Graham A request to permit consolidation of three (3) lots into one (1) parcel located at 18582 Main Street. This request is a Categorical Exemption, Class 15, California Environmental Quality Act, 1970. Ms. Pierce stated that Dr. Graham had asked that his application be withdrawn. Downs A request to permit recreation and leisure areas to consist of enclosed area (15%) and to allow remaining area to be satisfied by existing development plan which provides private patios, balconies, and common open space in an apartment complex located at 5101 Dunbar Drive (North side of street approximately 490 feet East of Bolsa Chica Road). Ms. Pierce reported this is an existing fourplex where the applicant proposes to add units over the garage. Staff does not find a land -related hardship. The balcony areas more than exceed the minimum open space requirements for fourplexes. If the Board should decide on approval, Staff would recommend removal of two parking spaces - Nos. 9 and 10 - and deletion of the second stairway. Staff would also require a revised site plan. Bruce Crosby opened the Public Hearing and Donna Oliveira was present to represent the owner, Stephen F. Downs. Ms. Oliveira felt both stairways should remain because units would be located over the garage. Tom Poe said the second stairway would not be required to meet Fire Department standards but had no problem with it remaining. Mr. Poe also stated the garages should be separated by one -hour fire walls and fire sprinklers. Ken Moody spoke on behalf of the applicant. He mentioned the building was originally designed as a five -unit building which he had constructed and the City had requested the second stairway. If the stairway had to be removed now, part of the building would have to be torn off. There was no one else present to speak so the Public Hearing was closed. CONDITIONAL EXCEPTION NO. 84-64 Applicant: Murray's Arco A request to permit beer and wine sales in a snack shop at an existing gas station located at 16742 Beach Boulevard (Northeast corner of Terry Drive and Beach Boulevard). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Ms. Pierce said the service station standards were changed in 1976 to require six percent (6%) of the property to be landscaped. The City gave stations until December 1977 to comply. This property has been landscaped in front of both pumps, along Beach Boulevard and side street, but the applicant needs a three-foot (3') planter along property line to bring it up to minimum standards. Staff would recommend denial based on no land -related hardship. The Public Hearing was opened and the applicant, Rolland Murray, was present. Mr. Murray stated he could not afford to install the required landscaping nor did he feel there was ample space for additional landscaping without interference with propane tanks, camper dumping area, parking spaces, etc. Bruce Crosby informed Mr. Murray the Board could find no land -related hardship and could not base approval on financial situation of applicant. After considerable discussion, Ms. Pierce mentioned there was a part in the Code which would allow the Board of Zoning Adjustments to reduce the required landscaping, upon written request of the -3- 10/31/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 31, 1984 Page 4 applicant, if conditions exist which would warrant it. Glen Godfrey read the items referred to by Ms. Pierce as 1) the reduction is necessary for traffic safety, 2) reduction of landscaping would not substantially reduce the buffering effect from the right-of-way or interior properties, and 3) the design of the service station site, as it exists, inhibits logical placement of landscaping to achieve an aesthetic appearance. Ms. Pierce pointed out that there was no requirement for a Certificate of Occupancy so the Board might wish to impose a time limit on installation of the suggested landscaping. Bruce Crosby closed the Public Hearing since there were no other persons present to speak. UPON MOTION BY GODFREY AND SECOND BY POE, CONDITIONAL EXCEPTION NO. 84-64 WAS APPROVED AS AMENDED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The reduction is necessary for traffic safety. 2. Reduction of landscaping would not substantially reduce the buffering effect from the right-of-way or interior properties. 3. The design of the service station site, as it exists, inhibits logical placement of landscaping to achieve an aesthetic appearance. CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted showing parking and a minimum of 250 Square Feet of landscaping in addition to existing as required. 2. UPON MOTION BY GODFREY AND SECOND BY POE, USE PERMIT NO. 84-77 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the conditional use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: a. Minimum 250 Square Feet of landscaping in addition to existing is required. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Additional landscaping shall be installed and approved prior to final inspection. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. The major identification sign shall be removed or altered to comply with Article 948 within ninety (90) days. 5. Board of Zoning Adjustments October 31, 1984 Page 6 AYES: Crosby, Godfrey, Poe NOES: None ABSTAIN: Evans ABSENT: Vogelsang CONDITIONAL EXCEPTION NO. 84-62 Applicant: Jeffrey and Nancy Welles A request for a reduction in rear yard setback from ten feet (10') to five feet (5') (approximately 53 Square Foot encroachment) to allow a single story addition to an existing two (2) story single family residence. The subject property is located at 7561 Danton Circle (North side of street approximately 65 feet East of Carnaby Lane). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Ms. Pierce reported this is a Conditional Exception which does have a land -related hardship. The lot is located on a cul-de-sac and the house is not parallel to the property line. This lot abuts one neighbor's rear yard and another's side yard. The encroachment referred to would be on the side yard abutment and the neighbors have not voiced any objections. Staff would recommend approval of this request but would limit it to one story. Bruce Crosby opened the Public Hearing and the applicants, Jeffrey and Nancy Welles, were present. Mr. Welles explained that there was an existing bathroom on this side of the building and they would need to be adjacent to it; otherwise, they would have to go through the Kitchen to get from the Bath to the Bedroom. There was no one else present to speak so the Public Hearing was closed. UPON MOTION BY POE AND SECOND BY EVANS, CONDITIONAL EXCEPTION NO. 84-62 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. -6- 10/31/84 - BZA Minutes, H. The granting of Conditional Exception No. 84-62 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 4. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. SUGGESTED CONDITIONS OF APPROVAL 1. The site plan, floor plans, and elevations received and dated October 15, 1984, shall be the approved layout with the modification that the West side yard shall maintain a five foot (5') setback. 2. Proposed structure shall be architecturally compatible with existing structure. 3. Proposed structure shall be limited to one (1) story. AYES: Evans, Godfrey, Crosby, Poe NOES: None ABSENT: Vogelsang TENTATIVE PARCEL MAP NO. 84-597 Applicant: Ken Moody A request to consolidate portion of private street with Lot 20 of Block A, Tract 349 at 16621-31 Dolores Street (West side of street at intersection of Prairie Drive). This request is covered by Categorical Exemption, Class 15, California Environmental Quality Act, 1970. Staff reported there is correspondence from the Director of Public Works that this is not a dedicated public street. Staff does not have a copy of the title report which covers this property; however, Staff would recommend approval with the conditions that title report and parcel map be submitted. The applicant, Ken Moody, was present and said he did not understand. Bruce Crosby explained the title report was needed to show there were no encumberances; i.e., no easements, no restrictions, etc., on this lot. Glen Godfrey asked if this could be handled as a waiver and Les Evans stated it could. -7- 10/31/84 - BZA Minutes, H. B. Board of Zoning Adjustments October 31, 1984 Page 8 UPON MOTION BY CROSBY AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 84-597 WAS APPROVED WITH FINDINGS AND CONDITIONS AS OUTLINED FOR A WAIVER, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Development Services on October 10, 1984, shall be the approved layout (with the amendments as noted thereon). 2. The applicant shall file, through the Huntington Beach City Clerk's Office, and have recorded with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map. A copy of the recorded Certificate of Compliance and plat map shall be filed with the Department of Development Services prior to issuance of building permits on the subject property. 3. A copy of the entire title report shall be submitted to the Department of Development Services prior to submittal of a final parcel map. This request is covered by Categorical Exemption, Class 15, California Environmental Quality Act, 1970. Ms. Pierce reported there are three (3) parcels the property owner wants to consolidate into two (2) parcels. UPON MOTION BY EVANS AND SECOND BY CROSBY, TENTATIVE PARCEL MAP NO. 84-598 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed subdivision of three (3) parcels for purposes of industrial use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing commercial buildings was placed on the subject property. 4., The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Development Services on October 11, 1984, shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 5. AYES: Evans, Crosby, Godfrey, Poe NOES: None ABSENT: Vogelsang ADMINISTRATIVE'REVIEW NO. 84-73 (TPM 84-598) (AR 84-74) Applicant: Kaiser Development Company A request to permit a 34,925 Square Foot industrial building at property located on the North side of Oceanus Drive approximately 780 feet West of Graham Street. This project is covered by Environmental Impact Report No. 73-16. Ms. Pierce stated that there will be two (2) buildings constructed on each parcel of the previously approved parcel map. Building "A" is covered under Administrative Review No. 84-73 and Building "B" under Administrative Review No. 84-74. The applicant has provided additional parking spaces over the required parking ratio and has reciprocal drives. Les Evans asked if the Fire Department had settled on drives into the buildings and it was determined that twenty-seven foot (27'), radius type driveways would be required. Tom Poe stated the Fire Department would require two (2) additional fire hydrants and would require posting "NO PARKING" signs along drives for fire lanes. The applicant's representative, Scott Cairns of HCH and Associates, explained the building plans and renderings he presented UPON MOTION BY EVANS AND SECOND BY GODFREY, ADMINISTRATIVE REVIEW NO. 84-73 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan dated October 25, 1984, and floor plans and elevations received and dated October 11, 1984, shall be the approved layout. 2. Tentative Parcel Map No. 84-598 shall be recorded prior to final inspection. 3. Prior to issuance of building permits, the applicant shall submit the following plans: -10- 10/31/84 - BZA Minutes, H. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 5. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 6. Outer driveway approaches shall be a minimum of twenty-seven feet (27') in width and shall be of radius type construction. Interior driveways shall be to the satisfaction of the Fire Department and Public Works Department. 7. On site fire hydrants shall be provided in number and at locations specified by the Fire Department. 8. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 9. All signs shall comply with Article 976 of the Huntington Beach"Ordinance Code. 10. Low -volume heads shall be used on all spigots and water faucets. 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 12. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 13. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. -11- 10/31/84 - BZA Minutes, H. The subject property shall enter into irrevocable reciprocal driveway and access aisles, and easement(s) between the subject site and adjacent property. This project is covered by Environmental Impact Report No. 73-16. Staff reported the concerns of this application had been covered under Administrative Review No. 84-73 and would apply also to this request. UPON MOTION'BY EVANS AND SECOND BY GODFREY, ADMINISTRATIVE REVIEW NO. 84-74'WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. AYES: Crosby, Evans, Godfrey, Poe NOES: None ABSENT: Vogelsang ADMINISTRATIVE REVIEW NO 84-79 Applicant: Redevelopment Agency - City of Huntington Beach A request to permit garage structures with optional unit above to be constructed at a zero side yard setback on each of sixteen (16) lots located within the Koledo Lane Demonstration Project. Subject property is located at 17361-17441 and 17362-17442 Koledo Lane (both sides of street approximately 150 feet North of Slater Avenue). This project is covered by Negative Declaration No. 84-31. Staff reported this application is by the City and they propose to take existing carports, enclose them to make garages, and build apartments over the garages. Staff would recommend approval of this project based on the plans as submitted. The City's representative, Pat Spencer, said he found no problem with the conditions as presented. Tom Poe expressed definite concerns over the corner cutoffs to allow access by fire trucks and over the locations of fire hydrants. Mr. Poe requested that Item 7, "The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department" and Item 13, "On -site fire hydrants shall be provided in number and at locations specified by the Fire Department" be added to the conditions. Glen Godfrey referred to the importance of working out problems because approval of this project would provide living quarters for many needy families. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop mechanical equipment plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. I. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Alley corner cutoffs shall be to the satisfaction of the Fire Department. 5. On site fire hydrants shall be provided in number and at locations specified by the Fire Department. 6. Low -volume heads shall be used on all spigots and water faucets. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 8. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 9. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division.
