Chairman Porter indicated that he had been requested to continue this item until more members of the commission were present. However, in response to parties who were present that evening, the public hearing and discussion would be held for the record. He asked if staff had received the letter from the Legal Aid Society. Mike Adams presented the staff report and recommended approval of the Huntington Beach Mobile Home Impact of Conversion Report and approve Resolution No. 1326. The public hearing was opened. Seeing there was no one present to speak for or against the item, the public hearing was closed. Secretary Palin asked if anyone was present from the Legal Aid Society in order to clarify comments on their communication. We feel that some of the comments in this communication are invalid and the Impact of Conversion Report does comply. If there is a need for additional information, we can seek that out in the next two weeks. Chairman Porter asked if anyone was present from the Legal Aid Society. No one was present. Commissioner Livengood requested that staff prepare a response to the Legal Aid Society's concerns at our next regular meeting. He also requested staff include a relocation date, whether it would be March or April. Commissioner Erskine requested that the Huntington Beach Company be given a copy of the letter from the Legal Aid Society. Chairman Porter commented that it (1085) -2- P.C. Minutes 8-24-84 would be appropriate to inform the residents of the mobile home park of the continuance of this item to the meeting of September 5, 1984. ON MOTION BY LIVENGOOD AND SECOND BY WINCHELL, RESOLUTION NO. 1326 WAS CONTINUED TO THE MEETING OF SEPTEMBER 5, 1984 BY THE FOLLOWING VOTE: AYES: Winchell, Livengood, Porter, Erskine NOES: None ABSENT: Higgins, Schumacher, Mirjahangir ABSTAIN: None TENTATIVE PARCEL MAP NO. 84-585/CONDITIONAL USE PERMIT NO. 84-20/CONDITIONAL EXCEPTION NO. 84-04/NEGATIVE DECLARATION NO. 84-25 Applicant: Hancock Development Tentative Patcel Map No. 84-585 is a request to create 4 industrial parcels with reciprocal ingress and egress on 8.0 acres of property located on the northeast corner of Warner Avenue and Gothard Street. Conditional Use Permit No. 84-20 is a request to construct a mixed use industrial/commercial/office development at this location. Conditional Exception No. 84-04 is a request to permit a 20 ft. high building within 45 ft. of property zoned residential, in lieu of 18 ft., eliminate the landscape buffer and to allow zero setbacks in lieu of 15 ft. setback as required. Mike Adams made the staff presentation which recommended denial of Conditional Use Permit 84-20 with findings, approve Negative Declaration No. 84-25 with mitigating measures, request withdrawal of Tentative Parcel Map 84-584, and withdraw Conditional Exception No. 84-04 as it is not required. As an alternative, continue this item to allow the developer time to work with staff to develop a theme. Public Hearing was opened. Eugene Hancock, developer for this project stated that the project is in compliance with the requirements and that the mixed use is a good use for this area. He stated that it was not feasible to leave the trees and develop the property as the trees were either in the middle of a building or the root structure would cause problems. He stated his willingness to continue to September 5, 1984 and work with Commission's and staff's guidance. The public hearing was closed. Mike Adams stated that the major issue that the commission should discuss is whether the applicant may be granted the flexibility of commercial on Warner Avenue as opposed to the 50% mixed use requirement by code. Commission discussion began with Commissioner Livengood stating that Gothard should be protected as an industrial corridor and Warner Avenue as commercial. Commissioner Winchell stated that there is enough commercial along Warner Avenue and we should stay with industrial. She favors enforcing the mixed use requirements. She further stated that she would like to see some upgrade to the architecture of the building along Warner Avenue. Chairman Porter (1085) -3- P.C. Minutes 8-24-84 stated that is seems that the light industrial is more appropriate along Warner Avenue. Commissioner Erskine stated that he was in favor of the mixed use but was concerned about the architecture. Commissioner Winchell recommended that the Design Review Board look at the architecture of the building. CONDITIONAL USE PERMIT NO. 84-19/TENTATIVE TRACT NO 12238 Applicant: Mola Conditional Use Permit No. 84-19 in conjunction with Tentative Tract No. 12238 is a request to create a one lot subdivision and construct a 105 unit condominium development on 3.07 gross acres of property bounded by Pacific Coast Highway, 12th Street, 13th Street and Walnut Avenue. Jim Barnes made the staff presentation and recommended approval subject to the findings and conditions and deletion of condition no. 13. Tom Poe presented the Fire Departments recommendation to add to condition no. 11 "A fire sprinkler system shall be installed throughout in accordance with the National Fire Protection standard 13 and standards of the Huntington Beach Fire Department". Condition no. 17 add "A wet stand pipe system approved by the Fire Department is to be installed throughout the complex in accordance with standards of the building code". Commissioner Livengood suggested adding condition no. 18 "Shall comply with the design concept of the Downtown Specific Plan and be approved by the Design Review Board". Public hearing was opened. Richard Harlow, representing Mola, went over the following key points: The project is consistent with the density standards, subterrranean parking is provided, common area is double the Downtown Specific Plan requirements, and each unit has a private balcony. He requested that condition no. 2 to be "a balanced system of natural gas and electric be provided". He also requested that condition no. 14 requiring a second access out of basement B be deleted as it is in compliance with code. Ernie Vasquez, representing (1085) -4- P.C. Minutes 8-24-84 `1 the applicant made his presentation. He stated that this project would not meet the affordable housing, however, Mola has several other projects in the city that did meet the affordable housing requirements. Public hearing was opened. A local resident spoke in opposition of the project stating that this project would destroy the view corridor for the current property owners in the area. She also expressed concern over the increased traffic and parking congestion that a project of this size would create. Public hearing was closed. Commissioner Winchell stated that she would be voting no on this action and recommended continuance until more members of the commission are present. She stated that this is the type of project that will be allowed under the new Downtown Specific Plan and that we should have been more restrictive in the plan. This project has 50 units per net acre. She further stated that the developer is using the land to the hilt and she finds it appalling, but it is legal. Commissioner Erskine stated that there is no vested right to a view corridor. The land at the site has been vacant for a number of years and that this is a fine project, not one that is taking advantage of a poorly designed planning decision. There was some discussion as to width of the sidewalks, landscaping theme, possible cul-de-sac at 12th and 13th Street, and possible light at llth or 14th Street. Mike Adams suggested that the project be reviewed by the Design Review Board. Chairman Porter directed staff to be sure that the Design Board receive a recording of this meeting. He instructed staff to change condition no. 2 on CUP 84-19 to "a balanced system of natural gas and electric shall be provided", add to condition no. 11 "A fire sprinkler system shall be installed throughout in accordance with the National Fire Protection standard no. 13 and standards of the Huntington Beach Fire Department, delete condition no. 14, add condition no. 17 on TTN 12238 "A wet stand pipe system approved by the Fire Department is to be installed throughout the complex in accordance with standards of the building code." ,and condition no. 18 "Shall comply with the design concept of the Downtown Specific Plan and approved by the Design Review Board. Minutes 8-24-84 Mike Adams presented the staff recommendation to approve Conditional Use Permit 84-21 based on the findings and conditions. Public hearing was opened: Susan Kline, the applicant gave her professional background and spoke of the need for the type of school that would provide quality education, extended day care and 12 month service. She stated that the building on the ground floor had all ready obtained a permit in the past for a learning center and for assembly. She questioned the requirement for additional parking during phase 2. Staff indicated that upon opening of phase 2, the applicant will be required to meet parking codes. Three residents spoke in opposition of the school. They stated concern over the increased noise, traffic, and welfare of the children due to the flooding that occurred on this site last year. The public hearing was closed. ON MOTION BY LIVENGOOD AND SECOND BY ERSKINE, CONDITIONAL USE PERMIT NO. 84-19 AND TENTATIVE TRACT NO. 12238 WAS APPROVED, WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed use, subject to the conditions, will be compatible with existing and proposed uses in the neighborhood; and will not have a detrimental effect and convenience of persons upon the residing general health, welfare, safety or working in the neighborhood. 2. The proposed use is consistent with the goals and objectives of the General Plan. 3. The subject property is of adequate size and shape for the proposed use. 4. Access to and parking for the proposed use should not create undue parking problems. 5. Outside activity area to be buffered from existing R1. CONDITIONS OF APPROVAL: 1. The conceptual site and floor plans dated July 19, 1984 shall be the approved layout. 2. Maximum enrollment shall be limited to 40 children. If the assembly area of the first floor is utilized for assembly type uses, all conditions of Conditional Use Permit 83-26 for the additional parking lot shall be met. 3. Plans shall be submitted showing the play area in detail in conformance to Huntington Beach Ordinance Code Section 9331.d.1 and located along the southern property line, and shall be subject to review and approval of the Director of Development Services prior to occupying the building. (1085) -6- P.C. Minutes 8-24-84 4. The block wall along the north property line, shall be raised to a minimum of 6 feet. 5. A letter signed and notarized by the owner shall be submitted guaranteeing that all existing and future uses will not be conducted in a manner so as to conflict with the school use. 6. A minimum 5' x 7' masonry trash enclosure shall be provided in conformance with Huntington Beach Ordinance Code Section 9730.60. 7. No play equipment may be installed within the required parking area. 8. Hours of operation shall be limited to daytime hours only, 7:00 a.m. to 6:00 p.m. 9. The children shall be so supervised as to not create annoyances to adjacent property owners. 10. No signs shall be established on the subject property without prior Planning Department approval. 11. A parcel map or tentative tract map shall be submitted and approved by the City since the existing development overlaps two properties. 12. The applicant shall comply with the following Fire Department's requirements. a. The entire building shall be automatic sprinklered to comply with National Fire Protection Association, pamphlet 13 requirements. b. An automatic alarm system shall be installed to comply with Section 2-8209 of Title 24 of the California Administrative Code. c. All exits and the exit system are to comply with California Administrative Code, Title 24, Chapter 33 requirements. 13. A 10 foot wide storm drain and sewer easement shall be dedicated along the north property line as required by the Public Works Department. a. The grated inlet located at the northeast corner of the lot shall be replaced with a curb opening type. 14. The applicant and facility shall comply with all California Department of Education requirements. The Planning Commission reserves the right to rescind the Conditional Use Permit in the event of any violation of the terms of this approval or violation of applicable zoning laws. Any such decision shall be preceded by notice to the applicant and a public hearing, and shall be based upon specific findings. (1085) -7- P.C. Minutes 8-24-84 15. Limit the hours the outdoor play facility can be used to weekdays between 11:00 a.m. and 2:00 p.m.. AYES: Winchell, Livengood, Porter, Erskine NOES: None ABSENT: Higgins, Schumacher, Mirjahangir ABSTAIN: None CONDITIONAL USE PERMIT NO. 84-22 Applicant: Wayne Howard Construction Conditional Use Permit No. 84-22 was filed to allow the addition of a second unit to an existing single family residence pursuant to Section 9101.3 of the City's Ordinance Code. Mike Adams made the staff presentation and recommended approval with findings and conditions. The public hearing was opened. Joann Perry, owner of the property, stated that she will be moving into the addition and that her daughter and her family will be moving into the main house. She asked if the condition requiring one garage space to be partitioned from the other two spaces be deleted, due to the fact that this area contains the washer and dryer and needs dual access. The public hearing was closed. Commissioner Winchell stated that the requirement in the code states that we have four on -site parking spaces and that the family should decide if it is necessary to partition part of the garage. ON MOTION BY LIVENGOOD AND SECOND BY ERSKINE, CONDITIONAL USE PERMIT NO. 84-22 WAS APPROVED, WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the conditional use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and dated July 24, 1984, shall be the approved layout. (1085) P.C. Minutes 8-24-84 2. The applicant shall provide safety, energy and conservation measures as required by Section 9101.3. 3. The addition shall comply with all applicable provisions of the Ordinance Code and Building Division. 4. The parking spaces for the second unit shall be arranged in tandem, one space in the garage and one space on the driveway behind it. 5. A concrete walkway shall be provided around the side of the house as a means of access to the rear entry door. Mike Adams presented the staff report which recommended denial of SSP No. 84-6 based on the findings. The public hearing was opened. Norman Butler of Heath and Company spoke in favor of the sign stating that they feel the sign is in good taste and is designed to attract attention to Maxwell's Restaurant. The public hearing was closed. Commissioner Erskine stated that the sign is obnoxious and not needed. Commissioner Livengood stated that the sign is not compatible with the Downtown Specific Plan. ON MOTION BY ERKSINE AND SECOND BY LIVENGOOD, SPECIAL SIGN PERMIT NO. 84-6 WAS DENIED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: FNDINGS FOR DENIAL: 1. The proposed sign would constitute a grant of special privilege inconsistent with other properties in the vicinity. 2. The proposed sign would adversely affect other signs in the area. 3. The proposed sign would be detrimental to the property in the vicinity. 4. The proposed sign is inconsistent with the design concept for the Downtown Specific Plan. 5. The proposed sign would constitute a traffic hazard as it would be a distraction for passing motorists. (1085) -9- P.C. Minutes 8-24-84 AYES: Winchell, Livengood, Porter, Erskine NOES: None ABSENT: Higgins, Schumacher, Mirjahangir ABSTAIN: None PRECISE PLAN OF STREET ALIGNMENT NO. 84-1/NEGATIVE DECLARATION NO. 84-30 Initiated by the City of Huntington Beach Precise Plan of Street Alignment No. 84-1 was filed by the Department of Development Services to establish a 50 foot right-of-way, and to establish a 46 foot right-of-way on Lyndon Street north of Washington Avenue in lieu of the current 52 foot right-of-way. The reduction in street right-of-way on Washington Avenue is being requested by Development Services to permit property owners to retain adequate lot square footage for construction of three units per lot. The street width reduction on a portion of Lyndon Street is to be consistent with the parkway width reduction on Washington Avenue. The public hearing was opened. The time frame being 2 years with a maximum of 3 one year extensions. Staff presentation was made. The public hearing was opened. Minutes 8-24-84 ON MOTION BY WINCHELL AND SECOND BY LIVENGOOD CODE AMENDMENT NO. 84-17 WAS APPROVED AND RECOMMENDED TO THE CITY COUNCIL FOR ADOPTION, BY THE FOLLOWING VOTE: AYES: Winchell, Livengood, Porter, Erskine NOES: None ABSENT: Higgins, Schumacher, Mirjahangir ABSTAIN: None ITEMS NOT FOR PUBLIC HEARING CODE AMENDMENT NO. 84-16 - Reconsideration of Condition "1. e" Initiated by the City of Huntington Beach This item was scheduled by the Planning Commission at staff's request to reconsider Condition 1. e. of Code Amendment No. 84-16. Mike Adams made the staff presentation which recommended that Condition 1. e. be deleted requiring vehicular access between Dr. Friedman's property and the Humana Hospital property because it is unnecessary and impractical to implement. Mike Adams recommended that Condition 5 delete the reference to the "fee" property. Art Folger recommended that Condition 15 include: "and shall make an irrevokable offer to enter into a reciprocal access agreement". The proposed addition will not adversely affect surrounding properties or excessively increase traffic congestion nor create demand for additional parking spaces. CONDITIONS OF APPROVAL: 1. The site plan dated June 29, 1984, shall be revised to incorporate the following: a. removal of all parallel parking within the left turn pockets. b. removal of the storage buildings on the eastern property line and reclaiming the area for parking. C. extend the median island at the entrance off Beach Boulevard westerly to the property line. d. all mature landscaping should be maintained and not sacrificed for additional parking. e. increase amount of compact spaces within existing parking areas. f. provide handicapped parking to meet the State minimum standards. 2. The floor plans and elevations received and dated June 7, 1984, shall be the approved layout. 3. The applicant shall prepare a parking phasing plan showing future parking structures and their location, with a draft agreement entitling the proposed Beach Boulevard Medical Office and Center Medical Complex to participate in any future parking proposal in order to satisfy any future expansion needs. 4. The uses within the proposed development are limited to those outlined in the staff report dated July 10, 1984. Any modification, expansion or change of use shall require new entitlement and additional parking. 5. Parking lot modifications for the subject site and adjacent properties conveyed by lease shall be completed prior to the issuance of certificate of occupancy. 6. An automotic sprinkler system, or other approved system, shall be installed in the existing hospital complex and the addition subject to the review and approval of the Fire Department. 7. All life safety systems shall comply with State codes and Huntington Beach Fire Department standards. (1085) -12- P.C. Minutes 8-24-84 8. Should the addition cause any fire protection equipment to be obstructed, the equipment shall be reloacted to an area approved by the Fire Department. 9. Addition off -site fire hydrants are to be installed in locations approved by the Fire Department. 10. All travel lanes and turning radis shall conform with Fire Department standards. 11. All building spoils such as unusable lumber, wire, pipe and other surplus or unusable materials shall be disposed of at an off -site facility equipped to handle them. 12. If new lighting is included in the parking lot, energy efficient lamps shall be used. All outside lighting shall be directed to prevent spillage onto adjacent properties. 13. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, utilities, etc. 14. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement from such property. All structures within this development shall be constructed in compliance with G-factors as indicated by the geologist's report. Calculations for footings and structural members to withstand anticipated G-factors shall be submitted to the City for review prior to the issuance of building permits. 15. The applicant shall file a parcel map with the City to legally establish the lease lines shown on the approved site plan and shall make an irrevokable offer to enter into a reciprocal access agreement. 16. The installation of the C.T. scanner facility may be permitted to occur prior to the development of parking improvements. Administrative Action No. 84-6 Applicant: Ad -Art, Inc. Administrative Action No. 84-6 was filed to replace the sign faces of an existing non conforming, double -face pole sign. Mike Adams made the staff presentation which recommended approval, if the applicant and property owner concur, to allow alterations and continued use of nonconforming pole sign for a period not to exceed two years from the date of approval. Chairman Porter expressed concern over the proposed traffic signal at Neuman at the Humana Hospital site. We should spend some time working with Public Works for solutions to this problem.
