CONDITIONAL USE PERMIT NO. 83-6 (Continued from April 19, 1983)
Applicant: W & B Builders/Seaside Village Towne Homes Assoc.
A request to revise a previously approved conditional use permit
to allow the addition of security gates and wrought iron fencing
within a planned residential development located at the south-
west corner of Atlanta Avenue and Beach Boulevard.
Florence Webb informed the Commission that, although a letter
has been received from the applicant requesting another continu-
ance, there were persons in the audience who would like the
opportunity to address the Commission on this matter.
Chairman Porter reopened the public hearing.

Julie Perrine, 7815 Bayport, addressed the Commission to present
an alternative solution to the fencing problem proposed by a group
of the tenants in the rental portion of the project. She noted that
the majority of the renters are in favor of a physical separation
from the ownership units, saying that it does not seem to be a work-
able situation to keep the two projects in one development. However,
the present proposal will cut the rental units off from direct access
to Atlanta Avenue which is presently available to them by going
through the condominium development, while still allowing traffic
from the ownership units to go through the rental property; this is
not an equitable solution in the eyes of the renters. They would
like the gate at Poolside and Mainmast to also be a fixed gate with
a knox box for real emergency situations, and would also like a gate
installed at Poolside and Atlanta leading directly from the rental
complex out to Atlanta. This could be an exit only in order to
avoid creating a traffic problem, but it would allow much easier exit
for both vehicular and pedestrian traffic out of the project.
Ms. Perrine also informed the Commission that the renters would like
to see their project remain under planned residential development
zoning and not changed to apartments, questioning whether when the
units are available for sale after the required 30 years the project
would again be rezoned back to planned development.
There were no other persons to address the Commission on this matter,
and the public hearing was closed for this meeting.
Secretary Palin brought the Commission up to date on meetings held
between staff, the property owners in the ownership units, and the
developers of the project to try to arrive at a workable solution.
After brief discussion, the Commission directed that staff obtain a
name and address of a representative of the rental units and make
sure that they are notified of any future action regarding this re-
quest.

Mikd Adams presented slides of the project area which illustrated
the relationship of the proposed layout of the subject project
to the surrounding residential and industrial areas. He discussed
project density and site coverage, unit mix and location, buffer-
ing from adjacent properties, treatment of easements and setbacks,
building elevations and separation, open space, and recreation
areas to serve the total project.
Commissioner Schumacher questioned staff as to whether the pro-
ject has been designed to address all requirements of the "Q"
zoning existing on the property and whether or not there will be
conditions applied to address the recommendations in the noise
study. Mr. Adams replied that all "Q" requirements have been
addressed and conditions will be recommended for mitigation of noise
impacts at the common property line with the industrial. He also
noted that when an industrial development on Lot 10 is approved
it will be required to be designed not to adversely impact the sub-
ject project.
Commissioner Livengood inquired about the future development of
Lots 6, 7, and 8, held under private ownership. Mr. Adams indi-
cated that they may not be specifically senior -oriented units
and may be market -rate condominiums with self-contained open
space and recreational facilities.
The public hearing was opened.
Dr. Charlie Kern, 7795 Lui Drive, spoke generally in support of
the staff's recommendations, calling the new plan a good compro-
mise. He addressed the relocation of the easement at the south-
east corner of the property over to the east, saying this will
prevent an alley -type situation ; he also approved the gate pro-
posed at that end of the project to prevent bicycle access to the
walkway. Dr. Kern also discussed the architectural treatment
of the buildings, buffering between the properties, relocation
of the walkway, and the possibility of omitting windows and doors
abutting the R1 to the south to protect the privacy of the exist-
ing residents.
There were no other persons present to speak for or against the
proposal, and the public hearing was closed.
The following items were discussed by the Commission:
Public Accessway to Terry Park: The provision of this public
accessway across private property was a problem for the majority
of the Commission in regard to the_ incompatibility of the mix
of seniors with children from the market -rate condominiums and
the liability and responsibility for this public access. Alter-
natives were suggested which included providing the walk on the

east side of the senior project with other properties in the area
taking their access off the parking lot; providing the walkway on
the west side of the project adjacent to or on the industrial site;
using the streets for access; or actual elimination of the walkway
entirely.
Setbacks: Mike Adams noted an error on the submitted layout which
shows an 11-foot setback in some instances; this will be changed
and the minimum setback will be 15 feet. The Commission discussed
the setbacks of buildings from the drives and from the adjacent
residential properties.
Building Footprint: Commissioner Higgins suggested that buildings
on the west side of the project be reoriented'to take better advan-
tage of their location relative to the park and to avoid noise from
the adjacent lumber yard. Mr. Adams said other layouts had been
considered and he would again look at the plan to try to reorient
those structures. Separation between buildings was reviewed.
Elevations: Staff is recommending that no doors or windows on either
level be provided in elevations where units side -on to existing
residential. After discussion, Commissioner'Porter suggested that
the privacy of the R1 residents could be protected by only conditioning
the second story of the subject buildings with that restriction.
Easement: Secretary Patin reviewed for the staff and Commission the
original intent of the easement, imposed when the property was both
residential and industrial; that intent had been to maintain a way
for the residents of the general neighborhood to take access to the.
park after all the properties were developed. The Commission dis-
cussed whether or not a legal obligation remains to honor the ease-
ment, and staff was directed to research the legal ramifications of
asking the City Council to vacate that easement.
Security: Staff informed Commission that the total area will be
secured by a gate off Talbert Avenue. The southern boundary of the
subject property will be secured by a locked gate, to allow residents
entrance to Terry Park but to keep the public from entering the
projects through the park.
Commissioner Porter discussed the difficulty in approving what
staff has described as a "conceptual" layout and depending on con-
ditions of approval to attain Commission objectives. The consensus
developed that the Commission needed to have the layout before them
as it will be built, to assure that the project they approve will
address their concerns.
A MOTION WAS MADE BY LIVENGOOD AND SECONDED BY MIRJAHANGIR TO CON-
TINUE THIS PROJECT TO THE NEXT REGULAR MEETING TO ALLOW STAFF TO
MAKE NECESSARY CORRECTIONS AND INCORPORATE THE COMMISSION'S CON-
CERNS INTO THE LAYOUT.

Staff requested further direction from the Commission. Exten-
sive discussion ensued, and both Livengood and Mirjahangir
agreed to withdraw their motion for continuance.
A motion for a straw vote was made by Livengood in support of
the walkway through the greenbelt as it is shown on the pre-
sent plan. The motion failed by the following vote:

Dr. Kern requested permission to speak again; however, the
public hearing had been closed. Commissioner Winchell asked
him to address the Commission, and he indicated a strong ob-
jection to having a public access in the easement adjacent to
the back yards of the R1 dwellings, saying it would create an
alley effect and would not solve the problem.
The time frame was discussed by staff, with Secretary Palin
suggesting a 30-minute tabling so that staff could perhaps
work out some resolution to the stated concerns. Commissioner
Schumacher asked for a straw vote on the possibility of the
public accessway running along the east side of the project with
one side being fenced with a solid fence and the other with
open, wrought iron fencing to avoid the "alley" effect.
Tom Tincher pointed out another way that access might be taken
for the condominium projects to the park; this would involve
using a 10-foot strip still under the ownership of Collins
and Zweibel south of the shopping center out to Beach Boulevard.
This would provide the necessary access for those projects
and leave the interior walkway for the private use of the senior
projects only.
Commission direction for modifications to the project were:
1) add the conditions set forth in the Noise Study for the miti-
gation of noise impacts; 2) reorient the two westernmost build-
ings; 3) condition on openings in walls abutting residential;
4) show some landscaping and trees; and 5) investigate moving
the walkway out of the center of the project or deleting it en-
tirely. Commissioner Porter set forth four additional condi-
tions he would like to see imposed on the project in regard to
relocation of the wall to the eastern side of the easement,
minimum separation between structures and the project boundary,
elimination of doors and windows in specified locations, a
decorative masonry wall along the boundary between the project
and Terry Park, and a condition relating to security and
gating of the project.

CONDITIONAL USE PERMIT NO. 83-10
Applicant: Huntington Dance Academy
To permit a dance studio in an M1 district pursuant to Section
9331 of the Huntington Beach Ordinance Code, on property located
at the southwest corner of Gothard Street and Heil Avenue.
Staff planner Carol Inge presented an overview of the request,
expressing staff's concerns that the percentage of non -industrial
uses in this particular mixed use project might be over the
amount allowed by the resolution which established the entitlement.
Staff wishes to place this consideration before the Commission
because it is felt that continued approval of commercial/office
uses in the mixed use projects may be the beginning of a trend to-
ward the erosion of the industrial and manufacturing activities
which in staff's opinion offer- better employment opportunities in
the City.
In a brief discussion it was established that the corner building
in this project, housing offices and the Mercury Savings and Loan
operation, was not counted in the original percentage of mixed
use because it had been in operation prior to adoption of the reso-
lution,
The public hearing was opened.
Elizabeth Munson, property manager, addressed the Commission in sup-
port of the proposed use. She distributed copies of parking alloca-
tions for the project. Chris Toland of Stewart Development, owners
of the property, also spoke in favor or the proposal.
Sheila Hampton, operator of the dance academy, addressed the Commis-
sion to describe the nature and operation of her business.
There were no other persons present to speak for or against the
project, and the public hearing was closed.
Commissioner Winchell discussed the timing of the mixed use ordin-
ance and inquired why this project is apparently limited to 19 per-
cent while other mixed use developments in the City are allowed 35
percent. Secretary Patin noted that perhaps the discrepancy arose
because at the time this project was approved for commercial as
well as industrial use the staff was trying to apply standards to an
already existing project rather than working with an original dev-
elopment. In response to further questioning from Ms. Winchell, he
added that the project is also in violation of the amount of square
footage of office/commercial allowed by code along arterials•..•in the
mixed use projects.
The Commission discussion included consideration of the mixed use
standards, the parking within the complex, and the nature of the use
proposed.

FINDINGS:
1. The proposed dance academy is generally compatible with the
surrounding land uses.
2. Although 54 spaces are required by code to serve the building
to be occupied by the proposed use and only 52 are available,
the Commission has determined that special circumstances of
the type of operation and the hours in relation to the hours
of surrounding uses exist, and these circumstances demonstrate
that the proposed use has adequate parking to accommodate it.
3. The proposed project meets the existing code requirement that
no more than 35 percent of mixed use commercial be permitted
within a mixed use project in an industrial area.
4. The proposed project does comply with four of the five re-
quired standards for a mixed use development, and in regard to
the fifth (which regards the restriction to only 50 percent of
the original ground floor area fronting on arterials), there
are unusual circumstances in view of the fact that the corner
building of this project was developed as a separate office
building prior to the enactment of the mixed -use ordinance.
CONDITIONS OF APPROVAL:
1. Classes for adults on weekdays will be scheduled only after
5:00 p.m.
2. If the Director of Development Services deems it necessary be-
cause of complaints received from surrounding tenants, meas-
ures shall be taken, at the applicant's expense, to lower the
volume of sound to a level acceptable to the Director.
3. The square footage of the dance academy shall count as util-
izing a portion of the percentage of mixed uses allowed in
the Gothard Business Center.

Florence Webb indicated that staff has no additional information
to add at this time.
The public hearing was opened on ZC 83-5, CA 83-12, and ND 83-11.
Dick Harlow, representing the applicant, spoke to concur with the
staff's report and make himself available to answer any questions
the Commission might have. The Commission reviewed the need for
the zone change and the code amendment with Mr. Harlow and staff.
Florence Webb explained that the original recommendation for con-
tinuance had been made to allow additional advertising for the code
amendment, but that a determination had been made by the office of
the City Attorney that the advertising done for the zone change
was sufficient to cover the code amendment as well, and in the staff
report the recommendation is for approval.
There were no other persons to address the Commission in regard to
these applications, and the public hearing was closed.
The Commission discussed the other uses in the specific plan area
and the consistency of the present proposal. Ms. Webb indicated
that, although all the uses presently in the Pacifica complex as
well as the proposed use are permitted under the existing General
Plan designation, staff now has available to it a new designation,
Mixed Use, which it feels is more descriptive of the actual develop-
ment of the area and a General Plan amendment is being proposed to
apply that designation to the property in the future.

Plan, District Two, across Florida Street to the west; and

Applicant: Brad Jones

To permit the extended use of a nonconforming, freestanding pole
sign on property located on the southeast corner of Beach Boulevard
and Slater Avenue.
Mr. and Mrs. Carlos Benevenia, operators of the restaurant at the
subject location, were present to represent the application. Both
addressed the Commission in support of being allowed to continue
the use of the sign with amended copy. They informed the Commission
that they were unaware of the requirement to bring the sign up to
code until after they had ordered expensive modifications to the
sign,and to deny -them the use now would impose a severe economic
hardship.
Staff informed the Commission that the sign has been nonconforming
since 1969 and that, in addition to exceeding the height and square
footage limits, it also overhangs the public right-of-way by approxi-
matbly 3 feet. The Commission discussed the length of the amortiza-
tion period which the applicant has already enjoyed and the dollar

amount of his most recent investment. Commissioner Livengood in-
dicated that given the investment the two years' amortization period
staff is suggesting does not seem adequate and perhaps a 42-month
period could be agreed to. Mr. Benevenia said he did not agree with
that proposal since at the end of the time he would still be faced
with the same problem.
A MOTION WAS MADE BY LIVENGOOD AND SECONDED BY PORTER THAT THE NON-
CONFORMING SIGN BE ALLOWED TO CONTINUE FOR A PERIOD NOT TO EXCEED
THREE AND ONE-HALF YEARS, WITH THE CONDITIONS RECOMMENDED IN THE
STAFF REPORT. AT THE END OF THAT THREE AND ONE-HALF YEAR PERIOD, THE
APPLICANT SHALL BRING THE SIGN INTO COMPLIANCE WITH ALL PROVISIONS
OF THE HUNTINGTON BEACH ORDINANCE CODE.
Mr. Benevenia refused to concur with the motion, saying he wanted
unlimited approval or denial. Livengood and Porter then withdrew
the motion.

TENTATIVE TRACT 10853 (Revision)
Applicant: Mola Development Corporation
To permit the revision of a previously approved 3-lot subdivision to
a 7-lot subdivision for the purpose of phasing construction on prop-
erty located on the east side of Bolsa Chica Street approximately 700
feet south of Warner Avenue.
Secretary Palin explained the request and noted that the proposed
additional conditions of approval should have the concurrence of the
applicant on record. Jerry Lindquist, an engineer for Don Greek and
serving as representative for Mola, addressed the Commission to say
that the developer does agree with the proposed new conditions.

ADDITIONAL CONDITIONS OF APPROVAL:
1. The tentative tract received and dated May 13, 1983, shall be
the approved lot line layout for Tentative Tract 10853.
2. All recreational facilities approved for the proposed project
shall be constructed and in place prior to the closing of
escrow on the first unit in the first phase.
3. All seven lots shall be .included within the same master home-
owners' association and shall be considered one overall
project with equal rights to all of the common.facilities and
over all of the common streets. Prior to the closing of escrow
of the last unit in the last phase, all units located within
this project shall be recorded under one condominium map.
4. The approval of this revised map shall not modify or change
any of the previously approved conditions of approval or the
original approval date.
5. Prior to the recordation of a condominium map, a copy shall
be submitted to the City for review and approval.

revision of site plans approved by either the Commission or the Board

Florence Webb, noting that the landscaping ordinance is on the agenda
for the June 7, 1983 meeting, suggested that the study session could
address that item at 6:00 p.m. before the meeting and then the Com-
mission could adjourn to a study session after the meeting to consider
the housing recommendations. The Commission concurred with this
approach.

DEVELOPMENT SERVICES ITEMS;
Secretary Palin briefly reviewed the actions taken at the City
Council meeting of May 16, 1983, for the Commission's informa-
tion.
PLANNING COMMISSION ITEMS:
The Commission noted receipt from the office of the City Attorney
of the requested information in regard to what should be trans-
mitted to the City Council when the Planning Commission has
approved for recommendation only certain portions of a proposed
action for a specific plan.
Planning Commissioner Livengood informed the Commission that
there is a workshop on transportation taking place at UCI; Com-
missioner Mirjahangir indicated that he will be attending this
workshop on June 11, 1983.
