ROLL CALL Present: Kelly, MacAllister, Finley, Bailey, Mandic Pattinson (arrived 7:20 P.M.) Absent: Thomas ORDINANCES REQUIRED TO IMPLEMENT THE COASTAL ELEMENT The City Clerk presented a communication from the Development Services Director summarizing the code amendments required to implement the Coastal Element. Jeanine Frank, Associate Planner, presented a brief overview of Visitor Serving Commercial area near Peters Landing. Discussion was held regarding residential buildings behind Sam's Seafood and whether this ordinance would affect that area. It was suggested that boundaries be redrawn to exclude that area. The Conservation Element, Shoreline District, Water Recreation District and Coastal Zone Suffix were discussed. Discussion was held regarding the Coastal Deveopment Permit procedure. Absent: None PRESENTATION - "VOLUNTEER OF THE MONTH" FOR JULY - DAN KEEGAN Mayor MacAllister presented a plaque to Dan Keegan "Volunteer of the Month" for the month of July for his work on the Meadowlark Airport Board. PRESENTATION - "VOLUNTEER OF THE MONTH" FOR AUGUST - CHRIS PEOPLES The Mayor presented a plaque to Chris Peoples "Volunteer of the Month" for the month of August for his work in the Public Works Department. PROCLAMATION - OCTOBER - ESCROW MONTH Mayor MacAllister presented a plaque designating the month of October as "Escrow Month" to Beverly Hanon, member of Orange County Escrow Association. PROCLAMATION - OCTOBER - TOASTMASTERS COMMUNICATION MONTH Mayor MacAllister presented a plaque designating the month of October as "Toastmasters Communicaton Month" to Toastmaster Area Governor Don Huntley. CITY EMPLOYEE SUGGESTION AWARDS - MORRISON/GOMEZ/HAGEMAN/CLARK/CONROY/DONOHO Mayor MacAllister presented City Employee Suggestion Awards to the following people: Police Department - Gloria Morrison; Library - Mark Gomez, Beatrice Hageman and Mary Clark widow of employee Austin Clark; Personnel Department - Jeane Conroy and Shari Donoho, who were unable to be present. Page 2 - Council Minutes - 10/17/83 PROCLAMATION - 10/31 THROUGH 11/4 - UNITED WAY CAMPAIGN WEEK Mayor MacAllister presented a plaque designating October 31 through November 4, 1983 as "United Way Campaign Week" to Vivian Barns, Recreation & Human Services Superintendent and Charles Thompson, City Administrator. PRESENTATION - "1983 OUTSTANDING NATIONAL PUBLIC SERVICE AWARD" - ASSISTANT CITY ATTORNEY AMSBARY Mayor MacAllister extended recognition and congratulations from the City Council to Assistant City Attorney Bill Amsbary for receiving the National Institute of Municipal Law Officers distinguished service award for "1983 Outstanding National Public Service Award". PROCLAMATION - NOVEMBER - CHEMICAL PEOPLE MONTH Mayor MacAllister presented a plaque designating the month of November as "Chemical People Month" to Executive Director Kenneth Rhea from West County Counseling Center. YOUTH IN GOVERNMENT DAY - YOUTH BOARD The City Clerk presented a communication from the Director of Community Services transmitting a request from the Youth Board.of its proposal to plan and promote a "Youth in Government Day" involving high school students who are Huntington Beach residents. Representatives from the Youth Council presented a report to Council regarding the matter. On motion by MacAllister, second Finley, Council adopted the "Youth in Government Day" Agenda as submitted by the Youth Board and agreed to designate a date as presented by the Youth Board representative. The motion carried unanimously. ASCON LANDFILL - URGENCY ORD NO 2661 - ADOPTED - MORATORIUM EXTENSION The Mayor announced that this was the day and hour set for a public hearing to consider the extension of a forty-five day moratorium on the excavation of material from the Ascon Landfill adopted as an Urgency Ordinance expiring on November 3, 1983. The extension on the moratorium would be for a period not to exceed ten months and fifteen days, expiring on September 18, 1984 pursuant to Section 65858 of the Government Code. Said extension of the moratorium is necessary because of the potential threat to the public health and safety of residents living in the surrounding community from disturbance, excavation or removal of material on the site. Extension of the moratorium will enable the City to complete studies and ordinances designed specifically to protect the environment and population in the vicinity of the Ascon Landfill. Page 3 - Council Minutes - 10./17/83 The City Clerk announced that all legal requirements for publication and posting had been met, and that she had received no communications or written protests to the matter. The Mayor declared the hearing open. Beverly Titus urged Council support of the moratorium. Ron Titus urged Council support of the moratorium. Forrest Harrell urged Council support of the moratorium and questioned when it would be determined when the dump was full. There being no one present to speak further on the matter and there being no further protests filed, either oral or written, the hearing was closed by the Mayor. The City Clerk presented Urgency Ordinance 2661 for Council consideration - "AN INTERIM ORDINANCE OF THE CITY OF HUNTINGTON BEACH IMPOSING A TEN MONTH AND 15 DAY EXTENSION OF THE PRESENT MORATORIUM ON THE EXCAVATION OF MATERIAL, FROM THE ASCON LANDFILL." A motion was made by Finley, seconded by Pattinson, to adopt Urgency Ordinance No. 2661, after reading by title, by the following roll call vote: AYES: Pattinson, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: Thomas APPEAL TO PC CONDITIONS OF APPROVAL - CUP 83-20 - OKTOBERFEST - (CONTINUED OPEN TO 11/7 83) ' The Mayor announced that this was the day and hour set for a public hearing to consider an appeal filed by Josef Bischof to the Planning Commission's conditions of approval of Conditional Use Permit No. 83-20, a request to permit an Oktoberfest from mid -October to mid -November on property located north of Center Avenue, approximately 600 feet east of Gothard Street (7561 Center Avenue) within the North Huntington Centger Specific Plan District. Mayor MacAllister stated that the appellant was appealing the occupant load of 1450 imposed by the Planning Commission and is also appealing five conditions of approval imposed by the Planning Commission at the September 7, 1983 Commission meeting. The appellant had stated he would abide by the current conditions of approval for the 1983 Oktoberfest, but was appealing the occupant load and conditions of approval for future Oktoberfests. The City Clerk announced that all legal requirements for notification, publication and posting had been met, and that she had received a communication from Mr. Bischof dated October 17, 1983 requesting postponement of the hearing. The Mayor declared the hearing open. PUBLIC HEARING - CODE AMENDMENT 83-19 - APPROVED - VISITOR SERVING COMMEERCIAL ZONING DISTRICT - ORD NO 2656 - INTRODUCTION APPROVED The Mayor announced that this was the day and hour set for a public hearing to consider Code Amendment No. 83-19, an amendment to the Huntington Beach Ordinance Code adding Article 949 which creates a visitor -serving commercial zoning district within the Huntington Beach Ordinance Code. The City Clerk announced that all legal requirements for publication and posting had been met, and that she had received no commnuniatons or written protests to the matter. Jeanine Frank, Associate Planner, presented a staff report, including viewgraphs, regarding the matter. The Mayor declared the hearing open. There being no one present to speak on the matter and there being no protests filed, either oral or written, the hearing was closed by the Mayor. . The City Clerk presented Ordinance No. 2656 for Council consideration - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING A NEW ARTICLE 949 PERTAINING TO VISITOR SERVING COMMERCIAL DISTRICT." On motion by Finley, second Kelly, Council approved Code Amendment 83-19 and, after reading by title, approved introduction of Ordinance No. 2656 by the following roll call vote: AYES: Pattinson, Thomas, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: None Councilman Pattinson left the coon. PUBLIC HEARING - CODE AMENDMENT 83-21 - APPROVED - ORD NO 2657 - INTRODUCTION APPROVED - COASTAL CONSERVATION DISTRICT The Mayor announced that this was the day and hour set for a public hearing to consider Code Amendment No. 83-21, an amendment to the Huntington Beach Ordinance Code adding Article 969.7 which would create a Coastal Conservation District for the protection of wetlands and environmentally sensitive areas. The City Clerk presented Ordinance No. 2657 for Council consideration - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING A NEW ARTICLE 969.7 PERTAINING TO COASTAL CONSERVATION DISTRICT." On motion by Bailey, second Finley, Council approved Code Amendnemnt 83--21 and, after reading by title, approved introduction of Ordinance No. 2657 by the following roll call vote: AYES: Thomas, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: Pattinson (out of the room) Councilman Pattinson returned to the room. PUBLIC HEARING - CODE AMENDMENT 83-22.- APPROVED - ORD NO 2658 - INTRODUCTION APPROVED - SHORELINE DISTRICT The Mayor announced that this was the day and hour set for a public hearing to consider Code Amendment No. 83-22, an amendment to the Huntington Beach Ordinance Code which would repeal Article 965 and replace it with a new Article 965 entitled Shoreline District. Said Article would establish regulations for the protection and enhancement of beaches within the City. The City Clerk announced that all legal requirements for publication and posting had been met, and that she had received no communications or written protests to the matter. Jeanine'Frank, Associate Planner, presented a staff report, including viewgraphs, regarding the matter. The Mayor declared the hearing open. There being no one present to speak on the matter and there being no protests filed, either oral or written, the hearing was closed by the Mayor. On motion by Kelly, second Bailey, Council approved Code Amendment 83-22 and, after reading by title, approved introduction of Ordinance No. 2658 by the following roll call vote: 4 Page 6 - Council Minutes - 10/17/83 AYES: Pattinson, Thomas, Kelly,.MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: None PUBLIC HEARING - CODE AMENDMENT 83-23 - APPROVED - ORD NO 2659 - INTRODUCTION APPROVED - WATER RECREATION DISTRICT The Mayor announced that this was.the day and hour set for a public hearing to consider Code Amendment No. 83-23, an amendment to the Huntington Beach Ordinance Code adding Article 969.8 entitled Water Recreation District. Said Article regulates permitted uses and activities below the mean high tide line within the City. The City Clerk announced that all legal_ requirements for publication and posting had been met, and that she had received no communications or written protests to the matter. Jeanine Frank, Associate Planner, presented a staff report,.including viewgraphs, regarding the matter. The Mayor declared the hearing open. The City Clerk presented Ordinance No. 2659 for Council consideration - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING A NEW ARTICLE 969.8 PERTAINING TO WATER RECREATION DISTRICT." On motion by Pattinson, second Kelly, Council approved Code Amendment 83-23 and, after reading by title, approved introduction of Ordinance No. 2659 by the following roll call vote: AYES: Pattinson, NOES: None ABSENT: None Thomas, Kelly, MacAllister,. Finley, Bailey,.Mandic PUBLIC HEARING - CODE AMENDMENT 83-26 - APPROVED - ORD NO 2660 - INTRODUCTION APPROVED - COASTAL ZONE SUFFIX The Mayor announced that this was the day and hour set for a public hearing to consider Code Amendment No. 83-26, an amendment to the Huntington Beach Ordinance Code adding Article 969.9 which would create a Coastal Zone Suffix which would be attached to all districts within the coastal zone with the exception of the Downtown Specific Plan. Code Amendment No. 83-26 addresses certain State and City costal concerns and is the triggering mechanism for the Coastal Development Permit. The City Clerk announced that all legal requirements for publication and posting had been met, and that she had received no communications or written protests to the matter. The City Clerk presented Ordinance No. 2660 for Council consideration "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING A NEW ARTICLE 969.9 PERTAINING TO COASTAL ZONE SUFFIX." On motion by Kelly, second Bailey, Council approved Code Amendment 83-26 and, after reading by title, approved introduction of Ordinance No. 2660 by the following roll call vote: AYES: Pattinson, Thomas, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: None PUBLIC HEARING - CODE AMENDMENT 83-27 - APPROVED - ORD NO 2655 - INTRODUCTION APPROVED.- COASTAL DEVEOPMENT PERMIT The Mayor announced that this was the day and hour set for a public hearing to consider Code Amendment No. 83-27, an amendment to the Huntington Beach Ordinance Code adding Article 989.5 which would create a Coastal Development Permit. Code Amendment No. 83027 encompasses the local administrative aspects required by State law or regulation for all areas within the Coastal Zone. The City Clerk announced that all legal requirements for publication and posting had been met, and that she had received no communications or written protests to the matter. Jeanine Frank, Associate Planner, presented a staff report including viewgraphs regarding the matter. The Mayor declared the hearing open. The City Clerk presented Ordinance No. 2655 for Council consideration - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING A NEW ARTICLE 989.5 PERTAINING TO COASTAL DEVELOPMENT PERMIT." On motin by Pattinson, second Mandic, Council approved Code Amendment 83-27, and after reading by title, approved introduction of Ordinance No. 2655 by the following roll call vote: AYES: Pattinson, Thomas, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: None I PUBLIC HEARING - CONTINUED OPEN TO 11/7/83 - RESUBMITTAL OF FINAL PARCEL MAP 83-551 - BOBBY CORNELIUS The Mayor announced that this was the day and hour set for a public hearing to consider resubmittal of Final Parcel Map No. 83-551. Final Parcel Map No. 4 Page 8 - Council Minutes - 10/17/83 83-551 consolidates three (3) parcels comprising approximately 0.210 acres of property into two (2) parcels, said property being located north of Los Patos Avenue between Lynn and Green Streets in the R1 (Low Density Residential District). The City Clerk announced that all legal requirements for notification, publication and posting had been met, and that she had received no communications or written protests to the matter. On motion by Finley, second Kelly, Council continued the public hearing open to November 7, 1983 by the following roll call vote: AYES: Pattinson, Thomas, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: None PUBLIC HEARING - REQUEST FOR RATE INCREASE - APPROVED - SEAL'S AMBULANCE SERVICE - RES NO 5316 The Mayor announced that this was .the day and hour set for a public hearing to consider a request from Seal's Ambulance Service for permission to increase their service rates pusuant to S. 5.20.090 of the Huntington Beach Municipal Code. The City Clerk annoucced that all legal requirements for publication and posting had been met, and that she had received no communications or written protests to the matter. The Mayor declared the hearing open. There being no one present to speak on the matter and there being no protests filed,either.oral or written, the hearing was closed by the Mayor. The City Clerk presented Resolution No. 5316 for Council consideration - "A RESOLUTION OF THE CITY OF HUNTINGTON BEACH COVERING RULES AND RATES PERTAINING TO AMBULANCE SERVICE WITHIN THE CITY OF HUNTINGTON'BEACH, AND REPEALING RESOLUTION NO. 4659." Councilman. Kelly pointed out a typographical error regarding Section 2 (c) Night Call: "...when between 7 a.m. and 7 p.m." should read "when betweeen 7 p.m. and 7 a.m." Discussion was held as to when the rates were last changed. On motion by Kelly, second MacAllister, Council approved the request of Seal's Ambulance Service for permission to increase their service rates prusuant to S. 5.20.090 of the Huntington Beach Municpal Code and adopted Resolution No. 5316 by the following roll call vote: AYES: Pattinson, Thomas, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: None Page 9 - Council Minutes - 10/17/83 PUBLIC COMMENTS No one came forward to speak. RES NO 5311 - ADOPTED -- SALARY OF BUSINESS LICENSE MANAGER S CITY TREASURER The City Clerk presented a communication from the Directorof Finance of Resolution No. 5311 - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING THE COMPENSATION FOR THE CITY TREASURER AT $588 AND THE BUSINESS LICENSE MANAGER AT $3,087 AND FURTHER CONSOLIDATING BOTH FUNCTIONS UNDER THE CITY TREASURER." The City Administrator presented a staff report regarding the matter. On motion by Pattinson, second Kelly, Council adopted Resolution No. 5311 by the following roll call vote: AYES: Pattinson, Thomas, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None ABSENT: None ORDINANCE_NO 2644 - LARGE VEHICLE PARKING ORDINANCE - CONTINUED TO 11/7/83 The City Clerk presented a communication from the Department of Public Works transmitting Ordinance No. 2644 regulating parking of oversize vehicles on arterial highways. Following discussion, a motion was made by Kelly, seconded by Thomas, to continue consideration of Ordinance No. 2644 to November 7, 1983 and directed staff to amend the ordinance to include provisions for emergency stops for a certain length of time. The motion carried by the following roll call vote: AYES: Pattinson, Thomas, Kelly, MacAllister, Finley, Bailey NOES: None ABSTAIN: Mandic ABSENT: None CONSENT CALENDAR - (ITEMS APPROVED) On motion by Pattinson, second Kelly, Council approved the following items, as recommended, by the following roll call vote: AYES: Pattinson, Kelly, MacAllister, Finley, Bailey, Mandic NOES: None NOT VOTING: Thomas ABSENT: None BID RESULTS - RECONSTRUCTION OF BDLSA CHICA STATE BEACH BIKE TRAIL - CC-609 - REAPPROPRIATION - CALIFORNIA LIVING - Accepted the low bid of California Living in..the amount of $18,967.50 for the reconstruction of the Bolsa Chica State Beach bike trail, hold bid bonds on the lowest three bidders until execution of contract and filing of. bonds and directed the City Clerk to 92 Page 10 - Council Minutes - 10/17/83 notify the unsuccessful bidders and return their bids bonds, and further, authorized the reappropriation of $15,800 remaining in City. Account #893521 to the Project Account #893635. The bids were as follows: California Living Wakeham Contruction Sully -Miller $18,967.50 $19,787..50 . $21,467.00. GOTHARD/TALBERT STORM DRAIN & SEWER IMPROVEMENTS - CC-651 CONSULTANT AGREEMENT - HALL &.FOREMAN, INC - Approved the selection of Hall & Foreman, Inc., to prepare plans, specifications and cost estimates for the construction of sewer and strom drain improvements in the Gothard/Talbert area, established a design budget of $7,200 to include consultant agreement and miscellaneous.costs and authorized the Mayor and City Clerk to execute the appropriate consultant agreement., PARCEL MAP 83-561 -PRINCELAND LPOPERTIES - Approved final parcel map pursuant to the mandatory findings and conditions set forth by the Board of Zoning Adjustments on..prop.erty located.on the east side of Gothard Street, south of Heil Avenue and instructed the City Clerk to release for processing by the County. PARCEL MAP 83-562 - HUNTINGTON BEACH COMPANY - Approved final parcel map and accepted offer of dedication pursuant to the manda-tory findings set.fo.rth by the Board of Zoning.Adjustments on property located southeast of Main Street and Clay Avenue and instructed the Cty Clerk to release for processing by the County. YORKTOWN AVE IMPROVEMENTS/MEDIAN ISLAND MODIFICATIONS ON BROOKHURST & CONTINENTAL - NOTICE OF COMPLETION.. CC-567 - Accepted work completed by Nobest, Inc. on the construction of street improvements along the north side of .Yorktown Avenue between Huntington.and Delaware Streets,.and median island modifications on Brookhurst Street .at.Continental.Drive, for a total amount of $38,328.82 and authorized the Clerk to file a Notice of Completion. REPLACEMENT. TRAFFIC.SIGNAL CONTROLLERS•- PLANS &:SPECIFICATIONS/CALL FOR BIDS - CC-666 - Aprpoved plans and specifications and authorized the call for bids for the replacement of traffic signal controllers, cabinets and hardware at the intersectons of Main/Yorktown, Main/1.7th/Utica, Gothard/Center and Springdale/Marina High School. RESOLUTION NO 5315 - ADOPTED - APPLICATION - SB 821 GRANT FUNDING - SANTA ANA RIVER TRAIL_ AT ADAMS AVE - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REQUESTING THE BOARD OF SUPERVISORS TO AUTHORIZE THE DIRECTOR, EMA, TO FILE APPLICATION FOR SB 821 GRANT FUNDING FOR THE SANTA ANA RIVER TRAIL AT ADAMS AVENUE." ENVIRONMENTAL BOARD APPOINTEES - HEKIMIAN/ZEIGER - Approved appointments of Kenneth Hekimian and David Zeiger to the Environmental Board for four year terms to expire June 30, 1987. BLUFF TOP LANDSCAPING PROJECT - PHASE II - CC-597 -- CONSULTANT AGREEMENT - DESIGN BUDGET - CONTINUED TO 11 7 83 The City Clerk presented a communication from the Director of Public Works regarding proposals from qualified architectural landscaping firms to prepare plans, specifications and cost estimates for stabilizing the bluffs along Pacific Coast Highway between -Eleventh and Goldenwest Streets. A motion was made by Bailey, seconded by Finley, to continue the matter to November 7, 1983 and directed staff to present backup material to clarify the proposal. DOWNTOWN PARKING METERS TO BE COVERED - CHRISTMAS PARKING On motion by Bailey, second MacAllister, domes over parking meters in the downtown Christmas shoppers. DRAINAGE - ADAMS/BEACH Council directed staff to place glass area to provide free parking for Councilwoman Bailey stated her concern regarding drainage at the Mola Project located.at Adams Avenue and Beach Boulevard. The matter was referred to staff. DRAINAGE ATLANTA/BEACH Councilwoman Finley stated her concern regarding potential drainage problems at Atlanta Avenue and Beach Boulevard at the Breakers project. ORDINANCE NO 2644 - TRUCK PARKING - REFERRED TO STAFF Councilman Thomas suggested that Ordinance No. 2644 be amendment to allow temporary parking for trucks at commercial establishments such as donut shops.
