BOARD MEMBERS PRESENT: Godfrey, Smith, Evans, Vincent STAFF MEMBER PRESENT: Pierce MINUTES: ON MOTION BY EVANS AND SECOND BY VINCENT, THE MINUTES OF THE REGULAR MEETING OF FEBRUARY 8, 1984 WERE APPROVED AS TRANS- CRIBED. AYES: Godfrey, Smith, Evans, Vincent NOES: None ABSTAIN: None ABSENT: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 84-10 (Con't. from 2/29/84) AND NEGATIVE DECLARATION NO. 83-55 AND USE PERMIT NO. 84-11 Applicant: Mansion Properties, Inc. C.E. Request - To permit a seven (7) foot encroachment into the required 25 ft. front yard setback. U.P. Request - To permit remodeling of the Huntington Seacliff Country Clubhouse. Chairman Smith introduced the applications. Staff reiterated reason for continuance of the applications from the Board Meeting of February 29, 1984. It was stated that additional time was required to allow the applicant an opportunity to meet with the homeowners of Seacliff to work out differences of opinion on the proposed change in location of the main entrance to the Country Club. Subsequent to today's Board Meeting, the applicant presented to the staff a preliminary plan showing the driveway entrance Minutes: H.B. Board of Zoning Adjustments March 7, 1984* Page Two located approximately mid -point on Palm Avenue providing a circulation pattern with easy access into all three parking areas. Upon the Board's review of the preliminary plan, it was noted that the design has incorporated the use of many large existing trees within the proposed area for the entrance. The public hearing was opened by Chairman Smith. Dave Eadie addressed the Board. He submitted a transparent copy show- ing changes to his plan relative to the entrance and design of the parking lot after soliciting and receiving input from the concerned homeowners abutting the Huntington Seacliff Country Club. He felt that as a result of this process a better buffer area can be achieved by moving the drive area northerly providing additional parking next to the homes. Additionally, the change in location of the entrance to the north will bring about a slight increase in the amount of parking available as well as the percentage of site landscaping. Merrill Walstad, 19851 Ocean Bluff, approached the Board stating he represents many of the homeowners who are in favor of the revised proposal. The public hearing was closed. Conditions for approval were discussed receiving the applicant's concurrence. The Board reviewed the information contained in the negative declaration and considered mitigating measures. ON MOTION BY EVANS AND SECOND BY VINCENT, THE BOARD HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 83-55, WITH MITIGATING MEASURES AS IMPOSED ON USE PERMIT'NO. 8.4-�111, BY THE FOLLOW- ING VOTE: AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None FINDINGS FOR APPROVAL - C.E. NO. 84-10 1. The granting of the conditional exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under identical zone classification. 2. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 3. Existing booster pump station is within public right-of-way. CONDITIONS OF APPROVAL - C.E. No. 84-10 1. Prior to issuance of building permits, a revised site plan shall be submitted incorporating the main entrance redesign as submitted March 6, 1984. 2. Maximum height of proposed wall/fence shall not exceed eight (8) feet. 3. Cross sections of the wall shall be submitted to the Secretary of the Board for review and approval prior to issuance of building permits. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL - U.P. NO. 84-11 1. Prior to issuance of building permits, the applicant shall submit the following plans: a. A revised site plan depicting the modifications described herein: 1. Main driveway modifications as submitted March 6, 1984. 2. Fire access lanes maintaining a minimum 24 ft. width. 3. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. c. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 2. The development shall comply with all applicable provisions of the Ordinance Code, Building Division and Fire Department. 3. Service roads and fire lanes as determined by the Fire Department shall be posted and marked. 4. Fire protection system shall be extended into building additions. 5. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 6. Low -volume heads shall be used on all spigots and water faucets. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 8. if lighting is included in the parking lot, high=pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 9. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 10. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. Board of Zoning Adjustments March 7, 1984 Page Five The request was introduced by Chairman Smith who informed all concerned that per Section 15101 of the California Environmental Quality Act of 1970, this request is categorically exempt, Class. 1. As the applicant was recently before the Board with the same request, it was staff's suqqestion that the same conditions be imposed on the new entitle- ment. The public hearing was opened with representatives, Yolanda Moran and Alexis Schreiner, of Circus Vargas present to speak in favor of their proposal. The Board was informed that a precise plan was submitted to the Fire Department covering the tent location and parking for the mobile vehicles connected with the circus satisfying all concerns. The public hearing was closed by Chairman Smith. ON MOTION BY EVANS AND SECOND BY VINCENT, USE PERMIT NO. 84-14 WAS GRANTED WITH THE FOLLOWING FINDINGS AND CONDITIONS IMPOSED, SUCCEEDED BY VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The precise plan received and approved by the Fire Department on March 1, 1984 shall be the approved layout. 2. Board of Zoning Adjustments March 7, 1984 Page Six TENTATIVE PARCEL MAP NO. 84-560 Applicant: Hartge Engineering Corporation To permit subdivision of one (1) large parcel into two (2) parcels. Subject property is located at 8171 Garfield. Chairman Smith introduced the applicant's request stating that the proposal is categorically exempt, Class. 15, under the California Environmental Quality Act of 1970. Staff indicated that on the subject parcel there is an existing residence and garage. If subdivided into two parcels, Parcel 1 *i1-1 be non -conform- ing as there will be no required parking and,on Parcel 2,there will be no main building to accommodate the garage. This would create two parcels in conflict with the zoning ordinance. Joe Hartge, representing the property owner, addressed the Board. He stated that the property owner's intent is to have the map approved so that financing may be obtained. The applicant was informed that on the final map, prior to recordation, onsite parking for Parcel 1 must be satisfied and on Parcel 2 the garage is to be shown as demolished or relocated to Parcel 1. Mr. Hartge stated that the property owner wishes to demolish the house and garage upon receipt of financing and construct -single-family residences on the R-3 property. It was stated that no improvements are required on Mora -Kai Lane as it is a privately operated alley. ON MOTION BY EVANS AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 84-560 WAS GRANTED WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Development Services on February 10, 1984 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Garfield Avenue shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's wate system at the time said parcel is developed (if such systems exis within 200 feet of said parcel). 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed (if such systems exist within 200 feet of said parcel). -6- BZA 3/7/84 Minutes: H.B. Onsite parking requirement on Parcel 1 shall be satisfied prior to recordation. 11. Garage on Parcel 2 shall be demolished or relocated to Parcel No. 1 prior to recordation. AYES: Godfrey, Smith, Evans, Vincent NOES: None ABSTAIN: None TENTATIVE PARCEL MAP Applicant: Auerswald NO. 84-515(W) & Sons To permit a waiver of parcel map for consolidation of two (2) parcels into one (1) parcel. Subject property is located at 623-14th Street. Following introduction of the applicant's request, Chairman Smith stated that this proposal is categorically exempt, Class. 15, under the Calif- ornia Environmental Quality Act of 1970. The waiver of a parcel map is being requested to alleviate an existing lot line separating a single, -family dwelling from a detached garage. The applicant wishes to add a room addition. There was no representation present to confirm that alley dedication on 14th and 15th Street has been made. As the applicant is proposing an addition to his garage with an existing five (5) foot rear yard setback,located in the Townlot Specific Plan Area, after dedication a use permit application approving setback for the proposed addition will be required. ON MOTION BY EVANS AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 84-565(W) WAS CONTINUED ONE WEEK, TO THE MEETING OF MARCH 14, 1984, TO RE ---NOTIFY THE APPLICANT OF THE NECESSITY OF HIS PRESENCE AT THE HEARING, BY THE FOLLOWING VOTE: AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None -7- BZA 3/7/84 Minutes: H.B. Board of Zoning Adjustments March 7, 1984 Page Eight TENTATIVE PARCEL MAP NO, 84-566 Appl.: Wilshire Development Company To permit consolidation of lots into one (1) parcel for a retail building. Subject property is located on Warner Avenue approximately 182 ft. east of Goldenwest on the north side of the street. Chairman Smith introduced the applicant's request and stated that this proposal, per Section 15115 of the California Environmental Quality Act of 1970, is categorically exempt - Class. 15. This parcel map request is to consolidate numerous encyclopedia lots adjacent to a commercial shopping center. The property owner, William Landis, was present prior to the meeting and stated' his concurrence with the Conditions of Approval. Improvements have been installed along Warner Avenue. Mr. Landis said that dedication of Warner Avenue will be made shortly; that some of his property had been taken by condemnation during redevelopment of the adjacent shopping center. The parcel map and suggested conditions for approval were reviewed by the Board. ON MOTION BY EVANS AND SECOND BY VINCENT, TENTATIVE PARCEL MAP NO. 84-566 WAS CONDITIONALLY APPROVED AS FOLLOWS, SUCCEEDED BY VOTE: CONDITIONS OF APPROVAL: 1. The tentative parcel map received by the Department of Development Services on February 16, 1984 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Warner Avenue shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. 6. All utilities shall be installed underground at the time said parcel is developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Departmen of Development Services. 9. Location is 17552 Beach Bouelvard (approximately 225 ft. from Slater Avenue). The proposal was introduced by Chairman Smith. This request is categorically exempt, Class. 1, under the California Environmental Quality Act of 1970. The "special event" is for three days (March 14 thru 16, 1984). The site plan submitted showing the location of the balloon above Suites "D" and "E" was reviewed by the Board. Mary Dell, representing the property owner, was present to answer questions of the Board. Conditions for approval were discussed. ON MOTION BY EVANS AND SECOND BY SMITH, USE PERMIT NO. 84-16 WAS GRANTED WITH CONDITIONS OF APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: 1. The proposed 11 ft.,=10 ft. wide, helium balloon shall be secured to the roof. 2. The balloon shall be removed by noon, March 17, 1984. 3. Certificate of Insurance and Hold Harmless Agreement shall be approved by the Risk Manager of the City of Huntington Beach prior to the event.
