OAKVIEW REDEVELOPMENT PLAN/E.I.R. (Continued from 8-17-82)
Initiated by City of Huntington Beach
To consider recommending approval of the Oakview Redevelopment Plan
and certification of the EIR to the City Council, and finding the
Redevelopment Plan consistent with the City's General Plan.
Tom Tincher gave an oral presentation reiterating the proposed plan
from the last regular meeting. Commissioner Schumacher asked about
the commercial venture on the corner of Beach and Warner Avenue. She
was currious if, when revenue comes in, would it have to go to that
particular project area. Mr. Tincher stated that the commercial ven-
ture in question was included in the original neighborhood enhancement
program and that, as of now, the tax revenue would only be designated
for the particular project area. He further stated that there is a
plan to consolidate these areas some time in the future. He also again
stressed the idea of redevelopment stating that it has a self-support-
ing mechanism which provides the possibility of tax exempt financing
and will eliminate blight while supporting development.

REVIEW OF CONDITIONAL USE PERMIT NO. 78-26
Initiated by Development Services
A review initiated by the Department of Development Services of Con-
ditional Use Permit No. 78-26 and existing conditions of approval
for the Old World Oktoberfest. This CUP was approved Oct. 3, 1978;
since that time there have been a number of problems and concerns
related to this special event. The subject property is located at
the northwest corner of Center Drive and Huntington Village Way.
Fire Department and Police Department representatives gave presenta-
tions on the history of the event and various problems which have
occurred during this event in the past. Most of the concern was
related to overcrowding and various life safety violations by the
applicant, Mr. Joe Bischof. Mr. Palin also cited a history of
building permit violations. It was discovered that the original
application was "to erect a tent periodically for various festivals".
Upon inspection, a fence was erected without the benefit of permit,
blocking parking spaces. Further discussion revealed that the ori-
ginal permit was silent on a time factor. In other words, is this
event annual or not? Fire Department spokesman, Bill Cooper, went
on to state that last year's event was marked by an incident where
one of his inspectors was hit by a bottle. He described the incident
as "near riot" to which Police Department spokesman corroborated.
Art Folger stated that the permit could be revoked or conditions of
the original application could be modified or added to.
The public hearing was opened. Lee Durst, attorney for the homeowners
association, stated that basically the homeowners appreciate the extra
business that is brought in by the annual event and would, therefore,
recommend approval. However, there was some concern about the in-
surance requirements placed on the applicant. Joe Bischof, applicant,
refuted any misconduct as reported by staff. He said that no struc-
tural changes were made to any of the buildings and that, in his
opinion, the "near riot" was only "people having a good time". He
further stated that he would provide 20 security guards on duty at
his own expense and would be separating patrons by age (e.g. over 21
years of age and under 21). Further testimony was received by his
wife, Delores Bischof, three employees of Old World and Nancy Lickt,
a shop owner, favoring continued approval of the event. The public
hearing was closed.
Commission discussion ensued clarifying many of the points raised
by staff and public testimony.
Commissioner Livengood made a motion to support the existing CUP
as it presently reads; to allow the event to be held this year; and
to review the event next year. This motion failed for lack of a
-second.
A motion was made by Paone and seconded by Higgins to modify the CUP-

permitting it to extend from September 11 through November 15, 1982
with all fire and building code strictly enforced, and that no
annual event be allowed. After some discussion, the motion and second
was withdrawn and a recess called by the Chairman to discuss added
conditions with staff.
The meeting resumed at 9:15 PM. Staff stated their recommended con-
ditions.
ON MOTION BY PAONE AND SECOND BY HIGGINS CONDITIONAL USE PERMIT No.
78-26 WAS REAPPROVED AND MODIFIED WITH THE FOLLOWING CONDITIONS,
BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL: (AMENDED)
1. All previous conditions of approval imposed upon Conditional Use
Permit No. 78-26 shall apply except as expressly superseded by
this modification.
2. The applicant shall hire a professional security service to be
approved by the City Police Department both as to the number of
security personnel and the quality of the personnel hired.
Police Department approval of the security service shall be
obtained in writing on or before September 10, 1982.
3. Location of the proposed fence shall be subject to the absolute
discretion of the Huntington Beach Fire Department, to assure
adequate fire access lanes and access to parking.
4. The Director of Development Services shall have the discretion
to employ a professional sound engineer at the applicant's ex-
pense to monitor the noise levels on the premises.
5. At no time during the operation of the event shall the noise
level on the premises exceed 65 dBA between the hours of
10:00 P.M. and 6:00 A.M.
6. The occupant load shall be monitored by Fire Department personnel
at the applicant's expense.
7. This conditional use permit shall be valid only for the period
of time from September 11, 1982, through and including
November 15, 1982, and shall expire at midnight on Novem-
ber 15, 1982.
8. The event may be terminated immediately by City staff and/or
the City Police Department if any of the conditions as set forth
in this conditional use permit approval are not complied with.
This condition will not in any way limit the City or the Police
Department powers should any other violations of City codes and
ordinances occur.

9. The event shall close operation at 2:00 A.M. on each day.
10. All Fire and Building codes of the City will be strictly complied
with and will be applied to this event, this property, and this
use in the same manner as they are applied to every other event,
business, or property in the City.
11. The applicant shall provide liability insurance and property
damage insurance, including product liability coverage, written
by an insurance company acceptable to the City in the minimum
limits as set by resolution of the City Council.

Commissioner Livengood stated that he would be abstaining from voting
on both Zone Change 82-13 and Zone Change 82-14.
The public hearing was opened. Seeing no one came forward to address
this issue, the public hearing was closed.
After clarification about the possibility of drilling on the propertt,
a motion was made.

An appeal to conditions of approval imposed by the Board of Zoning
Adjustments pertaining to the side yard setback for a garage and
height limits for a proposed garage on property located on the south
side of Williams Avenue, approximately 300 feet east of Florida
Street. A letter from the applicant was received requesting a con-
tinuance.
Chairman Paone asked if there was anyone present to speak to this
issue. Seeing no one came forward, the public hearing was opened
and will remain open.

An appeal of the Board of Zoning Adjustments' denial to permit a
218" encroachment into the required 10-foot rear yard setback of pro-
perty located on the south side of Hideout Circle, approximately
175 feet west of Green Street.
The public hearing was opened. Speaking in favor of granting the
appeal was the appellant, James Neal. The public hearing was closed.
Commissioner Winchell asked where the stairs were located. Mr.
Bellavia said they were located inside. Some discussion took place
regarding the encroachment at the first story level. Commissioner
Livengood made a motion to overrule the BZA denial and approve
Conditional Exception 82-39. This motion failed for lack of a second.
ON MOTION BY HIGGINS AND SECOND BY SCHUMACHER THE PLANNING COMMISSION
UPHELD THE BOARD OF ZONING ADJUSTMENTS' DENIAL OF CONDITIONAL EXCEP-
TION NO. 82-39 BASED ON THE FOLLOWING FINDINGS, BY THE FOLLOWING

FINDINGS FOR DENIAL:
1. The applicant can modify the design of the buildings allowing for
compliance with the minimum standards set forth in the Ordinance
Code.
2. 'A substantial hardship has not been demonstrated to grant the
subject conditional exception.
3. The granting of Conditional Exception No. 82-39 would be a
- special privilege inconsistent with the past actions of the Board
of Zoning Adjustments.
4. The proposed layout of the building would adversely impact the
property to the rear because the 218" encroachment would place

dential.
CONDITIONS OF APPROVAL:
1. The site plan received and dated July 29, 1982, shall be the
approved layout.
2. The secured parking lot shall remain open during the day for
use by the employees and customers of the existing office complex.

prohibited on the subject property.

the existing office compliex onto Main Street and Yorktown Avenue.
7. The Planning Commission reserves the right to rescind this con-
ditional use permit approval in the event of any violation of
the applicable zoning laws. Any such decision shall be preceded
by a notice to the applicant and a public hearing, and shall be
based on specific findings.
8. The parking space located at the east end of the secured parking
lot shall be eliminated due to inadequate turning radius and
manuevering space.

A request to permit the establishment of a temporary recreational
vehicle storage yard on property located east of Graham Street, ap-
proximately 400 feet south of Engineer Drive.
Commissioner Schumacher asked if the two tanks were holding tanks.
Mr. Bellavia stated that those tanks were for the plant itself and
will not be used to service recreational vehicles.
The public hearing was opened. Art Williams spoke in opposition to
the project stating that it would create a dust problem and a nui-
sance in the area. The public hearing was closed.
Commissioners had some concern regarding sewer connections to service
the RV'-s, the possibility of a dump station, clarification of the
material to be used on the access road, the height of the fence and
an additional gate on the property.

ON MOTION BY LIVENGOOD AND SECOND BY HIGGINS CONDITIONAL USE PERMIT
NO. 82-22 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. The proposed recreational vehicle storage yard is compatible with
surrounding land uses and will not be detrimental to the general
health and safety of those people working in the industrial area.
2. The proposed recreational vehicle storage facility substantially
complies with the criteria found in Section 9331.2 of the
Huntington Beach Ordinance Code.
CONDITIONS OF APPROVAL:
1. The site plan received and dated August 4, 1982, shall be the
approved layout. Approval of Conditional Use Permit No. 82-22
shall become effective concurrently with Ordinance No. 2568 on
September 15, 1982.
2. The RV storage facility shall comply with all provions contained
within 9331.2 Temporary Recreational Vehicle Storage of the
Huntington Beach Ordinance Code.
3. Conditional Use Permit No. 82-22 shall become null and void five
(5) years after the approval date (or 9-15-87).
4. Repair, service, refueling, and other related functions shall
be prohibited on the subject property.
5. A minimum six-foot high, slatted chain link fence shall be con-
structed and properly maintained to screen the RV storage fa-
cility from public streets and adjacent properties.
6. Storage on the subject property shall be limited to recreational
vehicles, boats, and travel trailers.
7. Access to the RV storage facility shall be limited to the exist-
ing driveway located at the northerly end of Graham Street.
Vehicle access from the RV storage facility to the Weiser Lock
facility shall be prohibited.
8. The unimproved portion of Graham Street adjacent to the RV stor-
age facility shall be landscaped to match the improved portion
of Graham adjacent to the Weiser Lock facility.
9. The Planning Commission reserves the right to rescind the con-
ditional use permit approval in the event of any violation of
the applicable zoning laws. Any such decision shall be preceded
by a notice to the applicant and a public hearing, and shall be
based on specific findings.

10. An additional gate shall be located in the fence along the south
side of the project. Said gate is for Fire Department access
and shall be approved by the Fire Department as to location and
locking device.
11. The installation of a holding tank dump station shall be approved
as to location and installation by the Departments of Development
Services and Public Works. Said dump station shall be limited
to the customers of the RV storage facility only and not be opened
to the general public.

Applicant: Nu Art Signmakers, A Wood Art Inc. Company
A request for a 6 ft. by 8 ft. freestanding monument sign at an
existing shopping center located at the southeast corner of Magnolia
and Garfield.
The public hearing was opened. Speaking in favor of approval was Russ
Jednick stating that a monument sign would be much more aesthetically
pleasing that the existing sign. Walt Brooks was also in favor of
granting the special sign permit. The public hearing was closed.
Some discussion took place with regard to situations, as in this in-
stance, where sign rights are obtained by only part-owners of a
parcel.
ON MOTION BY HIGGINS AND SECOND BY WINCHELL SPECIAL SIGN PERMIT NO.
82-5 WAS DENIED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS FOR DENIAL:
1. The applicant has not demonstrated that strict compliance with
the Ordinance Code will result in substantial economic hardship.
Other options are available to the applicant, including a
planned sign program or utilizing the available space on the
existing on -site signs.
2. The applicant has not demonstrated any exception or extra-
ordinary circumstances that do not apply generally to the pro-
perties in the same zone classifications as demonstrated by
other commercial uses within the general area.
3. The granting of this request will constitute a special privilege
because the applicant has several options available that fall

CITY COUNCIL ACTION OF SEPTE14BER 7, 1982:
Secretary Palin reviewed the actions taken by City Council at their
meeting of September 7, 1982. Among some of the issues discussed
and acted on were the appeal to a special sign permit which was over-
ruled and approved; three redevelopment project were approved; and
concurrence with a zone change for a service station at Edinger and
Springdale.
DEVELOPMENT SERVICES ITEMS:
Florence Webb informed the Commission that, regarding the Conditional
Use Permit No. 80-25 request for extension, the applicant will need
to reapply.
PLANNING COMMISSION ITEMS:
Commissioner Livengood complimented staff on a letter that was sent

to the property owners in the vicinity of a zone change for a service
station.
Commissioner Winchell reported on a tour sponsored by various redevelop-
ment agencies. The tour took them to projects in Long Beach and
Redondo Beach.
Commission consensus requested staff to look at the code (Section
9331.2) to see if better screening should be required on major
arterials (referencing Item C-8, which was approved). Most of the
Commissioners felt that a six foot fence was not high enough.
Commissioner Schumacher asked staff to investigate the height of a
block wall causing obstruction of traffic vision, located in the
parking lot of Huntington Lanes bowling alley on Beach Boulevard.
She also inquired about the setbacks for certain three-story struc-
tures in the Downtown area. Mr. Bellavia stated that the buildings
in question were all built prior to the ordinance.
Chairman Paone requested staff to review the Planning Commission by-
laws which pertain to the automatic continuance procedure.
ADJOURNMENT:
There being no further business before the Planning Commission, the
meeting was adjourned by the chairman at 11:10 PM to the next regular
meeting of September 21, 1982.
