Applicant: Mr. William Mitchell
To permit,an existing office and hotel. Subject property is located
at 307 Main:Street.
Chairman Smith introduced the applicant.'s request and stated that this
request is categorically exempt, Class. 1 under the Califonria Environ-
mental Quality Act of 1970.
Secretary Godfrey reiterated the reason for continuance of Administrative
Review No. 83-73 from the Board Meeting of January 4, 1984; a request
'to,reinstitute the second floor of a building back to temporary use
'as a hotel for a maximum period of three (3) years. The subject property
is located in District 5 of the Downtown Specific Plan. As the applicant
was not present at the meeting of January 41 1984, it was felt he should
be afforded another opportunity to be present to hear concerns of the
Board with regard to seismic safety and be able to respond to the
condition to be imposed that the hotel, prior to issuance of a certificate
of occupancy, comply with all local and State Fire Codes.
Secretary Godfrey further stated that when the "Notice of Hazard"
classification was issued on -the building by the City, the building

was inspected subject to Chapter 17.16 and was classified as an excessive
hazard. This Chapter states that all buildings classified as an
excessive hazard shall be improved or removed within one (1) year after
date of certification of the City's Coastal Plan.
The applicant was not present. Discussion ensued. It was felt that
the Condition that the complete building meet the Fire Codes would
satisfy concerns for safety to the public.
ON MOTION BY EVANS AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW
NO. 83-73 WAS GRANTED WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING:
CONDITIONS OF APPROVAL:
1. The approval of A.R. No. 83-73 is to be viewed as a temporary use
of property for a maximum of three (3) years or until one year
after certification of the City's local coastal plan, whichever
occurs first.
2. During this approval period, the building shall be retrofitted
to satisfy seismic safety requirements and convert by Use Permit
to a permitted use of District 5 of the Downtown Specific Plan.
3. The applicant's participation agreement for future parking dated
October 18, 1983, shall become a part of this approval.
4. Prior to expiration of this approval, the second floor shall be
brought into Building Code compliance.
5. Prior to issuance of a Certificate of Occupancy, the entire
building shall comply with the Fire Code.

NEGATIVE DECLARATION NO. 83-50 AND
ADMINISTRATIVE REVIEW NO. 83-82
Applicant: Mr. Ronald. 'Sher
To permit the renovation of exterior facades of existing buildings,
the addition of 33,080 sq. ft. of new retail space, up -grading of
parking and landscaping and joint use of parking spaces. Subject
property is located at 18500 - 18700 Main Street.
Chairman Smith introduced the applicant's request with I4ir. Sher present
to speak in favor of his proposal.

Secretary Godfrey outlined the applicant's request and stated that
the plan submitted was reviewed by staff who are in support of
modernization to the shopping center. The elevations and architecture,
as submitted are very good which will upgrade the area in addition to
the new shopping center previously approved across the street with
construction starting shortly. The parking has been analyzed which
appears toineet the parking requirements with the possibility of some
joint use agreements if necessary.
Mr. Godfrey cited a problem with the parking layout with the possibility of
a conflict of traffic in the driveway throat which has been addressed
to the applicant and his architect. Additional landscaping is to be
provided with special architectural treatment to be provided on the
rear building walls on Ellis and Delaware as well as Main Street.
Staff's suggested conditions for approval were discussed in depth with
the applicant. Comments of the Board Members covered the need for more
perimeter landscaping, possibly in. a phasing process, with a key area
in need of improvements being the northwest corner back along Ellis
and Delaware and on Delaware; no sidewalk proposed in the public right-
of-way; that the site plan does not show the location of the existing
traffic signal which will require modification by the applicant if the
driveway is changed; dedication required; consolidation of lot lines
via a parcel map; and that fire lanes may require enlargement upon
review of a dimensioned site plan with the proposed additional retail
building requiring sprinklering.
Ron Sher addressed the Board. He stated it is their intention at this
point to do most of the improvements immediately with some phasing
in the shopping center. Not all buildings will be constructed immediately.
They wish to first upgrade the parking lot, increase parking, and
improve -circulation for their tenants and patrons. Additional lighting
is proposed to prevent vandalism, increased landscaping and architectural
treatment are proposed for the rear of the building. Their intention
is to make it a first-class shopping center. Mr. Sher felt that by
adding the required six-foot landscaping along the frontage of the
center might decrease the parking. He stated his willingness to comply
with all necessary requirements of the Code. He did state he had not
given any consideration to putting in a sidewalk as there is very little
foot traffic, although it has increased somewhat since the installation
of the traffic signal.
It was the feeling of all of the Board Members that the applicant should
meet with staff in an effort to resolve concerns prior to submittal of
a dimensioned site plan. The applicant was informed of the possibility
that a conditional exception, upon review of a dimensioned site plan,
may be necessary permitting a reduction in the six foot perimeter
landscape requirement. Mr. Sher concurred with a one -week continuance
of his application.
ON MOTION BY EVANS AND SECOND BY SMITH, NEGATIVE DECLARATION NO. 83-50
AND ADMINISTRATIVE REVIEW NO. 83-82 WERE CONTINUED ONE WEEK, TO THE

ADMINISTRATIVE REVIEW NO. 83-86
Applicant: Donco & Sons, Inc.
To permit modernization of non -conforming station. Subject site is
located at 18972 Beach Boulevard.
Chairman Smith introduced the applicant's proposal and stated that
per Section 15101, this request is categorically exempt, Class. 1,
under the California Environmental Quality Act of 1970.
Secretary Godfrey informed all concerned that this request is to
renovate anexisting service station located at the intersection of
Beach Boulevard and Garfield Avenue. The applicant is proposing a
new facia on the building carrying out Arco's,theme of colors. The
site is presently non -conforming as it does not meet the landscape
requirements of Article 979 of the Huntington Beach.Ordinance Code.
Additionally, a freestanding sign, located at the corner of Beach
and Garfield,_is nonconforming which should have been removed in
1979. The fact that a traffic signal control box is located within
the corner was discussed with the applicant. The applicant was
informed that one (1) major identification sign is allowed. This
identif ication sign -shall be located in a landscaped area not to
exceed a height of ten .(10) feet. An identification sign may also
contain change panels for fuel pricing only, provided that no detached
pricing signs are placed on the site. If detached.pricing signs are
placed on the site, the major identification sign shall contain only
the*name or symbol of the business and shall not contain change panels,
or exceed forty (40) square feet per face.. -If pricing information is
to be included on the major identification-sign,.-the.sign shall not
exceed fifty (50) sq. ft. per face. The applicant was informed that
if he felt the traffic signal control box created a visual problem
for signage he could apply for a special sign permit, otherwise,he
would have to comply with Article 948 of the Huntington Beach Ordinance
Code.
Mr. Dick Kohler, of Arco, addressed the Board. He said he was not
sure whether*or not the traffic signal control box would be a problem.
He was informed he could provide on each street detached signs for the
purpose of providing pricing information with a maximum height of each
such sign not exceeding seven (7) feet from.ground level. Such signs
not to exceed five (5) feet in width. The Board emphasized that a
"mini-market"was not a permitted use without the approval of the
Planning Commission. Mr. Kohler said a "mini -market" is not being
proposed at'this_time although they do intend to have two vending
machines for the sale of soft drinks and candy.

Staff's recommended conditions of approval received the applicant's
concurrence.
ON MOTION BY EVANS AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW
NO. 83-86 WAS APPROVED WITH THE FOLLOWING CONDITIONS FOR APPROVAL,
SUCCEEDED BY VOTE:
CONDITIONS OF APPROVAL:
1. The elevations and colored renderings received December 16, 1983
shall be the approved layout.
2. A revised site plan shall be submitted reflecting compliance
with S.9482.1.1 - Landscaping.
3. Prior to issuance of building permits, the applicant shall submit
to the departments of Development Services and Public Works for
review and approval landscape and irrigation plans complying with
5.9482.1.1.
4. Installation of required landscaping and irrigation system shall
be completed prior to final inspection.
5. The major identification sign shall be removed or altered to
comply with Article 948 within ninety (90) days.
6. All signs shall comply with Articles 948 and 976 of the Huntington
Beach Ordinance Code.
7. The site shall be restricted to servicing of automobiles and sale
of automobile related products. A "mini -market" shall not be
permitted without the approval of a Conditional Use Permit by
the Planning Commission.
