BOARD MEMBERS PRESENT: Godfrey, Evans, Smith, Vincent BOARD MEMBER ABSENT: Vogelsang STAFF MEMBER PRESENT: Pierce REGULAR AGENDA ITEMS: USE PERMIT NO. 83-60 (Con't. from Nov. 23, 1983 Meeting) Applicant: Mc Donald"s Corporation To permit a drive-thru addition to an existing Mc Donald's Restaurant. Location is at-16866 Beach Boulevard (east side of Beach Boulevard approximately 300 feet north of Warner Avenue). Secretary Godfrey informed the Board Members that the applicant has requested a one (1) week continuance to allow additional time to revise his plan. ON MOTION BY SMITH AND SECOND BY VINCENT, USE PERMIT NO. 83-60 WAS CONTINUED ONE WEEK, TO THE DECEMBER 14, 1983 MEETING, BY THE FOLLOWING VOTE: AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None USE PERMIT NO. 83-63 Applicant: Mr. Joseph ,Imbrogulio To permit an 1,100 square foot addition to an existing commercial building. Subject property is located on the northeast corner of Terry Drive and Beach Boulevard. Minutes: H.B. Board of Zoning Adjustments December 7, 1983 Page Two Plans for an addition of two restrooms, an office and storage area for lay aways to the existing retail building were reviewed by the Board Members. Staff's suggested findings and conditions for approval were outlined by Secretary Godfrey. The public hearing was opened by Acting Chairman Evans. Mr. Joseph Imbrogulio introduced himself to the Board and stated that he did not concur with the suggested condition that a portion of the parking lot be restriped where fading as revealed in the field check. He felt that as his use required only forty (40) of the 462 required parking spaces for the center (496 spaces provided), as a new tenant he should not be penalized for his landlord's responsibility of main- tenance. It was agreed by the Board that Land Use should be informed of this situation. Member Godfrey announced that it was proper for the Boar to ex act conditi ns of t�js sort at time of entitlement; in pro- ortio to a size o to new a ition. There being no one else present to speak in favor or opposition of the applicant's proposal, the public hearing was closed. The necessity for fire sprinklering of the addition was explained to Mr. Imbrogulio. ON MOTION BY SMITH AND SECOND BY EVANS, USE PERMIT NO. 83-63 WAS GRANTED WITH FINDINGS, CONDITIONS OF APPROVAL AND VOTE FOLLOWING: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan, floor plan, and elevations received and dated November 14, 1983, shall be the approved layout. 2. Proposed 1,100 sq. ft. addition shall be sprinklered. Board of Zoning Adjustments December 7, 1983 Page Three USE PERMIT NO. 83-64 Applicant: Mordigan Trees To permit the wholesale distribution of growing plants and nursery stock used in landscaping activity. Subject location is at 21982 Brookhurst Street. Acting Chairman Evans introduced the applicaht's proposal and stated that per Section 15101 of the California Environmental Quality Act this request is categorically exempt - Class. 1. Secretary Godfrey stated that wholesale distribution of growing plants and nursery stock used in landscaping activity is allowed in a RA-0 Zone subject to approval of a Use Permit application for one (1) year. Extensions of the original permit may be given for one (1) year periods with four (4) such extensions being the maximum time allowed per permit. Staff's suggested conditions for approval were outlined for the Board's consideration. Acting Chairman Evans opened the public hearing. Mr. Richard Mordigan addressed the Board. He informed the Board that he has a five (5) year lease with the Orange County Sanitation District. Conditions for approval were discussed with the applicant. As property to the north of the site is zoned R-3 and R-1 to the west; emphasis was placed on the location of the trees, use of chemicals for spraying, and hours of operation allowing consideration to the neighboring properties. Mr. Mordigan stated he is watched closely by the Orange County Agricultural Commissioner's Office. He mentioned he had talked to many of the neighbors who expressed they are in favor of the trees fronting on Brookhurst felt to enhance the area. The public hearing was closed. ON MOTION BY SMITH AND SECOND BY VINCENT, USE PERMIT NO. 83-64 WAS GRANTED WITH FINDINGS AND CONDITIONS OF APPROVAL FOLLOWING, SUCCEEDED BY VOTE: FINDINGS FOR APPROVAL: 1. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS FOR APPROVAL: 1. The conceptual site plan received and dated November 28, 1983, shall be the approved layout. 2. Lower growing trees and shrubs only shall be permitted adjacent to residential property to the north, and plant material shall not exceed seven (7) feet in height. 3. All soil amendments or planting mix shall be kept damp as to not blow onto adjacent properties. All such material shall not be stacked over a height of ten (10) feet and shall not be located within 150 feet of residential properties. 4. Spraying of plant materials shall be done inwardly, away from residential properties. "Chemical spraying" shall be held to a minimum and used only on an as -needed basis. Spraying shall be done in such a manner to prevent the chemicals from being carried into the residential areas north and west of the subject property. 5. There shall be no activity, including maintenance and selling, between the hours of 8:00 p.m. and 8:00 a.m. 6. Outside telephones, alarms, intercoms, loudspeakers, etc. are prohibited. 7. Any yard lighting proposed shall be directed away from adjacent residential properties. 8. Any proposed signing shall conform to Article 976 of the Huntington Beach Ordinance Code. 9. The proposed mobile office and steel building shall be issued building permits. 10. Driveway approach and necessary asphalt paving transitions shall be to the satisfaction and specifications of the Public Works Department. -4- BZA 12/7/83 Minutes: H.B. Board of Zoning Adjustments December 7, 1983 Page Five 11. Placement of access gate shall be to the satisfaction of Public Works and the Fire Department. 12. No retail activity shall take place on the property. 13. All flammable liquids, handling and storage to comply with Article 79 of the Huntington Beach Fire Code. 14. Prior to any underground fuel tank installation, a permit must be obtained from the Fire Department. 15. All pesticide storage to comply with Article 86 of the Huntington Beach Fire Code. 16. Fire extinguishers to be required to comply with National Fire Protection Association (NFPA) Standard 10. NOTE: Section 9601.4.1, of the Huntington Beach Ordinance Code, provides that the Board may approve the permit for one (1) year. Extensions may be given for one (1) year periods not to exceed a maximum of four (4) extensions. Such extensions are to be requested in writing, accompanied by the established fee, and submitted 30 days prior to expiration. AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None ADMINISTRATIVE REVIEW NO. 83-79 Applicant: Mr. Frank W. Owen To permit a 7,800 + square foot Industrial Building to be located at 17911 Sampson Circle. Acting Chairman Evans stated that this request per Section 15103 of the California Environmental Quality Act of 1970, is categorically exempt - Class. 3. Staff's suggested conditions of.approval were outlined to all concerned by Secretary Godfrey. Mr. Art Armijo was present representing the property owner. He explained the reason for two individual warehouses, As they have two (2) product lines the smaller warehouse will be used for testing of equipment and the larger warehouse will be used for storage of component parts. There will be no manufacturing or use of chemicals. Mr. Armijo was informed that should the use become more intensified (manufacturing), on -site parking would not be adequate. -5- BZA 12/7/83 Minutes: H.B. Board of Zoning Adjustments December 7, 1983 Page Six Twenty (20) parking spaces were provided with nineteen (19) required. As the Board Members had concern with the location of the trash bin as shown on the applicant's plan, it was agreed that on his revised plan same would be shown as enclosed and relocated to the additional parking space allowing improved access. ON MOTION BY EVANS AND SECOND BY GODFREY, ADMINISTRATIVE REVIEW NO. 83-79 WAS GRANTED WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: 1. The conceptual plot plan, floor plan and elevations received and dated November 22, 1983, shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit to the Department'of Development Services the following plans: (a) Landscape and irrigation plans complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. (b) A rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and delineate the type of material proposed to screen said equipment. 3. Maximum separation between building wall and property line shall not exceed two inches. 4. All unusable spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. If lighting is included in the parking lot area, energy efficient lamps shall be used (e.g. high presssure sodium vapor, metal hilide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 6. Low volume heads shall be used on all spigots and water faucets. 7. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties,foundations, retaining walls, streets and shall be reviewed by the Department of Development Services prior to issuance of building permit. 8. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. -6- BZA 12/7/83 Minutes: H.B. Board of Zoning Adjustments December 7, 1983 Page Seven 9. Development shall meet all applicable provisions of the Huntington Beach Fire Code, Ordinance Code and Uniform Building Code. 10. The driveway approach shall be a minimum of twenty-seven (27) ft. in width and shall be of radius type construction. 11. Any proposed signing shall conform to Article 976 of the Huntington Beach Ordinance Code. 12. The revised plot plan shall reflect enclosure of the trash container(s). AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None TENTATIVE PARCEL MAP NO. 83-570(W) Applicant: William R. Green To permit a waiver of parcel map. Property located at 617 and 619 - 13th Street (100 ft. south of Palm). Acting Chairman Evans introduced the request and stated that under the California Environmental Quality Act of 1970, this request is categorically exempt - Class. 15. A'review of the applicant's plat map disclosed alley dedication was accepted by the City and that all applicable improvements were evident on the plat map. The procedure for filing a Certificate of Compliance (accompanied by a plat map) with the Orange County Recorder's Office was explained to Mr. Green. ON MOTION BY SMITH AND SECOND BY EVANS, WAIVER OF TENTATIVE PARCEL MAP NO. 83-570(W) WAS GRANTED WITH FINDING, CONDITIONS OF APPROVAL FOLLOWING, SUCCEEDED BY VOTE: FINDING FOR APPROVAL: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision section of the Ordinance Code. CONDITIONS OF APPROVAL: 1. The tentative parcel map received by the Department of Development Services on November 23, 1983, shall be the approved layout. -7- BZA 12/7/83 Minutes: H.B. The applicant shall file, through the Huntington Beach City Clerk's Office, and have recorded with the Orange County Recorder's Office, a certificate of compliance in conjunction with the approved plat map. A copy of the recorded certificate of compliance and plat map shall be filed with the Department of Development Services prior to issuance of building permits on the subject property. AYES: Godfrey, NOES: None ABSTAIN: None MISCELLANEOUS ITEM: USE PERMIT NO. 81-48 Applicant: Mark Chi Evans, Smith, Vincent Additional One -Year Extension of Time from 1/20/84 through 1/20/85. Construction of a ten (10) unit apartment complex to be located at 17682 Cameron Street (west side of street). Secretary Godfrey informed the Board Members that a letter was received from Mr. Chi, A.I.A. for the project, requesting a one-year continuance. A previous extension commencing on January.20, 1983 through January 20, 1984 was granted to the applicant justified by difficulties encountered while having his working drawings prepared. The owner is presently arranging for a construction loan which will not be processed before his Use Permit expires. S. ON MOTION BY VINCENT AND SECOND BY GODFREY, AN ADDITIONAL ONE-YEAR EXTEN- SION OF TIME WAS GRANTED FROM 1/20/84 THROUGH 1/20/85, WITH AN ADDITIONAL CONDITION OF APPROVAL IMPOSED THAT CURRENT PARK AND RECREATION FEES WILL APPLY, BY THE FOLLOWING VOTE: AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None 11 THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED TO THE DECEMBER 11, 1983, STUDY SESSION AT 10:00 A.M.
