Commissioner Schumacher asked that Item A-2, General Plan Conform- ance No. 82-8, be pulled for separate consideration. She also requested a separate vote on the minutes of the meeting of Octo- ber 5, 1982. ON MOTION BY HIGGINS AND SECOND BY WINCHELL THE REMAINDER OF THE CONSENT AGENDA, CONSISTING OF GENERAL PLAN CONFORMANCE NO. 82-9 AND A REQUEST FOR EXTENSION OF TIME FOR TENTATIVE TRACT 11351 AND CONDITIONAL USE PERMIT NO. 80-32, WAS APPROVED BY THE FOLLOWING VOTE: AYES: Higgins, Winchell, Paone, Porter, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: None Commissioner Schumacher requested that the minutes of October 5, 1982, be corrected to clarify the fact that information regarding the railroad corridor had been presented by'staff at the meeting in response to an inquiry from the Commission. Planning Commission October 19, 1982 Page 2 CONSENT AGENDA ITEM A-2: CONFORMANCE WITH GENERAL PLAN 82-8 This item is a request for a finding of conformance by the Planning Commission of the vacation of a one -block segment of Pine Street. Commissioner Schumacher pointed out that this item is very closely related to Zone Change No. 82-15, scheduled later in this agenda, and should properly be discussed in conjunction with that item. By consensus, CGP 82-8 was deferred to be reviewed when the zone change request is discussed. ORAL COMMUNICATIONS: None REGULAR AGENDA ITEMS: TENTATIVE TRACT NO. 11831 (Continued from September 21, 1982) Applicant: Campbell Trust A request to permit a 15=lot industrial subdivision on property loc- ated on the north side of Talbert Avenue east of the Southern Pacific Railroad right-of-way. Savoy Bellavia explained the reason for the prior continuance, which was to allow processing of an adjacent tract to the east of the sub- ject property. This processing would have allowed the extension of Woodwind Drive through that adjacent tract to become a condition of approval on the property over which it would be built rather than of TT 11831. However, the second developer has requested a postponement on his tract until after the first of the year, and staff has pre- pared an amended condition which makes the street improvements of Woodwind Drive contingent upon completion of at least 50 percent of the subject development. Commission discussion of the proposed condition ensued. ON MOTION BY WINCHELL AND SECOND BY SCHUMACHER TENTATIVE TRACT NO. 11831 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed subdivision is in substantial conformance with all applicable provisions of'the Huntington Beach Ordinance Code. 2. The proposed subdivision complies with the City's General Plan land use designation on the subject property as general industrial. 3. The lot size, depth, frontage, street width, and all other design and implementation features of the proposed project are proposed to be constructed in compliance with standard plans and specifica- tions on file with the City as well as in compliance with the State Map Act and supplementary City subdivision ordinance. -2- 10-19-82 - P.C. This property was previously studied for this type of land use at the time the industrial land use designation was designated on the General Plan and the Ml zoning was desig- nated in the zoning ordinance. CONDITIONS OF APPROVAL: 1. The map received and dated August 9, 1982 shall be the approved tentative map. 2. The developer shall be responsible for installing full street improvements between the existing termination of Sampson Lane and the subject property. The developer shall also be responsible for installing street improvements between the easterly property line of the subject property and the completed portion of Woodwind Drive, located approximately 330 feet east of the subject property. These improvements to Woodwind Drive will be required prior to the issuance of a building permit on the first structure which exceeds the sum total of 50 percent of developed floor area for the project. The improvements for this portion of the street will consist of permanent street section with temporary curb and gutter. 3. The water system shall be through the City of Huntington Beach water system. 4. Sewerage disposal shall be through the City of Huntington Beach sewer system. 5. Drainage for the subdivision shall be approved by the Depart- ment of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the pro- ject. 6. The sewer, water, and fire hydrant systems shall be designed in accordance with all applicable provisions of the Hunting- ton Reach Municipal Code. 7. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide det- ailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, and streets and utilities. Planning Commission October 19, 1982 Page 4 ZONE CHANGE NO. 82-15/NEGATIVE DECLARATION NO.'82-40 Applicant: City of Huntington Beach A proposal to change the zoning from RI-O (Low Density Residential combined with Oil Production) and Rl-O-CD (Low Density Residential combined with Oil Production/Civic District) to R2-0-CD (Medium Density Residential combined with Oil Production/Civic District) on property located north of Utica Avenue between Seventeenth and Lake Streets. Conformance with General Plan No. 82-8 was also deferred to be dis- cussed at this point in the meeting. Savoy Bellavia informed the Commission that staff is asking for a continuance in order to include the "PD" suffix with the proposed rezoning. The Commission discussed parking and traffic flow in the general area, questioning where the additional parking for the Civic Center can be located, what the traffic considerations had been at the time the property was designated medium density on the General Plan, what plans if any exist for the extension of Utica Avenue across the rail- road right-of-way, and what documentation is available on street configuration. Les Evans of the Department of Public Works indicated that there is no intent to extend Utica Avenue, to his knowledge. He also pointed out that on this particular conformance there is no through circulation that would be cut off; there are, however, some internal circulation problems which can be addressed at the time a project is proposed on the subject property. Florence Webb noted that the zoning and the General Plan are inconsistent in the area and the rezoning will bring the property into conformity with the General Plan. Chairman Paone opened the public hearing, cautioning those present that in all likelihood the request will be continued and if they spoke to the subject at this meeting they could not address the Com- mission at the continued hearing. George Abbond questioned the legality of this procedure. A gentleman in the audience asked for and received information from staff on the public notification process which had been followed on this item. The Commission directed that the next staff report should include prior traffic studies for the area, including future plans for Utica Avenue. Warmington Company To permit the development of a 21-lot planned residential devel- opment at the southern terminus of Countess Drive approximately one-half mile south of Edinger Avenue. Staff reported that a request for continuance has been received for these applications. The public hearing was opened; no one was present to speak for or against the proposal. AND CONDITIONAL USE PERMIT NO. 82-25 WERE CON- TINUED AT THE REQUEST OF THE APPLICANT•TO THE MEETING OF DECEMBER 7, 1982, BY THE FOLLOWING VOTE: AYES: Higgins, Winchell, Paone, Porter, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: None MASTER PLAN OF BIKEWAYS/NEGATIVE DECLARATION NO. 82-38 (Cont. from Applicant: Initiated by the City of Huntington Beach 10-5-82) To permit addition of links to the existing bikeway system through- out the City. Mike Adams addressed the Commission to outline the history of the bike trail system and explain the changes made in the master plan submitted in the Commission's packet. He also handed out a sup- plemental map which indicates deletion of a portion of the trail on Garfield Street because it does not connect with the Santa Ana River trail, deletion of a strip on Newland Street connecting to Edinger Avenue where no bike path is proposed, and deletion of the portion of trail through the Bolsa Chica. These changes will re- flect the intent of the plan to have all bike paths connect to activity centers such as schools, the beach, or a community park. The Commission reviewed the plan, taking into consideration its relationship to the County's trail systems. Of particular con- cern was the change to the plan through the Huntington Beach Com- pany ranch property, which is now shown as a curved line instead of the original straight configuration following the railroad right-of-way. Mr. Adams replied that it had been changed only from a precise alignment to a conceptual alignment in this location, and Florence Webb added that no agreement has been made as to whether or not the bikeway will actually go through the ranch property. Planning Commi.sSi_on October 19, 1982 Page 6 ON MOTION BY PORTER AND SECOND BY SCHUMACHER NEGATIVE DECLARATION NO. 82-38 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Higgins,- Winchell, Paone, Porter, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: None ON MOTION BY PORTER AND SECOND BY SCHUMACHER THE MASTER PLAN OF BIKEWAYS WAS APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL FOR ADOPTION AS DEPICTED ON THE PLAN SUBMITTED TO THE COMMISSION AT ITS OCTOBER 19, 1982 MEETING, WITH THE EXCEPTION OF THE LAKE STREET ALIGNMENT BETWEEN YORKTOWN AND GARFIELD AVENUES WHICH SHALL BE AP- PROVED AS IT CURRENTLY EXISTS ON THE MASTER PLAN OF BIKEWAYS, THROUGH ADOPTION OF RESOLUTION NO. 1298, BY THE FOLLOWING VOTE: AYES: Higgins, Winchell, Paone, Porter, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: None CODE AMENDMENT NO. 82-9 Initiated by the City of Huntington Beach An amendment to the ordinance code to repeal the definition of special event, define temporary outdoor event, and authorize the Director of Public Works to receive applications from persons desiring to waive street improvement requirements. Jeanine Frank described the code amendment, designed to clarify the code and to allow the Public Works Director to accept applications for the waiver of street improvements and dedication upon receipt of a fee set by Council. This fee will be in addition to the bonds which must be posted for the street improvements themselves. The Chairman opened the public hearing and closed it when no one appeared to address the Commission on the matter.
