BOARD MEMBERS PRESENT: Webb, Kelly, Vogelsang, Smith, Evans STAFF PRESENT: Zelefsky MINUTES: ON MOTION BY EVANS AND SECOND BY WEBB, THE MINUTES OF THE REGULAR MEETING OF JUNE 9, 1982, WERE APPROVED AS TRANS- CRIBED BY THE FOLLOWING VOTE: AYES: Webb, Kelly, Vogelsang, Smith, Evans NOES: None ABSTAIN: None ABSENT: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 82-36 Appl.: -Mr. Daniel Craig To permit a second story'residential addition to encroach 7-1/2 ft. into the required fifteen (15) ft. front yard setback. Property located at 16245 Santa Barbara Lane. Staff introduced the proposal and stated that this request is a Categorical Exemption, Class. 1, California Environmental Quality Act. Chairman Kelly opened the public hearing and informed the applicant, as well as others present requesting conditional exceptions, of, guidelines necessary whereby allowing the Board to grant a Conditional Exception provided that in so doing, the general purpose of the Ordinance Code is not affected. Minutes: H.B. Board of Zoning Adjustments July 14, 1982 Page Two Mr. Jorge, A.I.A., for the project introduced himself to the Board. He said his clients, Mr. and Mrs. Craig, are proposing to acid a second story addition for a billiard room and gymnasium over their three (3) car garage. The applicants garage has a front setback of 7-1/2 ft. from the public right-of-way. Mr. Jorge stated that the applicants hardship is created by the configuration of their pie -shaped lot located on a channel, coupled with the fact that it is a corner lot. Mr. Jorge cited other homes in the same vicinity wherein similar additions have been approved. The public hearing was closed by Chairman Kelly. The Board discussed the plan submitted with Mr. Jorge. It was pointed out that as the applicants home was located on a corner, the plan did not make an allowance for the front entry set farther back than the garage. Mr. Jorge was informed that a revised plan showing the appropriate dimensions would be necessary as outlined in the Conditions of Approval. Parity in the applicants neighbor- hood was discussed. ON MOTION BY WEBB AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 82-36 WAS APPROVED WITH REASONS, FINDINGS, AND CONDITIONS OF APPROVAL FOLLOWING, BY THE FOLLOWING VOTE: FINDINGS AND REASONS: 1. This property has unique characteristics because of its configuration (pie -shaped) creating a hardship. The strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 2. The granting of this request is one of parity with surrounding homes. 3. Addition will not impact the neighborhood. 4. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 5. The granting of a conditional exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 6. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. -2- BZA 7/14/82 Minutes: H.B. Board of Zoning Adjustments July 14, 1982 Page Three CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE.OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received on June 24, 1982, shall be the approved layout, subject to the following: a. A revised plot plan shall be submitted to the Secretary of the Board for review and approval indicating the appropriate.dimensions. If such plan complies with the modifications outlined by the Board; said plan shall be approved and made a permanent part of the administrative file. In its approval -action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. B. General Conditions_: 1. The addition shall not exceed the face of the existing garage. AYES: Webb, Kelly, Vogelsang, Smith, Evans NOES: None ABSTAIN: None ADMINISTRATIVE REVIEW NO. 82-27 (Con't. from 6/30/82) Applicant: Mc Donnell -Douglas Astronautics Co. To permit the addition of two (2) 60,000 square foot buildings -located at 5301 Bolsa Avenue. Staff outlined the proposal and stated that the reason this application was tabled at the meeting of June 3Q, 1982, was because the applicant was not sure of receiving a specific Government contract necessitating the two proposed buildings and had submitted to the -Board a preliminary plan which did not contain adequate information for the Board to take action.. At the meeting of June 30, 1982, Negative Declaration No. 82-16 was approved for this project with mitigating measures as outlined in the following Conditions of Approval for Administrative Review No. 82-27. -3- BZA 7/14/82 Minutes: H.B. Board of Zoning Adjustments July 14, 1982 Page Four ON MOTION BY WEBB AND SECOND BY VOGELSANG, ADMINISTRATIVE REVIEW NO. 82-27 WAS TAKEN OFF THE TABLE FOR BOARD ACTION, BY THE FOLLOWING VOTE: AYES: Webb, Kelly, Vogelsang, Smith, Evans NOES: None ABSTAIN: None Mr. J.P. Valinsky, Staff Specialist - Environmental Engineering, for Mc Donnell Douglas Astronautics Company, was present to speak in favor of this proposal. Upon review of the applicant's new plan submitted, the Board outlined many points of concern with the applicant's plan covering items which were not shown in detail e.g. circulation, fire lanes, dimensions for parking spaces, driveway widths, location of chain - link fence, landscaping, etc. It was the consensus of the Board, with the applicant's concurrence, to have a representative involved with drawing up the plans meet with our Planning staff to work out a precise plan for the proposal of these two buildings. It was mentioned to Mr. Valinsky that aesthetics were of great importance not only to the surrounding area but also for the new proposed high-rise hotel being considered by Mr Donnell Douglas at a later date which will overlook this particular area. ON MOTION BY SMITH AND SECOND BY EVANS, ADMINISTRATIVE REVIEW NO. 82-27 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL APPLICABLE, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B, GENERAL CONDITIONS: 1. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 2. If lighting is included in the parking lot energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 3. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 4. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Depart- ment. Property located at 1840 Pine Street. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. AYES: Webb, Kelly, Vogelsang, Smith, Evans NOES: None ABSTAIN: None TENTATIVE PARCEL MAP NO. 82-566 Applicant: Khan Associates To permit division of one (1) existing parcel into two (2) parcels. Property located at 17172 Ash Street zoned R-2, Two -Family Residence District. Staff introduced the proposal and stated that as a request has been received on Tentative Parcel Map No. 82-566 to create two (2) lots smaller than required by Code, a conditional exception (No. 82-09) was issued and that both applications will have to be heard,in con- junction,by the Planning Commission. The Board reviewed the tentative parcel map received and noted that many concerns need to be resolved prior to the Planning Commission taking action. Staff was directed to forward a letter to the applicant outlining all concerns.
