BOARD MEMBERS PRESENT: Godfrey, Evans, Smith, Poe BOARD MEMBER ABSENT: Vogelsang STAFF MEMBER PRESENT: Zelefsky MINUTES: ON MOTION BY GODFREY AND SECOND BY SMITH, THE MINUTES OF THE REGULAR MEETING OF OCTOBER 5, 1983, WERE APPROVED AS REVISED, BY THE FOLLOWING VOTE: Acting Chairman Evans informed the Board that in the minutes of October 5, 1983, on Page 4, within the Request for Amendment and Reconsideration of C.E. #83-28, in conjunction with U.P. #83-39, (Applicants - John Kavanagh and Mike Whitney) which has been appealed, it was not his intention to have a traffic study performed and requested that same be deleted from the minutes. He felt the site was just not large enough to accommodate the auto repair service in addition to the auto Tube building. AYES: Godfrey, Smith, Evans, Poe NOES: None ABSTAIN: None ABSENT: Vogelsang REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 83-68 Applicants: Drs. Robert Maurer/Winston Cheshire c/o Wayne Penny, A.I.A. To permit joint use of existing parking within an existing shopping center. Subject property is located on the east side of Beach Boulevard approximately 300 feet south of Ellis Avenue (within the Town and Country Shopping Center at 18582 Beach Blvd.). Present zoning is C-4 - Highway Commercial District. Minutes: H.B. Board of Zoning Adjustments October 26, 1983 y Page Two Acting Chairman Evans introduced the applicants proposal and stated that this request is Categorically Exempt per Section 15101, Class. 5, of the California Environmental Quality Act, 1970. Staff informed all concerned that the Board may grant through the application process a reduction in the total number of required off-street parking spaces, when it can be shown that the parking facilities have divergent needs on the basis of non-use by one user during a period of use by another. The basis of use versus non-use must be in relation to nightime versus daytime hours or weekdays in relation to weekend needs. The applicants wish to occupy within the shopping center 2,500 square feet of vacant space of what was originally retail space for a medical use. Mr. Zelefsky further stated that a letter of justification was received from the applicants wherein parking ratios were outlined show- ing available/required parking for the total site at 272 spaces. Staff's calculations revealed that 307 parking spaces for the total site are required; a difference of-35 parking spaces short in lieu of six (6) thought to be short by the applicants. It was determined that the applicants had based their calculations on Ichabod's Bar use as "general retail" rather than "restaurant use". The proposed medical facility requires 14 parking spaces. Board discussion ensued. Based on a field inspection, it was stated that the existing landscaping for the site is deficient felt to be caused by lack of maintenance. Board Member Smith suggested that if the application was approved a condition should be imposed that the new tenants refurbish the land- scape planter and irrigation system located to the west of the proposed suite (No. 101) on Beach Boulevard. Mr. Wayne Penny, A.I.A. for the project, agreed with the Board stating he felt that by improving the surrounding aesthetics, it would be beneficial to the medical facility. Mr. Penny was informed that the rooftop sign and free standing revolving sign on the site were nonconforming requiring upgrading. The require- ments of the Sign Code and amortization schedule were discussed. ON MOTION BY SMITH AND SECOND BY GODFREY, THE BOARD HAVING TAKEN INTO CONSIDERATION THE FACT THAT ICHABOD'S BAR HAS ONLY AN EVENING OCCUPANCY, GRANTED ADMINISTRATIVE REVIEW NO. 83-68, WITH CONDITIONS OF APPROVAL FOLLOWING, SUCCEEDED BY VOTE: CONDITIONS OF APPROVAL: The site plan and elevations dated October 12, 1983, shall be the approved layout, subject to the following: 1. The applicant shall comply with Article 976 of the Huntington Beach Ordinance Code or comply with nonconforming sign amort- ization schedule. -2- BZA 10/26/83 Minutes: H.B. The landscape planter located to the west of the applicants building on Beach Boulevard (adjacent to parking area) shall be refurbished by the applicants prior to issuance of a Certificate of Occupancy. 3. Prior to issuance of building permits, all interior and exterior alterations to the structure, in addition to exterior architectural treatment, shall be reviewed and approved by the Secretary of the Board. All Fire and Building Code requirements shall be met. AYES: Godfrey, Smith, Evans, Poe NOES: None ABSTAIN: None ABSENT: Vogelsang TENTATIVE PARCEL MAP NO. 83-578 (WAIVER) Applicant: Paul F. Darden To permit waiver of a parcel map for the consolidation of two (2) 30-foot lots into one (1) lot. Property located at 808 Geneva. Acting Chairman Evans introduced the proposal and stated that this request is categorically exempt per Section 15115, Class. 15, of the California Environmental Quality Act, 1970. Secretary Godfrey outlined the procedure permitting a waiver of a parcel map for a minor lot consolidation. He explained that under Article 992 of the City's Subdivision Ordinance, a parcel map may be waived, providing that a finding is made by the Board of Zoning Adjustments, on appeal, by the City Council, that the proposed lot consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection and other requirements of the Subdivision Map Act. A review of the applicant's plat map disclosed alley dedica- tion was accepted by the City and that all applicable improvements were evident on the plat map. The procedure for filing a Certificate of Compliance (accompanied by a plat map) with the Orange County Recorder's Office was explained to Mr. Darden. ON MOTION BY EVANS AND SECOND BY SMITH, A WAIVER OF THE PARCEL MAP FOR TENTATIVE PARCEL MAP NO. 83-578 WAS APPROVED WITH FINDINGS AND CONDITIONS OF APPROVAL FOLLOWING, SUCCEEDED BY VOTE: -3- BZA 10/26/83 Minutes: H.B. Board of Zoning Adjustments October 26, 1983 Page Four FINDING: The Board of Zoning Adjustments has found that the proposed lot con- solidation complies with Article 992 of the Huntington Beach Ordinance Code and Section 66428 of the Subdivision Map Act allowing the waiver of a final parcel map. CONDITION OF APPROVAL: The applicant shall file with the County Recorder's Office a Certifi- cate of Compliance in conjunction with the approved plat map. Said documents shall be filed with the Department of Development Services prior to issuance of building permits. AYES: Godfrey, Evans, Smith, Poe NOES: None ABSTAIN: None ABSENT: Vogelsang USE PERMIT NO. 83-61 Applicant: Downtown Merchants Guild To permit a temporary "outdoor event". Staff informed the Board that a children's Halloween party is being proposed by the Guild on October 30, 1983, between 1:00 - 3:00 p.m. Further, that the applicant has received permission for use of the City -owned property at the corner of Main Street and Orange Avenue for the event. Conditions for approval were discussed. ON MOTION BY EVANS AND SECOND BY SMITH, USE PERMIT NO. 83-61 WAS CONDITIONALLY GRANTED, WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL PRIOR TO ISSUANCE OF PERMIT: 1. The location of the showmobile shall be to the satisfaction of the Fire Department., 2. An electrical permit shall be obtained. An on -site inspection approving electrical hook-ups shall be made by the Fire Depart- ment. 3. A certificate of insurance form shall be filed in the Administrativ Services Department, in an amount deemed necessary by the Public Liability Claims Coordinator, along with a Hold Harmless Agreement executed by insured, prior to the event. -4- BZA 10/26/83 Minutes: H.B.
