ROLL CALL Present: Thomas, MacAllister, Kelly, Finley, Bailey Absent: Pattinson, Mandic RESOLUTION NO 5419 - ADOPTED - AMENDS RULES AND REGULATIONS RELATING TO HOME MORTGAGE FINANCING PROGRAM The City Clerk presented Resolution No. 5419 for Council consideration - "A RESOLUTION OF THE CITY COUNCIL'OF THE CITY OF HUNTINGTON BEACH AMENDING RULES AND REGULATIONS RELATING TO ITS HOME MORTGAGE FINANCING PROGRAM. Following discussion, on motion by MacAllister, second Thomas, Council adopted Resolution No. 5419 by the following roil call vote: AYES: MacAllister, Thomas, Kelly, Finley, Bailey NOES: None ABSENT: Pattinson, Mandic STUDY SESSION ON CODE AMENDMENT #83-16 - STANDARDS & GUIDELINES FOR CONVERSION OF APARTMENTS - ORD NO 2711 - PUBLIC IM"ING OPENED 7 2 84 & CONTINUED OPEN TO'8/6/84 The City Clerk presented Code Amendment 83-16 proposed to amend the Huntington Beach Ordinance Code by adding Article 936.5 establishing standards and guidelines for conversion of apartments to residential condominiums, stock cooperatives and community apartments. Negative Declaration No. 84-12 was also presented for consideration. Deputy City Attorney Art Folger stated that a case is pending before the California Supreme Court which, if it is upheld, would make a large portion of the proposed ordinance void. Considerable discussion was held regarding the matter. The Director of Development Services presented a history of the proposed condominium conversion ordinance. He referred to the parking survey of five apartment sites: Apple, 6700 Warner Avenue; Banbury Cross, 16761 Viewpoint Street; Californian, 6242 Warner Avenue; Casa del Sol, 21661 Brookhurst Street and Casa Monterey, 6551 Warner Avenue. 153 Page 2 - Council Minutes - 7/30/84 Jim Barnes, Associate Planner, presented a staff report on the proposed ordinance. Discussion was held regarding density bonus and sound attenuation. Norbert Dall',.representing developmental interests, suggested adding the following wording .to, Section 936.5.12.1(a) pertaining to density bonus "...pursuant to current existing zoning..." A representative of .the Huntington Beach/Fountain Valley Board of Realtors spoke in opposition to Section 936.5.12.1(g) pertaining to a rental dwelling unit vacancy rate of 3% or' --less may be. a basis of denial of an application. Discussion was held regarding the matter._ Section 936.5.9(i) pertaining to relocation assistance to displaced tenants was discussed. Dick Harlow, representing Dick Harlow and Associates, commented on various aspects of the proposed ordinance. RESOLUTION NO 5422 - ADOPTED - SUBMITTING TO ELECTORS CITY QUESTIONS RELATING TO SPECIFIC CHARTER AMENDMENTS - GENERAL MUNICIPAL ELECTION 11/6/84 The City Clerk presented Resolution No. 5422 for Council consideration -- "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY QC3ESTIONS RELATING TO SPECIFIC CHARTER AMENDMENTS." On motion by MacAllister, second Bailey, Council adopted Resolution No. 5422 by the following roll call vote: AYES: MacAllister, Thomas, Kelly, Finley, Bailey NOES: None ABSENT: Pattinson, Mandic RESOLUTION NO 5423 - ADOPTED - AUTHORIZING Mar-ALLISTER/THOMAS TO FILE WRITTEN ARGUMENTS FOR CITY MEASURES - GENERAL MUNICIPAL ELECTION - 11/6184 The City Clerk presented Resolution No. 5432 for Council consideration - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTNGTON BEACH AUTHORIZING CERTAIN OF ITS MEMBERS TO FILE WRITTEN ARGUMENTS FOR CITY MEASURES." On motion by MacAllister,' second Bailey, Council adopted Resolution No. 5423 authorizing Councilmembers John Thomas and Don MacAllister to file the written argument for the city measure pertaining to removal of limitation barring a person from serving more than two consecutive terms as a City Councilmember, by the following roll call vote: AYES: MacAllister, Thomas, Kelly, Finley, Bailey NOES: None ABSENT: Pattinson, Mandic ,A Page 3 - Council Minutes - 7/30/84 A T% YnTTO MMU Um Mayor Kelly adjourned the regular meeting of the City Council of the City of Huntington Beach.
