Applicant: Mr. Bobby Cornelius c/o Pacifica Properties
To combine three (3) existing parcels into two (2) parcels.
Assessor's Parcel Numbers 163-292-43, 44, and 45 (200 feet north-
west of Los Patos-and Green Street).
Chairman Kelly introduced the proposal and stated that this request
is Categorically Exempt, Class. 15, California Environmental Quality
Act, 1970. -
Secretary Godfrey explained that the expiration of the fifty (50)
day approval period is fastly approaching necessitating that the
Board of Zoning Adjustments render a decision of the applicant's
tentative parcel map application. The Board was informed that one
of the following actions need to be taken: 1) deny the map; 2) approve
with Conditions; 3)-ask the applicant to submit a statement requesting
that the decision be continued and reasons therefor if he is unable
to submit at todays's hearing the necessary documents -requested

at the February 16, 1983 meeting. Secretary Godfrey further explained
that the applicant was informed that the following would be required
in time for today's hearing: (a) assurance from the title company,
or other records, that the twenty (20) foot access along the northerly
property line and easterly to Green Street exists as a clear title
easement; (b) that title search documents, or a letter of assurance
from the title company be provided that shows title vesting from
time of release of this property by the U. S. Government to date;
and that the parcel map presented is a true representation of owner-
ship as vested in the owners as shown on the map.
The applicant's representative, Gene Wilson, furnished the Board
with a Preliminary Parcel Map Guarantee from Transamerica Title
Insurance Company. Upon the Board's review of the Preliminary Parcel
Map Guarantee Mr., Wilson was informed that this document only speaks
to the records of ownership of the property with the exclusion of
the Long Beach Trust and Savings Bank signature shown as the holder
of the easement. Mr. Wilson was informed that the Transamerica Title
Insurance Company needs to address ownership of the easement and
state that it is a part of this parcel map providing ingress and
agress to and from adjoining parcels.
Mr. Wilson stated that he wished to waive his rights as to the
fifty (50) day time limit of his application for action and requested
a thirty (30) day continuance of time which he felt was adequate to
obtain the required document.

Secretary Godfrey was asked by the applicant of Use Permit No. 83-13
if it was possible to be heard next on the Agenda and stated her
reason for the request. There being no objections from the audience,
Use Permit No. 83-13 was taken out of sequence and heard next by the
Board.

Chairman Kelly introduced the applicant's proposal.
Secretary Godfrey commented that the City Ordinance -states that
no person shall conduct, operate or maintain a home for the care
of non -related persons on a twenty-four (24) hour basis until an
application for a Use Permit has been approved by the Board.
This proposed facility will house adult blind or mentally handicapped
persons. According to the applicant, these persons are those who
have been successfully trained or rehabilitated to an extent that
they are able to be placed in a home environment provided there is
constant supervision. The applicant has operated a care of non -
related adults facility for handicapped persons at another location.
Secretary Godfrey informed the Board that he received a telephone
call from a Mr. Michael Cunningham, neighbor who received notification
of the hearing and is unable to attend, who wishes to register a
protest on the use.- His primary concern is -with property value.
He does not want any outward manifestation of this use as being
something of a commercial nature with the coming and going of vans,
vehicles, etc. on a constant basis. Mr. Cunningham also indicated
that Heil Avenue is a very active street with high traffic and speed
activity occurring and expressed his concern especially for blind
handicapped persons living in such close proximity to Heil Avenue.
Michael Tamiyasu, Fire Protection Specialist, stated that in determining
if an individual is.ambulatory or non -ambulatory each case has to be
dealt with individually confirmed by the Social Services Department
of the State of California and the local enforcement agency (Fire
Marshall). He defined non -ambulatory as a person unable to leave
a building unassisted under an emergency condition; and mentally
retarded as a person unable to respond to an oral instruction
relating to fire danger and who unassisted could not take appropriate
action relating to this danger. State -and City requirements for
housing ambulatory versus non -ambulatory were discussed.
The public hearing was opened by Chairman Kelly.
Helen J. Buhrow, applicant, introduced herself to the Board. She
stated that for the last nine (9) years she has been licensed to
provide board and care in her -home located at 16301 Magellan Lane
in Huntington Beach. She recently purchased property at 5151 Heil
Avenue wherein she is desirous to have board and care of six or less
ambulatory persons only, operated by house parents under her supervision.
She felt as she has taken care of her blind twins for 28 years, in
addition to care of non -related persons for 24 hours/day for the past
nine years,is proof she is well qualified.
There being no one present to speak in favor or opposition of the
applicant's request, the public hearing was closed.

ON MOTION BY SMITH AND SECOND BY EVANS, USE PERMIT NO. 83-13 WAS
CONDITIONALLY APPROVED WITH FINDINGS, CONDITIONS OF APPROVAL AND

USE PERMIT NO. 83-3
Applicant: Classic Camaro Parts (Con't. from 3/30/83)
To permit an expansion of use within a temporary structure.
Location - 15661 Producer Lane, Unit No. "I".
Secretary Godfrey reiterated reason for one (1) week continuance
stating that it was the consensus of all of the Board Members after
discussing many alternatives that the 20 x 30 ft. proposed area
to encompass a 20 ft. in length office coach and trash enclosure
was not adequate space to afford compliance with Fire Department
requirements. Further, that the applicant was agreeable to a one -
week continuance to look into the possibility of obtaining a shorter
coach, in addition_ to working with the Fire Department staff on a
revised plan with exact measurements within the proposed area.
The public hearing was reopened by Chairman Kelly.
Mr. Jeff M. Leonard, applicant, submitted a revised site plan to
the Board proposing the use of an eighteen (18) foot office coach
in lieu of twenty (20) foot originally proposed with additional
space separation to satisfy the Fire Department requirement.
The applicant was informed that a field investigation revealed that
cardboard boxes were being strewn within the fenced rear area of his
building. Mr. Leonard was cautioned on this situation and told not
only was this a fire hazard but it detracted from thb aesthetics
of the Industrial Park. Further, that periodic inspections shall
be conducted to verify compliance with this condition. Mr. Leonard
stated this situation would be immediately corrected.
The public hearing was closed with no one else present to speak in
favor or opposition of,the applicant's request.
Conditions for approval of the temporary office coach were discussed.

Board discussion ensued. It was the consensus of the Board Members
that by granting the applicant his request for a two (2) foot
encroachment into the required twenty-two (22) foot setback for a
front -on garage would not only allow -the applicant parity with
his neighbors but would allow architectural compatibility staying
consistent with original construction in his subdivision.
ON MOTION BY EVANS AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO.
83-5 WAS APPROVED WITH REASON, FINDINGS AND CONDITIONS OF APPROVAL
FOLLOWING, SUCCEEDED BY VOTE:
REASON:
1. Subject property is located within a subdivision (Tract 4324,
developed in 1964) in which all front entry garages were con-
structed at a twenty (20) foot setback.
FINDINGS-:
1. The granting of this conditional exception will not constitute
a grant of a special privilege inasmuch as the subject property
is located within a subdivision in which all front entry garages
are constructed at twenty (20) foot setback.
2, The strict application of the zoning ordinance would deprive the
subject property of privileges enjoyed by other properties
within the applicant's subdivision.
3. The proposal to convert an existing side entry garage into a
front entry garage at twenty (20) foot setback would be consis-
tent with what exists throughout the neighborhood.
4. The granting of the conditional exception will not be materially
detrimental to the public welfare or injurious to property in the

To permit a church sponsored carnival June 10, 11, and 12, 1983.
Location - 18631 Chapel Lane (Ellis Street one.block to the north).
The special event -was introduced by Chairman Kelly.
Mrs. Bemis was present in lieu of Mr. L. Phillip Bemis who was
unable to attend.
The Board reviewed the proposal arid advised Mrs. Bemis of all
necessary"permits, insurance, etc. as outlined in the Conditions
of Approval:

This request is a Categorical Exemption, Class. 4, California En-
vironmental Quality Act, 1970.
No-one was present to represent the application.
Upon the Board's review of the site plan submitted, it was noted
that a "hot air balloon" for display purposes only was part of the
applicant's promotion.
Fire Department requirements were discussed for the "hot air balloon"
as well as other conditions -to be imposed for the grand opening
of the farmers market.
ON MOTION BY KELLY AND SECOND BY EVANS, USE PERMIT NO. 83-18 WAS

and the City's Subdivision Ordinance.
CONDITIONS, OF APPROVAL:
1. The tentative parcel map received by the Department of Develop-
ment Services on March 21, 1983 shall be the approved layout.
2. The parcel map shall be filed with the City and approved by the
departments of Development Services and Public Works and recorded
with Orange County prior to final inspection. A copy of the
recorded map shall be filed with the departments of Development
Services and Public Works.
3. Driveway and vehicle access to serve the lot shall be approved
by the departments of Development Services and Public Works
prior to issuance of building permits.
4. Grading and street improvements shall be provided to City
standards at the time the parcel is developed.
5. All utilities shall -be installed underground at the time said
parcel is developed.
6. Compliance with all City standards and ordinances.

Applicant: A. J. Mentas, D.D.S.
To permit a sixty-five (65) square foot addition to an existing
medical/professional building. Location - 6082 Edinger Avenue
(east of Springdale Avenue).
The applicant's request was introduced by Chairman Kelly who
informed the Board that this proposal was Categoricdlly Exempt,
Class. 1, California Environmental Quality Act, 1970.
Secretary Godfrey briefly outlined the applicant's request and
stated that staff has been in touch with Dr. Mentas and his
architect to inform them that the addition for the storage room
is in compliance with the requirements of the Huntington Beach
Ordinance Code with the exception of the setback from the rear
property line which will have to be a minimum distance of five (5)
feet in lieu of 416" as shown.
It was noted that documentation was received stating that State
energy regulations -have been reviewed and that the design sub-
stantially complies with Title 24 regulations.
Conditions for approval were discussed.
