The Chairman called the meeting to order. He made the announcement
that Mr. Leonard Wright, a resident who was active in the downtown
area, had passed away the night of July 18, 1983.

Applicant: Huntington Beach Company
A request to change the zone from R4-01 to R3-0 and from ROS-0 and
R3-0 to R3-01 at the southeast corner of Doral Drive and Seaview
Avenue. Jim Barnes made a presentation. He stated that it was a re-
quest to change the zoning on an oil island and re-establish the island
on a parcel northeast of the existing island with the Seacliff Golf
Course. He said the purpose is to eliminate incompatibility that would
allow future development on the property.
The public hearing was opened. Dave Eadie representing the Huntington
Beach Company explained the company's objectives and outlined on the
display map the affected area. Chairman Porter asked him if there
were any plans with the island as far as the Seacliff project. Mr.
Eadie said that would be part of the penninsula, that it could be
looked at again, but the island would be isolated. The public hearing
was closed. M

Applicant: Robert J. Zinngrabe
A request to permit construction of a 55-unit retirement condominium
a waiver of the required 20 foot perimeter setback for carports to be
constructed along the north and east property lines and site coverage
over the maximum 45 percent allowed on property 530 feet south of
Main Street on the east side of Florida Street. Staff made a brief
presentation.
Commissioner Schumacher asked if because there were security gates was
this why there was no turnaround. Mr. Cooper responded that the com-
plete building was fire sprinklered. He recommended access off of
Florida Street on the north. Commissioner Schumacher asked staff what
was presently on the other side. Carol Inge stated that it was a park-
ing lot for a senior retirement community. The Chairman stated that
an opening in the wall and lane designation would keep it clear.
The public hearing was opened. Richard Harlow spoke on behalf of the
applicant. He said that the slides shown by staff accurately depict
the property; that the access -point is shown as a fire access so he_
saw no problem there. He said the project was basically a repeat of
the one that exists on Delaware Street. He said it would provide a
better living environment. The public hearing was closed.

Chairman Porter had some concern about impact from an adjacent car
dealership as far as noise from loud speakers. Staff said there were
no loud speakers at the dealership.

FINDINGS FOR APPROVAL:
1. The General Plan sets forth provisions for this type of land use
as well as setting forth objectives for implementation of this
type of housing.
2. The proposed project was previously studied for this intensity of
land use at the time the land use was designated and the Pacifica
Community Plan zoning designation was placed on the property.
3. The lot size, depth, frontage, street width, and all other design
and implementation features of the proposed subdivision, with the
granting of Conditional Exception 83-2, are proposed to be con-
structed'in compliance with standard plans and specifications on
file with -the City as well as in compliance with the State Map
Act and all supplementary City subdivision ordinance.
CONDITIONS OF APPROVAL:
1. The tentative tract map received and dated June 13, 1983, shall be
the approved layout.
2. Water systems shall be through the City of Huntington Beach water
system.
3. The sewer, water and fire hydrant systems shall be designed to
City standards.
4. The property shall participate in local drainage assessment dis-
trict requirements and fees.
5. Drainage for the subject subdivision shall be approved by the
Department of Public Works prior to recordation of a final map..
This system shall be designed to provide for erosion and siltation
control both during and after construction of the proposed project.

7. All structures on the subject property, whether attached or detached,
shall be constructed in compliance with the State acoustical stan-
dards set forth for units that lie within the 60 CNEL contours of
the property. Evidence of compliance shall consist of submittal of
an acoustical analysis report prepared under the supervision of a
person experienced in the'field of acoustical engineering, with
the application for a building permit.
8. All proposed structures shall meet the requirements of the Hunting-
ton Beach Fire Department; the development shall meet access require-
ments of the Huntington Beach Fire Department. An on -site fire
hydrant shall be provided as deemed necessary by the Huntington
Beach Fire Department.
9. The convenants, conditions and restrictions shall contain a provi-
sion that will prohibit storage of boats, trailers and recreational
vehicles on site, unless an area that is specifically designated
for such storage and which is in compliance with the provisions of
Article 936 is provided for in the project.
10. The location and design of the entry gate proposed at the main
entrance shall be reviewed and approved by the Department of De-
velopment Services and the Fire Department.
11. A soils analysis shall be prepared by a registered soils engineer.
This analysis shall include on -site sampling and laboratory testing
of materials to provide detailed recommendations regarding grading,
chemical and fill properties, foundations, retaining walls, streets
and utilities.
12. The design and materials of all perimeter walls shall be subject
to the approval of the Department of Development Services, prior
to the issuance of building permits.
13. A detailed landscape and sprinkler plan shall be subject to the
approval of the Department of Development Services prior to the
issuance of building permits.
14. Each inhabited dwelling unit shall be occupied by at least one
person sixty years of age or older.
15. The site plan shall be modified to provide 32 parking spaces along
the north property line, 23 spaces adjacent to the building, 3
visitor parking spaces and a relocation of the trash area to the
fourth visitor space.

that the applicant will install a more energy efficient alternative
subject to the review and approval of the Department of Development
Services.
3. Natural gas shall be stubbed in at the locations of cooking facili-
ties, water heaters, and central heating units. This requirement
may be waived provided that the applicant will install a more
energy efficient alternative subject to the review and approval
of the Department of Development Services.
4. Low volume heads shall be used in all showers.
5. All building spoils such as unused lumber, wire, pipe and other
surplus or unusable materials, shall be disposed of at an offsite
facility equipped to handle them.
6. Energy efficient lighting, such as high pressure sodium vapor lamps,
shall be used in parking.lots to prevent spillage onto adjacent
areas and -for energy conservation.

FINDINGS FOR APPROVAL:
1. The waiver of the twenty foot perimeter setback will not have
adverse impacts on the adjacent land uses because the north and
east property lines of the subject site abut parking lots.
2. The granting of the conditional exception is not inconsistent with
the general purpose and intent of the Pacifica Community Plan
because it promotes senior residential housing.
3. Strict application of the provisions of the Pacifica Community
Plan would not allow construction of the carports which are a
desired amenity since they provide covered and protected parking
for the resident senior citizens.
4. The granting of a conditional exception will not be materially
detrimental to the public welfare or injurious to property in the
same zone classifications.

CONDITIONAL USE PERMIT NO. 83-17/TENTATIVE PARCEL MAP NO. 83-564
Applicant: Mola Development Corporation
A request to construct a 395,300+ square foot commercial/office complex
and to subdivide the site into 7 parcels on property located at the
southwest corner of Beach Boulevard and Warner Avenue. Jim Barnes
gave staff's presentation. He said that a previous EIR was conducted
on the area and that that document and the Greer Traffic Study adequately
addresses environmental impacts. He also distributed the findings
for approval on the tentative parcel map.
The Chairman opened the public hearing. Carl McClaren, the architect
on the project, gave a presentation with a model of the project. He
requested approval. There was some discussion on vacation or acquisi-
tion of property to attain a curve, however, Mr. Harlow said he could
work that out with staff. Mr. Harlow requested to "leave that option
open". Some discussion took place regarding parking. Chairman Porter
had some concern about access points off Beach Boulevard. He was also
concerned about the width of Ash Street. Mr. Harlow stated that Ash
will be widened; that the design can take in the existing lanes and
the right-of-way will be sufficient by the elimination of parking.
The Chairman also asked if there would be any drive-throughs located
in the project. The applicant knew of none. Commissioner Schumacher
was concerned about the proposed materials of concrete and glass as
far,as the color of the concrete producing a glare. Discussion took
place regarding the possibility of asking the City Council to include
adjacent area into the Oakview Redevelopment Plan area.

Discussion took place regarding the possibility of a planned sign pro-
gram. Frank Mola stated he would agree to such a condition. Leonard
Lichter, owner of an adjacent office building suggested that the entire
area including his office be combined in the Oakview redevelopment area:
The Chairman closed the public hearing.
Further discussion took place regarding redevelopment. Mr. Mola com-
mented that they have discussed the possibility and that he "can live
with the development as is". Chairman Porter asked the applicant if
he would be agreeable to a condition to underground all utilities. He
stated for the record that he was agreeable. Some discussion took
place about signalization at Ash and Warner. The applicant said if
it is in order to participate in a signal at the time of development
he would agree. Les Evans felt that as it is there is already some
breaks in traffic flow in that area. Condition #7 was amended to state
signalization participation would be determined by traffic generated
from the project.
ON MOTION BY ERSKINE AND SECOND BY SCHUMACHER CONDITIONAL USE PERMIT
NO. 83-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
I. The proposed development is in conformance with the policies and
development standards contained in both the City's General Plan
and Division 9 of the Huntington Beach Ordinance Code.-
2. The project will not adversely affect living conditions in the
surrounding neighborhood due to its design in terms of providing
adequate setbacks from property lines and adjacent streets and
landscaped buffers around the perimeter of the site.
3. The project will not create or excessively increase traffic con-
gestion provided that recommendations suggested in the traffic
report and by the Traffic Division of the Department of Public
Works, are carried out.
4. The project could have a beneficial effect on property values in
adjacent areas due to the additional economic stimulation resulting
from an increased number of businesses and employees in the
vicinity.
CONDITIONS OF APPROVAL:
I. The site plan should be changed to remove or relocate the restau-
rant indicated in the southeastern portion of the complex, a por-
tion of which is sited on the not -a -part (N.A.P.) parcel; and a
new use identified for the area, such as additional parking or
landscaping. An additional parcel map shall be filed with the De-
partment of Development Services to incorporate this 9.264 square
foot area as part of the overall commercial complex, when the

necessary entitlement is secured. At such a time, an additional
conditional use permit will also be required.
2. The site plan, floor plans and elevations received and dated
July 7, 1983, as modified by Condition #1, shall be the approved
layout.
3. Off-street improvements (e.g. streets, sidewalks, gutters, etc.)
shall be constructed in accordance with Public Works standards.
All sidewalks shall be a minimum of 8 feet except adjacent to a
bus turnout where the sidewalk may be reduced to 5 feet.
4. The City and developer shall execute a landscape maintenance
agreement with provisions determined by the City for the main-
tenance of landscaping along the street frontages.
5. The curb knuckle at the corner of Sycamore Avenue and Elm Street
shall be designed and constructed by the applicant in accordance
with Public Works standards.
6. The traffic signal at Warner Avenue and Beach Boulevard shall be
modified by the applicant in accordance with Public Works standards.
7. At the time of Phase 1 construction, the applicant shall install
the necessary subterranean conduit and connections for a traffic
signal at Warner Avenue and Ash Street. Traffic patterns and im-
pacts will be studied by the Department of Public Works prior to
approval of Phase II and, if warranted, a traffic signal may be
conditioned prior to any Phase II construction with participation
to be determined proportionately to the traffic generated by the
project.
8. The site plan should be changed to reflect the following circula-
tion concerns; the drive exiting from the complex to Ash Street
should be widened to 27 feet. The parking structure scheduled
for Phase II should widen both access points to provide two-way
entrance and exit movement, rather than a single entrance and exit
as depicted on the site plan.
9. Sewer, water and drainage improvements shall be constructed in
accordance with Public Works standards. The applicant shall sub-
mit to the Department of Public Works, a water -network and dis-
tribution analysis prior to issuance of grading permits. All
necessary improvements as determined by the analysis shall be
constructed.
10. The applicant shall construct full median improvements on Warner
Avenue and upgrade the existing median on Beach Boulevard adjacent
to the site in accordance with Public Works standards.
11. The applicant shall initiate the procedure for vacating the twenty

foot alley right-of-way presently on the site.
12. Structures on the site shall be provided with systems related to
fire protection and life safety as deemed necessary by the Hunting-
ton Beach Fire Department and all applicable codes.
- Automatic sprinkler systems shall be required as per code.
- All high-rise must comply with State and local codes.
- All fire lanes must be designated.
- All hydrant locations must be approved by the Fire Department.
- Rear access must be provided to the theatre. Minimum access
opening must be 12 feet.
- First level of parking structure must be automatic sprinklered.
- The second through sixth levels of parking structure must be
equipped with stand pipe systems as approved by the Fire De-
partment.
13. A deatiled landscape plan shall be submitted to the City and
approved by the Department of Development Services and the De-
partment of Public Works prior to the issuance of building permits.
Perimeter landscaped areas shall be a minimum of 10 feet in width.
14. Energy efficient lights shall be used in parking areas. All out-
side lighting shall be diverted to prevent spillage onto adjacent
properties.
15. An engineering geologist shall be engaged to submit a report in-
dicating the ground surface acceleration from earth movement for
the subject property. All strctures within this development shall
be constructed in compliance with the G-factors as indicated by
the geologist's report. Calculations for footings and structural
members to withstand anticipated G-factor shall be submitted to
the City for review prior to issuance of building permits.
16. A plan for silt control for all storm runoff from the property
during construction and during initial operation of the facilities
shall be submitted to the Department of Public Works for review
and approval.
17. Upon completion of Phase I and prior to approval of Phase II, an
additional parking analysis shall be conducted. If the parking
analysis indicates parking demand in excess of the present supply,
then additional parking shall be a condition of Phase II and added
to the proposed parking structure. The parking structure shall be
constructed prior to issuance of building permits in Phase II.
18. A planned sign program for the entire complex, related to the

architectural theme, shall be submitted, reviewed and approved
by the Planning Commission.
19. Particular attention shall be paid to maintaining architectural
continuity throughout the project site and to minimizing the impact
of buildings near the site boundaries on surrounding properties.
20. The project shall conform in concept with the model presented at
the July 19, 1983 Planning Commission meeting.
21. All on and off -site utilities shall be installed underground.

Commissioner Schumacher requested that a time frame of July 26th be
placed on the request and amended the above -motion to include that

CONDITIONAL USE PERMIT NO. 83-3.6
Applicant: Calvary Chapel of Huntington Beach
A request to permit a church in an existing building on property located
on the north side of Talbert west of Brookshire Lane. Staff gave a
brief presentation.
The Chairman opened the public hearing. Steve Purdue, representing the
church, stated that many homeowners are members of the church and that
the church is needed in the community and wishes to establish a per-
manent residence. The present'situation is a rented building with the
children's Sunday school classes at a separate location. This, he said,
was not an ideal situation. Commissioner Schumacher asked if the plan
was to purchase the building. Mr. Purdue answered yes. Dick VaVerka,
the applicant, stated he did not agree with the staff's reason for
recommending denial,,that it was for purposes of preserving industrial
uses. He pointed out that the market continues to be "bad" and that,
in his opinion it was better to have occupied buildings rather than
vacant ones. His understanding of the code was that a church is a
permissible use in an industrial zone or a commercial zone. He did
not agree with one argument that the church was "invading" the tax base.
He felt that parking was adequate, however, if necessary, restriping
could add even more. Michael DeCoski said he was occupying Building A-5

which is near the subject site. He submitted a letter opposed to the
granting of the application and he went on to enumerate the items in
his letter. His business is a private shooting range and club and he
felt that the church group would not be condusive to his operation and
his clientelle. He said the hours of his business and the planned
church services do conflict. He further stated that his business did
add to the tax base in the City. The public hearing was closed.
Chairman Porter pointed out that the project was originally approved
for office use. Commissioner Schumacher stated that she would be in
favor of the application if it was a new building site, however, she
agreed that it would be an intruding use to the present occupants in
the surrounding industrial buildings. and would go along with staff's
recommendation for denial. Commissioner Erskine was concerned about
the neighboring gun business and agreed with denial.
ON MOTION BY SCHUMACHER AND SECOND BY MIRJAHANGIR CONDITIONAL USE PERMIT
NO. 83-16 WAS DENIED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE:

located on the east side of Beach Boulevard approximately 1,300 feet
south of Atlanta Avenue.
Bill Cooper from the Fire Department stated he was concerned about
the compact parking as "normal -sized" cars would still try to park
in the small stalls which could conceivably block the fire lanes.
The public hearing was opened. The applicant, Dan Young, stated he
believed he has come up with a better design that is more in keeping
with the beach atmosphere. He said he would be willing to comply
with any Fire Department requirement. Commissioner Schumacher was
concerned with the proposed color scheme. The applicant agreed to a
condition that the Planning Commission would look at a color scheme
before issuance of building permits. The public hearing was closed.

WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE

property. The interior noise levels of all dwelling units shall
not exceed the California insulation standards of 45 Dba CNEL.
Evidence of compliance shall consist of submittal of an acoustical
analysis report, prepared under the supervision of a person experi-
enced in the field of acoustical engineering, with the application
for building permits. All measures recommended to mitigate noise
to acceptable levels shall be incorporated into the design of the
project.
9. if lighting is included in the parking lot and/or recreation areas,
energy efficient lamps shall be used, such as high pressure sodium
vapor or metal halides. All outside lighting shall be directed to
prevent spillage onto adjacent properties.
10. A detailed soil analysis shall be prepared by a registered soils
engineer. This analysis shall include onsite soil samples and
laboratory testing of materials to provide detailed recommendations
regarding grading, chemical and fill properties, foundations and
retaining walls, streets and utilities.
11. All foil -type insulation is to be used. A fire retardant type
shall be installed as approved by the Building Department.
12. An engineering geologist shall be engaged to submit a report indi-
cating the ground surface accelleration from earth movement for
the subject property. All structures within this development shall
be constructed in compliance with the G-factors as indicated by the
geologist's report. Calculations for footings and structural members
to withstand anticipated G-factors shall be submitted to the City

for review prior to the issuance of building permits.
13. All buildings including the semi -subterranean parking structures,
shall be fire sprinklered and/or constructed in accordance with all
applicable fire prevention regulations and provisions as required
by the Huntington Beach Fire Department.
14. If at any time an entrance gate or gates are proposed for the ve-
hicular access roads, location and design shall be reviewed and
approved by the Department of Development Services and by the Fire
Department.
15. All approved drives shall be considered fire lanes and shall be
signed as such and designed to the approval of the Huntington Beach
Fire Department.
16. An approved fire alarm system shall be required in all buildings
with over 15 units.
17. On site fire hydrants required shall meet local specifications
and approval.
18. All exits on the recreation building shall be posted and provided
with panic hardware.
19. All sewer storm drain and water lines and connections shall be con-
structed per Public Works standards.
20. All median openings between the frontage road and Beach Boulevard
shall be 50 feet wide.
21. The applicant shall be required to provide and install traffic
control devices as required by the Department of Public Works.
22. The applicant shall be required to dedicate and/or exchange equal
amounts of roadway presently located on site to the City for the
property necessary to construct a frontage road and median strip
along the easterly edge of Beach Boulevard. If the frontage road
or any portion of said road cannot be constructed at the present
time, the developer shall sbumit to the City a bond for the full
cost of improving said frontage road.
23. The site plan shall also include provisions for landscaping along
the easterly property line. If the landscaping is located on the
Orange County Flood Control District's property, the applicant shall
submit proof of easement to the City prior to the issuance of a
building permit. The developer shall be required to install vinyl
coated, see -through fencing along the easterly property line adjacen
to the flood control channel and decorative fencing along the southe
ly property line. The masonry fencing on the northern boundary
shall be six (6) feet in height.
24. The proposed project shall comply with all provisions of Article

932 and any other applicable provisions of the Huntington Beach

25. A detailed landscape and irrigation plan shall be submitted to the

sified landscaping within the median adjacent to Beach Boulevard
and the front setback of the proposed project and in landscaped
planters within the drive corridors.
26. Prior to the issuance of building permits, the applicant shall
submit to the Army Corps of Engineers and the Department of Fish
and Wildlife, a plan for the establishment of the natural area
element located along the south property line of the proposed pro-
ject. Both agencies shall submit in writing to the City, certi-
fication and approval of said water element design and construction.
27. The proposed project shall comply with all floor plain development
regulations in effect at the time the building permits are issued
on the proposed project.
28. The applicant shall submit an exterior material scheme including
color and project type to the Director of Development Services
for review and approval prior to the issuance of building permits.

An amendment which would add Article 965 to the Huntington Beach Ordi-
nance Code and establish an SP-2 Special Zone (Pet Cemetery) that sets
forth standards for development of pet cemeteries.
Florence Webb explained that the code amendment was initiated at the
request of an individual who has a pet interred in the pet cemetery on
Beach Boulevard and requests the amendment to preserve the cemetery.
Staff was directed to restrict the application of the new proposed
zoning to a minimum size parcel.

Staff explained that Orange County omitted a plan for the Huntington
Beach portion of a horse trail running parallel with the beach from
Bolsa Chica Linear Park to the Santa Ana River. The City Council wants
this trail implemented and requested the Planning Commission to review
it before they submit it to the County. Commissioner Schumacher was
concerned that it only covered horse trails and nothing was mentioned
about bike or pedestrian trails. She also felt that because the various
equestrian groups in the City would be interested, that there should be
a public hearing held on the subject. She disagreed with the report on
the choices for street selection as Slater or Adams. She did not think
that either street was a good site. Mike Adams suggested a staging area.
