BOARD MEMBERS PRESENT: Crosby, Godfrey, Smith, Vincent, Vogelsang STAFF PRESENT: Pierce, Poe MINUTES: Minutes of the regular meeting of September 19, 1984 ^� APPROVED AS TRANSCRIBED REGULAR AGENDA ITEMS SITE PLAN AMENDMENT NO. 84-16 (Cont. from 10-3-84) Applicant: Randy Leong (Delton Leasing) A request to permit construction of equipment shed addition to back of existing building on property located at 17891 Jamestown Lane (West side of Jamestown Lane approximately 140 feet North of Windfield Drive). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Ms. Pierce stated the applicant has met with members of the Fire Department and Development Services Department in an effort to meet their concerns. The storage shed will be relocated and redesigned to meet our standards. All parking requirements will be satisfied and Site Plan Amendment No. 84-16 will amend Administrative Review No. 80-55 for Lot 7 only. The applicant, Randy Leong, was present and said he understood the conditions as imposed. UPON MOTION BY VINCENT AND SECOND BY CROSBY, SITE PLAN AMENDMENT NO. 84-16 WAS APPROVED WITH THE FOLLOWING CONDITIONS, WITH THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. Site Plan Amendment No. 84-16 amends Administrative Review No. 80-55, Lot 7 only. Minutes, H. B. Board of Zoning Adjustments October 17, 1984 Page 2 2. The proposed structure shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 3. The applicant shall obtain all necessary permits. AYES: Crosby, NOES: None ABSENT: Godfrey, Smith, Vincent Vogelsang USE PERMIT NO. 84-75 (Cont. from 10-10-84) Applicant: Kaley Hosn A request to permit an automotive service center in conjunction with a self-service service station located at 8471 Warner Avenue (Northwest corner of Newland Street and Warner Avenue). This request is covered by Categorical Exemption, Class 3, California Environmental Quality Act, 1970. It was reported by Susan Pierce that this request had been continued due to the applicant not being present. Staff has made several recommendations to the project designer and a new site plan and floor plans with revisions have been received. This is an existing service station which will be demolished and a new building constructed. The Director of Development Services has indicated the Use Permit procedure would be the proper one to follow for applicant's request. Staff has recommended the Newland Street driveway aprons be removed and a new twenty-seven foot (27') wide drive be established. Canopies will be placed on front of the building to prevent it from looking like an automobile repair center. There was a discussion concerning moving the pumps, granting a drainage easement, or participation by the applicant in cost of removing cross gutter in Newland Street. Tom Poe asked where the cashier's booth would be located since the applicant would need a communication system for the booth for a self-service operation. Glen Godfrey arrived at this point. The Public Hearing had remained open from the previous meeting and the applicant's representative, Jesse Raymond from the Architect's office, was present. Mr. Raymond stated the corner booth would be the cashier's booth and Tom Poe said he would give them the Fire Department standards. Board of Zoning Adjustments October 17, 1984 Page 3 Ms. Pierce asked the Board if they wished to limit the hours of operation for the station. Glen Godfrey recommended the hours of 7:00 A.M. to 10:00 P.M. but Mr. Raymond stated the applicant would prefer 7:00 A.M. to 6:00 P.M. for the repair center and unlimited time for service station operation. UPON MOTION BY CROSBY AND SECOND BY GODFREY, USE PERMIT NO. 84-75 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the . vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the conditional use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated October 16, 1984, shall be the approved layout. 2. The property owner shall grant an easement for drainage purposes to the City of Huntington Beach or participate in cost of removing cross gutter. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. -3- 10/17/84 - BZA Minutes, H. B. Such treatment is subject to approval by the Department of Development Services. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 6. Driveway approaches shall be a minimum of twenty-seven feet (27') in width and shall be of radius type construction. 7. Hours of operation for automobile service center shall be limited to 7:00 A.M. to 6:00 P.M. Self-service portion has unlimited hours of operation. 8. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 9. All repair work shall be conducted wholly within the building. 10. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 11. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 12. The site shall be restricted to servicing of automobiles and sale of automobile -related products. A "mini -market" shall not be permitted without the approval of a conditional use permit by the Planning Commission. 13. No curb side parking shall be provided along Warner Avenue or Newland Street. 14. Low -volume heads shall be used on all spigots and water faucets. 15. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 16. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 17. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. -4- 10/17/84 - BZA I Minutes, H. AYES: Crosby, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang CONDITIONAL EXCEPTION NO. 84-61 (AR NO. 84-71) Applicant: Main Office Professional Building A request to permit a reduction in landscape planter width of ten feet (10') to eight feet (8') and nine feet (9') at property located on the North side of Kartron Street approximately 150 feet East of Florida Street. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Ms. Pierce noted this property has been an item of concern for several years. It is City -owned and was acquired in a tax sale. The applicant proposes to construct four (4) buildings on a vacant parcel. Staff does not find a land -related hardship; however, a ten foot (10') planter would not be consistent with the existing street scene and our findings for approval are based on conditions of the neighborhood. The Public Hearing was opened and Robert Jarrard was present to represent the applicant. Mr. Jarrard said he did not feel this project any longer warranted three (3) story buildings and he wants to build smaller buildings. The applicant also stated he has an agreement with the City to maintain landscaping for both front projects and we could have matching conditions on this project. Tom Poe expressed concern about the traffic circulation pattern in the parking lot. There was no one else present to speak so the Public Hearing was closed. Daryl Smith said he would like an additional condition stating that an agreement for maintenance of the landscaping in the parkway be required between the applicant and the City wherein the applicant will maintain that area. UPON MOTION BY VINCENT AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 84-61 WAS APPROVED AS AMENDED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Because of special circumstances applicable to the subject property, including size, shape, topography, location or -5- 10/17/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 17, 1984 Page 6 surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 2. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 3. The granting of Conditional Exception No. 84-61 will not be materially detrimental to the public welfare or injurious to property in the same zone classifications. 4. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. 5. Kartron Street is two-thirds (2/3) built with a reduced landscaped planter area. 6. Applicant proposes to install and maintain off site landscaping adjacent to the front property line. CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: a. All compact parking spaces shall be 8' x 15' with no portion overhanging landscaped planters. 2. Parkway landscaping at end of Kartron Street shall be maintained. AYES: Crosby, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang ADMINISTRATIVE REVIEW NO. 84-71 (CE NO. 84-61) Applicant: Main Office Professional Building A request to permit four 2,325 Square Foot office buildings with reciprocal ingress, egress and parking at property located on the North side of Kartron Street approximately 150 feet East of Florida Avenue. This request is covered by Categorical Exemption, Class 3, California Environmental Quality Act, 1970. -6- 10/17/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 17, 1984 Page 7 Staff would like to request that all signs be compatible in color as well as style. Glen Godfrey stated it was his understanding the applicant is carrying through the same style of architecture as in the front. Bruce Crosby asked if the applicant should file a parcel map but Ms. Pierce explained there will be four (4) separate parcels with reciprocal ingress and egress. Jim Vincent asked that Item No. 8, "Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked", be added to the Conditions of Approval and the applicant agreed to accept the conditions. UPON MOTION BY GODFREY AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW NO. 84-71 WAS APPROVED AS AMENDED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL 1. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 10. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 11. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 12. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 13. An irrevocable reciprocal driveway and parking easement(s) between the subject sites shall be prepared. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the office of the County Recorder and a copy filed with the Department of Development Services prior to final inspection. AYES: Crosby, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang USE PERMIT NO. 84-79 Applicant: buddy Cheatham A request to permit a temporary outdoor event on October 20 and 21, 1984, for sporting goods sale at 8909 Adams Avenue (North side of Adams Avenue approximately 175 feet West of Magnolia Street). -8- 10/17/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 11, 1984 Page 9 This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1970. Ms. Pierce said the site plan indicates this is a swap meet but it is a sporting goods store which holds an annual outdoor sale. Children can sell their sports equipment and purchase new and there will also be some new equipment for adults. The applicant has had this event in this location for several years with no problems. The Public Hearing was opened and the applicant, Buddy Cheatham, was present. Mr. Cheatham had no questions and there was no one else present to speak, so Mr. Smith closed the Public Hearing. UPON MOTION BY GODFREY AND SECOND BY VINCENT, USE PERMIT NO. 84-79 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The conceptual site plan received October 9, 1984, shall be the approved layout. 2. A certificate of insurance form shall be filed in the Administrative Services Department in an amount deemed necessary by the Public Liability Claims Coordinator, along with a Hold Harmless Agreement executed by the insured, at least five (5) days prior to the event. 3. A Certificate to Operate, as required by S.9730.80 of the Ordinance Code, shall be issued prior to the event. Gendron dba Stubby Paper Company A request to permit construction of a recycling center on property located on the North side of Talbert Avenue directly East of P. E. right-of-way. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Susan Pierce stated the site exists in an area where street improvements will be required when the Tentative Parcel Map is filed. The property owner wishes to generate some revenue and has contracted with a recycling company to operate a business at this location. The applicant will bale newspapers which will be hauled -9- 10/17/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 17, 1984 Page 10 to another site. The owner has signed a one (1) year lease with the recycling center but this lease can be terminated at any time the property is sold. The current drive crosses an adjacent piece of property and that owner has given the applicant permission to use i t . Glen Godfrey stressed the fact this request would be granted for only one (1) year and the applicant would have to return at that time for new entitlement. Daryl Smith suggested the applicant should obtain a waiver on street improvements from the Director of Development Services prior to developing the lot. Russell and Bonnie Gendron were present and stated they were not building anything on the lot - just moving equipment in there. UPON MOTION BY CROSBY AND SECOND BY SMITH, ADMINISTRATIVE REVIEW NO. 84-60 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan received October 4, 1984, shall be the approved layout. 2. The use of subject property is an interim use, and valid for a one (1) year period. 3. The property owner shall obtain from the Director of Public Works a waiver of street improvements. Said waiver shall be submitted to the Department of Development Services prior to issuance of building permits or Certificate of Occupancy, whichever occurs first. 4. The development shall comply with all applicable provisions of the Ordinance Code, Building Division and Fire Department. 5. Approval for one (1) year at which time the Board of Zoning Adjustments shall review for an extension of further use. 6. The site shall be policed up and shall remain in a neat manner. AYES: Crosby, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang ADMINISTRATIVE REVIEW NO. 84-65 Applicant: William Goodman A request to permit construction of a 3,200 Square Foot industrial building at 17042 Palmdale Street (East side of Palmdale Street approximately 210 feet South of Warner Avenue). -10- 10/17/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 17, 1984 Page 11 This request is covered by Categorical Exemption, Class 3, California Environmental Quality Act, 1970. It was reported by Ms. Pierce that this property was created a number of years before the City had minimum frontage regulations for industrial lots. M-1 Zone requires 10,000 Square Feet but this is less than one-third of that size. Staff does not feel there is enough parking or maneuvering space; however, the applicant might redesign with an entrance off Cain Avenue and Parking Stall No. 2 could be relocated to allow wider access for truck door. The applicant, William Goodman, stated he would prefer not to have the entrance on Cain Avenue because of the proximity to Ocean View High School. Mr. Goodman was informed by Bruce Crosby that he would still have to install one-half of the street improvements'on Cain Avenue even if the entrance remained on Palmdale Street. Susan Pierce said a parcel map would have to be filed. A general discussion followed concerning the parking, entrance change, landscaping, and street improvements. With concurrence of the applicant, it was decided to require the new entrance off Cain Avenue, and the applicant was requested to submit a revised site plan. UPON MOTION BY SMITH AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW NO. 84-65 WAS APPROVED WITH THE FOLLOWING CONDITONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: a. Site access from Cain Avenue. 2. Prior to issuance of building permits, applicant shall file a parcel map consolidating Lot 7 of Town of Wintersburg, Block A, and the fifteen foot (15') strip to the East. Said map shall be recorded prior to final inspection. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. AYES: Crosby, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang SITE PLAN AMENDMENT NO. 84-21 Applicant: Taco Bell/Michael Peterson A request to permit a 7 foot x 11 foot building addition to a previously approved site plan at property located on the East side of Beach Boulevard approximately 300 feet South of Blaylock Drive. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Susan Pierce stated that the restaurant had approached the City in 1982 requesting a drive-thru operation. Since that time, they have developed a need for a storage room on the rear of the building. This storage room will not encroach into the parking space and the treatment will be architecturally compatible with the existing structure. Michael Peterson was present to represent Taco Bell and he agreed to the conditions as presented. -12- 10/17/64 - BZA Minutes, H. B. Board of Zoning Adjustments October 11, 1984 Page 13 UPON MOTION by VINCENT AND SECOND BY CROSBY, SITE PLAN AMENDMENT NO. 84-21 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The area clouded on the site plan received and dated September 28, 1984, shall be the approved amendment to Use Permit No. 82-38. 2. The proposed structure shall be architecturally compatible with the existing structure. 3. All necessary permits shall be obtained. 4. The development shall comply with all applicable provisions of the Ordinance Code, Building Division and Fire Department. AYES: Crosby, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang TENTATIVE PARCEL MAP NO. 84-591 Applicant: Masai, Tadashi, and Mitsuko Fujita A request to divide one (1) parcel of land into two (2) separate parcels at property located on the West side of Gothard Street approximately 850 feet North of Ellis Avenue. This request is covered by Categorical Exemption, Class 15, California Environmental Quality Act, 1970. Ms. Pierce explained this property was located on Gothard Street and the applicants wished to create two (2) parcels from one (1) existing parcel. This request conforms to the zoning regulations, and vehicular rights to Gothard Street shall be dedicated to the City of Huntington Beach except at locations approved by the City. Dave Gillette was present to represent the applicants and agreed to the conditions as discussed by the Board. UPON MOTION BY GODFREY AND SECOND BY VINCENT, TENTATIVE PARCEL MAP NO. 84-591 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed subdivision of two (2) parcels for purposes of industrial use is in compliance with the size and shape of property necessary for that type of development. -13- 10/17/84 - BZA Minutes, H. The General Plan has set'forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community• business district allowing industrial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well -as in compliance with the State Map Act and supplemental City Subdivision - ordinance. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the'Department•of Development Services on September 20, 1984, shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at'the time said parcel(s) is/are developed. 5. All utilities shall be installed underground at the time said parcel(s) is/are developed. 6. Compliance with all applicable City Ordinances.'''' 7. Board of Zoning Adjustments October 17, 1984 Page 15 SITE PLAN AMENDMENT NO. 84-23 Applicant: Arthur H. Ridgers A request for a site plan amendment to Use Permit No. 84-57 for property located at 17172 Ash Street (East side of street approximately 95 feet South of Cypress Lane). This request is covered by Negative Declaration No. 84-24. Staff reported this was a request to convert a previously approved balcony area into storage space and Glen Godfrey stated this would not affect the amount of required open space. Ms. Pierce mentioned that Southern California Edison Company did not want the electrical control panel installed on either the rear or front of building but rather in the corridor, and the applicant said he had discussed this with the City's Electrical Inspector. Ms. Pierce stated the applicant was installing a landscaped planter area long the sides and Daryl Smith wanted assurance this would be properly maintained. Concerning parking stalls, the applicant assured the Board the stalls would be legal standard stalls; and he also mentioned they would be installing more attractive roofing of either Class A or Class B fire -retardant shingles. Ms. Pierce noted that the applicant has submitted a plan which satisfies the City's zoning requirements for parking, setbacks, etc. This will be an industrial building which will require twenty-three (23) parking stalls. Vince Stagliano was present to represent the applicant. Tom Poe stressed the importance of the security gates meeting Fire Department standards. The site plan, floor plans, and elevations received and dated October 9, 1984, shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Driveway approaches shall be a minimum of twenty-seven feet (27') in width and shall be of radius type construction. 5. This approval is granted for a 15,186 Square Foot industrial warehousing building requiring twenty-three (23) parking spaces. Any modification, expansion, or change of use shall require additional parking and approval of a site plan amendment. 6. On site fire hydrants shall be provided in number and at locations specified by the Fire Department. 7. Security gates shall be subject to review and approval of the Fire Department. 9. Low -volume heads shall be used on all spigots and water faucets. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 11. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 12. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. .13. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 14. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division.
