BOARD MEMBERS PRESENT: Godfrey, Smith, Evans, Vincent STAFF MEMBER PRESENT: Pierce MINUTES: ON MOTION BY VINCENT AND SECOND BY EVANS, THE MINUTES OF THE REGULAR MEETING OF FEBRUARY 1, 1984 WERE APPROVED AS TRANS- CRIBED, BY THE FOLLOWING VOTE: AYES: Godfrey, Smith, Evans, Vincent NOES: None ABSTAIN: None ABSENT: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 84-9 AND USE PERMIT NO. 84-12 Applicant: Bodega Bay Restaurant c/o Thomas Opitz C.E. Request - To permit a reduction in required landscape dimension from 6 ft. to 3 ft. U.P. Request - To permit upgrading and enhancement of the exterior of an existing restaurant building. Chairman Smith introduced both applications stating that both applications are categorically exempt, Class. 5, under the California Environmental Quality Act of 1970. The subject restaurant is located on the corner of Beach Boulevard and Constantine Drive with residential property adjacent to the west side of the site. Minutes: H.B. Board of Zoning Adjustments February 29, 1984 Page Two The bleak appearance of the five to six foot wide sidewalk along Constantine Drive adjacent to one of the parking lots was discussed. There is no landscaping although a landscape planter does exist. The public hearing was opened for both applications by Chairman Smith. There being no one present to speak in favor or opposition of the applicant's requests, the public hearing was closed. Upon reviewing the landscape plan submitted by the applicant, it was determined that not only should a change be made in landscape require- ments on Constantine Drive but that Beach Boulevard should have a six (6) ft. wide landscape planter area installed. Additionally, if the parking lot on Beach Boulevard was restriped for compact parking, one additional parking space would be achieved. The proposed glass green- house on Beach Boulevard and elevations were viewed by the Board. It was stated that the watchtower shown was within height limitation with architectural approval received from staff. ON MOTION BY EVANS AND SECOND BY VINCENT, CONDITIONAL EXCEPTION NO. 84-9 AND USE PERMIT NO. 84-12 WERE BOTH CONDITIONALLY APPROVED AS FOLLOWS, SUCCEEDED BY VOTE: CONDITIONAL EXCEPTION NO. 84-9 FINDINGS: 1. The granting of a partial reduction in landscape planter requirement will not reduce the parking ratio requirement. 2. The granting of the conditional exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under identical zone classification. 3. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a conditional exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 5. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL - C.E. NO. 84-9 1. A six (6) foot wide landscaped planter shall be constructed along Beach Boulevard. 2. Compact parking,spaces shall be provided along Beach Boulevard. 3. Prior to occupancy, the applicant shall saw cut the existing sidewalk adjacent to property line along Constantine Drive, reducing said sidewalk width to four (4) ft. This area shall become an additional landscaped and maintained planter area planted with intensive plant material to the satisfaction of the Public Works Department. FINDINGS FOR APPROVAL - U.P. NO. 84-12 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan -of Land Use. CONDITIONS OF APPROVAL: - U.P. NO. 84-12 1. The site plan and elevations received February 9, 1984 shall be the approved layout. 2. Prior to occupancy, the following plans shall be submitted: a. Revised site plan to reflect six (6) .ft. wide landscape planter along Beach Boulevard and.restriping of front parking area to accommodate compact parking spaces. b. Landscape and irrigation plan to the departments of Development Services and Public Works for review and approval. c. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Additional tree wells (15 gal, min. size) shall be provided along the north and east property lines within the parking lot. NO. 83-55 IN CONJUNCTION WITH USE PERMIT NO. 84-11 Applicant: Mansion Properties, Inc. C.E. Request: To permit a seven (7) foot encroachment into the required 25 ft. front yard setback. U.P. Request: To permit remodeling of the Huntington Seacliff Country Clubhouse. The applicant is wishing to add additional square footage to the existing country club facility, modifying parking lot, upgrading landscaping, change front ehtrance'and carry through with a security fence. Staff informed the Board that a secondary addendum was submitted for the Board's review at this meeting showing a change in the main circulation lane resulting from a meeting held between the property owners and the applicant. It was suggested that the applicant address the encroaching varied wall height, also to respond to concerns of the Fire Department with regard to the proposed island planters at the entrance of the Huntington Seacliff Country Club. The public hearing was opened on both applications by Chairman Smith. Dave Eadie addressed the Board. He stated that the country club and golf course facility is an open space facility where all structures are set back hundreds of feet from any other property improvements. The parking facility for the complex is located at its most easternmost border abutting Palm Avenue. They are proposing to construct a pilaster and wrought iron wall along the frontage where the setback encroachment would take place. As the other walls adjacent to the area where this wall is proposed have far less setback area it would be an exceptional circumstance to require the full 25 ft. setback for this wall. The wall shown as 9 feet is measured from the low side. He felt that this variance was necessary to achieve a more meaningful landscape theme.' With a landscaped area on both sides of the see - through wall it would provide an attractive street scene as well as an attractive parking lot scene when viewing out onto Palm Avenue. Mr. Eadie stated that they investigated every comparable country club facility in Orange County and found that Seacliff Country Club parking (286 spaces) exceeds parking capacities of those clubs. With the addition of the two vacant portions of land on either side of the parking lot, the resulting parking count will be 334 spaces - a 48-space increase over existing amounts. Several residents of Seacliff were present. Mr. and Mrs. Robert Snyder, 19861 Ocean Bluff Circle and Nancy Tanaka, 19872 Ocean Bluff Circle addressed the Board stated they were representing many of the residents. They had concern with the location of the entrance and fel it should be moved farther north on Palm Avenue closer to the location of the tennis courts felt to alleviate noise and allow safety when entering or exiting the country club. -4- BZA 2/29/84 Minutes: H.B. Board of Zoning Adjustments February 29, 1984 Page Five After considerable discussion, it was felt that a one -week continuance ,0as necessary to allow the applicant additional time to meet with the residents to reach a reasonable compromise and, if necessary, submit revised plans. ON MOTION BY EVANS AND SECOND BY VINCENT (WITH THE APPLICANT'S CONCURRENCE), CONDITIONAL EXCEPTION NO. 84-10 AND NEGATIVE DECLARATION NO. 83-55 IN CONJUNCTION WITH USE PERMIT NO. 84-11 WERE ALL CONTINUED FOR ONE -WEEK, TO THE MEETING OF MARCH 7, 1984, BY THE FOLLOWING VOTE: AYES: Godfrey, Smith, Evans, Vincent NOES: None ABSTAIN: None ADMINISTRATIVE REVIEW NO. 84-2 Applicant: Mr. David Meier To permit a 12,467 sq. ft. Industrial Building in a MI -A Zone. Chairman Smith introduced the applicant's proposal and stated that this request is covered by Negative Declaration No. 79-35. Staff informed the Board Members that during plan check it was revealed that the site is short 540 sq.'ft. of required landscaping. The original entitlement approval has expired. Eight percent of the site in lieu of six percent landscaping is now required. Jennifer Meier was present to speak in favor of the proposal. She felt their problem was created by the pie shape of the lot with a narrow entrance leading into the building. Areas within the site for additional landscaping were suggested to Mrs. Meier along with the possibility of applying for a conditional exception variance if, after calculation, they can not meet the landscaping requirement of eight percent. The services of staff were offered to Mrs. Meier. ON MOTION BY VINCENT AND SECOND BY EVANS, ADMINISTRATIVE REVIEW NO. 84-2 WAS CONTINUED FOR TWO WEEKS (WITH THE APPLICANT'S CONCURRENCE), TO THE MEETING OF MARCH 14, 1984, TO HAVE LANDSCAPING RECALCULATED AND, IF NECESSARY, FILE FOR A CONDITIONAL EXCEPTION, BY THE FOLLOWING VOTE: AYES: Godfrey, Smith, Evans, Vincent NOES: None ABSTAIN: None -5- BZA 2/29/84 Minutes: H.B. Board of Zoning Adjustments February 29, 1984 Page Six ADMINISTRATIVE REVIEW NO. 84-5 Applicant: Warren Lortie Associates To permit construction of a light industrial multi -tenant facility to be located on Sampson Circle. After introduction of the applicant's request, Chairman Smith stated that this proposal is covered by Negative Declaration No. 79-35. Staff informed the Board Members that prior to today's hearing, the applicant was notified by telephone that landscaping and parking, which can be accommodated on his plan, are deficient. Mr. Lortie was present and displayed to the Board an overlay of the site meeting Code requirements. He stated that inadvertently they were working with previous ordinance requirements. He pointed out that their criginal plan showed office and warehouse use only. They have reanalyzed the"site adding "manufacturing" with parking and landscaping in-conformahce with Code. Mr. Lortie was informed any proposal to create a more intense use (over nine (9) parking spaces) will require a new entitlement. ON MOTION BY EVANS AND SECOND BY SMITH, ADMINISTRATIVE REVIEW NO. 84-5 WAS GRANTED WITH THE FOLLOWING CONDITIONS OF APPROVAL IMPOSED, SUCCEED BY VOTE: CONDITIONS OF APPROVAL: 1. The revised site plan submitted at the Board Meeting dated February 29, 1984, shall depict the modifications described herein: a. 14.5 ft. wide landscape planter (10 ft. easement plus 4.5 ft. easement) along property line except at driveway opening. b. Eight percent of net site in landscaping exclusive of easement and automobile overhang. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irriation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipm 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 5. Maximum separation between building wall and property line shall not exceed two (2) inches. 6. Driveway approaches shall be a minimum of twenty-seven (27) feet in width and shall be of radius type construction. 7. There shall be no outside storage. 8. Low -volume heads shall be used on all spigots and water faucets. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 10. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 11. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations retaining walls, streets, and utilities. 12. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 13. This approval shall allow a combination of office, manufacturing and warehousing which requires no more than nine (9) parking spaces. Any proposal to create intensity of use shall require new entitlement and parking requirement conformance. AYES: Godfrey, Smith, Vincent, Evans NOES: None ABSTAIN: None ADMINISTRATIVE REVIEW NO. 84-6 Applicant: Warren Lortie Associates To permit construction of a light industrial single -tenant facility to be located on Reynolds Circle. Staff informed the Board that this application was,.submitted at the same time Administrative Review No. 84-5 was and, consequently, parking and landscaping for the site are deficient as current requirements were not applied. Mr. Lortie submitted to the Board for their overview a layout showing increased requirements as.required by Code. One additional parking space -7- BZA 2/29/84 Minutes: H.B. Board of Zoning Adjustments February 29, 1984 Page Eight was provided for a total of twenty-nine (29) required inclusive of eight (8) percent landscaping. The Board felt satisfied with the applicant's preliminary plan. ON MOTION BY EVANS AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW NO. 84-6 (IN CONJUNCTION WITH TENTATIVE PARCEL MAP NO. 84-561(W) WAS GRANTED WITH CONDITIONS IMPOSED FOLLOWING, SUCCEEDED BY VOTE: CONDITIONS OF APPROVAL: 1. The revised site plan submitted at the Board Meeting dated February 29, 1984 shall depict the modifications described herein: a. 14.5 ft. wide landscape planter (10 ft. easement plus 4.5 ft. easement) along property line except at driveway opening. b. Warren Lortie Associates To permit waiver of parcel map consolidating two parcels into one. (Lots 10 and 11 of Tract No. P.M. 157-19) Staff informed the Board'Members that this parcel map is in conjunction with Administrative Review No. 84-6,with approval necessary prior to development of the property. Upon the Board's review of the plat map it was determined that all necessary requirements for a waiver of a parcel map were met. The waiver process was explained to Mr. Lortie. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision section of the Ordinance Code. All utilities shall be installed underground at the time said parcel is developed. 6. The applicant shall file, through the Huntington Beach City Clerk's Office, a certificate of compliance in conjunction with the approved plat map. A copy of the recorded certificate of compliance and plat map shall be filed with the Department of Development Services prior to issuance of building permits on the subject property. Request: To permit the construction of a 40,000 sq. ft. research and development building. U.P. Request: To permit truck loading facilities to face public street. T.P.M. Req.: To permit waiver of parcel map permitting consolidation of four (4) lots into one (1) for construction of a building. Subject property is located on the south -side of Engineer between Pipeline and Connector. 1 Chairman Smith introduced the proposals and stated that the A.R. and U.P. applications are covered by E.I.R. No. 76-16 and that the T.P.M. is a Class. 15, categorically exempt, under the California Environmental Quality Act of 1970. The applicant is proposing to consolidate four (4) recorded parcels within Lusk Industrial Park for construction of a research and develop- ment building. An overview of the applicant's site plan, incorporating Code requirements, disclosed that additional parking and landscaping were provided. It was felt that all development standards were -10- BZA 2/29/84 Minutes: H.B. Board of Zoning Adjustments February 29, 1984 Page Eleven incorporated into the applicant's plan justifying the use. The public hearing was opened on Use Permit No. 84-13. Mr. Darrel Hebenstreit, A.I.A. of Architects Orange, was present to speak in favor of the proposal. He felt that as the truckwell was setback a considerable distance from the public street that more than adequate space was provided eliminating the possibility of stacking of trucks into the required drives. The public hearing was closed. Board discussion carried on the recessed, fully enclosed loading facility screened from view located approximately 140 ft. from the public right- of-way in lieu of 45 ft. required by Code. It was staff's feeling that the three (3) ft. wide sidewalk on the southwest corner of the building would provide adequate sight visibility eliminating the need of a corner cutoff. John Mandrell, authorized agent for R.M.G. Engineering, was present. He stated he was in receipt of and concurred with the Conditions for Approval of the prat map. The waiver of a parcel map procedure was explained to Mr. Mandrell. The site plan, floor plans, and elevations received and dated February 14, 1984 shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Landscaping shall comply with S.9792 et seq. of the Huntington Beach Ordinance Code. 4. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 5. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards. 10. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 11. Low -volume heads shall be used on'all spigots and water faucets. 12. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 13. The location of the truck loading facility will not be detrimental to surrounding properties. The proposed facility is located approximately 140 ft. from a public street. AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None ON MOTION BY EVANS AND SECOND BY VINCENT, TENTATIVE PARCEL MAP NO. 84-563(W) WAS GRANTED WITH FINDING, CONDITIONS OF APPROVAL AND VOTE FOLLOWING: FINDING FOR APPROVAL: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision section of the Ordinance Code. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The plat map received by the Department of Development Services on February 14, 1984 shall be the approved layout. 2. Compliance with all applicable City Ordinances. 3. The applicant shall file, through the Huntington Beach City Clerk's Office, a certificate of compliance in conjunction with the approved plat map. Godfrey, Evans, Smith, Vincent None None USE PERMIT NO. 84-9 Applicant: Mr. Ronald L. Jessee To permit expansion of a wholesale nursery into an Edison right-of-way abutting its existing location. Subject property is located at 21251 Bushard Street. Staff informed the Board Members that this is the applicant's second year of operation on the leased easement owned by Southern California Edison. Wholesale distribution of growing plants and nursery stock used in landscaping activity is allowed in a RA Zone subject to approval of a Use Permit for one (1) year. Extensions of the original permit may be given for one (1) year periods with four (4) such extensions being the maximum time allowed per permit. The applicant is desirous of expanding his storage area perpendicular to Hamilton Avenue. Conditions of Approval imposed on the original entitlement were distributed to the Board Members,with additional conditions relevant to grading and access,of which the Board may wish to repeat, modify, eliminate or add conditions to assure a continued compatible use. Conditions for approval were discussed. The public hearing was opened by Chairman Smith. Mr. Bruing, representing Mr. Jessee, addressed the Board and stated they would have no problem complying with the conditions as discussed. The public hearing was closed. Lower growing trees and shrubs only shall be permitted adjacent to the residential properties, and plant material shall be no higher than one (1) foot lower than the top of existing block wall. 4. All soil amendments or planting mix material shall be kept damp as to not to blow onto adjacent properties. All such material shall not be stacked over a height of ten (10) feet and shall be located within the north fifty (50) feet of the facility. 5. Spraying of plant materials shall be done inwardly, away from residential properties. "Chemical spraying" shall be held to a minimum used only on an as needed basis. Spraying shall be done in such a manner to prevent the chemicals from being carried into the residential area. 6. There shall be no activity, including maintenance, selling or other between the hours of 8:00 p.m. and 8:00 a.m. on weekdays excluding holidays. On weekends or holidays there shall be no activity whatsoever other than general maintenance. 7. Any yard lighting proposed shall be directed away from adjacent residential properties. 8. Any proposed signing shall conform to Article 976 of the Huntington Beach Ordinance Code. 9. Driveway approach and necessary asphalt paving transitions shall be to the satisfaction and specifications of the Public Works Department. 10. Location for the circus is in the northeast corner of the Huntington Center Parking Lot. The request was introduced by Chairman Smith who informed all concerned that per Section 15101 of the California Environmental Quality Act of 1970, this request is categorically exempt, Class. 1. Staff stated that this proposal is an annual request. It was suggested that all previous conditions imposed become applicable on the new entitlement for the "special event" with -an additional condition,recommended by the Special Operations Section of the Police Department,that four (4) extra police officers be staffed with related equipment to respond to traffic tnd police calls for service on each day of the event.at cost to app scan Representatives,Yolanda Moran and Alexis Schreiner, of :Circus Vargas were present and were informed by Fire Protection Specialist Poe that prior to this meeting the Fire Department had not received a layout covering the tent;and parking for the mobile vehicles connected with the circus. b1s. A certificate of insurance in the amount of $1,000,000 shall be filed with the Administrative Services Dept. five (5) days prior to the event. 4. The applicant shall comply with all Fire Department safety standards. 5. Appropriate temporary signs for the direction of traffic and parking shall be provided by the applicant. Said signs shall be subject to the approval of the Traffic Division of the Police Department. 6, A $500 sum, in cash or cashier's check, shall be deposited in trust for fire standby. 7. Handicapped facilities and access shall be provided. 8. All trash, debris, and deleterious material deposited on or carried to public streets shall be picked up and removed by the proponents to the satisfaction of the Department of Public Works. 9. The applicant shall secure the services of four (4) City of Huntington Beach Police Officers and related equipment for each day of the event, if required. 10. If applicable, prior to operation of any equipment used in conjunction with amusement rides, the City shall be in receipt of State Certifica- tion and permits showing inspection within one-year period, stating that the rides meet all requirements of the State Industrial Safety Divison. 11. A precise site plan depicting location of tent, parking, etc. shall be received by the Fire Department no later than March 2, 1984. 12. This approval is only valid for March 8, 9, and 10, 1984. Board of Zoning Adjustments February 29, 1984 Page Eighteen USE PERMIT NO. 84-8 Applicant: Memorial Medical Center To permit a temporary Outdoor Event March 2, 3, and 4, 1984 (Helicopter in parking lot). Proposed site is Huntington Center on Edinger Avenue. Chairman Smith introduced the application and stated that this request is a Class. 1, categorically exempt, under the California Environmental Quality Act of 1970. Staff informed all concerned that the applicant is requesting approval to display the "life flight" helicopter in conjunction with the Memorial Medical Center Health Fair. Permission is also being requested to allow the helicopter, during medical emergencies, to leave and return to the Huntington Center parking area. The pilot, Mr. Pat Conroy, met with Lt. Morrison of the Huntington Beach Heliport Division with regard to rules for landing and take -off of the helicopter as governed by the F.A.A. The public hearing was opened. Mr. Roy Evans, representing the Memorial Medical Center, outlined the operation of the helicopter. The public hearing was closed. Conditions for approval were discussed. Signs shall be prohibited within the public right-of-way area. 5. Fire access lanes shall be maintained. 6. The applicant shall obtain all necessary electrical permits. 7.
