BOARD MEMBERS PRESENT: Evans, Godfrey, Smith, Poe STAFF MEMBERS PRESENT: Pierce REGULAR AGENDA ITEMS: USE PERMIT NO. 84-65 Applicant: Thomas Kardos A request to permit construction of a three-plex apartment building where abutting a major highway at property located on the East side of Bolsa Chica Road approximately ninety-five feet (95') South of Dunbar Drive. This request is covered by Categorical Exemption, Class 3B, California Environmental Quality Act, 1970. Ms. Pierce reported this property will be reduced approximately one-half in size by the widening of Bolsa Chica Road. There will be seven (7) on -site parking spaces required but this plan does not reflect them. Based on this plan, Staff would recommend denial; however, with some adjustments, Staff could recommend approval. The applicant would need one (1) additional on -site parking space and Staff feels the trash enclosure area could be deleted and replaced with recreational or open space areas. For only three (3) units, trash could be picked up at curb side. Staff also feels the driveways should be approved by Public Works. Daryl Smith opened the Public Hearing. Thomas Kardos, the applicant, was present and agreed to the Conditions of Approval. Mrs. Janet Kater, owner of the property directly to the North, was present, and she objected to the proposed plan because the driveway would be next to her bedroom instead of the opposite side of the property as it is now. Mrs. Kater does not want the noise from cars entering or leaving the condominium project. Les Evans arrived at this point in the meeting. Mrs. Kater said cars could cross her driveway unless some type of barrier is erected, and she also inquired about construction of a block wall. Glen Godfrey suggested Mrs. Kater might discuss that possibility with the builder/developer to participate in Minutes, H. B. Daryl Smith said the Board could condition installation of a maximum height fence or block wall along the property line but Susan Pierce said the first fifteen feet (15') of fencing could be no higher than 3-1/2 feet. Mrs. Kater stated they could install trees on their side of the property line. Mr. Kardos explained he would be occupying the unit next to the northerly driveway so there would be very little traffic. He preferred to build the block wall rather than flipping the units. Les Evans said the barricade on the South property line would have to be relocated to the North and the drainage swale also relocated to satisfaction of Public Works. Daryl Smith expressed concern about the outside lighting and suggested the item "All outside lighting be directed to prevent spillage onto adjacent properties" be added to the Conditions. UPON MOTION BY GODFREY AND SECOND BY POE, USE PERMIT NO. 84-65 WAS APPROVED AS AMENDED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the conditional use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: a. One (1) additional on -site parking space. b. Deletion of all floor space areas encroaching into front setback. c. Deletion of trash area. -2- 10/24/84 - BZA 1 Minutes, H. B. Board of Zoning Adjustments October 24, 1984 Page 3 d. A block wall of maximum height shall be constructed along the North property line. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. Block wall plan which shall be compatible with proposed structure. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Driveway approaches shall meet Public Works Department standards. 5. Barricade now in place on South property line shall be relocated to North property line and drainage swale relocated to the satisfaction of the Public Works Department. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 9. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit's). 10. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. -3- 10/24/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 24, 1984 Page 4 11. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 12. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. AYES: Godfrey, Smith, Poe NOES: None ABSTAIN: Evans ABSENT: Vogelsang TENTATIVE PARCEL MAP NO. 84-595 Applicant: David H. Williams A request to permit a two (2) lot subdivision at property located on the East side of Beach'Boulevard 890 feet North of Adams Avenue (Newland Center). This request is covered by Categorical Exemption,' Class 5, California Environmental Quality Act, 1970. Susan Pierce stated this property was first before the Board as a restaurant addition and the applicant now needs to create two (2) parcels from one (1). Staff is asking that a note be added to the Conditions which reads: "Parcel 1 of Tentative Parcel Map No. 79-572 is the common area of the project used for ingress, egress, parking, landscaping and utilities and is privately maintained". Ron Orosco represented the applicant and stated Mr. Williams had reviewed and accepted the Conditions as presented. UPON MOTION BY EVANS AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 84-595 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Development Services on October 4, 1984, shall be the approved layout (with the amendments as noted thereon): Note No. 10 to read "Parcel 1 of Tentative Parcel Map No. 79-572 is the common area of the project used for ingress, egress, parking, landscaping and utilities and is privately maintained". -4- 10/24/84 - BZA 1 Minutes, H. B. Board of Zoning Adjustments October 24, 1984 Page 5 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 5. All utilities shall be installed underground at the time said parcel(s) is/are developed. 6. Compliance with all applicable City Ordinances. 7. A copy of the recorded parcel map shall be filed with the Department of Development Services. 8. All applicable Conditions of Approval of Tentative Parcel Map No. 79-572 shall apply. AYES: Evans, Godfrey, Smith, Poe NOES: None ABSENT: Vogelsang LOT LINE ADJUSTMENT NO. 84-12 Applicant: Betty Elkins -Rice A request to permit two (2) parcels from three (3) lots on property located at 302-04-06 Thirteenth Street (Southeast corner of Olive Street and Thirteenth Street). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. According to Ms. Pierce, the applicant represents a property owner who wishes to purchase three (3) lots - two by one deed and the third by a separate deed. The owner would like to take five feet off the double lot and add it to another. Staff has prepared an application for Tentative Parcel Map No. 84-599 but Staff will defer to the City Engineer on this issue. Les Evans stated his office would require the lots be surveyed and monuments located before a new plat map is prepared. Additional monuments may be required. Glen Godfrey stated there was a fairly new subdivision adjacent to this project and monuments may be established. Mr. Evans determined the tentative parcel map was not necessary. -5- 10/24/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 24, 1984 Page 6 UPON MOTION BY EVANS AND SECOND BY GODFREY, LOT LINE ADJUSTMENT NO. 84-12 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The lot line adjustment is consistent with the criteria outlined in Section 9811.3.1 of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL: 1. The applicant shall submit a copy of the recorded Lot Line Adjustment to the Department of Development Services. 2. A revised plat map shall be submitted to the City Engineer noting existing monuments. Additional monuments may be required.
