BOARD MEMBERS PRESENT: Godfrey, Evans, Smith, Vincent STAFF MEMBER PRESENT: Pierce MINUTES• ON MOTION BY EVANS, AND SECOND BY VINCENT, THE MINUTES OF THE REGULAR MEETING OF DECEMBER 21, 1983 WERE APPROVED AS TRANS- CRIBED, BY THE FOLLOWING VOTE: AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSENT: None ABSTAIN: None REGULAR AGENDA ITEMS: AMENDMENT - TENTATIVE PARCEL MAP NO. 79-558 Applicant: Manthei/Buccella Investments To permit a change of access to Parcel 4. Subject property located at 7391 Talbert (northeast corner of Talbert Avenue and Gothard Street) . Chairman Smith introduced the applicant's request and stated that same is covered by Negative Declaration No. 79-14. Staff informed the Board that the property owner met with staff, as well as adjoining property owners,for review and approval of proposed access to Parcel No. 4. Original access was approved on T.P.M. No. 79-558 with a condition imposed that access rights be reviewed and approved by the BZA at the time of development of each parcel. Minutes: H.B. The applicant would like to substitute access via a fully improved public road extension of Metzler La,e from the north across private property. Mr. Joe Hartge and Mr. Thomas Manthei were present and acknowledged concurrence with staff's suggested conditions of approval. The necessity of imposing fire requirements was not felt nAcessary at this time as same will be imposed as the other parcels are deve_oped. ON MOTION BY VINCENT AND SECOND BY EVANS, THE AMENDMENT TO TENTATIVE PARCEL MAP NO. 79-,558 WAS CONDITIONALLY APPROVED AS FOLLOWS, SUCCEEDED BY VOTE: 1. The proposed 30 foot easement across Parcel ' of T.P.M. 82-573 extending south of the terminus of Metzler Lane to Parcel 4 of T.P.M. 79-558 shall be the approved access. 2. Prior to approval of final grading plan, copies of the recorded access easement shall be submitted to the Department of Develop- ment Services for inclusion into T.P.M. No. 82-573 and T.P.M. 79-558 records. 3. All applicable conditions of approval imposed on to T.P.M. 79-558 shall apply. AYES: Godfrey, Vincent, Evans, Smith NOES: None ABSTAIN: None CONDITIONAL EXCEPTION NO. 83-65 USE PERMIT NO. 84-1 TENTATIVE PARCEL MAP NO. 83-583 Applicant: Mr. Leonard'Lichter C.E. Request - To permit reduction in interior property line parking spaces from 12 ft. wide to 9 ft. U.P. Request - To permit construction of dwelling units abutting an arterial. T.P.M. No. 83-583 - To permit subdivision of one (1) parcel into four (4) parcels. Subject property is located on Garfield (north side of street) 150 ft. west of Delaware. The applications were introduced by Chairman Smith who stated that the C.E. request is a Class. 5, the U.P. request is a Class 1, and the T.P.M. is a Class. 15, all categorically exempt under the California Environmental Quality Act of 1970. Board January 25, 1984 Page Three of Zoning Adjustments An analysis of the applicant's plan determined that the buildings location, open space and -number of parking spaces meet the Code requirements with the exception of the reduction in stall size width of three (3) ft. for parking spaces located at the interior property line. It was staff's feeling that the setback for the garages could be moved closer to the property line allowing the parking space size to come closer to meeting the minimum size required. The applicant's plan shows the garages with an eight (8) ft. setback in lieu of five (5) ft. required by Code. The public hearing was opened by Chairman Smith with the applicant, Ron Lichter, present to speak in favor of his proposal. Layout revisions were discussed with the applicant. It was agreed that by incorporating a -change on a revised plan for setback of garages, a six (6) inch exception only would_ be necessary to parking stall sizes on Parcels No. 1 and No. 4 in lieu of three (3) it-. originally proposed. This change would also provide a twenty-seven (27) ft. turning radius for the 90 degree parking spaces and, additionally, would not destroy the design proposed by the applicant. Mr. Lichter explained that alley dedication between parcels was made. He felt that as the storm drain easement was private rather than public it was to his advantage allowing a reduction in setback requirements on his forthcoming revised plan. The public hearing was closed by Chairman Smith. Conditions for approval of the three applications were discussed with the applicant receiving his concurrence. DITIONAL CEPTION ON MOTIONBY GODFWIITHREY THEAND SECOND BY FOLLOWING FINDINGS ,ANDNCONDITIONSXN WAS APPROVED BY VOTE: FINDINGS FOR APPROVAL: 1. There are exceptional circumstances that apply which deprive the subject property from being developed in compliance with the zoning ordinance. 2. There are special unique circumstances relating to the land which would justify the granting of a conditional exception not to exceed .six (6) inches. CONDITIONS OF APPROVAL: 1. Conditional Exception No. 83-65 shall be amended allowing only a six (6) inch exception to each parking space. 2. All applicable conditions imposed on Use Permit No. 84-1 and Tentative Parcel Map No. 83-583 shall apply. -3- BZA 1/25/84 Minutes: H.B. No. 83-65 and T.P.M. No. 83-583) WAS GRANTED WITH FINDINGS, CONDITIONS FOR APPROVAL AND VOTE FOLLOWING: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. Prior to issuance of building permits, a revised site plan with parking layout shall be submitted to the Department of Develop- ment Services for review by staff and approval by the Secretary of the Board. No more than a six (6) inch exception to each parking space shall be designated as approved on Conditional Exception No. 83-65. 2. Prior to issuance of building permits, the applicant shall submit the following plans for review and approval: a. Landscape and irrigation plan to the Department of Development Services. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Service roads and fire lanes as determined by the Fire Department shall be posted and marked. -4- BZA 1/25/84 Minutes: H.B. Board of Zoning Adjustments' January 25, 1984 Page Five 5. Natural gas shall be stubbed in at all locations of cooking facilities, water heaters, and central heating units. 6. Low -volume heads shall be used on all spigots.and water faucets. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 8. The structures on the subject property, whether attach-d cr detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the u0 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permits as so required by the Building Department. 9. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 10. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets and utilities. 11. If foil -type insulation is to be used, afire retardant type shall be installed as approved by the Building Division. AYES: Godfrey, Smith, Evans, Vincent NOES: None ABSTAIN: None ON MOTION BY GODFREY AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 83-583 (IN CONJUNCTION WITH C.E. NO. 83-65 and U.P. NO. 84-1) WAS APPROVED WITH FINDINGS, CONDITIONS AND VOTE FOLLOWING: FINDINGS FOR APPROVAL: 1. The proposed subdivision of one (1) parcel into four (4) parcels for residential development is in compliance with the size and shape of property necessary for that development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. -5- BZA 1/25/84 Minutes: H.B. The property was previously studied for this intensity of land use at the time the land use designation for light industrial development which allows for light industrial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file, with the State Map Act, and supplementalCity Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Develop- ment Services on January 5, 1984, shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed (if such systems exist within 200 feet of said parcels). 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed (if such systems exist within 200 ft. of said parcels). 5. All utilities shall be installed underground at the time said parcels are developed. 6. Compliance with all applicable City Ordinances. 7. A copy of the recorded parcel map shall be filed with the Department of Development Services. 8. Vehicular access rights along Garfield Avenue shall be dedicated to the City of Huntington Beach. 9. The private alley for ingress and -egress shall be delineated on the final parcel map. 10. Reciprocal ingress -egress agreement shall be recorded. Board of Zoning Adjustments January 25, 1984 Page Seven SITE PLAN AMENDMENT NO, 84-1 Applicant: Foster -Walters, Inc. To permit a write-up canopy 22' x 36' x 14' to be located at 18835 Beach Boulevard (west side of street). Chairman Smith introduced the applicant's request and stated that his proposal is categorically exempt, Class. 1, under the California Environmental Quality Act of 1970. Secretary Godfrey stated that staff is recommending approval of the site plan amendment and outlined suggested conditions for approval. Mr. Foster and Mr. Walters were both present to speak in favor of their request for a write-up area cover for DOT Datsun. Mr. Foster addressed the Board and stated that if the area cover was approved, it would eliminate the uncomfortable working conditions and customer inconvenience presently being experienced during extreme weather conditions. It was the consensus of all of the Board Members that the proposed revision.did not constitute a substantial change to the applicant's originally approved site plan. ON MOTION BY EVANS AND SECOND BY SMITH, SITE PLAN AMENDMENT NO. 84-1 WAS GRANTED WITH THE FOLLOWING CONDITIONS IMPOSED, SUCCEEDED BY VOTE: CONDITIONS OF APPROVAL: 1. The site plan, and elevations received and dated January 6, 1984 shall be the approved layout. 2. The development shall comply with all applicable provisions of the Ordinance Code, Building Division and Fire Department. 3. The proposed structure shall be architecturally compatible with the existing building.
