LA LA BOARD MEMBERS PRESENT: Godfrey, Evans, Smith, Cooper, Vogelsang REGULAR AGENDA ITEMS: USE PERMIT'NO. 83-26 Applicant: Mr. Jimmy E. Cole To permit an -Auto Body Repair located at 18081 Redondo Circle - Unit "C", zoned M1-A (Restricted Manufacturing District). Acting Chairman Evans informed the Board that this request is categorically exempt, Class. 3, California Environmental Quality Act, 1970. The public hearing was opened with the applicant, Mr. Jimmy Cole, present to speak in his behalf. Secretary Godfrey stated that buildings within an Ml-A district are not designed for outside storage. Further, the applicant was cautioned that this Condition would be strictly enforced. Mr. Cole addressed the -Board and stated that within the proposed complex there are six (6) units; five (5) are currently occupied by either automobile body repair or automobile mechanical repair shops. He felt this particular location was appropriate for his proposed related business. The public hearing was closed by Acting Chairman Evans. The proposal was reviewed by the Board and found to be in sub- stantial ordinance code conformance. Findings and Conditions of Approval were discussed. ON MOTION BY SMITH AND SECOND BY GODFREY, USE PERMIT NO. 83-26 WAS GRANTED WITH FINDINGS, CONDITIONS OF APPROVAL AND VOTE FOLLOWING: Minutes: H.B. Board of Zoning Adjustments May 11, 1983 Page Two FINDINGS: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: The conceptual plot plan received April 26, 1983 shall be the approved layout. General Conditions: 1. There shall be no outside storage of vehicles, vehicle parts equipment or trailers. 2. All repair work shall be conducted wholly within the building. 3. Applicant shall -obtain necessary permits from the Orange County Air Quality Control Board. 4. Applicant shall meet all applicable local, State and Federal fire codes, ordinances and standards. 5. A review of the use shall be conducted within six (6) months of the date of this approval to verify compliance with all Conditions of Approval and applicable sections of Article 951 of the Huntington Beach Ordinance Code. If,at any time, there is a violation of these conditions or Code sections, Use Permit No. 83-26 may become null and void. Board of Zoning Adjustments May 11, 1983 Page Three To permit utilization of the lease -hold interest in subject property as a seasonal.parking lot for the period of May 21, 1983 to September 6, 1983. Location - N.E. corner-PCH and Newland Street (1.7 acre rectangular parcel of land in front of the Edison Generating Station). Secretary Godfrey outlined the proposal and stated that as the applicant has used this particular area for over two consecutive seasons, further use as a seasonal parking lot is prohibited unless approved in compliance with the conditions outlined for a "temporary commercial parking lot" per Section 9730.28 of the Code. However, the applicant can not meet the requirements of Section 9730.28; therefore, he is applying for a conditional exception. The public hearing was opened by Acting Chairman Evans with Mr. Lyle Overby present to speak in favor of subject application. Mr. Overby stated that the property is owned by Edison and that they have obtained a limited lease. He informed the Board that it is an economic impossibility to conduct a seasonal parking lot business on the subject site if the strict interpretation of the Code is imposed because of the requirement to construct permanent improvements. He stated that the specific constraint from which they need relief is the requirement that this seasonal parking lot be converted to a "temporary commerical lot". Because Southern California Edison will not enter into a long term lease and, because the lot receives such limited use, simple economics make permanent improvements infeasible. In addition, the lease requires removal of all permanent improvements at the end of the lease period. He felt that if the economics of compliance existed they would not be asking for relief but, in this case, it would cause termination of the business and the benefits it provides to its dependents. Discussion carried on securing of the property with a chain -link fence, with -the only opening for ingressing and egressing allowed on the west end of the parking lot facing Newland Street. It was felt that this solution would prevent pedestrians who use the parking lot from walking directly across Pacific Coast Highway from the location where they park their vehicles on the lot and would enforce the use of the pedestrian crosswalk and traffic signal located at the corner of Newland and Pacific Coast Highway. The public hearing was closed by Acting Chairman Evans. Board discussion ensued with special consideration given to the location of the full-time parking attendant in an effort to -prevent stacking of vehicles entering into the seasonal parking lot. ON MOTION BY EVANS AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 83-12 AND ADMINISTRATIVE REVIEW NO. 83-18 WERE APPROVED WITH FINDINGS, -3- BZA 5/11/83 Minutes: H.B. Board of Zoning Adjustments May 11, 1983 Page Four CONDITIONS OF APPROVAL AND VOTE FOLLOWING: FINDINGS: 1. As the applicant is operating under a short-term lease with a public utility and that utility is contemplating a future expansion into the requested area it would necessitate removal of permanent improvements. It is found to be a hardship to require street improvements for a temporary use. 2. As the subject use is temporary, the site shall be returned to its original condition after September 6, 1983; therefore, the granting of this application will not adversely affect or be materially detrimental to the public welfare or injurious to other properties in the same zone classification or in the vicinity. 3. Granting of this application will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: 1. The conceptual plot plan received April 29, 1983 shall be the approved layout. Directional signs are to be posted clearly indicating access -location on Newland Street. No access will be permitted from Pacific Coast Highway. 2. Location for driveway approach and parking attendant shall be installed to the satisfaction of the Department of Public Works. Said approval shall be obtained ten (10) days prior to May 21, 1983, 3. Surfacing and/or oiling of the parking lot shall be to the satisfaction of the Department of Public Works. 4. Inspection of the site for compliance of all Conditions shall be made prior to issuance of permits or license. 5. Pedestrian access shall be controlled by the installation of a chainlink fence around the periphery except for the entrance on Newland Street so that there is no indiscriminate pedestrian crossing of Pacific Coast Highway. 6. All litter on the property and just outside the fence shall be picked up and bagged daily. Bagged litter shall be disposed of weekly, or more frequently if determined necessary by Land Use Enforcement. 7. No signs, swags, cable, post -signs, etc. shall be allowed in the public right-of-way. -4- BZA 5/11/83 Minutes: H.B. Smith To permit consolidation of three (3) parcels into one (1) parcel for residential use. Property located at 16672 Pacific Coast Highway (northeast side of street) - Portion of Assessor's Parcel No. 178-565-13 and all of Assessor's Parcels No. 178-565-14 and 15. Acting Chairman Evans introduced the proposal and stated this request is to be covered by Negative Declaration No. 83-21. Secretary Godfrey informed the Board Members that Tentative Parcel Map No. 83-560 was to be referred to the Planning Commission, to be heard in conjunction with Negative Declaration No. 83-21 and Zone Change No. 83-6, at their June 7, 1983 Meeting.
