Center CA BOARD MEMBERS PRESENT: Godfrey, Smith, Vogelsang, Vincent, Crosby STAFF MEMBERS PRESENT: Pierce, Poe MINUTES: ON MOTION BY POE AND SECOND BY GODFREY, THE MINUTES OF THE REGULAR MEETING OF MAY 2, 1984, WERE APPROVED AS TRANS- CRIBED BY THE FOLLOWING VOTE: AYES: Godfrey, Smith, Poe NOES: None ABSTAIN: Vogelsang, Vincent, Crosby REGULAR AGENDA ITEMS: RECONSIDERATION - USE PERMIT NO. 84-24 (Con't. from 5/30/84) Applicant: Dr. John F. Pelochino To permit a 1,550 sq. ft. office addition to an existing building. Site location is 19471 Beach Boulevard. Chairman Smith introduced the proposal and stated that this request is categorically exempt, Class. 1, under the California Environmental Quality Act of 1970. Staff informed the Board that the applicant's new plan allows for a 1,550 sq. ft. office building in lieu of original proposal for a restaurant which was denied by the Board as it was felt not to be a proper use for the site due to circulation, parking, etc. The new concept consists of twenty (20) parking spaces (18 required) utilizing compact parking ratio. Discussion carried on the fact that a 27 ft. turning radius is required for parking shown at the north of the property in addition to reciprocal use of the existing drieway also at this location. Necessary Ordinance Code requirements with regard to street improve- ments at the corner of Yorktown and Beach Boulevard were explained to the applicant along with necessary dedication at the southwest property line. Dr. Pelochino was informed that handling of dedication would have to transpire prior to issuance of building permits with curb cuts and paving prior to final framing as depicted in the Ordinance Code. Widening of the most easterly driveway on Yorktown and an area for the trash enclosure were discussed. There being no one else present wishing to speak in favor or opposition of the applicant's proposal, the public hearing was closed. Conditions of Approval were discussed. ON MOTION BY VINCENT AND SECOND BY GODFREY, RECONSIDERATION OF USE PERMIT NO. 84-24 WAS CONDITIONALLY APPROVED AS FOLLOWS, SUCCEEDED BY VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modification described herein: a. location of trash area. 2. The storage area at rear of building shall be screened from street view. 3. Applicant shall enter into irrevocable ingress and egress easement between the subject site and property owner to the north. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder and a copy shall be filed with the Department of Development Services prior -2- BZA 6/6/84 Minutes: H.B. Board of Zoning Adjustments June 6, 1984 Page Three to issuance of building permits. 4. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval for new and upgrade of existing landscaping. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 5. Proposed addition shall be architecturally compatible with the existing structure. 6. Signing shall be brought into conformance with Article 976 of the Huntington Beach Ordinance Code. 7. Low -volume heads shall be used on all spigots and water faucets. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 9. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 10. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 11. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 12. The most easterly driveway on Yorktown shall be widened and constructed to the satisfaction of the Traffic Engineer and the Department of Development Services. Board of Zoning Adjustments June 6, 1984 Page Four CONDITIONAL EXCEPTION NO. 84-25 AND USE PERMIT NO. 84-34 Applicant: Mr. Phil Zisakis C.E. Request - Alternative "A" - To permit a reduction in parking, sight angle encroachment and elimination of a p tion of required perimeter landscaped planter area; or Alternative "B" - To permit a reduction in required perimeter landscape planter area, allow compact parking, a reduction in exterior side yard from 10 ft. to 6 ft. and parking encroachment into required perimeter landscape planter area. U.P. Request - To permit construction of a 2,000 sq. ft. commercial building. Site location is at the northwest corner of Cypress and Beach Boulevard. Secretary Godfrey stated that he had received a telephone call wherein a three (3) week continuance for both applications was requested. There being no one present wishing to speak in favor or opposition of the requests, the public hearing was not opened. ON MOTION BY CROSBY AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 84-25 AND USE PERMIT NO. 84-34 WERE CONTINUED FOR THREE WEEKS, TO THE MEETING OF JUNE 27, 1984, BY THE FOLLOWING VOTE: AYES: Godfrey, Smith, Vogelsang, Vincent, Crosby NOES: None ABSTAIN: None USE PERMIT NO. 84-38 Applicant: Thomas L. Wickstrom To permit a seven (7) unit apartment building to be located at 2714 Delaware Street. Chairman Smith introduced the proposal and stated that this request is categorically exempt, Class. 3, under the California Environmental Quality Act of 1970. Upon staff's review of.the applicant's plan, it was felt that the project substantially meets the Zoning Code requirements with the following two exceptions: 1) the trash enclosure needs to be relocated to within 200 feet of units intended to be served and 2) that the turnaround at the rear of the parking area is insufficient for maneuvering of fire equipment to serve the two units located at the rear of the property. The public hearing was opened with Thomas Wickstrom present to speak in behalf of his proposal. -4- BZA 6/6/84 Minutes: H.B. Board of Zoning Adjustments June 6, 1984 Page Five The applicant was informed that as a trade-off, if he could not increase the driveway width to 24 feet�fbr adequate.turnaround area, he could install residential sprinkler systems within the two rear units and, as an onsite fire hydrant is required which presently exits, providing it's within 150 feet of each of the other five units, he would satisfy the fire requirement. Architectural features were discussed. ON MOTION BY VINCENT AND SECOND BY VOGELSANG, USE PERMIT NO. 84-38 WAS CONDITIONALLY APPROVED AS FOLLOWS, SUCCEEDED BY VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 10, 1984, shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit a chain of title indicating original creation of subject property. Said deed shall have been recorded prior to January 16, 1984. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. -5- BZA 6/6/84 Minutes: H.B. June 6, 1984 Page Six Board of Zoning Adjustments 4. The development shall comply with all applicable provisions of the Ordinance Code, Building Division and Fire Department. 5. Service roads and fire lanes as determined by the Fire Depart- ment shall be posted and marked. 6. Driveway approaches shall meet the requirements and approval of Public Works Department. 7. Fire hydrants shall be provided in number and at locations specified by the Fire Department as required by 5.9320.23. 8. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 9. Low -volume heads shall be used on all spigots and water faucets. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 11. Galvin To permit a 4,472 sq, ft. addition at 17072 Gothard Avenue (east side of street). Following introduction of the applicant's request, Chairman Smith informed all concerned that this proposal is categorically exempt, Class. 1, under the California Environmental Quality Act of 1970. -6- BZA 6/6/84 Minutes: H.B. Board of Zoning Adjustments June 6, 1984 Page Seven Ray Galvin, property owner, was present to speak on his proposed warehouse addition to be located at the site of his auto body shop in an M-1 Zoning District. The necessity for a parcel map, consolidating numerous small parcels, was explained to the applicant. He was also informed that since his original entitlement in 1980, the Code now requires a ten (10) ft. landscape planter along the frontage of the property. Additionally, the existing block wall fence along Palmdale will have to be reduced to not exceed forty-two (42) inches in height or completely removed. Discussion carried between the Board and applicant on the architectural features for the proposed addition with emphasis placed for special treatment for the rear building wall along Palmdale Street. Landscaping for the site was adequate (over 6 percent). ON MOTION BY SMITH AND VINCENT, ADMINISTRATIVE REVIEW NO. 84-36 WAS APPROVED WITH FINDINGS FOR APPROVAL AND VOTE FOLLOWING: CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: a. A 10 ft. wide planter shall be provided along Palmdale Street except at driveway opening. b. Elimination of 6 ft. high wall within ten ft. setback along Palmdale Street. c. Handicapped parking space shall be located in front parking area. 2. Prior to issuance of building permits, the applicant shall file a parcel map (which shall be recorded prior to final inspection) consolidating Lots 4 and 9, and south 35 ft. of Lots 3 and 10 and north 20 ft. of Lots 5 and 8 of Block "D" in the Town of Wintersburg. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. -7- BZA 6/6/84 Minutes: H.B. Board of Zoning Adjustments June 6, 1984 Page Eight 4. Special architectural treatment shall be provided using split -face block on the rear building wall along Palmdale Street. Such treatment shall be reviewed and approved by the Department of Development Services. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division and Fire Department. 6. Maximum separation between building wall and property line shall not exceed two (2) inches. 7. Driveway approaches shall be a minimum of twenty-seven (27) ft. in width and shall be of radius type construction. 8. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations or firewalls constructed in compliance with Fire and Building Codes. 9. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 10. Low -volume heads shall be used on all spigots and water faucets. 11. All building spoils, such as unusable lumber, wire, pipe,'and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 12.
