The procedure of -the Board of Zoning -Adjustments was outlined
to the applicants by Chairman Kelly.

Chairman Kelly informed -the Board that this request is Categorically
Exempt, Class. 5, California Environmental=Quality..Act,-1970.'
Staff -reiterated the proposal stating that Mr. Stansfield had
appeared..before f_K&..Board. of Zoning. Adjustments on March 3, 1982
with a plan'whicli.did-not denote existing setbacks",?, -dimensions
and -lot size and -•that 'Mr: Stansfield had reto scale:

Mrs. Stansfield introduced herself and submitted a revised plan,
with elevations, to the Board depicting exact measurements. She-
said*that an important point which she wished to call to the
Board's attention is*that as she has a three car garage she
would like to -have the -single car garage set back further than
the double -car garage located at 7-1/2 feet from the public
right of way._- She also would like a balcony over the indented
single car garage to extend out, supported by posts, to 7-1/2
feet from the public right of way:- Mrs. Stansfield felt by .
having the single car garage indented,.it would eliminate the
look of,.a square box to her residence.
Barbara Mozan, next door neighbor of the Stansfield!s,_was present.
She stated she. had reviewed their original plan only:, , and , felt
*the neighborhood would be enhanced by Mr. &_Mrs. Stansfield's
addition_Ishowing their -garage located at'13 feet from the, -public
right of-way'but--when Mr: Stansfield returned from=the Board of
Zoning-- djustments meeting of -March 3,- 1982, stating that the
City had'requested,,a 7-1/2 foot garage setback for their -addition,
she'Wanted,to come today to find out if this was a City Ordinance
as she felt with the garage at a 7-1/2 ft. setback from the back
of the sidewalk, it would -give Mrs. Stansfield's home"'the,-appear-
ance of a townhouse or condominium: She also stated she did not-
want,to'look out her window at a shingled wall. The safety
factor of requiring a 7-1/2 foot garage setback as opposed to
allowing a--13,f99t setback was explained by the Board.:: -They.
stated that-at,13 feet a car would overhang the sidewalk.'and-
at 7-1/2 feet a car couldn't be parked in the driveway. -
Their being.no-one else present to speak for or against this
proposal, -the --public hearing was closed by Chairman Kelly.
Discussion ensued between the applicant and the Board covering
the Conditions of Approval. Mrs.-Stansfield agreedto'resubmit
a revised plan.to the Secretary of the Board for review and approval
with modifications as outlined in the Conditions of Approval.
ON' MOTION BY,:WEBB AND SECOND BY SMITH, CONDITIONAL EXCEPTION
NO. 82-7 WAS APPROVED WITH FINDINGS AND CONDITIONS OF -APPROVAL
AS FOLLOWS, BY THE FOLLOWING VOTE:
FINDINGS:
1.' The granting of the•Conditional Exception will not constitute_
a grant of a special -privilege inconsistent upon other properties
in the vicinity and under identical zone classifications.

2," Because of special circumstances applicable to the subject
_property, including size, shape, location,"and surroundings,
the -strict application of the zoning ordinance is found to
deprive''the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone class-
ifications,
3. The granting of a conditional exception is necessary -in order
to preserve the enjoyment of one or more substantial property
rights.
4. The granting of a conditional exception will not be materially -
detrimental to the public welfare, or injurious to property in
the same zone classifications.
5. The granting of the conditional exception will not adversely
affect the General -Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. A revised plot plan and elevations shall be submitted
to the Secretary of the Board with the following
modifications.
a. The residential addition over the garage to encroach
two (2) feet into the 15 ft. front yard setback as
requested by the applicant.
b. Garage is to be setback 7-1/2 ft. from back of
sidewalk.
If such plan complies with the modifications outlined
by the Board, said plan shall be approved and.made a
permanent.part of the -administrative file.

Traffic circulation and drives;
Parking layout; -
Lot area;
-Lot.-width and lot depth;

The -proposal was outlined by staff with Mr. Richard R. Hand
present to speak in favor of his request.
The-public"hearing was opened by Chairman Kelly.
Mr. Hand introduced himself to the Board and stated he would
like to add 925 sq. ft. to his existing Townlot-home and is
requesting that he be allowed to continue the side walls of
his residence fifteen (15) feet into his rear yard. He said
the existing structure has a sideyard setback of 2-1/2 feet in
lieu of the Code requirement of three (3) feet. He felt to comply
with the code requirement would pose design problems which he
hoped to avoid. Mr. and Mrs. H.S. Cruse, neighbors immediately
to the south of Mr.; Hand's residence were present to speak in
favor of Mr. Hand's addition. Mr. Cruse stated his residence
is identical to Mr. Hand's existing structure with a walkway
between the two houses which is utilized by both families without
problems. Mr. -Hand stated they do not use the access to their.
rearyard on the north side of their property.
The public hearing was closed by the Chairman with no one present
to speak in opposition of Mr. Hand's request.
Board discussion -carried covering fire safety requirements and
alley dedication.
ON MOTION BY VOGELSANG AND SECOND BY CROSBY, USE PERMIT NO. 82-4
WAS APPROVED WITH FINDINGS, CONDITIONS OF APPROVAL, -AND VOTE AS
FOLLOWS:
FINDINGS:
1.- The establishment, maintenance and operation of the use will
not be detrimental to:
a.' The general welfare of persons residing or working in
the vicinity;
b. -Property and improvements in the vicinity of such use
or building.
2., The -granting of a use permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan
of Land Use.
_ CONDITIONS OF APPROVAL:
The-conceptual'plot plan and elevations received February 23,
1982,-shall be the approved layout.

GENERAL CONDITIONS:

To permit a one (1) year,extension,of Administrative-Review.No. 81-9
originally approved by the -Board -of -.Zoning Adjustments on March 4,
1981, covering an expansion of present facility from 1.81 acres to
4.65 acres -located at-17,121.,Nichols. Street. -
Staff reported that financial delays brought about by the Federal
SBA Program and other financial. -institutions, of which they have no
control,, created their dela-r=- -The extension will -allow them the
necessary -time required for this -project.
IT WAS THE CONSENSUS OF,THE BOARD TO GRANT,A ONE (1) YEAR EXTENSION
FOR ADMINISTRATIVE REVIEW NO. 81-9.
THEIR -BEING -NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED.
