BOARD MEMBERS'PRESENT: Spencer, Kelly, Evans, Smith, Vogelsang STAFF MEMBERS PRESENT: Cooper MINUTES:' ON MOTION BY SMITH AND SECOND BY EVANS, THE MINUTES OF THE REGULAR MEETING OF OCTOBER 6, 1982, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES:- Spencer, Evans, Smith NOES: None ABSTAIN: Kelly REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 82-58 Applicant: Gerald L. Chapman A request to permit a three (3) foot reduction to required minimum recreational open space dimension on property located at 17891 Bol- ton. Circle. Chairman Kelly introduced the proposal stating that this request is a categorical exemption, Class 5, California Environmental Quality Act, 1970. Acting Secretary Spencer outlined the proposal, explaining that be- cause of the placement of the original house on the already odd - shaped lot, the only way additional square footage could be added would be out to one side. The public hearing was opened. Speaking in favor of granting the request was the applicant, Mr. Chapman and a neighbor, Katherine Lockard. Seeing no other persons were present to address the issue, the public hearing was closed. Mr. Evans asked the applicant what would happen to the old kitchen. Mr. Chapman explained that the kitchen was going to be enlarged, but remain in the same location. H.B. Board of Zoning Adjustments Oct. 13, 1982 Page 2 ON MOTION BY KELLY AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 82- 58 WAS APPROVED WITH REASONS, FINDINGS AND CONDITIONS AS FOLLOWS, BY THE FOLLOWING VOTE: REASONS: 1. Subject addition will not diminish parcel's required recreational open space. 2. The proposed encroachment affects less than ten (10) percent of the required recreational open space. FINDINGS: 1. Granting of this application is found not to be a granting of special privilege. 2. Due to property's configuration being located on a cul-de-sac, strict application of zoning regulation was found to deprive it of privileges enjoyed by surrounding properties. 3. Approval was found not to be materially detrimental to the public welfare or injurious to surrounding properties and will not adversely affect the City's General Plan. CONDITIONS OF APPROVAL: The plot plan and elevations received and dated September 24, 1982, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity. AYES: Spencer, Kelly, Smith, Evans NOES: None ABSTAIN: None USE PERMIT NO. 82-36 Applicant: Dean Jakob A request to permit auto repair use on property located at 18101 Re- dondo Circle, Suite M. Chairman Kelly introduced the subject application stating that it is a categorical exemption, Class 1, California Environmental Quality Act, 1970. -2- 10-13-82 - BZA H.B. Board of Zoning Adjustments Oct. 13, 1982 Page 3 The public hearing was opened. The applicant, Mr. Dean Jakob stated that the reason for his request was to enable him to expand his auto repair shop. He stated that a larger facility was needed so that he did not have to park the cars being repaired left on the street over night. Seeing no other persons wished to address this issue, the public hear- ing was closed. ON MOTION BY SPENCER AND SECOND BY SMITH, USE PERMIT NO. 82-36 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS: 1., The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: The plot plan and elevations dated September 23, 1982, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. General Conditions: 1. Noioutside activity (e.g. storage and/or repair) shall occur. 2. A six (6) month review period shall be established by the Board of Zoning Adjustments assuring that all provisions are met. AYES: Spencer, Kelly, Smith, Evans, Vogelsang NOES: None ABSTAIN: None -3- 10-13-82 - BZA H.B. Board of Zoning Adjustments Oct. 13, 1982 Page 4 USE PERMIT NO. 82-37 Applicant:-Clothestime, Incorporated A request to permit a temporary outdoor event (placement of a tent to conduct retail sales during store refurbishing) at property lo- cated at 19115 Beach Boulevard. Chairman Kelly introduced the proposal, stating it is a categorical exemption, Class 1, California Environmental Quality Act, 1970. Acting Secretary Spencer gave the applicant's reason for requesting a use permit which was to allow some mechanism to operate their cloth- ing business while their facility was being remodeled. Bill Cooper, Fire Department, stated that the applicant, Mr. Chuck LaRosa has met with Fire Department staff to discuss the requirements he must meet with regard to the tent. The public hearing was opened. Mr. LaRosa, the applicant, reiterated his reasons for asking for permission for the special event. Seeing no one else wished to address the Board on this issue, the public hearing was closed. Acting Secretary Spencer reminded the Board that a maximum of 21 days was allowed for a temporary outdoor event. The Board felt that al- though the applicant was only asking for a 13 day permit, that they would grant him the full 21 clays in case for some reason the refur- bishing was not completed by the end of 13 days. ON MOTION BY SMITH AND SECOND BY SPENCER, USE PERMIT NO. 82-37 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the •vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. 1 -4- 10-13-82 - BZA 1 H.B. Board of Zoning Adjustments Oct. 13, 1982 Page 5 CONDITIONS OF APPROVAL: The conceptual plan dated September 30, 1982, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Type and use and its relation to property and improvements in the immediate vicinity. General Conditions: 1. Use is granted for a period not to exceed 21 days from Octo- ber 18, 1982. If the project is completed sooner than Novem- ber 7, 1982, the tent and all materials shall be removed from the premises at that time. 2. All building code requirements shall be met and approval from the Fire Department obtained, prior to the special event.
