Regarding the extension of time, Mr. Bellavia stated that there was a correction to Condition #5 on the tentative tract that adds the requirement of a hydrology report. Commissioner Winchell asked staff why an extension of time was necessary when an item was approved at the last meeting for the same location. Staff responded that the item approved was a use permit and this was a different entitlement. A short discussion ensued regarding Item A-3 on the consent calendar relating to a portion of acreage being vacated. Mr. Palin stated that there were still some exchanges to take place in the future and that the City was still pursuing the railroad right-of-way. ON MOTION BY ERSKINE AND SECOND BY MIRJAHANGIR THE CONSENT CALENDAR CONSISTING OF THE MINUTES OF THE REGULAR MEETING OF APRIL 5, 1983, AN EXTENSION OF TIME ON CUP 81-25 AND TT 11603, AND GENERAL PLAN CONFORMANCE NO. 83-1 WAS APPROVED (ITEM A-2 IS SUBJECT TO THE FOLLOWING ADDED AND MODIFIED CONDITIONS), BY THE FOLLOWING VOTE: AYES: Higgins, Winchell, Porter, Erskine, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: None ADDITIONAL CONDITIONS -OF APPROVAL - C.U.P.81-25 (Extension of time) Applicant: R & R Investments 12. The project shall be subject to current park and recreation fees (Resolution No..5072). 13. If the developer proposes both sewer and drainage facilities to H.B. Planning Commission April 19, 1983 Page 2 flow to the north of the project, proof of an easement shall be submitted to the City allowing -said facilities to cross over pri- vate property and connect into either Michael Circle or Van Buren Street. Said proof of easement shall be obtained prior to the issuance of building permits. 14. A detailed soil analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil samples and laboratory testing of materials to provide detailed recommenda- tions regarding grading, chemical and fill properties, foundation, retaining wall, street and utilities. 15. The design and materials of all perimeter walls shall be subject to the approval of the Department of Development Services prior to the issuance of building permits. 16. A detailed landscape and irrigation plan shall be subject to the approval of the Department of Development Services prior to issu- ance of building permits. 17. The developer shall comply with all conditions of approval origi- nally imposed on Conditional Use Permit No. 81-25. REVISED CONDITION OF APPROVAL - TENTATIVE TRACT 11603: 5. Drainage for the subject subdivision shall be approved by the De- partment of Public Works prior to the recordation of a final map. This system shall be designed to provide for erosion and'silta- tion control both during and after construction of the proposed project. A hydrology report shall be prepared and submitted to and approved by the Department of Public Works prior to the recor- dation of a final map. ADDITIONAL CONDITION OF APPROVAL - TENTATIVE TRACT 11603: 7. The developer shall comply with all conditions of approval originally imposed on Tentative Tract No. 11603. COMMISSION ITEMS: 11 E Commissioner Erskine asked for a report on the parking situation at General Telephone. Mr. Palin stated that Mr. Godfrey is still working with the City Attorney's office to be able to respond and also that the land use section is still investigating the situation. Mr. Folger further stated that the code is "silent" on this issue, therefore, there is nothing that would prohibit General Telephone from charging for park- ing. Commissioner Winchell suggested that staff check with other itie to see if they might have policies regarding this. Commissioner Higgin commented that if this facility were located in an industrial area it might not create an impact on surrounding residential as it does in this instance. Chairman Porter suggested that the City Administrator's office be informed of this matter. H.B. Planning Commission April 19, 1983 Page 3 Commissioner Schumacher requested that the agenda for public hearings be rearranged so that the item regarding the senior citizen project proposed by Mola Development be heard after the code amendment and re- lated City -initiated items. Since there was no objection from the Commission on this suggestion, the Chairman granted the request. Mr. Bellavia further requested that Agenda Item C-8 be heard first since it was a request to continue the item to the next regular meeting. The Chairman agreed to move this item to the front of the agenda. REGULAR AGENDA ITEMS: CONDITIONAL USE PERMIT NO. 83-8 Applicant: Thrifty Oil Company A request to permit the conversion of an existing service station into a convenience market combined with gasoline sales at property located at the northwest corner of Beach Boulevard and Adams Avenue. The ap- plicant requested a continuance to allow them time to work with staff toward a "more mutually acceptable parking, landscape, traffic flow and signing plan". The Chairman opened and continued the public hearing as there was no one present to speak for or against the item. ON MOTION BY WINCHELL AND SECOND BY HIGGINS CONDITIONAL USE PERMIT NO. 83-8 WAS CONTINUED TO THE MEETING OF MAY 3, 1983, AT THE REQUEST OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: Higgins, Winchell, Porter, Erskine, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: None CONDITIONAL USE PERMIT NO. 83-6 (Continued from 4-5-83) Applicant: W & B Builders Inc. & Seaside Village Towne Home Association A request to revise a previously approved CUP to permit the addition of security gates and wrought iron fencing at property located at the south- west corner of Atlanta Avenue and Beach Boulevard. Mr. Bellavia stated that, as requested at the previous meeting, the 75 tenants of the HUD rentals were notified of the public hearing by mail. He further stated that, after additional review, a number of problems have been identified and staff feels that additional investigation and discussion with the applicant and the City Attorney is necessary. The Chairman stated for the record that he will be abstaining from this item as he was not present for the public hearing on April 5, 1983. Commissioner Higgins made the comment that since there was a lack of open space, maybe one of the tennis courts could be made available. At the suggestion of Art Folger, the public hearing was reopened, due to the fact that there was a second publication. However, the Chairman requested that only new testimony be taken. Before the public testi- mony was taken, Commissioner Erskine requested a "show of hands" from H.B. Planning Commission April 19, 1983 Page 4 the audience of the tenants who received notification. Three people stood up. He requested that these people speak first. The Chairman re- opened the public hearing. Thad Kline, representing B.K. Management, stated that management's concern -was only about the'' -entrance gate(s) and not about the fencing or any other aspects of the request by the applicant. Nancy Schlachter stated that the HUD units do have an emer- gency exit, and further stated that the only help.she received -from staff was from the Fire Department.-�She_said she -agreed with -Condi- tions #1, #2, #3 and #6, but felt #4;and,#5' were _unreasonable adding that they do not intend to annex Lot l0`. Commissioner Erskine'a'sked the applicant if she was willing to consider the two impulse gates. Nancy stated that -she, would-be willing, -to discuss the matter, but the cost was the main reas6n­i:t2was-_not--discussed to date. Frank Thompson, president of W & B Builders -,-stated his -frustration -in trying to comply with three government`�agencies.- -He said _",I''m +sure we have riot followed all the original conditions of approval . . but we had to comply with HUD re- gulations!',., _ Julie Perrine,_,-a :tenant from the HUD rentals, addressed the Commission. She said the- -tenants were not interested in usurping their (market -rate units) open space., She -went -on to ;say.�that they _have only -one exit now and-that�if gatesyare_placed on,P,00_lside,' there would be no 'emergency exit. The Chairman called for a recess; meeting reconvened at 9:30 PM. REPEAL OF PRECISE PLAN OF STREET ALIGNMENT NO. 82-1/CODE AMENDMENT 83-5/ LAND USE ELEMENT AMENDMENT-83-2 in conjunction with NEGATIVE DECLARATION NO. 83-4/ZONE CHANGE NO. 83-3 (All continued from 4-5-83) Initiated by City of Huntington Beach PPSA 82-1 established the alignment of a private street to provide access to a 12-acre site located on the south side of Talbert Avenue approximately 450 feet west of Beach Boulevard. The alignment will hereafter be de- termined by approved tract maps. Code Amendment No. 83-5 adds Article 932.5 to the Huntington Beach Ordi- nance Code and establishes a Senior Residential suffix (SR) that sets forth standards for residential developments designed for senior citizens. LUEA 83-2 and Negative Declaration 83-4 concern a request to redesignate approximately 4.65 acres (at the same location) from General Industrial and Medium Density Residential to High Density Residential. Zone Change No. 83-3 is a request to change the existing zoning from Ml-A (Restricted Manufacturing) and (Q)R2-PD (Qualified Medium Density Residential with a Planned Development Suffix) to R4-SR (High Density Residential with a Senior Residential Suffix), same location as above. Since the items all deal with the same location, the Chairman heard all discussion at one time. Carol Inge stated that she did not feel the Mola Development application (CUP 83-7) would be affected by the SR suffix. She went on to give a slide presentation and briefly explain the ramifications of the senior suffix. She said this would allow the development requirements to be relaxed so that the units could be built and sold at a lower cost. Brief discussion took place regarding the Lyon project. Florence Webb stated that -a developer agreement has already begun. Discussion also following regarding the result of dealing with street alignment at the project level. Chairman Porter stated that this may circumvent the public process. Secretary Palin clarified the point that, regarding the actual project, the proposed street through Terry Park is intended to be a secondary entry. Commissioner Schumacher had several concerns relating to the SR suffix which included: granting of density bonuses, method used in determining H.A. Planning Commission April 19, 1983 Page 6 density - (e. g. , `persons per- acre vs. units ' per acre, building height re- strictions -and -consideration given to_surrounding-land-uses. She sug- gested a policy-stat_ement-.- Staffnoted-these concerns:, -Mr. Godfrey further stated that -in regards-to'the density bonuses,' state law requires that cities provide this-or'other,•incentives to developers. Mr. Bellavia noted that -,'in the proposed project,; the site coverage is less than what was being proposed 'in- the --ordinance,- ; The public hearing -on all four items was reopened at this time. AYES: Higgins, Winchell, Erskine, Porter, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: None CONDITIONAL USE PERMIT NO. 83-9/TENTATIVE TRACT NO. 11955 Applicant: Redevelopment Agency, City of Huntington Beach A request for a CUP to•permit construction of 96 senior citizen condo- minium units and 220 senior citizen rental units and a request for a tentative tract to permit the subdivision of numerous parcels into 10 lots:- 9 residential and 1 industrial, on property located on the south side of Talbert Avenue, west -of Beach Boulevard. The redevelopment agency and staff have requested a continuance due to a number of necessary de- sign changes. However, because the item was advertised, the Chairman opened the public hearing. Charles Kerns, a resident adjacent to the site, had several concerns. He believed the proposed project would create an alley and cited existing problems with "truant school kids", etc., loitering in the area. He also H.B. Planning Commission April 19, -1983 Page 8 had a concern about noise attenuation stating that there -would be an 'impact from the'"jaccuzzi'pumps..' The public hearing was closed. Chairman Porter recommended that staff take some ground shot pictures of the site for the next meeting. -ON MOTION BY,MIRJAHANGIR AND SECOND BY SCHUMACHER CONDITIONAL USE PERMIT NO. 83-9 AND TENTATIVE TRACT NO. 11955 WERE CONTINUED TO THE MEETING OF MAY 3, 1983, BY THE FOLLOWING VOTE: AYES: Higgins, NOES:, None - ABSENT: Livengood ABSTAIN: None Winchell, Porter,`Erskine,-Schumacher,--Mirjahangir CONDITIONALUSE "PERMIT NO. 83-7 •(Continued - from-4-5'=83)- Applicant:- Mola"Development Corporation A request to,permit construction of a restaurant, office building and a 59 unit senior citizen housing development within Subarea B-1 of the Seabridge'Specific-Plan. - The public hearing was -'opened; Richard Harlow, speaking for the appli- cant, stated that he was not clear as to the intent of the Planning Commission's action -'at -the April 5th meeting -when an -approval was grant for the conditional -exception and code amendment; but not the condi- tional use permit. --He further stated that Mola's•intent was in trying to comply with the apparent direction of the City to facilitate the need for senior -housing. -and not in any -way -to deviate from the original objectives_ of-the-'Seabridge-Specific Plan. He also=made reference to page 1 of-the:staff-report which -states -that dwelling units are designed and restricted to use by persons 50 years of age and older - he said that should read "62 years of -age and -older". --The public hearing was closed: RECONSIDERATION"OF`=CODE AMENDMENT"-,N0:'83=4: Commission Higgins, -,stated he --recalled from --the previous -meeting -that he did not hear the -excluding sections-of--the-code amendment (Sections B-C) when the -motion was made by Commissioner Schumacher and expressed a desire to reconsider the code-amendment.--:Commissioner-Schumacher-stated that although she is•not against senior housing, she is against that housing be'developed in Subarea"B-1. -She--further stated -that the previous-=plan--that-was approved' -on this°site showed -the senior housing concept on a-not-a=part-parcel--and therefore was not a part of the approval. Mr. Palin­ stated � ' that -the site; Subarea • B&-1,, carries � no -=designation on it, that'it could go either residential; -office professional orcommer- cial-as delineated in the specific plan: He agreed that although it was perhaps not the best site for senior housing, that it did offer certain amenities such as bus stops, convenient shopping and ample open space. Chairman Porter stated that he would be abstaining from the vote on this issue, but passed on a comment from Commissioner Livengood (and agreed with his comment) that with separate access, this project might be acceptable, however, he did not like the "interaction" between the two uses, i.e., the two restaurants and the senior housing. He further H.B. Planning Commission April 19, 1983 Page 9 cited the example of Peter's Landing where the interaction produced problems. Mr. Palin stated that this is usually due to the type of operation as well as the orientation of the buildings that tend to create problems such as was the case at Peter's Landing when the Red Onion had a disco. A MOTION WAS MADE BY WINCHELL AND SECONDED BY SCHUMACHER TO RECONSIDER CODE AMENDMENT NO. 83-4. MOTION PASSED BY THE FOLLOWING VOTE: AYES: Higgins, Winchell, Erskine, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: Porter ON MOTION BY WINCHELL AND SECOND BY MIRJAHANGIR CODE AMENDMENT NO. 83-4 (SECTION D) WAS APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL FOR ADOPTION WITH THE FOLLOWING AMENDMENTS, BY THE FOLLOWING VOTE: AMENDMENTS TO THE CODE AMENDMENT: The recommended amendments to the applicant's proposed code amendment are that Items A through C be deleted from the ordinance. The motion also eliminated all reference to housing and only deals with Item D as shown on the reference map dated March 9, 1983, with language for that Item to read as requested in the applicant's letter dated April 5, 1983. AYES: Higgins, Winchell, Erskine, Schumacher, Mirjahangir NOES: None ABSENT: Livengood ABSTAIN: Porter Commissioners Erskine and Higgins stated for -the record that although being in favor of the previous motion (because it at least approved part of staff's recommendation) to approve the code amendment, they felt the Development Services' recommendation has merit, and that a mixed use concept is feasible on the site. APPROVAL OF CONDITIONAL USE PERMIT: ON MOTION BY WINCHELL AND SECOND BY HIGGINS THE COMMERCIAL ALTERNATIVE FOR CONDITIONAL USE PERMIT NO. 83-7 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed development is in conformance with the policies and development standards contained in both the City's General Plan and the Seabridge Specific Plan. 2. The proposed development will not adversely affect surrounding properties. H.B. Planning Commission April 19, 1983 Page 10 CONDITIONS OF,APPROVAL: 1. The site plan and elevations received and dated March 16, 1983, shall -be the approved layout reflecting only the commercial alter- native. -:All parking requirements for said commercial use shall comply with provisions of Article 979 of the ordinance code. 2. The occupancy -for Sam Wong's Restaurant shall be limited to the number of tables and/or fixed seats allowed pursuant to Article 979 of the ordinance code for 40 parking spaces. 3. Off-street improvements (i.e., streets, sidewalks, gutters, etc.) shall be in accordance with Department of Public Works standards. 4. Sewer, drainage and water -improvements shall be constructed in accordance-with•Department of Public Works standards. 5. The subject building shall be provided with systems: -related to fire protection and life safety as deemed necessary by_;the Huntington Beach -Fire Department and_all.applicable codes. 6. Oil wells within the oil production area shall be set back from proposed structures on the site or modified in a -manner as deemed appropriate by the Huntington -Beach Fire Department. 7. A detailed -landscape plan shall be -submitted to the City and ap- proved by the Department of Development Services and the -Department of Public Works prior to the issuance of building permits. The perimeter.of the resource production area as shown on the site plan shall be sufficiently screened and buffered from -adjacent -uses in a manner acceptable to the' Departments of Public Works and Develop- ment Services. The method of screening could include either fenc- ing and/or intensified landscaping within the resource production area. -8. Areas for pedestrian access to the buildings on the.site shall be delineated through appropriate striping in the drive -areas subject to the approval of the Department of Public Works. 9. If lighting is included in the -parking --'lot, energy efficient lamps shall -be used (e.g., high pressure sodium vapor). -All-outside lighting shall be directed to prevent _spillage onto adjacent pro- perties.' 10. ,An engineering geologist shall be- engaged to submit a report indi- cating the ground surface acceleration from earth movement for the subject property. All structures within this development shall be constructed in -compliance with the G-factors as indicated by the geologist's report. -Calculations for fittings and structural mem- bers to withstand anticipated G-factors shall be submitted to the City for review prior to the issuance of building permits. 1 H.B. A plan for silt control for all storm runoff from the property during construction and during initial operation of the project shall be submitted to the Department of Public Works for review. 12. All previously imposed conditions of CUP 82-19, where applicable, shall be a part of this approval.
