Foss To create a one (1) lot Industrial Subdivision - Property located on the east side of Gothard between Slater and Talbert Streets (Assessor's Parcel No. 111-010-25), zoned M-1-CD, Light Industrial District -Civic District. Acting Secretary Spencer informed the Board Members that the applicant has requested a one (1) week continuance which will allow him the opportunity of being present at the hearing. Board of Zoning Adjustments November 24, 1982 Page Two ADMINISTRATIVE REVIEW NO, 82•-42 Applicant% D'.• Lindsay c/o Shell Oil Company To allow the demolition of an existing service station and reconstruction as a self-service station with car wash. Property located at 16001 Bolsa Chica. Chairman Kelly introduced the application and stated that this request was categorically Exempt, Class. 1, California Environ- mental Quality Act, 1970. Acting Secretary Spencer stated that staff has gone through two revisions to the site plan and feels that the conceptual plot plan received November 5, 1982, is acceptable meeting the Ordinance requirements with the following conditions: 1) that the elevations which w6re,submitted be revised showing compatibility, both in architecture and materials, with the shopping center to the south and west of the complex and 2) that the non -conforming signs presently existing be removed with proposed signage meeting Articles 976 and 948 of the Ordinance Code. Mr. Decosta Lindsay, Engineer for the project, was present to speak in favor of his application. He said they had hoped to be able to keep their high rise sign on the sight. Mr. Spencer informed the applicant that one (1) major identification sign is allowed and that such identification sign shall be located in a landscaped area and shall not exceed a height of ten (10) feet. He further informed the applicant that during the ten (10) day appeal period staff would be willing to work out details with him covering the restrictions of the sign code. The requirements of a landscape plan (including the location and screening of the trash enclosure), fire code requirements necessary should excavation go beyond the footings, etc. were explained to the applicant as outlined in the following Conditions of Approval. ON MOTION BY SPENCER AND SECOND BY SMITH, ADMINISTRATIVE REVIEW NO, 82-42 WAS CONDITIONALLY APPROVED AS FOLLOWS, BY VOTE AS FOLLOWS: CONDITIONS' OF APPROVAL% A, TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan received November 5, 1982, shall be the approved layout, subject to the modifica- tions described herein: a. Elevations for all structures to be compatible both in architecture and materials with adjacent shopping center. -2- BZA 11/24/82 Minutes: H.B. Board of Zoning Adjustments November 24, 1982 Page Three A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action,. the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type,of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. The Fire Department shall be notified, and have an opportunity to be present, if any excavation is to go below 18 inches in depth. 2. All existing signs that are non -conforming shall be removed. 3. All proposed signage shall conform to provisions of Articles 948 and 976, Huntington Beach Ordinance Code. AYES: Spencer, Kelly, Evans, Smith NOES: None ABSTAIN: None TENTATIVE PARCEL MAP NO. 82-575 (Con't. from 11/17/82) Applicant: Huntington Beach Company To permit creation of two (2) legal size lots from one (1) - Assessor's Parcel No. 111-170-03, located on the west side of Huntington Street, 630 feet south of Garfield. -3- BZA 11/24/82 Minutes: H.B. Board of Zoning Adjustments November 24, 1982 Page Four Chairman Kelly introduced the application. Acting Secretary Spencer reiterated the reason for continuance of this tentative parcel map from the meeting of November 17, 1982. He stated that the applicant's plan did not meet fire code requirements with respect to setbacks for the proposed re -location of tanks from their property line for consolidation purposes. The Huntington Beach Company requested approval from the Fire Department that in computing the setback require- ments they be allowed to use the twenty (20) ft. of vacant land behind the water reservoir owned by the City of Huntington Beach. Dave Eadie, Authorized Agent for the Huntington Beach Company, addressed the Board. He stated that by their increasing the width of Parcel No. 1 from 80 feet to 100 feet the Fire Depart- ment has agreed to relax the required setback granting a seven (7) foot deviation. Mr. Eadie stated that the proposed pipeline easement on the northwest side of Parcel No. 2 would be included on the revised map. The applicant was informed by the Board that street improvements will have to be installed on Huntington Street meeting the Code requirements. He was further informed that should the General Plan Amendment,changing the development classification from R-2 to Industrial,not be approved, findings for approval of Tentative Parcel Map No. 82- 575 shall be reviewed for amendment. ON MOTION BY EVANS AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 82-575 WAS APPROVED WITH FINDINGS, CONDITIONS OF APPROVAL, AND VOTE AS FOLLOWS: FINDINGS: (Jubject to and based on approval of pending application -- or Zone Change No. 8w-18) 1. The proposed creation of two (2) legal size lots form one (1) lot for purposes of Light Industrial Use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for Light Industrial Use allowing for Industrial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and 1 -4- BZA 11/24/82 Minutes: H.B. Board of Zoning Adjustments November 24, 1982 Page Five specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The amended tentative parcel map received by the Department of Development Services on November 24, 1982, shall be the approved layout with the amendments as noted thereon. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Compliance with all applicable City Ordinances. 4. A copy of the recorded parcel map shall be filed with the Department of Development Services. Morris To permit creation of a one -lot subdivision of property - Assessor's Parcel No. 111-010-46, located on the east side of Gothard, 1,009 feet north of Talbert Avenue. Chairman Kelly introduced the proposal and stated that this request is categorically exempt, Class. 15, California Environ- mental Quality Act, 1970. Acting Secretary Spencer outlined the proposal and informed the Board Members that some years ago the Planning Commission had approved a use (A to Z Auto Dismantling) at this location but that the property was never created legally. He further stated that the improvements existing on Gothard Street, including landscaping, do meet the requirements of that approval and that Tentative Parcel Map No. 82-574 is strictly an assessor parcel, used by 'A to Z", in this particular configuration over the past twenty years. -5- BZA 11/24/82 Minutes: H.B. Board of Zoning Adjustments November 24, 1982 Page Six As the applicant was unable to attend today's hearing, Mr. Spencer stated that he was in receipt of a letter acknowledging concurrence with the Conditions of Approval. ON MOTION BY SPENCER AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 82-574 WAS APPROVED WITH FINDINGS AND CONDITIONS OF APPROVAL FOLLOWING, BY VOTE AS FOLLOWS: FINDINGS: 1. The proposed creation of a one -lot subdivision of property for purpose of Light Industrial Use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3.
