Present were past chairman Tom Bacon, present chairman Kathie Holmes, Merle
Cade, Stephen Schumacher, Carole Ann Wall, John Warde and ,Allen' Friedrich.
Also -.present were members of the Firecrackers. Jerome Bame, Donna Cross,
Spence Sheldon, Joyce -Riddell, Alice Bartlett and! Joan Y.ieser.. Also a member
but 'uiiable• to be present is Serine- Arnold.

Beach High School Drill Team and Tall Flags. girls. Present from .the Drill

Wendy Utu Samantha.Mehta, Jane Banaag, Dorm Breen, Tracy Jago, Ruth, Ann -

PUBLIC HEARING ---PRECISE PLAN OF STREET ALIGNMENT 84-2 -. RESCHEDULED TO
10/15 84
The Mayor, announced that this was .the day and hour set for a public hearing to
consider Precise Plan of Street- Alignment 84-2, a- proposed realignment of
Atlanta Avenue, Lake Street and Orange Avenue. The _proposed plan ,is, on file
with the Department of Development Services. Negative Declaration No. 84-14
has been' previously approved for'the• project'.
Development Services staff recommends that Council not hold a public hearing
on .Precise Plan of Street Alignment #84-2 with the repeal of Precise Plan of
Street Alignment #79-2 and repeal of a portion of PPSA #79-4, south�of'Chicago
Avenue until the meeting of October 15, 1984 in order for the Planning
Commission- to take formal: action on- repealing the affected -portion of Precise
Plan of Street Alignment #79-4.'
The. City Clerk announced that all legal requirements for`: iotification,
publication and posting had been met, and that she had received •no
communications or written protests to the matter.
The Director of Development Services recommended that the matter'be considered
on October 15, 1984.
On motion by Pattinson, second" MacAllister,. Council continued the. -'matter to
October 15, 1984 by the following ro11 call vote:

PUBLIC HEARING - APPEAL TO PC CONDITIONAL"APPROVAL OF CUP 83-20 - UPHELD PC
APPEAL DENIED-- OKTOBERFEST
The Mayor. announced that -this was the day and hour'set for a 'public, hearing to
consider .an appeal to the Planning Commission's conditional approval of
Conditional Use Permit "No. 83-20, a request to permit an annual Oktoberfest at
Old World Village located at the northwest corner of Center Avenue and
Huntington' Village Way within the 'North Huntington "Center Speci€ic` Plan. Tile
appellant is appealing the Planning Commission's requirement to provide eight
(8),portable 'toilets and four hundred .(400) parking spaces within 500 feet of
the event.
The City Clerk announced that all legal requirements for .notification,
publication and, posting had been met, and that she had received no
communications or"written protests to the matter.-

Tom Livengood, speaking on behalf_ of the Chairman of the Planning Commission,
recounted what had occurred at the Planning' Commission meeting when
Conditional Use Permit 83-20 was considered. He stated that future reviews of
the Conditional Use Permit would be held earlier in the year, ..in March, to
give.,the Oktoberfest promoters enough time to comply with any conditions that
::maybe imposed on the permit.-
The.Mayor declared the hearing open.
David. Rofer stated that he wholeheartedly supported the Planning Commission's
-desire to'be fair to keep the Oktoberfest on schedule. He stated he believed
future reviews should be on condition that.the applicant should get.permission
'from the' Association regarding accommodations. for the Oktoberfest. He
referred :to. a wall -.that had been retained for the year, since the last' "
Oktobe-rfest, expenses incurred in water usage and portable bathrooms placed on
common area without permission from the Association in violation of their
CG&Rs.
Harry Schellenbaum, President of Old World Village, stated that some of the,
businesse§ did not ,adhere to the CC&R's. established by the Association. -He
requested•.that Council conduct a thorough investigation of the matter..,
Bri•an•Rofer, Director of Old World Village Homeowners Association,.'s.tated that
the.board had not met to discuss Oktoberfest. He stated that'the Association
needed the support'of the City Council in enforcing their CC&Rs.
'Lee Durst,- legal counsel representing' the homeowners in Old World Village,
statedconcernregarding .parking for the Oktoberfest. He also mentioned the
noise generated during the Oktoberfest.
Ina Erbacker, Secretary -Treasurer of the Old World Homeowners. Association,
fw...stated;-her, concern regarding the number of restrooms' available, during, the
'Oktoberfest and concern as to whether the parking would be adequate. She
stated that she was'in favor of the_•Oktoberfest.but that it must be controlled.
Josef Bischof stated that lie was notified only ten days before the Oktoberfest
began that he must provide an additional eight 'toilets and 400 parking

spaces: ,He stated that he had managed to comply with these two.!,:coitions
�.He..described' the advertisement efforts on behalf of the Oktoberfest. He
requested that. Council declare the Oktoberfest, an annual event', and requested
:'that -he be informed 'several months before the event of` conditions, to the
Conditional Use Permit:
Bern e Bischof, manager -of the restaurant, stated that they_ had complied °with
all of 'the conditions to the Conditional Use Permit. He requested that.,
Council declare the Oktoberfest an annual event.
Ethi',Bussiere stated that she had a store in Old World Village' and spoke, in
favor. •She presented an informal survey she conducted of patrons of the store
and their attitude toward the Oktoberfest.
Dolores Bischof stated, that they had always complied with directionsf,•from'
agencies such as the' Police Department and Fire Department. She;; requested
':that Council declare the.Oktoberfest an annual event.

Serv,io Martinez addressed. Council and stated that- he believed .the problem
stemmed' from allowing residential tiand� •commercial to .be- mixed in the same
area. 'He suggested'a thorough investigation be made of the matter.

husband was barred from watching television. Mrs. Collins stated her' concern
regarding a news release stating chemicals had been added to the ,water supply
and that .warned people with 'kidney problems not to drink the i4ater., She
.•statedlthe notification also warned against putting fish in, the water, because .
of -the chemical.' She stated that she was concerned regarding her dog drinking
the ,water ;..
r Gordon Offstein stated that builders on Clay Street were using,'water from a
city;hydx`ant without paying for.it.
o ArloulAllan requested. that an ordinance 'be amended to allow twenty-four hour•
parking-,6f recreational vehicles on arterial streets to illow,a,,loading• and
` ,'unloading,of the vehicles.
Mayor Kelly directed staff to contact Mr. Allan regarding the matter..

Gloria Wheeler. stated! that she was a real estate agent and could not sell
property in the,Villa Court•comp.lex because of conditions,on Commodore Circle.,,
Discussion. was held between Council, staff and the City Attorney regarding the
possibility of declaring Commodore Circle a public nuisance. Discussion was
held regarding the possibility of trash clean up at Commodore,Circle.by either
cityemployees -or by. -Rainbow Disposal with the owners of the property being
,billed'at, a later date,, a project similar to the weed abatement -,program.
Staff ,was directed to take immediate steps toward solving -{the problem- by
consensus -of Council.
George., Arnold complained that Rainbow -Disposal used a trash container with"a
hold in it�. He also complained that bins were too full and when lifted toward
the ;truck,.:•trash fell- over' -the sides onto the alley. Mr. Arnold. stated,, that
weed;.abatement crews had not picked'up trash on 14th Street.
W. U Armstrong ''spoke regarding, the center divider .on Bolsa: Chica 'Street
between=Heil-Avenue,and Warner Avenue. He suggested the opening,in.1 the'median.,
' '.be moved ,to Shark Drive or to remove the center divider at. Shark- Drive and -..-
have. -double -lines only:

Chica Street median would create difficultyfor emergency vehicles 'entering
the. complex. .
• Councilwoman -Finley asked' if Shark. Drive was a private street. The City
^Eng neer'replied that it was'a private street serving the complex.' -.Discussion,
,.was held between Council -and. the Fire Chief regarding access to `the complex
with the median in,place. He .stated that his staff had inspected 'the`area,and.-
that he did not envision a problem in.gaining access to the complex..:'
~Howard Miller spoke regarding the Bolsa Chica Street median and suggested that
" approximately twenty feet of median•be removed to give access.to Shark Drive. .
John .Horne stated that' he 'was on Commodore Circle recently and that trash was
' stacked at a 45,degree'angle six feet high with toddlers playing nearby. .

SUPPLEMENTAL AGREEMENT #1 TO SPRINGDALE SCHOOL COMMUNITY RECREATION AGREEMENT
WESTMINSTER SCHOOL DISTRICT - Approved and authorized execution of
Supplemental Agreement #1 to the Springdale School Community Recreation
Agreement between the City and the Westminster School District to allow the
Franklin -School (formerly the Springdale School) to remove.a portion of'. the -
property from the present agreement to locate a vandal watch trailer.

FINAL TRACT 11560 - ALL OF TT 11560 - WOODTREE DEVELOPMENT - Approved Final
Tract. Map, 11560, being all of Tentative Tract 11560, pursuant to the required
'findings -set forth in S. 66458 and S. 66474 of the Government Code; accepted
offer of dedication and improvement subject to .completion of requirements
stipulated, 'on property located on the south side of Talbert approximately
$00' west of Beach Boulevard; examined and certified by the Director of Public
Works ,and.the Secretary to the Planning Commission as being substantially in "
accordance with the tenative map as filed with, amended and approved by the

affix'her signature to the map nor release such map for preliminary,processing
