Bollman A request to permit the consolidation of two (2) lots on property located at 7151 Garfield Avenue (North side of street). This request is covered by Categorical Exemption, Class 15, California Environmental Quality Act, 1970: Michael Strange reported a letter had been received from the applicant, Charles H. Bollman, requesting a thirty (30) day continuance. UPON MOTION BY GODFREY AND SECOND BY EVANS, TENTATIVE PARCEL MAP NO. 84-587 WAS CONTINUED TO THE MEETING OF DECEMBER 5, 1984, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Smith NOES: None ABSENT: Vogelsang, Vincent Jim Vincent arrived at the meeting at this time. CONDITIONAL EXCEPTION NO. 84-63 (UP 84-76) (Continued from 10/31/84) Applicant: Donna Oliveira/Stephen F. Downs A request to permit recreation and leisure areas to consist of enclosed area (15%) and to allow remaining area to be satisfied by existing development plan which provides private patios, balconies, Minutes, H: B: Board of Zoning Adjustments November 7, 1984 Page 2 and common open space in an apartment complex. Subject property is located at 5101 Dunbar Drive (North side of street approximately 490 feet East of Bolsa Chica Road). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Staff included Findings for Denial and Findings for Approval on this project for decision of the Board. This project had been discussed extensively at the previous meeting so the Public Hearing was opened by Daryl Smith. Donna Oliveira was present to represent the applicant, Stephen F. Downs, and Ken Moody also spoke since he had been the builder of the project. The Public Hearing was closed. UPON MOTION BY EVANS AND SECOND BY GODFREY, CONDITIONAL EXCEPTION NO. 84-63 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Granting of existing open space exception will not reduce the required total open space area. 2. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. - CONDITIONS OF APPROVAL: ` 1. A revised site plan and floor plan shall be submitted depicting the modifications described herein: a. Deletion of Parking Spaces 9 and 10. b. Proposed recreation room deleted and retained as garage spaces. c. Twenty -foot (201) wide West side yard shall be designated and provided as open space leisure area for proposed unit. d. Providing forty -two-inch (4211) high fence around patio area. e. Existing second stairway may remain. 2. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 3. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 7. If foil -type insulation, is to be used, a fire retardant type shall be installed as approved by the Building Division. Downs A request to permit a one (1) unit addition to an existing fourplex to comply with apartment regulations subject to approval of Conditional Exception No. 84-63. Subject property is located at 5101 Dunbar Drive (North side of street approximately 490 feet East of Bolsa Chica Road). This request is covered by Categorical Exemption, Class K-2, California Environmental Quality Act, 1S70. Michael Strange introduced the request and covered Staff's concerns on the project: As stated previously, this application had been covered in the earlier meeting before continuance. The Public Hearing was opened and Donna Oliveira was present to represent the owner, Stephen F. Downs. Ms. Oliveira had no further questions and the Public Hearing was closed. UPON MOTION BY VINCENT AND SECOND BY EVANS, USE PERMIT NO. 84-76 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: -3- 11/7/84 - BZA Minutes, K. B. Board of Zoning Adjustments November 7, 1984 Page 4 a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the conditional use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. 4. Conditional Exception No. 84-63 was granted to allow the existing open space to satisfy the Apartment Standards open space requirements. CONDITIONS OF APPROVAL 1. Pascal A request to permit a reduction of size of enclosed parking space from 18' x 19' to 15-1/2' x 19' at 8451 Friesland Drive (North side of street approximately 65 feet West of Newland Street). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Staff presented findings on this request and a discussion followed. Daryl Smith opened the Public Hearing and it was determined the applicant was not present. The Public Hearing was left open. UPON MOTION BY GODFREY AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 64-65 WAS CONTINUED TO THE MEETING OF NOVEMBER 14, 1984, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang ADMINISTRATIVE REVIEW NO. 84-75 Applicant: Signal Landmark, Inc. A request to permit an 8,430 Square Foot retail commercial building on a vacant parcel in an existing commercial center at 19720 Beach Boulevard (East side of Beach Boulevard at Utica Street). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970: Staff presented a report on this project concerning drives in the Shopping Center, and Bill Walkup was present to represent the applicant, Signal Landmark. Daryl Smith stressed the fact that no signs were being approved in this process. UPON MOTION BY SMITH AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW NO. 84-75 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: -5- 11/7/84 - BZA Minutes, H: B: Board of Zoning Adjustments Ncvember 7, 1984 Page 6 CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated October 11, 1984, shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 5. The use of this building is restricted to use as a furniture and/or appliance store. Any modification, expansion, or change of use shall require new entitlement: E. All signs shall comply with the planned sign program and Article 976 of the Huntington Beach Ordinance Code. 7. Proposed structures shall be architecturally compatible with existing structures. 8. Low -volume heads shall be used on all spigots and water faucets. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off site facility equipped to handle them: 10. If lighting is included in the parking lot, high-pressure sodium vapor lamps stall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 11. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 12. The subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. A request to permit warehouse facility - Conversion at later date to office structure - on property located on the South side of Bolsa Avenue approximately 214 feet East of Graham Street. This request is covered by Negative Declaration No. 80-18. Mike Strange presented information relative to this project which was followed by a general discussion. Fire Department's concern was the width of drives for fire lanes. The applicant's representative, Jim Church, presented renderings for the Board's viewing. Mr. Church stated there would be a parking recess to accommodate two cars where columns had been located. - UPON MOTION BY SMITH AND SECOND BY VINCENT, WITH CONCURRENCE OF THE APPLICANT, ADMINISTRATIVE REVIEW NO. 84-76 WAS CCNTINUED WITH NO SET DATE UNTIL TRAFFIC CIRCULATION PROBLEMS COULD BE RESOLVED, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang ADMINISTRATIVE REVIEW NO. 84-77 Applicant: Jess F. Perez A request to permit a 6,000 Square Foot Restaurant at 19810 Beach Boulevard (East side of Beach Boulevard at Utica Street in Newland Center). This request is covered by Environmental Impact Report No. 82-20: Staff presented the subject of driveways into and through the shopping center, specifically those between Burger King and the proposed Spire's Restaurant. It was determined a new site plan would have to be submitted reflecting changes in the drives. - UPON MOTION BY EVANS AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW NO. 84-77 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: -7- 11/7/84 - BZA Minutes, H: B. Board of Zoning Adjustments November 7; 1584 Page 8 CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: a. Site plan circulation and parking to be approved by Public Works Department and Development Services. b. Trash enclosure has to meet with the approval of Fire Department. Z. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 7. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 8. Proposed structures shall be architecturally compatible with existing structures. 9. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 10. Low -volume heads shall be used on all spigots and water faucets. 11. A detailed soils analysis shall be prepared by a registered soils engineer: This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 14. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 15. The subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. A copy of the legal instrument shall be recorded in the office of the County Recorder and a copy filed with the Department of Development Services prior to issuance of building permits. Bonner A request to permit a mini -warehouse facility at 7611 Talbert Avenue (North side of street approximately 975 feet East of Gothard Street). This request is covered by Negative Declaration No. 84-42. Staff reported that corner cutoffs on buildings had not been shown on site plan to meet Ordinance Code. Tom Poe said the applicant had new site plans to present but, after discussion, the Board felt the plans needed to be plan checked. UPON MOTION BY SMITH AND SECOND BY EVANS, AND WITH CONCURRENCE OF THE APPLICANT, ADMINISTRATIVE REVIEW NO. 84-78 WAS CONTINUED TO THE MEETING OF NOVEMBER 14, 1984, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Smith, Evans NOES: None ABSENT: Vogelsang -9- 11/7/84 - BZA Minutes, H: B: Board of Zoning Adjustments November 7, 1984 Page 10 ADMINISTRATIVE REVIEW NO. 84-80 Applicant: Susan Kline A request to permit temporary sign for two (2) periods of ninety (90) days from November to January and June to August in conjunction with new school and grand opening. Subject property is located at 20800 Beach Boulevard (East side of Beach Boulevard North of Atlanta Avenue). This request is covered by Categorical Exemption, Class 12, California Environmental Quality Act, 1970. After Staff's introduction to subject, Glen Godfrey stated he would not be opposed to granting the request for only sixty (60) days, not the one hundred eighty (180) as requested. The applicant, Ms. Susan Kline, made her presentation concerning the project. UPON MOTION BY EVANS AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW NO. 84-80 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The requested 4' x 12' temporary sign may be permitted for a maximum of ninety (90) days during the fall of 1984 and ninety (90) days during the summer of 1985: 2. Dates of sign posting shall be submitted to the Secretary of the Board prior to installation. Subject property is located on East side of Metzler Lane approximately 745 feet South of centerline of Slater Avenue. This request is covered by Negative Declaration No. 84-41. Board of Zoning Adjustments November 7, 1984 Page 11 UPON MOTION BY GODFREY AND SECOND BY EVANS, TENTATIVE PARCEL MAP NO. 84-600 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR AFPRCVAL: 1. The proposed subdivision of two (2) parcels for purposes of industrial use is in conformance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing commercial buildings was placed on the subject property. 4. The size, depth, frontage,;street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as'well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Development Services on October 23, 1984, shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). S. All utilities shall be installed underground at the time said parcel(s) is/are developed. 6. Compliance with all applicable City Ordinances. 7. Subject property is located at 921 Thirteenth Street (Northwest corner of Thirteenth Street and Park Street). This request is covered by Categorical Exemption, Class 15, California Environmental Quality Act, 1970. Staff made the standard recommendations for parcel map waiver and the applicant, Jeff Fracker, agreed to the conditions and to granting the City a 2-1/2 foot additional alley easement. UPON MOTION BY EVANS AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 84-1201 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Development Services on October 23, 1984, shall be the approved layout (with the amendments as noted thereon): 2. The applicant shall file, through the Huntington Beach City Clerk's Office, and have recorded -with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map. A request to permit 752 Square Foot addition and exterior remodel to existing automobile sales agency at 17331 Beach Boulevard (West side of Beach Boulevard approximately 630 feet North of Slater Avenue). Mike Strange stressed that only the portions of the plans in "clouded" areas was being presented for approval. The applicant, R. Foster, was present and agreed to the conditions. UPON MOTION BY EVANS AND SECOND BY VINCENT, SITE PLAN AMENDMENT NO. 84-24 WAS APPROVED WITH THE FOLLCWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The clouded areas shown on the site plan, floor plans, and elevations received and dated October 22, 1984, shall be the approved layout to Use Permit No. 84-20'. 2. The proposed structures and existing structures shall be architecturally compatible. 3. All previous conditions of Use Permit No. 84-20 stall be applicable.
