Board Member Smith asked that the background leading -up to the
reciprocal parking agreement be -outlined. Mr. Zelefsky stated
that -Wycliffe -Bible Translators, Inc: -_has recently built'sixteen
(16) motel -type units on"its office property. This was done
under planning action-AR.#80-59. A site plan showing the location
of replacement :parking, as -previously approved by,the City -of
Huntington Beach was-submitted'to the Board. -All--of the indicated
replacement -parking has been constructed except -for --the seventeen
(17) spaces' -located along the north end -of -the office building. -
All of the currently available spaces are full size;--none.are the
smaller size allowed for compact cars. They are requesting that
a joint use parking agreement, pursuant to 9794, be allowed in
lieu of.these seventeen (17) parking spaces. The Evangelical Free
Church property, adjacent to.the west property line of Wycliffe
Bible Translators; contains -one hundred (100) parking spaces. A
copy of.the Reciprocal Parking Agreement was submitted to the Board
for review between Wycliffe and the church and an -amendment to the
agreement which extends its term to October 9, 1998. .The agreement
gives Wycliffe -free use of the church's one hundred (100) parking
spaces and the church free use of Wycliffe's parking spaces. The
construction.of the -remaining seventeen-(17) parking spaces by -
Wycliffe would require the removal of an existing green belt area.
If the.churcli parking is added, Wycliffe owns or has -access to -
eighty -three '(83) more off-street parking spaces than is required
by the City ordinance.,
Mr. Wooldridge"introduced himself to the Board. He said one
point he -would -like to add is that-the"time of use between the church
and office would not be conflicting as Wycliffe's office activities -
are conducted"on"weekdays and the church's activities are'.on Sundays
and occasional evenings.
Many points"were discussed by the Board at.great length covering
the'Reciprocal-_Parking Agreement e.g. clouding the title to both
parties, selling of or ceasing of specific use -.on properties, etc.
By recordation -of this Reciprocal Parking Agreement, with Conditions,
as imposed; it would -put -a future buyer for the office on notice
.that -a parking problem, upon -purchaser would -exist in.that "it
would"not=meet the parking requirement`of the City's ordinance.
Mention -:-was made that -should -a change take place, allowing -this
agreement to become null and void, the office could pick up additional
parking" --spaces by-restriping-for compact parking spaces.

Acting Se-cretary..Webb outlined - proposal an' d-"stated-= that a revised
plan was submitted by the applicant for approval,- wherein a
request for the location of a new six (6)-foot-high block -wall
fence, pool enclosure, has been changed;from original request_
for a seven M - foot minimum front_ -yard setback -:to- now -show--a
ten (10) foot minimum front yard - setback. - _ _ _-_ _ ..__ _-
The public hearing was opened by, -Chairman Kelly with Mr. Saglietto-
_in--attendance-to--speak =on=his 'application.
Board,Member Smith addressed.the-applicant`:and mentioned that
-upon--his review of the file, he found a copy of the original
swimming_ pool permit which• Mr.- Saglietto stated was -,taken
out -by -the --contractor. Mr.-Saglietto was asked if he had
or-did-,-he-have a copy of_ the original -swimming pool permit.
--Mr.--Saglietto responded "yes". Board Member Smith stated
that on Swimming Pool Permit No. SP=8494 it was clearly noted
-on-the-.bottom-of-the permit that a 15-ft. front yard setback
- was -required ---for a pool enclosure and that he felt the -reason
for_this notation being put -,on the permit was`that who ever issued
the--permit.recognized;immediately that he would have a problem
=by -locating his pool--so--close to his front yard as the Code
requires _ a 154, ft. _ fro_ nt yard.. setback-- for-_ a -- fence= pool• enclosure. -
Mz. Saglietto stated he was not aware that the minimum setback line
was measured from the ultimate right of way; that he thought it
was j measured from. the street:_ =
As -the applicant had no further comments, and as there was no
one else present to -speak for or against this proposal, the public
hearing was:_closed.
-Board-discussion ensued.
A -motion was made..by Webb and second by Smith, to'deny Con =
=ditional-Exception No. 82-3 as it was felt the applicant created
his -own hardship as he had -ample room to have constructed the.
pool _.farther: _back on his_ property., -The motion failed by the

ON MOTION BY KELLY AND SECOND BY CROSBY, THE RESOLUTION CARRIED,
TO APPROVE CONDITIONAL EXCEPTION NO. 82-3 WITH FINDINGS AND
REASONS -AS FOLLOWS, BY THE FOLLOWING VOTE:
FINDINGS'AND•REASONS:
1. Because the house is located on a cul-de-sac, encroachment
of five (5)-feet into the front yard setback for a six (6)-
.foot high block wall is necessary in order to preserve the
enjoyment of -one or more substantial property rights.
2. The granting of the Conditional Exception will not constitute
a -grant of a special privilege inconsistent with adjoining
property in the vicinity and under identical zone classifications.
3.- The.granting of a conditional exception will -not be materially
detrimental to the public welfare, or injurious to property
in -the same -zone classifications.
4. 'The granting of the Conditional Exception will not adversely
_affect -the General Plan of the City of Huntington Beach.--
_ 5. Block wall will not impact neighborhood.
The revised conceptual plot plan dated February 12, 1982, shall
be the approved layout.

Acting'Secr'etary Webb informed all concerned that one of the
adjoining property owners had called saying she was•not'.notified
of the -public hearing and that; prior to the hearing; she wished
to review the applicant's plan. She said she"had heard of this
hearing.through her father-in-law who is also an adjoining property
owner. -Ms. Lowe 'further -stated she would like to be present at the
public -hearing -but was unable to-do so.on�such'short notice.
It•was--the•consensus of the Board to continue Conditional Exception
82-9 for two (2)'weeks, to the meeting -of -April 7, 19821 to allow

That the Board of Zoning Adjustments grant a conditional Certificate
of Occupancy which would allow the structure to be utilized while
the -final map is in process. Subject property is Lot No. 17-(Parcel
No. 2)-Tract 5030 located at the northwest corner of Warner Avenue
and Newland -Street.
Staff outlined request with Mr. John G. Goetten present to.give -
testimony'in his behalf.
Mr. Goetten informed.the Board -that the final map is presently
under, preparation -and -that they plan to. submit the map to the City
and -county for checking on March 26, 1982-. He said they the
the recordation process to take approximately two (2) months. -Mr.
Goetten mentioned that the owner has indicated that the structure
