Mayor Finley called the adjourned regular meeting of the City Council of
the City of Huntington Beach to order at 7:00 P.M.
ROLL CALL
Present: MacAllister, Pattinson, Finley, Bailey, Mandic, Kelly
Absent: None
FINA SUBSURFACE OIL & GAS LEASE - APPROVED IN CONCEPT - REFERRED TO STAFF
The Clerk presented a staff report from the Department of Development Services
entitled - "FINA SUBSURFACE OIL AND GAS LEASE." Mike Multari presented an
overview of the unitization and consolidation project including its benefits
to the City. He reviewed the proposed lease with American Petrofina (FINA).
Discussion was held regarding -the royalty; the physical attributes and loca-
tion of the islands; the flooding techniques that might be utilized; the
unitization procedure; and clean-up provisions in the event the project were
to be abandoned.
Councilman Mandic left the Council meeting at 8:15 P.M.
A motion was made by Pattinson, seconded by Thomas, to direct staff to bring
back the proposed lease with American Petrofina to the next Council meeting
with modifications to the lease as outlined in the Department of Development
Services staff report entitled "Fins Subsurface Oil and Gas Lease." The
motion failed by the following roll call vote:
AYES: Pattinson, MacAllister, Thomas
NOES: Bailey, Finley, Kelly
ABSENT: Mandic
A motion was made by Kelly to direct staff to bring back the proposed lease
with American Petrofina, with the modifications as outlined in the Department
of Development Services staff report entitled "Fina Subsurface Oil and Gas
Lease" with the deletion of paragraph d. of page 5 of the staff report
(paragraph 4 of the actual lease} to the November 16th Council meeting and
to schedule discussion of that paragraph at that meeting.• The motion died
for lack of a second.
Additional discussion was held regarding the royalty.

A motion was made by Kelly, seconded by Pattinson, to direct staff to bring
back the proposed lease with American Petrofina,.with the modifications as
outlined in the Department of Development Services staff report entitled
"Fina Subsurface Oil and Gas Lease" with the following change in paragraph d
of the report (paragraph 4 of the actual lease) delete the words "... to a
percentage equaling the average ..." to read ". , to be equal to the highest.
royalty...". The motion carried by the following roll call vote:
AYES: MacAllister, Thomas, Pattinson, Finley, Bailey, Kelly
NOES: None
ABSENT: Mandic
REQUEST TO APPROVE LEGAL FEES - OIL/GAS CONSULTING ATTORNEYS - FAILED
The City Attorney informed Council that they had been provided with a copy
of a memorandum dated November 5, 1981 from her office requesting that Council
approve payment for oil and gas consulting attorneys Sheldon L, Foreman/Nancy
Knight, for fees for analysis and negotiation of the Petrofina lease.
Following discussion, a motion was made by Kelly, seconded by Thomas, to approve
the transfer of $486 from the General Fund to the City's Contingency Account
No. 101593 and authorize the final payment of the oil and gas consulting law
firm of Sheldon L. Foreman in the amount of $486. The motion failed by the
following roil call vote:
AYES: Thomas, Kelly, Finley
NOES: Bailey, MacAllister
ABSTAIN: Pattinson
ABSENT: Mandic
COASTAL COMMISSION'S ACTION ON THE HUNTINGTON BEACH LAND USE PLAN - OPTION II -
AP R VED
The Clerk presented a staff report form Deveopment Services Department entitled
"Coastal Commission's Action on the Huntington Beach Land Use Plan" a memor-
andum dated October 29, 1981 transmitting the City Attorney's opinion on new
ligislation; and a letter dated November 2, 1981 from Michael L. Fischer,
Executive Director, California Coastal Commission, South Coast District.
Mike Multari, Associate Planner, presented an overview of the Coastal Commission's
action; spoke regarding the Mello bill and its effect on housing in the coastal
zone. He addressed options available to Council regarding the wetlands issue
including "white holes" and commented on new development in the coastal zone.
Councilman Thomas left the meeting at 9:20 P,M.
Discussion was held regarding the conditions imposed by the Coastal Commission
and the options available to Council.
A motion was made by Bailey, seconded by MacAllister, to approve Option Two on
Page 3, of the staff report submitted by the Development Services Department
entitled "Coastal Commission's Action on the Huntington Beach Land Use Plan"
with the understanding that the housing concerns as outlined in the Local
Coastal Flan be kept in their entirety without any changes. The motion carried
by the following roll call vote:

REQUEST FOR ADDITIONAL FUNDING - UEFENSE OF GULF OIL LEASE - NU ACTION TAKEN
The City Attorney informed Council that they had been provided with a memorandum
dated October 15, 1981 regarding a request for additional funding for the defense
of the Gulf Oil lawsuit.
A motion was made by Pattinson, seconded by Kelly, to authorize the transfer of
$50,000 to the City Attorney's Contractual Services Legal Account No. 130390.
The City Attorney suggested that Council adjourn to an Executive Session to
discuss the matter.
EXECUTIVE SESSION
The Mayor called an executive Session of Council for the purpose of discussing
litigation and personnel matters.
RECESS RECONVENE
The Mayor called a recess of Council at 9:45 P.M. The meeting was reconvened
at 10:05 P.M.
Councilman Pattinson left the. meeting at 10:00 P.M.
Councilman Kelly withdrew his second to the motion made by Pattinson to
authorize the transfer of $50,000 to the City Attorney's Contractual Services
Legal Account No. 130390,
ADJOURNMENT
The Mayor declared the adjourned regular meeting of the Council of the City of
Huntington Beach adjourned to 6:30 P.M., Monday, November 16, 1981 in the Council.
