BOARD MEMBERS PRESENT: Godfrey, Smith, Evans, Vincent STAFF MEMBER PRESENT: Pierce MINUTES: ON MOTION BY VINCENT AND SECOND BY SMITH, THE MINUTES OF THE REGULAR MEETING OF FEBRUARY 22, 1984 WERE APPROVED AS TRANSCRIBED, BY THE FOLLOW- ING VOTE: AYES: Godfrey, Smith, Vincent NOES: None ABSTAIN: Evans ABSENT: None REGULAR AGENDA ITEMS: USE PERMIT NO. 84-15 (Con't. from 3/14/84) AND ADMINISTRATIVE REVIEW NO. 84-9 Applicant: J. J. Byron U.P. Request: To permit two (2) loading facilities facing public streets. A.R. Request: To permit a 12,390 sq. ft. Industrial Building in an Ml-A Zoning District. Site location is 5812 Machine Drive. Staff stated that at the last Board Meeting, the applicant requested a one -week continuance to revise his plan to reflect the two (2) loading facilities facing public streets to meet the Code require- ment of a forty-five (45) ft. setback from the public right-of-way. The revised plan submitted March 16, 1984, depicts a side entry with a single -door entrance allowing a truck to enter the building on Assembly sane drive through the building and exit out of the warehouse onto Machine 6rive. The public hearing was opened by Chairman Smith with Mr. Byron present to respond to questions of the Board. Minutes: H.B. Board of Zoning Adjustments March 21, 1984 Page Two Upon review of the revised plan, the Board Members felt that not only were Code requirements satisfied but the design would provide less traffic impact to the area. The public hearing was closed. Conditions for approval were discussed. The necessity for a fire protection system and a twenty-seven (27) ft. in width driveway approach on Assembly Lane were explained to Mr. Byron. ON MOTION BY EVANS AND SECOND BY SMITH, USE PERMIT NO. 84-15 (IN CONJUNCTION WITH ADMINISTRATIVE REVIEW NO. 84-9) WAS CONDITIONALLY APPROVED AS FOLLOWS, SUCCEEDED BY VOTE: FINDINGS -FOR APPROVAL - U.P. NO. 84-15 1. The proposed loading facility will setback forty-five (45) feet from the right-of-way line as required by S.9518(b)(1). 2. The proposed loading facility will not impact traffic circulation to the vicinity of such use. 3. Granting of the use permit will not be injurious to property and improvements to the vicinity of such use. 4. Granting of the use permit will not be detrimental to the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL - U.P. NO. 84-15 1. The site plan, floor and elevations submitted March 16, 1984, shall be the approved layout. 2. All applicable conditions imposed on Administrative Review No. 84-9 shall apply. AYES: Evans, Vincent, Godfrey, Smith NOES: None ABSTAIN: None ON MOTION BY EVANS AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW NO. 84-9 (IN CONJUNCTION WITH U.P. NO. 84-15) WAS GRANTED WITH CONDITIONS FOR APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL - A.R. NO. 84-9 1. The site plan, floor and elevations received March 16, 1984, shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit -2- BZA 3/21/84 1 Minutes: H.B. Board of Zoning Adjustments March 21, 1984 Page Three the following plans: a. Landscape and irrigation plan to the Department of Develop- ment Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Maximum separation between wall and property line shall not exceed two (2) inches. 5. Driveway approach on Assembly Lane shall be a minimum of twenty- seven (27) feet in width and shall be of radius type construction. Driveway approach on Machine Drive may be of lessor width and of different construction as approved by Public Works Department. 6. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 7. All signs shall comply with Article 976 of the H.B. Ordinance Code. 8. Low -volume heads shall be used on all spigots and water faucets. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 10. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 11. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 12. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. To permit a greenhouse addition to encroach one (1) foot into the required five (5) foot sideyard. Site location is -at 6561 Vesper Circle (north side of street). Chairman Smith introduced the applicant"'s°proposal7�and stated that per Section 15105, of the California Environmental Quality Act of 197 0," this request is a Class.- 5-, 'categorically exempt. Staff informed -the --Board Members that the -applicant is proposing a sun room which would encroach into their sideyard one (1) foot. A reviewLof-they-sectional district maps for this particular section of Huntington Beach revealed that -no variances have been granted for encroachment into sideyards. Most"df.the lots in ,Tract #7'663 are over 60 ft. in width - 100 ft. in depth.'" -!This -particular" lot is at the beginning of a cul-de-sac'and is twenty=three (23) ft. shorter in length. To compensate for the difference the applicant's lot was made wider developed under all'R-1 zoning requirements. The sun room, as shown on the bruchure submitted (no elevations received), illustrated the• -"Vista -Room" solarium as being habitable shown with furniture,felt to constitute a room addition.` ,-Staff felt that to approve this conditi al Vexception would not only set -a --precedence but would be a grant of special privilege. The public hearing was opened by Chairman Smith. Marsh Hauge, of Sunbeams Construction, was present to speak in favor of his proposal. He pointed out that it was unfortunate that the sun room was not compatible with'the floor l-ayout-"of the applicant's dwelling on the north side as a sixteen (16) ft. sideyard does exist considered as excellent --access Should°emergency services -be required. The applicant was. asked_ if_ `he...c-ould go to a smaller model, possibly longer in length but one ft. shorter in width. Mr. Hauge explained that the next size was -one-half- of the -size -be&inq `requested and,- if • a custom size, the cost would.be prohibitive. He stated that the solarium has been designed and-engineerdd 'to`func£ion-as 'an' integral part` -of -a home, 'as a sun room, breakfast nook; -or spa enclosure -with endless possibilities. He felt the applicant was desirous of additional space. The public hearing was closed. Discussion carried 'in an -'effort- to -'justify the -applicant's -re-quest. ON MOTION BY GODFREY AND SECOND BY EVANS, A MOTION WAS MADE TO DENY CONDITIONAL EXCEPTION NO. 84-13 WHICH RECEIVED A DEADLOCK VOTE AS FOLLOWS: AYES: Godfrey, Evans NOES: Smith, Vincent ABSTAIN: None ON MOTION BY EVANS AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 84-13 WAS REFERRED TO THE PLANNING COMMISSION FOR HEARING ON APRIL 17, 1984, BY THE FOLLOWING VOTE: AYES: Godfrey, Evans, Smith, Vincent NOES: None ABSTAIN: None TENTATIVE PARCEL MAP NO. 84-557 Applicant: U-Haul of Orange County To permit consolidation of Lots 1 thru 3, 5 thru 7, 26 and the west 105 ft. of Lot 4, all in Block A of Tract 837. Subject property is located at 19261 Beach Boulevard. Chairman Smith introduced the applicant's request and stated that this proposal is categorically exempt, Class. 15, under the California Environmental Quality Act of 1970. Staff informed the Board that this parcel map will satisfy Condition of Approval No. 4 of Administrative Review No. 83-80 approved by the Board of Zoning Adjustments on January 4, 1984. Existing use of the property is a u-haul equipment rental center. A recreational vehicle service center is proposed. The zig-zag blue border. on Beach Boulevard was verified with the Public Works Department. Additionally, Beach Boulevard, Clay and Owen Avenue are fully improved and dedicated to City standards. Mr. Ed Hughes, of U-Haul of Orange County, addressed the Board and stated his concurrence with the Conditions of Approval. ON MOTION BY EVANS AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 84-557 WAS CONDITIONALLY APPROVED AS FOLLOWS, SUCCEEDED BY VOTE: CONDITIONS OF APPROVAL: A. Following 'introduction of .the. applicantl.s request, ;Chairman Smith stated .that this`proposal,;per;;Section 15ll5.of the California Environ- mental Quality Act of 1970; is a Class.-l5,'categorically exempt. Staff informed -the Board'that.the parcelt'map submitted did not show the existing structure on Parcel #142-111-27. A dimensioned site plan -;was requested -and verified ,that the ,subdivision would not violate zoning requirements. John Mandrell, of RMG Engineering, was present to speak in favor of the subdivision. He was informed that each parcel has to be serviced by its own sewer lateral with no encroachment on to another parcel. -6- BZA 3/21/84 Minutes: H.B. Board of Zoning Adjustments March 21, 1984 Page Seven Additionally, that the sewer line stops at the south of Parcel 0142-111-27 on Aldrich Street with no sewer service provided to Parcel #142-111-24. Mr. Mandrell stated that fifty-two (52) ft. of dedication has been made and concurred with the Conditions of Approval. It was noted by the Board Members that all right-of-way improvements have been installed. ON MOTION BY EVANS AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 84-568 WAS GRANTED WITH CONDITIONS OF APPROVAL FOLLOWING, SUCCEEDED BY VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE. 1. The tentative parcel map received by the Department of Develop- ment Services on March 5, 1984 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Edinger and Parkside Lane shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 5. Sewer disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. 6. All utilities shall be installed underground at the time said parcel is developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Development Services. 9. Site location -A's: 1'9.7.70--Beach-Boulevard;:(Newland_Center);:•- Chairman Smith introduced the applicant's request and stated that the proposal ;is_categorically exempt, Class. 3, under the California Environmental. -Quality Act of 1970. It was stated that the applicant met with staff at a study session on March.l9, 1984,. to work out discrepancies._ The applicant is pro- posing to -take', the 'end structure,•located -on the ,south -side of the shopping,center_;:incorporate three units into one (6,300 sq. ft. total), for use as a restaurant facility. Bill -,Glaser o£=R: J. Marvick & Associates and Mr. W.S. Walkup, Vice - President of Signal Development Corporation (property owner) were present to answer questions of the Board. A revised colored rendering was,submitted which eliminated previous concerns; placement of landscap- ing=and_ concrete sidewalk and.location•of handicapped ramp and entry. It was stated by the applicant that the architecture of the building will remain consistent with -the -existing center. Mr. Walkup informed all concerned that five two=person tables are proposed within the atrium area and agreed with the condition that the dining area be limited to twenty -percent of the floor area.
