall be approved by the
Department of Public Works prior to the recordation of a final
map. This system shall be designed to provide for erosion and
siltation control both during and after construction of the
proposed project.
6. All access rights along Algonquin Street, Old Warner Avenue and/
or Warner Avenue, except for the intersection of private drives,
shall be dedicated to the City of Huntington Beach.

A proposed revision to Articles 933 and 970 of the Huntington
Beach Ordinance Code to establish criteria for the permitting and
operation of game arcades.
Staff made a brief presentation and explained that a license would
be required for the owners of 4 or more machines (not necessarily
the store owners).
The public hearing was opened. Since there was no one who came
forward to speak for or against the amendment, the public hearing
was closed.
Commissioner Mahaffey suggested that upon inquiry, applicants could
be given guidance if the Commission could establish them.

An amendment to Division 9 of the Huntington Beach Ordinance Code
relating to the Board of Zoning Adjustments. Said code amendment
sets forth the purpose of the Board and outlines required findings

of fact for administrative review. (The first section of this code
amendment, 81-11(a) was previously approved by the Planning Commissio
Staff gave a brief presentation explaining that the rewriting of
Division 9 and conflicting language was designed to eliminate dup-
lication. The public hearing was opened.

CODE AMENDMENT NO. 81-12
Initiated by Community Services Department
A code amendment to repeal Artical 974, Park and Recreation.
Facilities, and amend Article 996, Dedication, relative to park
land dedication and in -lieu payment of fees. This amendment will
contain a provision to allow a 50 percent credit for private open
space.
Norm Worthy, of the Community Services Department, gave a brief
oral presentation to the Commission explaining the code amendment.
The public hearing was opened. Speaking in opposition to the code
amendment was Richard Harlow stating that any time there was an
increase in park fees it really relates to the parks in developed
areas rather than neighborhood parks. He further cited Seacliff
as a recent example, stating that they never received their park.
The public hearing was closed.
Commission discussion consisted of the rate of increase of home
equity in relation to the increase of the park fees. It was the
concensus that the park fees represent a much smaller increase than
the increase of housing costs. Also discussed was the issue of
park maintenance.

DISCUSSION ITEMS:
Review of City Council Agenda
Secretary Palin reviewed the actions taken at the City Council
Meeting of September 21, 1981. He passed along a request by the
Council to hold a joint study session on the Condo Conversion
Ordinance at 7:45 P.M., Monday, September 28, 1981. Commissioners
Kenefick, Paone and Schumacher said they would plan to be in
attendance.
COMMISSION ITEMS:
Commissioner Porter requested that Public Works staff investigate
the width of the driveway at the Newland Center at Adams Avenue
to see if it complies with the conditions that were outlined on
a previously -approved use permit at that location.
Chairman Winchell announced that one person from the Planning
Commission may attend the annual conference sponsored by the League
of Cities to take place in San Francisco from October 17 to
October 20, 1981, at the expense of the City.
