BOARD MEMBERS PRESENT: Godfrey, Evans, Kelly, Vogelsang BOARD MEMBER ABSENT: Smith Center CA MINUTES: ON MOTION BY VOGELSANG AND SECOND BY EVANS, THE MINUTES OF THE REGULAR MEETING OF APRIL 6, 1983 WERE APPROVED AS TRANSCRIBED BY THE FOLLOWING VOTE: AYES: Godfrey, Evans, Kelly, Vogelsang NOES:' None ABSTAIN: None REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 83-551 (Con't. from 4/6/83) Applicant: Mr. Bobby Cornelius c/o Pacifica Properties To combine three (3) existing parcels into two (2) parcels (Assessor's Parcel Numbers 163-292-43, 44, and 45 = located 200 feet from Los Patos and Green Street). Action on subject tentative parcel map was continued to this meeting to allow the applicant ample time to submit documents showing proof of right-of-way easement to public streets. Such documents have been received from the Title Company and have been reviewed by staff who is satisfied that these documents represent a right -of -easement as delineated on the tentative parcel map. Findings and Conditions for Approval were discussed with the applicant's representative, Gene Wilson, who concurred with the following conditions imposed. ON MOTION BY VOGELSANG AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 83-551 WAS APPROVED WITH FINDINGS, CONDITIONS OF APPROVAL AND Minutes: H.B. Board of Zoning Adjustments April 20, 1983 Page Two VOTE AS FOLLOWS: FINDINGS: 1. The proposed combination of three (3) substandard parcels into two (2) parcels for purposes of creating two "buildable" parcels is in compliance with the size and'area of property necessary for.that type of development. 2. 'The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. The zoning is in conformance with the General Plan. The parcel map creates parcels which provide for the intent of the zoning designation. 3. The size, depth, frontage, easements and other design and improvement criteria are proposed to be constructed in compliance with standards on file with the City as well as in compliance with the State Map Act and City Subdivision Ordinance. CONDITIONS FOR APPROVAL: 1. The tentative parcel map received by the Department of Develop- ment Services on April 20, 1983 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Compliance with all applicable City Ordinances. 4. A copy of the recorded parcel map shall be filed with the Department of Development Services. 1 5. Prior to issuance of a building permit, all encroaching fences and structures be removed to assure clear access on the twenty (20) foot easement and assurance -be shown to install utilities in that easement to the satisfaction of the Development Services Department. 6. The ingress and egress easement be constructed to City alley, standards as to center gutter, approach and section. Transition section be provided to the south along Green Street prior to final building inspection. 7. All utilities be provided underground... 8. The roadway shall be posted with standard "Fire Lane - No Parking" signs (Municipal Code 10.40.115 - C.V.C. 22658a) meeting Fire Department requirements. 10. All structures shall be completely automatic fire sprinklered meeting Fire Department specifications. 11. A fire hydrant shall be located at or near the access roadway. on Green Street in accordance with Fire Department requirements. AYES: Godfrey, Kelly, Vogelsang NOES: Evans ABSTAIN: None Appl,: Cambro Manufacturing NEGATIVE DECLARATION NO. 83-9 In Conjunction with ADMINISTRATIVE REVIEW NO. 83-12 To permit construction of a 52,000 sq. ft. (approx.) warehouse and future expansion. Property located at 19151 Huntington Avenue. The Board reviewed the information contained'in the negative declaration request and considered mitigation measures applicable to the project. ON MOTION BY GODFREY AND SECOND BY KELLY, THE BOARD HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 83-12, WITH THE MITIGATING MEASURESAS IMPOSED ON ADMINISTRATIVE REVIEW NO. 83-12, BY THE FOLLOWING VOTE: AYES: Godfrey, Kelly, Vogelsang NOES: None ABSTAIN: Evans Secretary Godfrey outlined the suggested findings and conditions for approval for the Board Members comments. Board Member Evans stated that a review of the last three City Council agendas have contained citizens concerns with the noise problems eminent from the manufacturing facility. Further, that the citizens were assured by City Council, as well as the Planning Commission, that future entitlements for additional development would contain -restrictive measures to deter the noise level, hours of operation, etc. Dick Hammond, speaking in behalf of Cambro Manufacturing, stated he felt__they were entitled to all privileges established for a M1-A Restricted Manufacturing District and have met all standards required. Also, they have tried to satisfy noise concerns �3� BZA 4/20/83 Minutes: H.B. Board of Zoning Adjustments April 20, 1983 Page Four of the adjacent residential neighborhood (Pier Pointe) by proposing to construct a.warehouse with no windows to help limit noise, with parking on the north side of the property -located away from the residential area adjacent to an eight (8)-,foot wall. -:In 1978 they employed 248 people and by the end of 1982 added an additional eleven employees for a total of 259 employees with sales increased some 83 percent. Mr. Hammond felt that as they have taken preventative measures.trying.-to.control noise, in addition to becoming more automated-and"efficient;-'that-'the''-proposed warehouse addition will not impact the area. Discussion -centered -or. the screened shipping area aimed towards Huntington; -Street with sight visibility provided by a ten (10) foot sidewalk located -at -the northeast corner of the proposed building, internal circulation, parking and hours of operation. Mr. Hammond and_Mr.:William Campbell, property -owner, concurred -with -:the conditions for approval. ON MOTION BY-GODFREY AND SECOND,BY-,KELLY,,,ADMINISTRATIVE REVIEW NO. 83-12 (IN CONJUNCTION WITH NEGATIVE DECLARATION NO. 83-9) WAS APPROVED WITH-CONDITIONS:FOR APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: 1. The plot plan submitted March 28, 1983 shall be the approved conceptual layout. 2. That the,.parking and landscaping layout received March 28, 1983_,identifying, the. area adjacent- to the Southern _Pacific right-of-way be- landscaped:' - - - - 3. A detailed:,landscape.-and.irrigationyplan.shall be -submitted„ .to the Department -of Development,Services for'review'and approval prior to issuance of building permits, with an approved plan on file -in the.-Department.of Public„Works. 4. The -elevations submitted March-28, 1983 shall be`the conceptually approved elevations.;.Elevations.,for, ,this building,to be compatible in -architectural treatment.,and .s_urface,.materials , to. other- industrial uses in this -.vicinity and-shal-,be approved by the Department of Development Services. 5. The sidewalk shown -at, -,the northeast' corner of the proposed warehouse building shall be extended to the north edge of the building to allow sight visibility. 6. A "screening wall to shield the loading area shall be erected at _the ten (10) foot setback area, a minimum of five (5) feet in height stepped down to 32 inches to allow line of sight visibility -4- BZA Minutes: H.B. Board of Zoning Adjustments April 20, 1983 Page Five and located no closer than five (5) feet from the edge of the driveway. 7. The fencing shown across the entrance drive shall be set back ten (10) feet from the front property line; such location to be approved by the Fire Department. 8. This structure shall be limited to "warehouse" use only due to parking spaces provided. Parcels 1 and 3 shall be labelled "not -a -part" of this application. 9. The area shown as future buildings on Parcel 2 will be subject to a separate entitlement reviewed by the Board. 10. Reciprocal driveway ingress and egress agreement shall be filed between Parcels 2 and 3. A copy of the recorded document -shall be submitted to the Department of Development Services establish- ing the ten (10) ft. easement shown along the north property line. 11. All pertinent conditions of Tentative Parcel Map No. 82-575 shall apply. 12. -The proposed warehouse will require an automatic sprinkler system meeting Fire Department specifications. 13. On -site fire hydrants will be required meeting Fire Department - requirements. 14. That the structure and the use be constructed in accord with the general requirements of the M1-A District. 15. Normal hours of shipping shall be limited to weekdays (excluding holidays) between the hours of 8:00 a.m. and 6:00 p.m. 16. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 17. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 18. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. -5- BZA 4/20/83 Minutes: ' H.B.- Board' of- Zoning' Adjustmtints April- 20,- 1983 Page Six 19. If foil -type insulation is to be used, a fire retardant .--.type shall be installed as approved by the Building Dept. General Condition: A., A rooftop -mechanical equipment screening plan,shall be submitted to the:Department,of Development Services. Said -plan shall indicate -screening of all rooftop mechanical equipment and shall delineate the,.type of material proposed to screen said equipment. AYES: Godfrey, Kelly, Vogelsang NOES: None . Chairman -Kelly introduced the applicant's proposal and stated that this request is categorically exempt, Class. 1, California Environ- mental" Quality -Act, 1970.-= >" Secretary Godfrey informed the Board that temporary banners are allowed in office=professional';" commercial' or' -community- business-, districts upon`approval-of-ari-'administrative'rediew application. "Mr." Godfrey stated 'that ='Al lstate Savings 'and Loari�,Associationj_ moved into an existirig"branch''of another savings and loan association at subject address. As identification relating to the prior tenant had to be immediately -removed; Allstate Savings and Loan Association feel. compelled to quickly provide temporary banner signage for identification -purposes. Permanent signage is presently being designed to comply with the Huntington Beach Ordinance Code and after appropriate•permits have been obtained, they will.be•-installed. They expect to'accomplish this iwithin ninety (90)­days-. Upon. -the Board's, -review of -the plan :submitted --.it .was noted•:that the temporary. -banners would'not"--obstruct pedestrian or- vehicular traffic .vision-, would not be -detrimental ,to the -,property. -and -are in keeping with the -character --of '-the' -surrounding -community-'business district.' :ON MOTION BY KELLY AND'SECOND BY'VOGELSANG, ADMINISTRATIVE -REVIEW NO.-83=14 WAS GRANTED WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING: -6- BZA 4/20/83 - - Minutes: H.B. Board of Zoning -Adjustments April 20, 1983 Page Seven CONDITIONS OF APPROVAL: The site plan received April 7, 1983 shall be the approved layout, subject to the following: 1. That the banners be displayed for a period not to exceed ninety (90) days or until the installation of the permanent signs, which ever occurs first. AYES: Godfrey, Kelly, Evans, Vogelsang NOES: None ABSTAIN: None ADMINISTRATIVE REVIEW NO. 83-15 Applicant: Richard Layne Tom & Associates To permit construction of a 9,000 sq. ft. Industrial building. Location - 5642 Research. Subject application was introduced by Chairman Kelly who informed all concerned that this request is covered by EIR 73-16. Secretary Godfrey briefly outlined the applicant's request and stated that it is staffs feeling that the plan submitted is sub- stantially in conformance with the general requirements of the M1-A restrictive manufacturing district. Mr. Mueller, Project Manager for Richard L. Tom & Associates, representing the interest of the property owner stated that upon completion of the proposed -industrial building it would be up for lease. It was the consensus of all of the Board Members that the proposed industrial building would allow architectural compatibility staying consistent with original construction within the proposed area. The permit process was explained to the applicant. ON MOTION BY VOGELSANG AND SECOND BY GODFREY, ADIMINISTRATIVE REVIEW NO. 83-15 WAS APPROVED WITH CONDITIONS AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: 1. The conceptual parking and landscape plan along with elevations received April 7, 1983, shall be the approved layout. 2. The following plans shall be submitted to the Department of Development Services for review and approval prior to issuance -7- BZA 4/20/83 Minutes: H.B. A detailed landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in,the Department of Public Works-. b. Rooftop mechanical equipment screening plan. Said plan shall -indicate screening of all rooftop mechanical equip- ment -and, -shall delineate the type of material proposed -to screen - -said equipment. 3. Elevations for the proposed building -shall be compatible in architectural treatment and" surface materials with industrial uses in the vicinity and shall be approved by the Department of Development Services." 4. Staff introduced the request with no one present-.to.speak-for or against the charity bazaar.: Secretary Godfrey -informed the Board that this event was held last year, at the same location, with no complaints received. - The Board reviewed the site plan submitted discussing location, flow of traffic" -within the shopping -center, and,fire-accessways. ON MOTION BY EVANS-AND SECOND'BY-GODFREY, USE PERMIT NO. 83-20 WAS GRANTED WITH THE FOLLOWING CONDITIONS OF APPROVAL IMPOSED, FOLLOWED BY -VOTE: - rONDITIONS'OF APPROVAL: 1. The plot plan received April 8, -layout.- = 1983 shall be the approved 2. Signs shall -be prohibited within the public right-of-way area. 1 3. AYES: Godfrey, Kelly, Evans, Vogelsang NOES: None ABSTAIN: None USE PERMIT NO. 83-21 Applicant: National Coalition for Marine Conservation To permit a parking lot charity bazaar to be held on May 15, 1983 at Marina High School (Springdale and Edinger). Chairman Kelly introduced the "special event". Secretary Godfrey stated that the request is being proposed to sell fishing tackle and related items as a fund raiser with proceeds to be used for Marine conservation projects in Southern California. The Board Members discussed conditions for approval and reviewed documentation submitted by the applicant covering necessary require- ments for use of a school facility e.g. location, maintenance, set-up and clean-up where applicable. Emphasis was placed on the necessity of keeping the access isles maintained for emergency vehicles. ON MOTION BY VOGELSANG AND SECOND BY EVANS, USE PERMIT NO. 83-21 WAS MINISTERIALLY APPROVED, WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING: 1. The plot plan received April 8, 1983 shall be the approved layout. 2. Signs shall be prohibited within the public right-of-way area. 3. Fire access lanes shall be maintained. 4. The applicant shall obtain all necessary electrical permits. 5.
