BOARD MEMBERS PRESENT: Godfrey, Crosby, Smith, Parker, Vogelsang AGENDA ITEM CONTINUED: USE PERMIT NO. 82-34 (Con`t. from 2/16/83) Applicant: Mr. Eric M. Hexberg To permit addition of two-(2) mobilehome spaces. Location - Brookfield Mannor Mobilehome Estates, 9850 Garfield. Acting Chairman Crosby introduced the proposal. Secretary Godfrey reiterated that this proposal was continued from the meeting of February 16, 1983,- pending response to a question relative to recreational vehicle space requirements which were in effect at the time of approval. A search of the record' -indicated that no specific square footage was required (nor is there a square footage requirement under current code) for -recreational vehicle storage. There -was no written condition that'two storage areas be'provided; that the plot plan received February 24, 1971, was the approved layout. A check of that plan indicates that two (2) areas were designated recreational vehicle storage. The current Code states that areas in the park shall be ,set aside for boat or trailer., storage without reference to number or size. It is within the'jurisdication of.the Board to grant waivers of this type should the Board find sufficient grounds for same. The public hearing was reopened with the applicant, Mr. Eric M. Hexberg, present to speak-in.favor of his proposal. Suggested Conditions for Approval were discussed with the applicant. Included was'a provision that no encroachment into the designated recreational area be allowed. Instead, a space be provided for a mobilehome of suitable width on the lot -designated "car wash" and that a second Minutes: H.B.-_Board of Zoning Adjustments February- 23,- 1983 7- Page Two space be created from the area designated "storage" on the plot plan. We feel this a more suitable arrangement than providing a space in an existing recreational area. Mr. Hexberg was informed that should he desire, he may replace the shuffle board court with a putting green._ Mr. Hexberg addressed the Board and stated his concurrence with the Conditions to -be imposed. The public'hearing'was closed by Acting Chairman Crosby.' - ON MOTION BY VOGELSANG AND SECOND BY SMITH, USE PERMIT NO. 82-34 WAS APPROVED -WITH FINDINGS AND CONDITIONS OF APPROVAL AS FOLLOWS, WITH VOTE -FOLLOWING: FINDINGS: 1. Review of th_e.proposed additions has shown that it will, -not be detrimental to the general welfare. of persons residirig`_iiCthe' vicinity nor -injurious to property- or improvements,in -the vicinity and that the.City's General Plan- will- riot-be-adversely_affected. 2. Testimony given by the Manager,of the Park has,indicated.that the two - (2) '. storag.e areas are, under-utilized and on-e.:,(1) - might - be put to - better' -use as space for ,an: additional, mobilehome-. The car wash is --not necessary to ;-the- successful„operation- of: the park. CONDITIONS.OF APPROVAL: A, TO BE COMPLETED,PRIOR TO ISSUANCE OF BUILDING (MOVE -ON) PERMIT: 1. The conceptual plot plans received September-10 and.November 8, 1982, shall be the approved layout,-sub_ject`to modifications described herein: : a. That only two (2) additional spaces shall be created. b. That a minimum twenty-five (25) foot turning radius be provided for all -the space now designated "storage". c. .All applicable ordinances -shall be complied with. All yard setback requirements currently in effect shall be complied with for each of the two (2) spaces created. d. No recreational open space shall be encroached upon. A revised site plan delineating said modifications shall be submitted to the Secretary of the Board. Reyes Reconsideration of Condition of Approval No. l(d) permitting the addition of 792 square feet of seating area and the addition of a drive-thru window. Property located at 6561 Edinger. Secretary Godfrey explained that at the end of the February 16, 1983 Board of Zoning Adjustments Meeting the applicant, Mr. Reyes, asked that the Board reconsider their action taken on Condition No. l(d) imposed at the beginning of the meeting of February 16 on the basis .that Mc Donalds had a certain understanding and, perhaps the way the motion was structured, it was not in keeping with what they understood. The public hearing was reopened for discussion of Condition of Approval No. 1(d) only. As the applicant, adjacent residential property owners in attendance, and the Board Members all concurred that Mc-Donalds should eliminate use of the alley/easement on the northeast corner of the property as outlined in the following -Conditions of Approval, the public hearing was closed. ON MOTION BY SMITH AND SECOND BY CROSBY, USE PERMIT NO. 82-30 WAS APPROVED, WITH FINDINGS AND CONDITIONS OF APPROVAL FOLLOWING, SUCCEEDED BY VOTE: FINDINGS: 1. The establishment and operation of the use will not be detri- mental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the .vicinity of such use. This can be assured by incorporating the Conditions of Approval listed below. 2. All existing non -conforming signs shall be removed and any signs proposed shall be in conformance with Article 976 of the City's code. Heard in conjunction with ADMINISTRATIVE REVIEW NO. 82-49 To permit an expansion to an existing motel. Applicant:.Mr. Dara Commissariat. Secretary Godfrey explained that the use permit request for expansion to an existing motel is a legally non -conforming structure with relation to current setback requirements. The use permit approval, if granted, will allow the non -conforming aspect to remain with certain modifications to the existing structure recommended by staff and conditioned under Administrative Review No. 82-49. The proposed structure, prior to construction over existing lot lines, will require filing of a tentative parcel map. The situation is complicated by the fact that the applicant is leasing both parcels - over a long term - from two property owners. Secretary Godfrey stated the Board is in receipt of a letter from one of the property owners (Barbara Simmet), stating that under the terms of the existing lease on subject property, she has the right to acquire the motel improvements upon termination of the lease. As such, her position is that all improvements on her property be kept within the boundary of her property and not integrated by boundary -crossing improvements on property of which she has no interest therein. By requesting that a parcel map be filed and recorded prior to building permits being issued, will require both property owners cooperation and acceptance of the recombining of two parcels into a single parcel thereby eliminating any possibility of a dispute in the future. The administrative review is required to allow the construction of a motel in this C-3 (General Business District) Zone. Secretary Godfrey informed all concerned that certain requirements be met before issuance of a building permit to assure conformance to existing zoning require- -5- BZA 2/23/83 Minutes: H.B.-Board of Zoning Adjustments February-23, 1983 Page Six ments by the proposed building and substantial conformance with the existing building: - The public hearing -was opened by Acting Chairman Crosby. Mr. Jitendra Barrot, other property owner, responded to the letter received by the Board from Barbara Simmet--.(present) opposing expansion_-ovr_ e-_the__boundary-on_to her property. The conceptual plot plan received January 11, 1983, and elevations submitted October 28, 1982, shall be the approved layout. A revised plot plan, with elevations, shall be submitted to the Secretary of the Board for review and approval providing the following modifications: a. Parking layout modifications to the existing unit, proper setbacks, elevations reflecting the height of the building not exceeding thirty-five (35) feet. b. Include all existing structures that will be removed (canopy, etc.). C. Show access ingress and egress provided to the alley. d. The existing building at the north end shall be structurally modified so as to be in conformance with the rear yard requirements in the C-4 District. e. No encroachment of structural support columns in to the required turning area for parking. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. 2. A parcel map shall be filed combining Parcels 9 and 10 shown on Assessor's map into one (1) parcel prior to issuance of building permits (All property owners' signatures are required on the parcel map). Taddeo To permit construction of a 1,510 square foot warehouse addition to be located at 15122 Bolsa Chica. Acting Chairman Crosby introduced the application and stated that this request is categorically exempt, Class. 1E, of the California Environmental Quality Act, 1970. Secretary Godfrey stated that a review of the site plan submitted has disclosed that the proposed addition will meet all standards relative to the zoning pending receipt and review of a landscape plan. Further, the expansion into the rear yard area will provide security and coverage in an area already used for outside storage and which is difficult to maintain. Mrs. Taddeo (applicant) was present and spoke in support of her application. She informed the Board Members that approximately six (6) months ago they moved into this relatively new industrial building located in Lusk Industrial Park. She assured the Board that due to the age of the building, the existing landscaping meets the Code requirement of six (6) percent. Board of Zoning Adjustments February 23, 1983 Page Thirteen TENTATIVE PARCEL MAP NO. 83-553 Applicant: Ervin Engineering To consolidate five (5) existing parcels into one (1) parcel. Property located on Beach Boulevard - south of Atlanta (Assessor's Parcel Numbers 148-021-04, 08, 05, 06, & 20.) Acting Chairman Crosby introduced the tentative parcel map stating that this request is covered by Negative Declaration No. 82-41. Secretary Godfrey informed the Board that the proposed consolidation of parcels is to accommodate construction of affordable Multi -family rental housing (342-unit apartment complex). This project is proposed to be constructed with funds from the sale of revenue bonds, pursuant to Section 52075 of the Government Code of the State of California. He further informed the Board that as a condition for approval of Use Permit 82-44/C.E. 82-65/N.D. 82-41, the applicant was informed that a Tentative Parcel Map consolidating subject parcels was necessary prior to issuance of building permits. Mr. Dick Harlow, representing the applicant, addressed the Board stating he had reviewed and concurred with the Conditions for Approval with the exception of Condition No. 9,wherein originally both the Edison Company and the Department of Public Works' satisfaction has to be reached for relocation of the Edison facility transmission lines. He felt that by having to satisfy Public Works only will put them in a better position to negotiate with Edison under the P.U.C. Guidelines. The Board Members agreed. A copy of the recorded parcel map shall be filed with the Department of Development Services and Public Works Department. 14. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder.
