Commissioner Kenefick also requested that the Minutes of the November 17, 1981 meeting show a change. Commissioner Schumacher, and not herself, seconded the motion on Conformance to General Plan 81-12. The change was reflected on the bottom of page 1. ON MOTION BY KENEFICK AND SECOND BY BANNISTER THE CONSENT CALENDAR, CONSISTING OF THE MINUTES OF THE REGULAR MEETINGS OF DECEMBER 1, 1981 AND NOVEMBER 17, 1981, WITH THE ABOVE CHANGES, AND EXPANSION OF A NON -CONFORMING USE, WAS APPROVED BY THE FOLLOWING VOTE: AYES: *Bannister, Kenefick, Winchell, Mahaffey NOES: None ABSENT: Schumacher, Paone, Porter ABSTAIN: Bannister* (abstained from minutes of 11-17-81) CONDITIONAL EXCEPTION NO. 81-58 (Appeal) (Continued from 11-17-81) Applicant: Roger Cole A request to allow a windscreen to be constructed at a ten foot height in lieu of the code -permitted eight feet. Subject property is located on Ragtime Circle approximately 300 feet south of Sundancer Lane. Commissioner Kenefick stated that although she has abstained from voting on this issue in the past, she has now listened to the tapes and will be eligible to vote. Commissioner Mahaffey also listened to the tapes and is eligible to vote. Minutes, H.B. Planning Commission December 15, 1981 Page 2 The public hearing was opened. Seeing that no one came forward to address this issue, the hearing was closed. The Commission was basically concerned with the fact that this would appear to be a habitable room as proposed, therefore, one of the conditions of approval would be to leave one end of the windscreen open. Also questioned was the material to be used for the cover. The proposed material was tempered glass. Commissioners requested that the conditions specifically state "glass or tempered glass" as an example of "light -weight material". A MOTION WAS MADE BY MAHAFFEY AND SECONDED BY BANNISTER TO APPROVE CONDITIONAL EXCEPTION NO. 81-58. THIS MOTION FAILED BY THE FOLLOWING VOTE: AYES: Bannister, Kenefick, Mahaffey NOES: Paone, Winchell ABSENT: Porter, Schumacher ABSTAIN: None Art Folger, Deputy City Attorney, advised the Commission that already this issue has been before them many -times and could show no due process. Discussion took place regarding one of the conditions of approval. It was felt that light -weight material to be used on the cover be more specific language -wise. ON MOTION BY BANNISTER AND SECOND BY MAHAFFEY THE ABOVE MOTION WAS AMENDED TO INCLUDE "GLASS OR TEMPERED GLASS" AS A DESCRIPTION OF THE MATERIAL USED ON THE COVER OF THE WINDSCREEN, BY THE FOLLOWING VOTE: AYES: Bannister, Kenefick, Mahaffey, Winchell NOES: Paone ABSENT: Porter, Schumacher ABSTAIN: None THE FOLLOWING VOTE WAS TAKEN ON THE AMENDED MOTION TO APPROVE CONDITIONAL EXCEPTION NO. 81-58 WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS- 1. The applicant is willing and able to carry out the purposes for which the conditional exception is sought and is willing to do so without unnecessary delay. CONDITIONS FOR APPROVAL: 1. That the height of the windscreen shall not exceed nine (9) feet. 2. That the cover of the windscreen be of a light -weight material (e.g. tempered glass). 3. One end of the windscreen must have an opening ten (10) feet wide by the height of the windscreen for purposes of ventilation and light. Tarrosa A request to permit a spa enclosure at 0' side and 0' rear yard and a patio cover at 0' rear yard,at property located at 8252 Forelle Drive. Commissioners asked staff how this issue came to the attention of the City. Staff stated that this was from a complaint from the applicant's neighbor. The public hearing was opened. Speaking in favor of overruling the BZA denial was the applicant, Levi Tarrosa, who stated that for medical reasons the request was made. His mother, Mrs. Tarrosa, also spoke in -favor of the request. Mr. Tarrosa's neighbor also spoke in favor of granting the request. The public hearing was closed. A MOTION WAS MADE BY BANNISTER AND SECONDED BY MAHAFFEY TO OVER- RULE THE BZA DENIAL BY GRANTING APPROVAL OF CONDITIONAL EXCEP- TION NO. 81-77. THE MOTION FAILED BY THE FOLLOWING VOTE: AYES: Bannister, Mahaffey NOES: Kenefick, Paone, Winchell ABSENT: Porter, Schumacher ABSTAIN: None Commissioners discussed the issue further. Chairman Winchell felt that the motion should be made separating the two structures in -3- 12-15-81 - P.C. Minutes, H.B. Planning Commission December 15, 1981 Page 4 question; that the spa enclosure be approved and the patio cover be denied. ON MOTION BY PAONE AND SECOND BY KENEFICK THE BZA DENIAL WAS OVER- RULED ON CONDITIONAL EXCEPTION NO. 81-77 WITH REGARDS TO THE SPA ENCLOSURE; THE PATIO DECISION WAS UPHELD, WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL OF SPA ENCLOSURE: 1. Based on the testimony presented to the Planning Commission during the public hearing, the Commission has determined that the re- quested spa enclosure will not be -detrimental to the public health, safety and general welfare of the neighborhood or the community. 2. The Planning Commission has determined that an exceptional cir- cumstance exists, therefore, the granting of Conditional Ex- ception No. 81-77 is necessary for,the preservation and enjoyment of property rights. CONDITION FOR APPROVAL: Approval of spa enclosure is subject to applicant applying for a building permit so that same can be inspected. NOTE: Patio cover was denied by the Planning Commission and, therefore, must be brought into compliance. TENTATIVE TRACT NO. 11519/CONDITIONAL USE PERMIT NO. 81-18/ NEGATIVE DECLARATION NO. 81-30 (Continued from 12-1-81) Applicant: Huntington Surfside Corporation A request to permit a 19 lot subdivision for purposes of constructing an 18-unit condominium project on 1.33 gross acres of property located on the west side of Florida Street approximately 200 feet south of Clay Avenue. Jim Barnes gave a brief oral presentation of the proposed project. He stated that the project is still deficient with regards to the Planned Development Ordinance, specifically the setbacks on the south side of the proposed project. -4- 12-15-81 - P.C. Minutes, H.B. Commission consensus was to approve the project. G. Williams, to come forward and state for the record that the conditions presented by staff were acceptable to him. He did so. Chairman Winchell stated that she was opposed to the granting of a special permit. Commissioner Kenefick stated that although she would vote in favor of granting the request, she was, in theory, opposed to any project which does not consider low-income housing. ON MOTION BY BANNISTER AND SECOND BY MAHAFFEY TENTATIVE TRACT NO. 11519 AND CONDITIONAL USE PERMIT NO. 81-18 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: -5- 12-15-81 - P.C. Minutes, H.B. Planning Commission December 15, 1981 Page 6 FINDINGS: TENTATIVE TRACT NO, 11519: 1. The proposed subdivision of this 1.33 acre parcel of land desig- nated on the Land Use Element of the General Plan as medium density residential and zoned R2, is proposed to be developed having a density of 15 units per gross acre which is consistent with the City's General Plan and zoning designations. 2. If the special permit is granted, the proposed plan as presented, will be in substantial compliance with the requirements set forth in Article 936 of the Ordinance Code, Planned Residential De- velopment, and will be in keeping with the intent of said ordinance. 3. The lot size, depth, frontage, street width, and through the use of a special permit, all other design and implementation features of the proposed subdivision will be in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map Act and supplementary City Sub- division Ordinance. CONDITIONS OF APPROVAL: TENTATIVE TRACT NO. 11519: 1. The tract map received and dated October 22, 1981, shall be the approved layout. 2. The water system shall be in accordance with Public Works De- partment standards. 3. Sewer, drainage and street improvements shall be in accordance with Public Works Department standards. 4. Fire hydrants and fire lanes shall be appropriately located and posted in accordance with Fire Department standards. 5. An erosion and siltation control plan shall be submitted to the Department of Public Works prior to the construction of the project. 6. The existing turnaround area at the end of the alley abutting the northerly property line shall be retained. FINDINGS: SPECIAL PERMIT REQUEST: CONDITIONAL USE PERMIT NO. 81-18: 1. Promote a better living environment insofar as the project has been designed to maximize privacy for the individual tenants, minimize vehicular traffic, and provide an adequate amount of private and public open space areas. 2. Promote better land planning techniques with the maximum use of -6- 12-15-81 - P.C. Minutes, H.B. Planning Commission December 15, 1981 Page 7 aesthetically pleasing types of architecture, landscaping, site layout and design of which this plan has incorporated architec- ture that has created interesting shapes, plains and areas, and which has incorporated landscaping in order to soften and enhance the hardscape design of the buildings, and which has utilized land planning techniques that reduce conflicts between vehicular. and pedestrian traffic. 3. Not be detrimental to the general health, welfare, safety or convenience of the neighborhood or the City in general, nor detrimental or injurious to the values of property or improve- ments of the neighborhood or the City in general. This project has been designed as an integrated planned residential develop- ment and has been adapted to the terrain and is compatible with the surrounding land uses. SPECIAL PERMIT: The Conditional Use Permit was granted subject to a Special Permit allowing variance from -the following code sections: 1. 9362.5 (Setback from interior property line) 2. 9362.7 (Building Separation) 3. 9362.10 (Building Bulk) 4. 9362.11 (Common Open Space) 5. 9362.12 (Main Recreation Area) 6. 9362.15 (Private Accessway Widths) 7. 9363.11 (Trash Collection Areas) FINDINGS FOR APPROVAL: CONDITIONAL USE PERMIT NO. 81-18: 1. The site plans, floor plans and elevations received and dated October 20, 1981, shall be the approved layout. All elements of the plan not addressed by the approval of a special permit must comply with the provisions of Article 936 and any other applicable provisions of the Huntington Beach Ordinance Code. 2. Natural gas and 220V electrical shall be stubbed in at the loca- tion of clothes dryers. 3. All hot water lines shall be insulated to provide less water waste and to keep hot water pipes from heating cold water pipes. 4. All building spoils such as unusable lumber, wire, pipe and other Surplus or unusable material shall be disposed of at an off -site facility equipped to handle them. 5. If lighting is included in the parking lot and/or recreation area, energy -efficient lamps_shall-,be used (e.g. high pressure sodium vapor). All outside lighting shall be directed to prevent spil- lage onto adjacent properties. 6. Landscaping shall consist of low water -consuming plants whenever feasible. Landscaped areas shall be extensively mulched to im- prove the water -holding capacity of the soil by reducing evapo- ration and soil compaction. 7. All dwellings on the subject property shall be constructed in com- pliance with the State acoustical standards set forth for units that are within the 60 CNEL contour of the property. Evidence of compliance shall consist of an acoustical analysis report pre- pared under the supervision of a person experienced in the field of acoustical engineering with the application for a building permit. 8. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site sampling and la�- boratory testing of materials to provide detail recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets,and utilities. 9. The covenants, conditions and restrictions shall contain a pro- vision that will prohibit storage of boats, trailers, and re- creational vehicles on site unless an area that is specifically designed for such storage and is in compliance with the provisions of Article 936 is provided for the project. 10. If at any time an entry gate is proposed at the main entrance, the location and design shall be approved by the Department of Development Services and Fire Department. -8- 12-15-81 - P.C. The necessary plumbing shall be installed in each unit to accom- modate the installation of solar hot water heating equipment. - The applicant shall offer to install solar hot water heating equipment to the buyer at the time of sale of the units. 12. The design and materials of the perimeter walls shall be subject to the approval of the Department of Development Services prior to the issuance of building permits. 13. A detailed landscape and sprinkler plan shall be subject to the approval of the Department of Development Services prior to the issuance of building permits. The public hearing was opened. A representative of the applicant, Mr. Sam Glick, spoke in favor of granting the request. He stated that the pole sign on the property would be replaced with a monument sign. He also stated that food sold on the premises would not be for consumption on -premises. The public hearing was closed. ON MOTION BY PAONE AND SECOND BY BANNISTER CONDITIONAL USE PERMIT NO. 81-28 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: CONDITIONAL USE PERMIT NO. 81-28_ 1. The proposed convenience market substantially complies with the provisions outlined in Article 947 of the Huntington Beach Ordinance Code. 2. The proposed use is generally compatible with surrounding land uses becuase the property is zoned C2, Community Business Dis- trict and pis shown on the General Plan as General Commercial. CONDITIONS FOR APPROVAL: CONDITIONAL USE PERMIT NO. 81-28: 1. The westerly approach on Heil Avenue shall be removed and re- placed with gutter, side walk and curb. -9- 12-15-81 - P.C. Minutes, H.B. A revised site plan shall be submitted to the Director of De- velopment Services reflecting all required changes and shall be in compliance with all of the provisions in Article 943 and shall comply with all provisions of the Department of Public Works.- Said site plan shall be submitted and approved by De- velopment Services and Public_ Works prior to the issuance of building permits. The public hearing was opened. Speaking in favor of granting the special sign permit was owner of the property, Sam Gilio. The public hearing was closed. Commissioners asked Mr. Gilio why he could not go along with the recommendation of staff to,replace the sign with a monument sign. Mr. Gilio responded that he felt there would be a greater risk of vandalism -with a monument sign. ON MOTION BY.BANNISTER AND`SECOND BY KENEFICK SPECIAL SIGN PERMIT NO. 81-6 WAS DENIED WITH THE FOLLOWING FINDINGS, BY'THE FOLLOWING VOTE: FINDINGS FOR DENIAL: SPECIAL SIGN PERMIT NO. 81-6: 1. The granting of a special sign permit for the restaurant will constitute the granting of a special privilege because the restaurant currently has two wall signs and a freestanding sign identifying the restaurant. 2. There are no exceptional or extraordinary circumstances that do not generally apply --to other businesses within the center or surrounding commercial properties. The applicant has not demonstrated that strict compliance with the Ordinance Code will result in a substantial hardship. Paste Sowers A request to permit a 6' X 12' freestanding pole sign to be erected on a public right-of-way on 0.17+ acre parcel located on the north side of Adams Avenue, approximately 530 feet east of Magnolia Street. Howard Zelefsky explained that the applicant requested a continuance to allow him more time to prepare for the public hearing. The public hearing was opened, and -seeing that no one came forward to address this matter, the public hearing was closed. ON MOTION BY PORTER AND SECOND BY WINCHELL ZONE CHANGE NO. 81-14 WAS APPROVED BY THE COMMISSION AND RECOMMENDED FOR APPROVAL AND ADOPTION BY THE CITY COUNCIL, BY THE FOLLOWING VOTE: AYES: Bannister, NOES: None ABSENT: Kenefick, ABSTAIN: None Paone, Winchell, Porter Mahaffey, Schumacher CODE AMENDMENT NO. 81-12 (Continued from 11-17-81) Initiated by Community Services Department -11- 12-15-81 - P.C. Minutes, H.B. Planning Commission December 15, 1981 Page 12 A code amendment to repeal Article 974, Park and Recreational Facilities, and amend Article 996, Dedication, relative to park land dedication and in -lieu payment of fees.. This amendment will contain a provision to allow a 50 percent credit for private open space. Savoy Bellavia informed the Commission that he distributed additional material which consisted of a revised density factor (Section 9961.5-). - The public hearing was opened. Richard Harlow -spoke to this issue. He stated that he favored a postponement of action on this issue until after the first of next year. He felt that an increase in fees was being rushed through the City Council to beat_ a deadline; and felt if the fees were proper, there was no reason why it could not wait. The public hearing was closed. Commissioners questioned staff regarding Mr. Harlow's concerns. Mr. Palin responded to this,,stating that he would be glad to com- municate any concerns the Planning Commission may have to the City Council, and reminded the Commission that this issue had been before them at least three times for public testimony. Also discussed was the issue of whether waterways and golf courses could be given credit as open space.
