AYES: Godfrey, Smith, Evans, Vincent NOES: None ABSTAIN: None ABSENT: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 84-2 AND USE PERMIT NO. 84-6 Applicant: James Ross Maddux C.E. Request - To permit reduction in minimum open space dimension from 20 ft. to 18 ft. and a reduction in open space area from 450 sq. ft. to 360 sq. ft. Subject property is located at 5001 Flamingo Circle. Chairman Smith introduced both applications and stated that the Conditional Exception is a Class. 5 and the Use Permit is a Class. 3, both categorically exempt under the California Environmental Quality Act of 1970. Staff informed the Board that the existing residential dwelling was constructed many years ago with the garage located within five (5) feet of Bolsa Chica right-of-way. The Code presently requires a ten (10) foot setback making the existing dwelling non -conforming. Minutes: H.B. Board of Zoning Adjustments February 8, 1984 Page Two The applicant's request is to construct an addition in his rear exterior sideyard following original construction severing the open space of 900 sq. ft. required into two (2) portions with one area exceeding the other in square footage. The public hearing was opened by Chairman Smith. Mr. Maddux introduced himself to the Board and asked that the Board act favorably on his request which would enlarge his dining room. He stAted that many of his neighbors have similar additions. Their being no one else present wishing to speak on the proposal, the public hearing was closed. Upon the Board's review of the applicant's site plan the irregular shape of the applicant's lot was noted. It was the feeling of all of the Board Members that although equal proportions of open space were not being met (540 sq. ft. and 360 sq. ft.) that as the total requirement for open space was met the applications should be approved. ON MOTION BY VINCENT AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 84-2 WAS GRANTED WITH FINDINGS, CONDITIONS OF APPROVAL AND VOTE ■ FOLLOWING: FINDINGS FOR APPROVAL: 1. Granting of reduction in open space minimum dimension and minimum open space area will not reduce the required total open space area. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under idential zone classifications. 3. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of Conditional Exception No. 84-2 will not be materially detrimental to the public welfare, nor injurious to property in the same zone classifications. 5. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: 1. Board of Zoning Adjustments February 8, 1984 Page Three ON MOTION BY VINCENT AND SECOND BY SMITH, USE PERMIT NO. 84-6 WAS CONDITIONALLY APPROVED WITH FINDINGS AND CONDITIONS OF APPROVAL FOLLOWING, SUCCEEDED BY VOTE: FINDINGS FOR APPROVAL: 1. The dwelling exists at a legal nonconforming exterior setback. The proposed addition will not alter or affect this setback. 2. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 3. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 4. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan and floor plan received and dated January 18, 1984, shall be the approved layout. 2. The addition shall be architecturally compatible with the existing structure. 3. The addition shall be limited to one story. 4. No future additions which will affect the open space shall be permitted. AYES: Godfrey, Smith, Evans, Vincent NOES: None ABSTAIN: None TENTATIVE PARCEL MAP NO. 83-585 (Con't. from 2/1/84) Applicant: Mr. William J. Sullivan To permit consolidation of small lots and resubdivision into three (3) parcels. Subject property is located at 7611 Talbert Avenue. Chairman Smith introduced the application and stated that this request is categorically exempt, Class. 15, under the California Environmental Quality Act of 1970. -3- BZA 2/8/84 Minutes: H.B. Board of Zoning Adjustments February 8, 1984 Page Four Staff informed all concerned that this map is a redesign of a previously approved Tentative Parcel Map by the Planning Commission (T.P.M. No. 83-571 heard in conjunction with C.U.P. No. 83-25). A problem resulted for the applicant when he tried to obtain consent from all of the small lot owners to sign the parcel map. Therefore, the owner of the property and his engineer have tried to include sufficient small lots to equal 100 ft. of street frontage. Lots 48, 49, and 50 are severed by creation of Woodwind Drive. This street was created to develop property to the east and provide for a storm drain easement. Parcel No. 3 at the south of the property was conditioned by the Planning Commission that development could have only one vehicular access off of Talbert and that the driveway would have to line up with Redondo located at the westerly side of the property. Conditions of Approval were discussed with Mr. Sullivan, applicant, and Joe Hartge, Engineer for the project- Mr. Sullivan stated his concurrence with the conditions. ON MOTION BY EVANS AND SECOND BY VINCENT, TENTATIVE PARCEL MAP NO. 83-585 WAS GRANTED WITH THE FOLLOWING CONDITIONS IMPOSED, SUCCEEDE BY VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSES: 1. The tentative parcel map received by the Department of Develop- ment Services on December 28, 1983, shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Woodwind Drive and Talbert Avenue shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City Ordinances. 8. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. 9. The following conditions of approval imposed on Tentative Parcel Map No. 83-571 shall apply: a. Access to Parcel 3 shall be limited to one driveway off Talbert Avenue and shall line up with Redondo Circle. b. Commercial industrial type radius driveways shall be constructed. c. A separate on -site utility plan shall be submitted on 25" x 36" city linen. d. Hydrology hydraulic sewer and water calculations shall be submitted for proposed and future development; proposed drainage shall be shown on parcel map. e. Erosion control plan shall be submitted for proposed and future development. Subject property is located This request is categorically exempt, Class. 15, under the California Environmental Quality Act of 1970. Staff informed the Board Members that recently the owner of the property appeared before the Board of Zoning Adjustments to expand his existing restaurant. At that time a condition was placed on the property that all the small lots be consolidated into one building site. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. The tentative parcel map received by the Department of Development Services on January 13, 1984 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Depart- ment of Public Works and recorded with the Orange County Recorder. 3. Beach Boulevard shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. 6. All utilities shall be installed underground at the time said parcel is developed. 7. Compliance with all applicable City Ordinances. 8. Subject property is located on Enterprise Lane (east side of street) approx. 100 ft. south of Prodan Drive. Chairman Smith introduced the applicants proposal and stated that this request, per. Section 15115 of the California Environmental Quality Act of 1970,is categorically exempt, Class. 15. Staff informed all concerned that the existing lot is located within an industrial subdivision. The property is zoned M-1 (light industri district) which requires 80 ft. street frontage and 10,000 sq. ft. -6- BZA 2/8/84 Minutes: H.B. On the parcel map a five foot public utility easement for future landscaping in lieu of a sidewalk is shown. Upon the Board's review of the subdivision, it was felt all necessary requirements of the Subdivision Ordinance and State Map Act were met. Mr. Wilch stated his concurrence with the Conditions Gf Approval. ON MOTION BY GODFREY AND SECOND BY VINCENT, TENTATIVE PARCEL MAP NO. 84-552 WAS APPROVED WITH CONDITIONS AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Development Services on January 18, 1984 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 4. AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None TENTATIVE PARCEL MAP NO. 84-554(W) Applicant: Mr. Ronald R.`Hix To permit waiver of parcel map permitting consolidation of three (3) lots into one (1). Subject property is located at 7923 Warner Avenue. The proposal was introduced by Chairman Smith. This request is categorically exempt, Class. 15, under the California Environmental Quality Act of 1970. -7- BZA 2/8/84 Minutes: H.B. Board of Zoning Adjustments February 8, 1984 Page Eight Staff stated that the applicant wishes to consolidate three lots; two of which are encyclopedia lots. The consolidation will provide an additional 100 sq. ft. in width to be used for parking in the C-4 Zoning District. The procedure waiving the requirement for filing and recording a parcel map by use of a Certificate of Compliance allowing the applicant, after the appeal period, to pull his building permits prior to recordation of the plat map by the Orange County Recorder's Office, was explained to the applicant. Mr. Hix concurred with the Conditions of Approval. ON MOTION BY EVANS AND SECOND BY VINCENT, TENTATIVE PARCEL MAP NO. 84-554(W) WAIVER WAS GRANTED WITH FINDINGS AND CONDITIONS OF APPROVAL FOLLOWING, SUCCEEDED BY VOTE: FINDING FOR APPROVAL: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision section of the Ordinance Code. CONDITIONS OF APPROVAL: 1. The plat map received by the Department of Development Services on January 20, 1984 shall be the approved layout. 2. Compliance with all applicable City Ordinances. 3. The applicant shall file, through the Huntington Beach City Clerk's Office, a certificate of compliance in conjunction with the approved plat map. A copy of the recorded certificate of compliance and plat map shall be filed with the Department of Development Services prior to issuance of building permits on the subject property. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. Board of Zoning Adjustments February 8, 1984 Page Nine TENTATIVE PARCEL MAP NO. 84-555 Applicant: Oro Engineering Corporation To permit a lot consolidation. Location is on Beach Boulevard (west side) Assessor's Parcels No. 159-102-345 and 34. Chairman Smith introduced the proposal and stated that this request, per Section 15115 of the California Environmental Quality Act of 1970, is categorically exempt, Class. 15. Staff informed the Board Members that the subject property in question is a result of a condition imposed on Administrative Review No. 83-72 to build a shopping center fronting on Beach Boulevard and Main Street. Mr. Kearin, Engineer for the project, was informed that dedication and improvements are required. Additionally, that on the final map existing lot lines must be shown by a dashed line. Mr. Kearin acknowledged receipt of and his concurrence with the Conditions of Approval. ON MOTION BY EVANS AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 84-555 WAS GRANTED WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Development Services on January 20, 1984, shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Beach Boulevard and Main Streets shall be dedicated to City standards. 4. AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None ADMINISTRATIVE REVIEW NO. 83-89 Applicant: Mr. Evan James, c/o James Company To permit a 10,000 (approx.) sq. ft. Industrial Building to be located at 15621 Chemical Lane. Chairman Smith introduced the applicant's request and stated that this proposal is covered by E.I.R. No. 73-16. Staff informed the Board Members that the proposed industrial building will be located adjacent to a similar type of facility. The rear of the building will abut a school site with residential property located to the south of the building. Mr. James was present to speak in behalf of his project. He was informed that a landscape buffer of trees will be required, per Code, inside of the existing six (6) ft. wall built at the time of original construction of the residential development located to the south of his property. Additionally, a wall (6 ft.) will be required with a landscape buffer inside at the rear of the property abutting the school site. Said trees .shall be of sufficient size (15 gal.) and species to provide maximum screening and buffering from noise and visual intrusion of the industrial use upon the residential and community facility use. The necessity for a ten (10) ft. corner cut-off at the northwest corner of the building was explained to the applicant along with compact parking adjacent to the trash enclosure allowing easier accessibility. ON MOTION BY VINCENT AND SECOND BY SMITH, ADMINISTRATIVE REVIEW NO. 83-89 WAS GRANTED WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: 1. The site plan and floor plans, as revised and dated February 2, 1984, shall be the approved layout. 2. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said" equipment. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Driveway approaches shall be a minimum of twenty-seven (27) feet in width and shall be of radius type construction. 5. Onsite fire hydrants shall be provided in number and at locations specified by the Fire Department. 6. Any signing proposed shall comply with Article 976 of the Huntington Beach Ordinance Code. 7. Low volume heads shall be used on all spigots and water faucets. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 9. If lighting is included,in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 10. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 11. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 12. The subject property shall enter into irrevocable reciprocal driveway easement between the subject site and adjacent property. Prior to issuance of building permits, a copy of the recorded easement agreement shall be submitted to the Department of Development Services. 13. A corner cut-off shall be provided at -the intersection of two driveways (northwest corner of building). -11- BZA 2/8/84 Minutes: H.B. Board of Zoning Adjustments February 8, 1984 Page Twelve 14. A revised site plan shall be submitted to the Secretary of the Board for review and approval delineating the landscape buffer along the property line adjacent to the school site. Revisions on parking, corner cutoff and total square footage of building are to be specified. To permit a parcel map waiver covering consolidation of two (2) parcels into one (1) parcel. Property is located at 17091 and 17101 Ash Street. The request was introduced by Chairman Smith who stated that this proposal is categorically exempt, per Section 15115, under the California Environmental Quality Act of 1970. Staff informed the Board Members that the proposed consolidation is a condition for approval imposed on Use Permit No. 83-67 granted to the applicant in December of last year. The lot consolidation will permit construction of an apartment complex. Upon the Board's review of the plat map it was determined that all necessary requirements for a waiver of a parcel map were met. ON MOTION BY GODFREY AND SECOND BY EVANS, WAIVER OF TENTATIVE PARCEL MAP NO. 84-553(W) WAS APPROVED WITH FINDING, CONDITIONS AND VOTE FOLLOWING: FINDING FOR APPROVAL: 1.
