REGULAR AGENDA ITEMS:
USE PERMIT NO. 82-21
Applicant: Mr. Frank Richman
To permit a 1,228 square foot addition to an existing restaurant
located at 18151 Beach Boulevard.
Staff outlined proposal and stated that this request is categorically
exempt, Class. 3, California Environmental Quality Act, 1970.
Mr. Frank Richman, property owner, accompanied by his architect
from W.S.B. and Associates, Inc., were present to represent their
application.
The public hearing was opened by Acting Chairman Crosby. The
applicant stated he had no_comments at this time. There being no
one else present to speak in favor or opposition of this proposal,
the public hearing was closed.
Discussion carried between the Board Members and the applicant.
The -applicant was questioned on what appeared to be an illegal
plywood structure at the back of his property which did not look
as though it was built to code. The applicant was asked if he had
.a permit for the plywood structure. Mr. Richman replied "No", the
plywood structure is'covering a boat which will be completed by
the end of the summer. He further stated that, if necessary, the
plywood structure could be removed immediately. The applicant
was further questioned on the other boats, along with five (5)
trailers -which appeared to be stored on his property. Mr. Richman
stated that the"boats and trailers belong'to his friends. It was
-explained to Mr. Richman that already there is a non -conforming

use .on this property with an -established residence
located on property which is zoned for Commercial Use. Mr.
Richman was informed that storage on his property is not an
allowable use although he could store his own boat and his own
trailer on his property. Mr. Richman agreed that this situation
did not enhance his property and that the time -frame of 90 days
from issuance-of'building permits would be adequate for removal
of the boatsf trailers, and plywood structure covering a boat.
The applicant was advised that a revised site plan reflecting
six (6)- percent of the restaurant site, including the parking area,
would have to-be.submitted for review and approval as the landscaping
requirements --since construction of the restaurant have increased
from three percent to six percent.

WAS -APPROVED WITH FINDINGS AND CONDITIONS OF APPROVAL IMPOSED
FOLLOWING, BY THE FOLLOWING VOTE:-
FINDINGS:
1. The -proposed addition, maintenance and operation of the use
will not be detrimental to:
a. The general welfare of -persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use
or building.
2, The granting of a use permit will not-adversely_affect the
General Plan of the City- of Huntington Beach.
3. The proposal -is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. _The revised conceptual_plot plan and elevations received
June 22,' 1982, shall be the approved layout, subject to
the following:
a, A revised site plan shall be submitted to the Secretary
of the Board for review and approval consisting of the
following:

1. Landscape and irrigation plan reflecting six (6)
percent of the restaurant site including the
parking area.
2. The plan shall depict type of materials to be
used for the two (2) trash enclosures.
If such plan complies with the modifications
outlined by the Board, said plan shall be
approved and made a permanent part of the
administrative file.
B. GENERAL CONDITIONS:
1• The proposed addition to the restaurant shall
be fire sprinklered and all requirements of the
Fire Code Ordinance shall be met.
2- The boats, trailers, and the plywood structure
covering a boat shall be removed within 90 days
from issuance of building permits.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in
the immediate vicinity;
Past administrative action regarding this property.

To permit the addition of two (2) 60,000 square foot buildings
located at 5101 Bolsa Avenue.
Acting Chairman Crosby stated that Administrative Review No. 82-27
shall be covered by Negative Declaration No. 82-16.

Staff introduced -the proposa with Mr: �J:PSpecialist
Environmental Engineering, for Mc Donnell Douglas Astronautics Company
present to speak on this application.
Mr. Valinsky addressed the Board and gave -a -.description of the two
proposed buildings. One building will be a manufacturing/assembly
building utilizing a steel frame with corrugated metal siding, painted
to match the existing buildings. The maximum height of this building
is _,40 feet_..T:The?ot_her "lbuilding will be used for engineering and
will be a concrete tilt=up buil3ing,- single story with a maximum
height of 20 feet. The concrete will be painted to match the existing

visitors parking area, concrete and asphalt areas, and ground cover

Upon- review"of the plan submitted_; the applicant was questioned
as to"why a preliminary plan, in lieu of a site plan, was submitted
as before the Board could make a determination on the proposal for
the' --'two bdildings::-Circulation, landscaping, elevations, parking
requirements, ingress and egress access, etc. must be reviewed.
Mr. Valih8ky-,stated=that as of this date they have not received the
Government contract,-.but=.ex_pect to hear within the next two weeks.
He further stated that as they are not sure of being awarded the
contract; they yhad•_hoped the}_preliminary: plan= -with-" photos of the
existirig,site'-would be adequate for the Board to take action. The Boa
discussed the need to review more specific plans prior to taking an action

82-563'WAS APPROVED WITH FINDINGS AND CONDITIONS OF APPROVAL AS
FOLLOWS, BY THE FOLLOWING VOTE:
FINDINGS:
1. The proposed subdivision of two (2) parcels creating four (4)
parcels for purposes of Industrial_Development is in compliance
with the size and shape of property necessary for that type
of development.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of use.
3. The property was previously studied for this intensity of land
use at the time the land use designation for "Restricted
Manufacturing District" was placed on the subject property.
4. The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standard plans and specifications
on file with the City as well as in compliance with the State
Map Act and supplemental City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS
FOR ANY PURPOSE:
1*. The tentative parcel map received by the Department of
Development Services on June 9, 1982, shall be the approved
layout.

Department of Public Works and recorded with the Orange
County Recorder prior to occupancy.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time said parcels are developed
(if such systems exist within 200 feet of said parcels).
4. All utilities shall be installed underground at the time
said parcels are developed.
5. Compliance with all applicable City Ordinances.
6. The property shall participate in the local drainage
assessment district at the time said parcels are developed.

Applicant: Mr. Norbert Olberz c/o Sports Chalet -
To permit consolidation of two (2) existing parcels of land into
one (1) parcel. Subject property is located on the east side of
Beach Boulevard, approximately 185 ft. south of Stark Street.
Zoning - C-2, Community Business District.
Staff introduced the application and stated that this request is
Categorically Exempt, Class. 1, California Environmental Quality
Act, 1970.
Mr. Dennis Trausch, representing the owner, was present and
acknowledged receipt of and concurrence with the Conditions of
Approval.
The Board Members discussed the Conditions of Approval with the
applicant. The necessity of the existing driveway along Stark
Street being shown on a revised tentative parcel map insuring adequate
circulation on the property was explained in detail to Mr. Trausch.
ON MOTION BY SMITH AND SECOND BY CROSBY, TENTATIVE PARCEL MAP
NO. 82-564 WAS APPROVED WITH FINDINGS AND CONDITIONS OF APPROVAL
FOLLOWING, BY THE FOLLOWING VOTE:
FINDINGS:
1. The proposed consolidation of two (2) parcels into one (1)
parcel for purposes of Commercial Use is in compliance with
the size and shape of property necessary for that type of use.

2. prior to submitting the final tract map, a revised tentative
parcel map shall be submitted to the Secretary of the Board
for review and approval reflecting the existing driveway
along Stark Street.
3. A parcel map shall be filed with and approved by the
Department of Public Works and recorded with the Orange
County Recorder prior to occupancy of the new addition.
4. Compliance with all applicable'City Ordinances.
5. A copy of the -recorded parcel map shall be filed with

To permit an eight (8) ft. encroachment into the required 110 f t.
setback from sectional district line. Property located at 17011
and 17021 "A" Street, zoned QC4 - Highway Commercial District.
Staff introduced the proposal and stated that this request is
assessed under General Plan Amendment No. 76-3.
Michael Lasley, A.I.A. for the project and Phillip A. Oliver, owner
of the property, were present to speak in favor of their proposal.
The public hearing was opened by Acting Chairman Crosby.
Michael Lasley introduced himself to the Board and stated that the
proposed professional office building is two stories with sub-
terranean parking. He mentioned that this particular layout was
designed to eliminate parking in the front of the building and that
by the use of additional landscaping, theN��aill be able to completely
conceal the parking area from Warner Avenue. The applicant stated
he felt the eight foot encroachment into the required 110 foot setback
for an open exterior stairway and open exterior landing was necessary
as the Precise Plan of Street Alignment for a major utility easement,

To permit a 7,500 square foot office building located at 17011
"A" Street, zoned QC4 - Highway Commercial District.
This project was previously assessed under General Plan Amendment
No. 76-3.
The necessary conditions, allowing this proposal to meet the
Huntington Beach Ordinance Code, were discussed with Mr. Oliver
and Mr. Lasley, as called out in the following Conditions of
Approval.
ON MOTION BY SMITH AND SECOND BY VOGELSANG, ADMINISTRATIVE REVIEW
NO. 82-28 (IN CONJUNCTION WITH C.E. NO. 82-33) WAS GRANTED WITH
CONDITIONS OF APPROVAL IMPOSED AS FOLLOWS, BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised conceptual plot plan received June 17, 1982,
shall be the approved layout subject to the following:
a. Applicant shall make the following dedications:
1. 2-1/2 feet off of the alley.
2. Parcel No. 167-324-02 only - five feet to "A" Street.
3. 35 foot radius to Warner Avenue and "A" Street.
4. 10 ft. by 10 ft. corner cut-off at Warner Avenue
and the alley.
b. A landscape, and irrigation plan shall be submitted
to the Secretary of the Board for review and approval.

C. An elevation plan depicting proposed colors and materials
to be used shall be submitted to the Secretary of the
Board for review and approval.
If --above plans comply with the modifications outlined
by the Board, said plans shall be approved and made a
permanent part of the administrative file.
d.- A parcel map shall be filed consolidating parcels
No. 167-324-02 and No. 167-324-03 and recorded prior
to issuance of a Certificate of Occupancy.
e. All vehicles access rights shall be released and
relinquished to the City of Huntington Beach.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property and improvements in
the immediate vicinity;

B. GENERAL CONDITIONS:
1..'If roof -top mechanical equipment is used, a mechanical
screening plan shall be submitted to the Secretary of the
Board for review and approval.
2. If general lighting is included in the parking lot, energy
efficient lamps shall be used (e.g. High pressure sodium vapor,
metal halide). All outside lighting shall be directed to
prevent "spillage" onto adjacent properties.
3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material shall be disposed
of at an offsite facility equipped to handle them.
