REGULAR AGENDA ITEMS: CODE AMENDMENT NO. 81-18/NEGATIVE DECLARATION NO. 82-3 (Continued from May 4, 1982) Initiated by City of Huntington Beach This is an ordinance amending the Huntington Beach Ordinance -Code by establishing a new article for Mobile Home Park Conversion regu- lations. The ordinance will establish requirements for notification of mobile home park residents, and will set guidelines for approval of a Tenant Relocation Assistance Plan prior to the change of use of a mobile home park. Chuck Clark, of staff, briefly outlined the four alternative ordi- nances prepared using the Newport Beach ordinance as a guide. Staff recommended Alternative 42. Commissioner Paone felt that Alterna- tive #4 did what #2 does only simplifies the process which the Minutes, H.B. Planning Commission May 18, 1982 Page 2 City Council directed the Planning Commission to take in terms of rezoning. He also thought that this alternative would save money, and would have less of a chance of ending up in the courts with every conversion. The matter of overlay zoning was discussed. Mr. Folger explained the need for this zoning stating that it would be added protection for the City. Commissioner Livengood asked if the public hearing would be opened. Chairman Winchell said that she felt that sufficient public input had been received to date and that the public hearing would remain closed. A motion was made by Paone and seconded by Porter to recommend to the City Council for approval, Alternative #4, incorporating Sec- tion 9270.7 and Section 9270.9 from Alternative #2. Commissioner Livengood also asked that Sections 9270.11 and 9270.13 should be incorporated. Commissioner Paone included it in his mo- tion and Commissioner Porter agreed with the second. Commissioner Schumacher felt that something should be incorporated regarding the Tenant Assistance Plan. It was at this point that the Chairman took a straw vote to determine if the motion on the floor would be supported by the Commission: MAHAFFEY - against all the proposed alternatives. SCHUMACHER - Alternative #1. PORTER - in favor of the motion. WINCHELL - would support the motion. PAONE - in favor of the motion. LIVENGOOD - in favor of the motion. HIGGINS - against all the proposed alternatives. A MOTION WAS MADE BY LIVENGOOD TO AMEND THE MOTION TO DELETE THE WORDS, "270 days" FROM ALTERNATIVE #2. Planning Commission May 18, 1982 Page 4 TENTATIVE TRACT NO. 11775/CONDITIONAL USE PERMIT NO. 82-5 Applicant: Hyeland Investments IV A request to permit the construction of five condominium units on .83 gross acres of property located on the southeast corner of Clay Avenue and 17th Street. Mr. Bellavia stated that a revised tentative tract map was received on this date showing the street sections. The public hearing was opened. John Leland; designer representing the property owner, addressed the Commission advising approval of the proposed project. The public hearing was closed. The Commission requested the applicant to come forward and agree to maintenance of landscaping on the right-of-way. The applicant stated that he does agree to this. Some discussion took place regarding the storage area and trash area in the garage. Mr. Bellavia also made the correction on the staff report regarding the General Plan designation and units per gross acre. Commissioner Porter felt that the site coverage shown looked like more than 56%. He further stated that he would be against ap- proval of this project as presented. A MOTION WAS MADE BY MAHAFFEY AND SECONDED BY HIGGINS TO APPROVE TENTATIVE TRACT NO. 11775 AND CONDITIONAL USE PERMIT NO. 82-5 WITH THE FINDINGS AND CONDITIONS AS OUTLINED BY STAFF. THIS MOTION PASSED BY THE FOLLOWING VOTE: TENTATIVE TRACT NO. 11775: FINDINGS FOR APPROVAL: 1. The proposed subdivision of this .83 acre parcel of land desig- nated on the Land Use Element of the General Plan as medium den- sity residential and zoned R4, is proposed to be developed having a density of 6 units per gross acre which is consistent with the City's General Plan and zoning designations. 2. With the granting of the special permit, the proposed plan as presented, will be in substantial compliance with the require- ments set forth in Article 936 of the Ordinance Code, Planned Residential Development, and will be in keeping with the intent of said ordinance. 3. The lot size, depth, frontage, street width and through the use of a special permit, all other design and implementation features of the proposed subdivision will be in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map Act and supplementary City Subdi- vision Ordinance. CONDITIONS OF APPROVAL: 1. The tract map received and dated May 18, 1982, shall be the approved tentative tract. 2. The applicant shall dedicate to the City, all vehicular access rights along Clay Avenue, Delaware Street and 17th Street, ex- cept at the intersections of private drives and public streets. 3. The water system shall be in accordance with Public Works Depart- ment standards. 4. Sewer, drainage, and street improvements shall be in accordance with Public Works Department standards. 5. Fire hydrants and fire lanes shall be appropriately located and posted in accordance with Fire Department standards. 6. Planning Commission May 18, 1982 Page 6 CONDITIONAL USE PERMIT NO. 82-5: FINDINGS FOR SPECIAL PERMIT: The Planning Commission found that the proposed development will: 1. Promote a better living environment insofar as the project has been designed to maximize privacy for the individual tenant, ' minimized vehicular traffic, and provided an adequate amount of private and public open space areas. 2. Promote better land planning techniques with the maximum use of aesthetically pleasing types of architecture, landscaping, site layout and design of which this plan has incorporated ar- chitecture that has created interesting shapes, plains and areas, and which has incorporated landscaping in order to soften and enhance the hardscape design of the buildings, and which has utilized land planning techniques that reduce conflicts between vehicular and pedestrian traffic. 3. Not be detrimental to the general health, welfare, safety or convenience of the neighborhood or the City in general, nor detrimental or injurious to the values of property or improve- ments of the neighborhood or the City in general. This project has been designed as an integrated planned residential develop- ment and has been adapted to the terrain and is compatible with the surrounding land uses. SPECIAL PERMIT: A special permit was granted by the Planning Commission allowing the applicant to deviate from the Ordinance Code pertaining to the following code discrepancies: 1. Section 9362.2, Maximum Site Coverage. 50o is allowed; 56% is provided. 2. Section 9363.3, Setback From Public Street. A 20-foot setback is required: a 10 foot setback is provided on the first floor and a 6 foot setback is provided on the second floor. 3. Section 9362.10, Building Bulk - "B" and "C". A 4-foot offset is required for units attached side -to -side; no offset is pro- vided. One-third (1/3) of the units are required to be one story; all 5 units are proposed as two-story units. 4. Section 9372.11, Common Open Space. 2,000 square feet is re- quired (400 square feet per unit); 1,883 square feet is pro- vided within the recreation room. 5. Section 9362.12, Main Recreation Area. 10,000 square feet is -6- 5-18-82 - P.C. Minutes, H.B. Planning Commission May 18, 1982 Page 7 required; 1,883 square feet is provided within the recreation room. FINDINGS FOR APPROVAL: 1. All elements of the plan not addressed by the approval of a special permit must comply with the provisions of Article 936 and any other appli- cable provisions of the Huntington Beach Ordinance Code. 2. Natural gas and 220V electrical shall be stubbed in at the lo- cation of clothes dryers. 3. All hot water lines shall be insulated to provide less water waste and to keep hot water pipes from heating cold water pipes. 4. All building spoils such as unusable lumber, wire, pipe and other surplus or unusable material shall be disposed of at an off -site facility equipped to handle them. 5. If lighting is included in the parking lot and/or recreation area, energy -efficient lamps shall be used (e.g. high pressure sodium vapor). All outside lighting shall be directed to pre- vent spillage onto adjacent properties. 6. Landscaping shall consist of low water -consuming plants wherever feasible. Landscaped areas shall,be extensively mulched to im- prove the water -holding capacity of the soil by reducing evapo- -7- 5-18-82 - P.C. Minutes, H.B. Planning Commission May 18, 1982 Page 8 ration and soil compaction. 7. All dwellings on the subject property shall be constructed in compliance with the State acoustical standards set forth for units that are within the 60 CNEL contour of the property. Evi- dence of compliance shall consist of an acoustical analysis re- port prepared under the supervision of a person experienced in the field of acoustical engineering with the application for a building permit. 8. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site sampling and la- boratory testing of materials to provide detail recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets and utilities. 9. The covenants, conditions and restrictions shall contain a pro- vision that will prohibit storage of boats, trailers, and re- creation vehicles on site unless an area that is specifically designed for such storage and is in compliance with the provisions of Article 936, is provided for the project. 10. If at any time an entry gate is proposed at the main entrance, the location and design shall be approved by the Department of Development Services and Fire Department. 11. A detailed landscape and sprinkler plan shall be subject to the approval of the Department of Development Services prior to the issuance of building permits. 12. The service drive at the intersection of Delaware Street and Clay Avenue shall be deleted. 13. All walls, boundary landscaping, or raised planters shall com- ply with the site angle, setbacks and height restrictions con- tained within Articles 936 and 979 of the Ordinance Code. 14. The driveway located on 17th Street shall be revised to reflect a 20 foot minimum width. 15. The developer shall be responsible for all signing and strip- ping of 17th Street, Clay Avenue and Delaware Street. 16. The developer shall maintain all landscaping within the public right-of-way on 17th Street and Clay Avenue. The developer shall also integrate the landscaping contained within the public right-of-way into the on -site landscaping plan. There shall be no street trees within the public sidewalk. A request to permit a reduction in lot frontage and site area; and to legally create four parcels from one existing lot, .85 acres in size, located at the northwest corner of Cypress Avenue and Beach Boulevard. The configuration of these four parcels have been exist- ing for a number of years as the result of individual sales of each parcel of land. Staff recommended approval. Mr. Bellavia called attention to the memo from Don Noble, Public Works Department, regarding the street width along Cypress Avenue. The public hearing was opened. Phil Zisakis, the applicant, asked that the application be approved. The public hearing was closed. A MOTION WAS MADE BY HIGGINS AND SECONDED BY LIVENGOOD TO APPROVE TENTATIVE PARCEL MAP 80-563 AND CONDITIONAL EXCEPTION 82-02 WITH FINDINGS AND CONDITIONS AS OUTLINED BY STAFF. THIS MOTION FAILED BY THE FOLLOWING VOTE: AYES: Mahaffey, Higgins, Livengood NOES: Paone, Winchell, Porter, Schumacher ABSENT: None ABSTAIN: None Commissioner Mahaffey stated that he could not support a motion to deny this application. ON MOTION BY PORTER AND SECOND BY SCHUMACHER TENTATIVE PARCEL MAP 80-563 AND CONDITIONAL EXCEPTION 82-02 WERE DENIED WITH REASONS FOR DENIAL, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: (TPM 80-563 & CE 82-02) 1. The Commission did not want to legalize existing illegal parcels which would establish lots fronting on Beach Boulevard with less than 60 feet of frontage. If this were proved, it would encour- age access for each parcel. 2. Alternative solutions to the Division of Land that would reduce long-range problems, could be found. CONDITIONAL USE PERMIT NO. 82-6/CONDITIONAL EXCEPTION NO. 82-07/ NEGATIVE DECLARATION NO. 82-13 Applicant: Frank Ayres and Son Construction Company A request to permit construction of a recreational vehicle and self - storage facility and to permit construction of a wood and stucco wall in lieu of the required block wall and to permit a 10-foot front and exterior side yard setback in lieu of the required 15-foot setback. Subject property is approximately 1 acre in size, located on the southwest corner of Ernest Avenue and Stewart Street. Commissioner Paone stated that due to possible conflict, he would be abstaining from voting on this application. The public hearing was opened. Bruce Ayers, applicant, asked that his application be approved. Bruce Geer, neighbor, protested the fact that no mention of the abandoned oil well on the subject pro- perty was made in the staff report. The public hearing was closed. Commissioners questioned the requirement for a block wall. Staff felt that with other materials, such as was proposed, more maintenance would be required. The applicant felt that this would be no problem since they would be willing to keep up maintenance as a viable busi- ness effort. Regarding the abandoned oil well, staff replied that a clearance from the respective departments in the City was required before the issuing of any building permits. A MOTION WAS MADE BY HIGGINS AND SECONDED BY SCHUMACHER DENYING THAT PORTION OF CONDITIONAL EXCEPTION NO. 82-07 THAT DEALS WITH THE VARIANCE ON THE BLOCK WALL AND THE 15 FOOT SETBACK ALONG STEWART STREET, WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: FINDINGS FOR DENIAL: 1. There are no exceptional circumstances applicable to the land and buildings that do not apply generally to other properties within the same district. 2. The granting of Conditional Exception No. 82-07 will constitute a grant of special privilege inconsistent with limitations placed on other properties within the same zoning classification. AYES: Higgins, Livengood, Winchell, Porter, Schumacher, Mahaffey NOES: None ABSENT: None ABSTAIN: Paone ON MOTION BY PORTER AND SECOND BY WINCHELL CONDITIONAL USE PERMIT NO. 82-6 WAS APPROVED WITH FINDINGS AND ADDITIONAL CONDITIONS AS LISTED BELOW, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed storage facility substantially complies with all provisions of the Huntington Beach Ordinance Code including parking, setbacks, landscaping and architectural design, with the exception of the 10 foot setback which shall be revised to show a 10 foot setback along Ernest Avenue and a 15 foot setback along Stewart Street. 2. The subject property is suitable for the proposed storage fa- cility and will be compatible with surrounding industrial uses which include two storage yards and vacant industrially -zoned property. CONDITIONS OF APPROVAL: 1. The site plan revised and dated April 29, 1982, is the approved layout except for the setback along Stewart Street shall be in- -11- 5-18-82 - P.C. Minutes, H.B. Planning Commission May 18, 1982 Page 12 creased to 15 feet for all buildings and/or fencing. 2. The entrance gate located on Ernest Avenue shall be relocated to reflect a 20 foot setback from the property line to prevent stacking of vehicles entering the storage facility. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g., high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 5. A chemical analysis, as well as tests for physical properties of the soil on the subject property, shall be submitted to the City for review prior to the issuance of building permits. 6. The development shall comply with all requirements set forth by the Huntington Beach Fire Department. 7.. The plan shall be revised to reflect a solid six (6) inch con- crete block or masonry wall not over eight (8) feet high, along Stewart Street. This wall shall be reviewed and approved by the Design and Review Board for colors and design prior to issuance of building permits. 8. The applicant is responsible for properly capping any abandoned oil wells located on the subject site. Said capping shall be completed in compliance with all City and state standards and prior to the issuance of building permits. 9. The applicant sahll provide a one-half (,) street section plus 10 feet from the intersection of Ernest Avenue and Goldenwest Street to the first entrance located on Ernest Avenue of the proposed project. Minutes, H.B. Planning Commission May 18, 1982 Page 13 80 feet east of Gothard Street. The staff recommends a denial. The public hearing was opened. Robert Cox, representing Sportmart, Incorporated, and Paul Taylor of San Pedro Sign Company, came forward to answer any questions, Seeing there were none, the public hearing was closed. A motion was made by Paone and seconded by Higgins to approve the Special Sign Permit subject to the approval of a special signed pro- gram on the entire building which would include the Levitz Furniture Warehouse. After a brief discussion on this motion, it was withdrawn; the maker of the second also agreed to withdraw his second. ON MOTION BY PORTER AND SECOND BY LIVENGOOD SPECIAL SIGN PERMIT NO. 82-1 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The granting of the special sign permit will not constitute a grant of special privilege because the size of the building and the increased building setback 1350 feet) from Edinger Ave- nue, affect a reduced signage impact. 2. The proposed sign will not be detrimental to the property lo- cated in the vicinity of such sign. 3. The proposed sign does not obstruct pedestrian or vehicular traffic vision. 4. The proposed sign will not adversely affect other signs in the area. 5. Strict compliance with Article 976 may result in a substantial economic hardship to the applicant. CONDITIONS OF APPROVAL: 1. Planning Commission May 18, 1982 Page 14 DISCUSSION ITEMS: ELLIS-GOLDENWEST SPECIFIC PLAN Staff reported back to the Planning Commission the comments received at a meeting on May 6, 1982 with representatives from Chevron USA and the Huntington Beach Company. The Commissioners had no questions regarding this information. The next steps in the Specific Plan pro- cess will be a meeting with the property owners in the area on May 20, and a public hearing on June 1, 1982. MINI -WAREHOUSE Although staff prepared this report for possible exploration of a code amendment that would allow for this type of use, the Commission felt it was not necessary at this time. DISCUSSION OF MAY 17, 1982 CITY COUNCIL MEETING Florence Webb reported that several items were continued by the City Council; namely, the appeals by Mr. Biddle (fertilizer production) and Mr. Habel (Old World Shopping Center). The code amendment per- taining to windscreens was approved along with a code amendment ex- tending the present expiration date on tract maps. City Council made no mention of the letter sent to them by the Planning Commission re- garding the progress of the Mobile Home Conversion Ordinance. Re- vocation of a Conditional Use Permit was made by the Council at staff's recommendation for "Games Plus" Arcade. DEVELOPMENT SERVICES ITEMS: COUNCIL -APPOINTED HOUSING COMMITTEE Ruth Bailey, appointed as Chairwoman, and Don McAllister were appointed by the City Council to serve on a 5-member Housing Committee. Chair- man Winchell appointed Commissioners Livengood and Mahaffey to serve on this committee. Also recommended by staff was Dick Harlow to serve as the'one building industry representative. The Commission went along with that recommendation and this will be forwarded to the City Council for confirmation. JOINT STUDY SESSION ON DOWNTOWN SPECIFIC PLAN A joint study session has been scheduled for the evening of May 24, 1982, to discuss the Downtown Specific Plan.
