This request is a Categorical Exemption, Class 3, California Environmental Quality Act, 1970. Mike Strange presented the staff report. He noted that a requirement for moving the trash enclosures is part of the suggested conditions of approval, and the Board discussed placing additional landscaping into the current location of trash enclosures. The public hearing was opened. Minutes, H.B. Board of Zoning Adjustments August 8, 1984 Page 2 John King was present to represent the application; he reviewed the proposed.change to the trash enclosures to make sure he under- stood what staff was proposing. There were no other persons to speak for or against the project, and the public hearing was closed. Jim Vincent, citing the hazard posed by use of propane barbeques, suggested that a condition for stubbing natural gas out to the patios be added. ON MOTION BY VINCENT AND SECOND BY EVANS USE PEP14IT NO. 84-60 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of land use. CONDITIONS OF APPROVAL: 1. The site plan, floor plan, and elevations received and dated July 18, 1984 shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Devel- opment Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indi- cate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. The development shall comply with all applicable provisions of the ordinance code, Building Division, and Fire Department. 4. Low -volume heads shall be used on all spigots and water faucets. 6. Natural gas shall be stubbed out to the private patio areas for use as barbeque connections. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 8. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 9. If foil -type insulation is to be used, a fire retardant tvpe shall be installed as approved by the Building Division. 10. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 11. The structures on the subject property,. whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervisd)on of a person experienced in the field of acoustical engineering, with the application for building permits. 12. Natural gas shall be stubbed in at the locations of cook- ing facilities, water heaters, and central heating units. 13. The trash enclosures shall be relocated to the westerly side of the property behind the required front yard set- back. Said trash enclosures shall be architecturally com- patible with the proposed apartment buildings. 14. Additional landscaping shall be planted on the east side of the property at the end of the proposed driveway. The design of said landscaped planter shall be to the approval of the Department of Development Services prior to the issuance of building permit. Board of Zoning Adjustments August 8, 1984 Page 4 TENTATIVE PARCEL MAP NO. 84-588 (UP 84-60) Applicant: Villa Vista Development Corporation To permit a two -parcel division of land on property located on the east side of Delaware Street approximately 178 feet north of Garfield Avenue. Mike Strange reported that the map has been checked and it com- plies with the Subdivision Ordinance and the Map Act. Applicants have been advised of the suggested conditions of approval and have agreed to them. ON MOTION BY EVANS AND SECOND BY SMITH TENTATIVE PARCEL MAP NO. 84-588 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: FOR COMPLETION PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Devel- opment Services on July 18, 1984 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Depart- ment of Public Works and recorded with the Orange County Recorder. 3. Delaware Street shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach sewage system at the time said parcels are developed. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City ordinances. 8. The property shall participate in the local drainage assessment district at the time said parcels are developed. 9. A copy of the recorded parcel map shall be filed with the De- partment of Development Services. 10. Vehicular access rights along Delaware Street shall be dedi- cated to the City of Huntington Beach except at locations approved by the Board of Zoning Adjustments. Board of Zoning Adjustments August 8, 1984 Page 5 USE PERMIT NO. 84-62 Applicant: William Messer To permit an addition to a single-family dwelling along setback line made nonconforming by adoption of Ordinance No. 1973. Subject property is located at 16989 Edgewater Lane. This request is a Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Mike Strange reported that the addition will not increase the footprint of the first floor but will add to the second floor only and will be constructed along the existing wall line established when the dwelling was first constructed. The public hearing was opened. William Messer was present and spoke in support of his request. There were no other persons present to speak for or against the proposal, and the public hearing was closed. Board review ensued. ON MOTION BY EVANS AND SECOND BY VINCENT USE PERMIT NO. 84-60 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. Board of Zoning Adjustments August 8, 1984 Page 6 ADMINISTRATIVE REVIEW NO. 84-50/NEGATIVE DECLARATION NO. 84-18 Applicant: M.U. and B.U. Patel To permit construction of a 30-unit motel with manager's living quarters, located on the east side of Beach Boulevard approximately 300 feet north of Ellis Avenue. Mike Strange reported that there are deficiencies on the site plan in regard to inner circulation and turnaround radius; also, there is a storm drain easement on the property which must be taken into consideration in site layout. Therefore, staff is recommending denial. The applicants were present and indicated that they had not pre- viously been made aware of the problems. They requested a con- tinuance instead of a denial to permit them time to meet with staff and revise the plan as necessary. ON MOTION BY VINCENT AND SECOND BY SMITH NEGATIVE DECLARATION NO. 84-18 AND ADMINISTRATIVE REVIEW NO. 84-50 WERE CONTINUED TO THE MEETING OF AUGUST 22, 1984, UPON THE APPLICANT'S REQUEST, BY THE FOLLOWING VOTE: AYES: Godfrey, Smith, Evans, Vogelsang, Vincent NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 84-53 (LLA 84-9) Applicant: Douglas Ely of Architects Orange To permit construction of a 12,150 square foot industrial building located in the area between Pipeline and Connector Lanes approxi- mately 160 feet north of Machine Drive. This request is covered by EIR 73-16, previously approved by the City Council for the Lusk Industrial Tract. Mike Strange said that this plan substantially complies with the code; however, staff is suqgesting that a requirement for a recip- rocal driveway agreement between the subject property and the property immediately to the north be imposed on the application. Daryl Hebenstreit, representing the application, was present at the meeting and indicated that the entire property is presently owned by the same owner. At this point there is no problem with reciprocal access, and if the properties are sold off separately in the future such an agreement would be part of the sales agreement. This was discussed by the Board and it was the consensus that the City would have no further control over the properties and it was desirable to obtain the access easement at this time, Mr. Hebenstreit concurred. He also pointed out that the property owner has plans to develop the parcel immediately behind the subject parcel, and there will be a shared driveway coming through 1 I -6- 8-8-84 - BZA Minutes, H.B. The applicant said that with his application for the next parcel he will include drawings showing how the total four -parcel area has been planned. ON MOTION BY VINCENT AND SECOND BY VOGELSANG ADMINISTRATIVE RE- VIEW NO. 84-53 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated July 16, 1984 shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Departments of Development Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indi- cate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. The development shall comply with all applicable provisions of the ordinance code, Building Division, and Fire Depart- ment. 4. Maximum separation between building wall and property line shall not exceed two (2) inches. 5. Driveway approaches shall be a minimum of twenty-seven (27) feet in width and shall be of radius type construction. 6. Onsite fire hydrants shall be provided in number and at locations specified by the Fire Department. 7. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 8. Low -volume heads shall be used on all spigots and water faucets. 9. All building spoils, such as unsuable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 10. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. The subject property shall enter into irrevocable reciprocal driveway and parking easements between the subject site and the adjacent property to the north. A copy of the legal in- strument providing such easements shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the office of the County Recorder and a copy of the recorded document filed with the Departemnt of Devel- opment Services prior to issuance of building permits. AYES: Godfrey, Smith, Evans, Vogelsang, Vincent NOES: None ABSENT: None LOT LINE ADJUSTMENT NO. 84-9 (AR 83-53) Applicant: Von Der Ahe Partners To permit minor adjustments of lines between parcels resulting in the same number of lots on property located between Pipeline and Connector Lanes approximately 160 feet north of Machine Drive. This request is a Categorical Exemption, Class 15, California En- vironmental Quality Act, 1970. John Mandrell was present to respond to any questions on the lot line adjustments and submitted the original plat layout for the subject application. ON MOTION BY EVANS AND SECOND BY VINCENT LOT LINE ADJUSTMENT NO. 84-9 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The lot line adjustment is consistent with the criteria out- lined in S. 9811.3.1 of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL: 1. The applicant shall submit a copy of the recorded Lot Line Ad- justment to the Department of Development Services. 2. All previous conditions of approval for Tentative Parcel Map No. 79-581 shall remain in effect. 3. The plan received and dated July 27, 1984 shall be the approved layout. Board of Zoning Adjustments August 8, 1984 Page 9 ADMINISTRATIVE REVIEW NO. 84-54 Applicant: T.H.,Forhan Associates To permit construction of a 15,300 square foot industrial building located on the east side of Commerce Lane approximately 232 feet north of Research Drive. This request is covered by EIR 73-16, previously approved by the City Council for the Lusk industrial tract in which it is proposed to be located. Vincent Stagliano was present at the meeting. He explained an apparent discrepancy between width of the property as shown on the assessor's maps at 232 feet and the width as shown on his site layout of 205 feet by saying that the subject parcel con- sists of one lot and a portion of another. The width of 205 feet is correct on his title report. The Board indicated that some confirmation that the lots were merged will be necessary. Mr. Stagliano also corrected a misstatement of the size of the building, noting that it is actually to be a 15,300 square foot building instead of the 21,000 square feet indicated in the agenda description. ON MOTION BY EVANS AND SECOND BY SMITH ADMINISTRATIVE REVIEW NO, 84-54 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated July 17, 1984 shall be the approved layout. 2. Prior to issuance of building permits, applicant shall sub- mit evidence that Lots 18 and 19 have been consolidated and recorded. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Departments of Public Works and Development Services for review and approval. h. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4.
