Board of Zoning Adjustments August 18, 1982 Page Two TENTATIVE PARCEL MAP NO. 82-569 Applicant: Mr. Breck Ule To permit lot consolidation - Lots 23 and 24 of Tract Map No. 8694 to one (1) lot, for the purpose of constructing an Industrial warehouse building. Property located at Connector Lane & Engineer Drive (East side of street) zoned Ml-A, Restricted Manufacturing District. Acting Chairman Evans introduced the proposal. Acting Secretary Spencer stated that the tentative parcel map was filed in compliance with a Condition of Approval on Administrative Review No. 82-6, previously approved. Mr. Breck Ule was present and acknowledged receipt of and his concurrence with imposed Conditions of Approval. ON MOTION BY VOGELSANG AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 82-569 WAS APPROVED WITH FINDINGS AND CONDITIONS OF APPROVAL IMPOSED FOLLOWING, BY VOTE AS FOLLOWS: FINDINGS: 1. The proposed consolidation of two (2) parcels into one (1) parcel for purposes of constructing an Industrial Warehouse Building is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3.- The property was previously studied for this intensity of land use at the time the land use designation for Restricted Manufacturing District allowing construction of Industrial buildings, was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Development Services on July 30, 1982, shall be the approved layout. -2- BZA 8/18/82 `1 Minutes: H.B. A copy of the recorded parcel map shall be filed with the Department of Development Services. 4. All Conditions of Approval imposed on Administrative Review No. 82-6 and Use Permit No. 82-6 shall be applicable to Tentative Parcel Map No. 82-569. AYES: Spencer, Evans, Vogelsang, Smith, Cooper NOES: None ABSTAIN: None ADMINISTRATIVE REVIEW NO. 82-38 Applicant: Centrilift-Hughes, Inc To permit a 10,000 sq. ft. addition to existing plant and 800 sq. ft. addition to existing office. Plant and office additions to match design of existing. Property located at 5421 Argosy Avenue, zoned M1-A, Restricted Manufacturing District. Acting Chairman Evans introduced the proposal and stated that this request is Categorically Exempt, Class. 1, California Environmental Quality Act, 1970. Acting Secretary Spencer outlined the applicant's request and stated that all improvements have been met with the exception of one deficiency which is parking. Seven (7) more parking stalls are required. Acting Secretary Spencer stated that the applicant has ample room in the rear of his building to satisfy the parking requirement. Mr. Henry Thompson, representing Centrilift-Hughes, Inc., agreed that additional parking could be provided without a problem. He further stated that they repair and test submersible deep well pumps aided by the use of two overhead crains. It was felt by the Board Members that the proposed additions would be architecturally compatible with the surrounding buildings in the Industrial Park. ON MOTION BY SPENCER AND SECOND BY SMITH, ADMINISTRATIVE REVIEW NO. 82-38 WAS APPROVED, WITH CONDITIONS OF APPROVAL FOLLOWING, BY VOTE AS FOLLOWS: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received July 23, 1982, shall be the approved layout, subject to the following: -3- BZA 8/18/82 Minutes: H.B. Parking ratio calculations shall be submitted to the Secretary of the Board for review and approval complying with Article 979 of the Huntington Beach Ordinance Code. If the parking ratio calculations comply with the modifications outlined by the Board, they will become a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. AYES: Spencer, Evans, Vogelsang, Smith, Cooper NOES: None ■ ABSTAIN: None ADMINISTATIVE REVIEW NO. 82-40 Applicant: S.S. Simon and Jude Church To permit a "Special Event", to be located at 20400 Magnolia Street. Parish festival to be held October 1, 2, and 3, 1982. This request is Categorically Exempt, Class. 1, California Environ- mental Quality Act,�1970. Ms. Kristina De Lorme and Mr. Albert Manirlle were present to speak in favor of the church fund-raising event. They were informed of concerns of the Fire Department as their site plan showed no dimensions for fire lanes for emergency vehicles should their services be required. The applicants were asked to contact Larry Marshburn, Fire Specialist, to discuss the necessary circulation requirements on site -for the "Special Event". ON MOTION BY COOPER AND SECOND BY SMITH, ADMINISTRATIVE REVIEW NO. 82-40 WAS APPROVED, WITH CONDITIONS OF APPROVAL FOLLOWING, BY VOTE AS FOLLOWS: CONDITIONS OF APPROVAL: 1. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. AYES: Spencer, Evans, Vogelsang, Smith, Cooper NOES: None ABSTAIN: None CONDITIONAL EXCEPTION NO. 82-52 Applicant: Huggins Sheet Metal, Inc. To permit a four (4) foot encroachment into the required garage setback and allow one (1) additional garage to face a street. Property located at 16691 Green Street. Acting Chairman Evans informed the applicant of guidelines necessary whereby allowing the Board to grant his application provided that in so doing, the general purpose of the Ordinance Code is not affected. This request is Categorically Exempt, Class. 5, California Environ- mental Quality Act, 1970. Acting Secretary Spencer outlined the applicant's intent and purpose for the conditional exception. The applicant is proposing to construct a multiple -family residential development in this R-2 zone. He is requesting a four (4) foot encroachment into the required 22 ft. setback for a front -on garage. Consideration is requested for the four (4) foot encroachment based upon the fact that the applicant has three (3) streets involved with his property, two of which are private streets, one of which he will be using for access onto his property. The strict interpretation of the Code mandates a twenty-two (22) ft. setback whereas surrounding properties in his area with private streets have setbacks of no more than five (5) feet. The recent Code amendment requires a twenty-two ft.- garage setback for private streets and public streets. Four garages and an open parking space are also being proposed. The applicant is requesting to have the one additional garage face the private street. The public hearing was opened by Acting Chairman Evans. Mr. Bob Huggins, present, stated that he had no further comment. The public hearing was closed with no one else present to speak in favor or opposition of Mr. Huggins request. Board discussion carried on concern for fire vehicular access for the private streets allowing for a "NO PARKING" sign on a portion of the alley which it was determined could be required when future development occurs. -5- BZA 8/18/82 Minutes: H.B, Board of Zoning Adjustments August 18, 1982 Page Six Conditions for approval were discussed. ON MOTION BY SMITH AND SECOND BY COOPER, CONDITIONAL EXCEPTION NO. 82-52 WAS APPROVED WITH REASONS, FINDINGS, AND CONDITIONS OF APPROVAL IMPOSED FOLLOWING, BY VOTE AS FOLLOWS: REASONS: 1. Neighboring properties, having garage access from other private streets or public alleys, are providing setbacks at a minimum distance of five (5) feet. 2. Although designated as "Private Streets" on zoning district maps, they serve no other purpose other than as vehicular access drives and not designed as typical/standard residential streets. 3. Adequate guest parking will be provided for without additional garage setback. FINDINGS: 1. The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity. 2. Because of property's special circumstances in that it abuts three (3) streets requiring dedication and setback, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity. 3. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a conditional exception will not be materially detrimental to the public welfare, or injurious to property in the vicinity. 5. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: The conceptual plot plan received August 10, 1982, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: -6- BZA 8/18/82 Minutes: H.B. General Conditions: 1. All Conditions of Approval for Tentative Parcel Map No. 82-565 shall be complied with. 2. Automatic or roll -up garage doors shall be provided. AYES: Spencer, Evans, Vogelsang, Smith, Cooper NOES: None ABSTAIN: None MISCELLANEOUS ITEM: TENTATIVE PARCEL MAP NO. 82-566 applicant: Khan Associates To permit division of an existing parcel into two (2) parcels. Property located at 17172 Ash Street. Acting Secretary Spencer stated that this application was before the BZA on July 14, 1982, at which time it was determined that many concerns needed to be resolved prior to hearing by the Planning Commission, in conjunction with C.E. No. 82-09. Staff, at the hearing of July 14-, 1982, was directed to forward a letter to the applicant outlining all concerns. Acting Secretary Spencer felt that as this application was accepted on June 29, 1982, and because of time constraint involved, the application should be referred to the Planning Commission meeting of September 23, 1982, allowing adequate time for a staff planner to obtain a revised tentative parcel map which would bring the proposal into conformance with the Ordinance Code prior to hearing by the Planning Commission. ON MOTION BY SPENCER AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 82-566 WAS REFERRED TO THE PLANNING COMMISSION MEETING OF SEPTEMBER 21, 1982, TO BE HEARD IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 82-09, BY VOTE AS FOLLOWS: AYES: Spencer, Evans, Vogelsang, Smith, Cooper NOES: None ABSTAIN: None -7- BZA 8/18/82 Minutes: H.B.
