BOARD MEMBERS PRESENT: Evans, Godfrey, Smith, Vincent STAFF MEMBERS PRESENT: Pierce, Poe MINUTES: Minutes of the regular meeting of October 3, 1984 -� APPROVED AS TRANSCRIBED WITH GLEN GODFREY ABSTAINING REGULAR'AGENDA ITEMS: - ADMINISTRATIVE REVIEW NO. 84-76 (Cont. from 11/7/84) Applicant: Public Warehouse, Inc. A request to permit warehouse facility - Conversion at later date to office structure. Subject property is located on the South side of Bolsa Avenue approximately 214 feet East of Graham Street This request is covered by Negative Declaration No: 80-'18. Ms. Pierce reported that new plans had been submitted with corrections showing revised parking, traffic flow circulation, etc. Les Evans asked about the conversion to office structure and it was determined this would require a new entitlement. UPON MOTION BY EVANS AND SECOND BY SMITH THAT FLOOR PLANS AND ELEVATIONS SHALL BE THE APPROVED LAYOUT FOR WAREHOUSE ONLY AND CONVERSION TO OFFICE SPACE WILL HAVE SEPARATE ENTITLEMENT, ADMINISTRATIVE REVIEW NO. 84-76 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The floor plans and elevations received and dated November 16, 1984, shall be the approved layout for Warehouse only and conversion to office space will require a separate entitlement. 2. A revised site plan shall be submitted depicting required parking spaces in compliance with Article 979 and closure of East driveway on Bolsa Avenue replaced with off site street improvements. Prior to issuance of building permits, applicant shall file a parcel map consolidating Lots 2, 311 161 17, 18, and 19 of Tract 9879. Said map shall be recorded prior to final insepction. 4. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 6. Service roads and fire lanes, as determined by the Fire Department, shall.be posted and marked. 7. Driveway approaches shall be a.minimum of twenty-seven feet (27') in width and shall be of radius type construction. 8. Full width accessways on_Buckingham Drive and Bolsa Avenue shall be installed prior to, final inspection. 9. Security gates shall be subject to review and approval by the Fire Department. 10. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 11. There shall be no outside storage. 12. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 13. A wet standpipe system shall be installed in the stairways in accordance with Chapter 38 of the Uniform Building Code. -2- 11/21/84 - BZA 1 Minutes, H. B. Board of Zoning Adjustments November 21; 1984 Page 3 14. The Bolsa Avenue entry door shall be equipped with a knox locking mechanism. 15. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 16. Low -volume heads shall be used on all spigots and water faucets. 17. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material; shall be disposed of at an offsite facility equipped to handle them. 18. The structures on the subject property; whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 19. If lighting is included in the parking lot; high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 20. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 21. If foil -type insulation is to be used; a fire retardant type shall be installed as approved by the Building Division. 22. The subject property shall enter into irrevocable reciprocal driveway between the subject site and adjacent properties. A copy of the legal instrument shall be approved by the City Attorney as to form and content prior to issuance of building permits, and, when approved, shall be recorded in the office of the County Recorder and a copy filed with the Department of Development Services prior to final inspection. -3- 11/21/84 - BZA Minutes, H. Van Vlahakis A request to permit a six foot (6') high wall to encroach four feet (4') into the required fifteen foot (15') front yard setback for a distance of nineteen feet (19') across the fifty foot (50') wide lot. Subject property is located at 16727 Bolero Lane (West side of street South of Nalu Circle): This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Ms -Pierce reported this application had been continued to request a copy of the approved swimming pool plan and permit. - The Public Hearing had been left open and the applicant; E. Van Vlahakis, was present: He presented photographs showing neighbor's properties with setbacks which were similar to what he was proposing. Another resident, Warren Lortie, was present to speak and then Daryl Smith closed the Public Hearing. Les Evans stated there seemed to be more exceptions than compliances in the neighborhood and suggested this situation be brought to the attention of the City Council or Planning Commission. The Board discussed this possibility UPON MOTION BY EVANS AND SECOND BY VINCENT,- CONDITIONAL EXCEPTION NO. 84-67 WAS REFERRED TO THE PLANNING COMMISSION FOR ACTION BASED ON THE BOARD'S FINDINGS THAT THERE ARE MORE VARIANCES IN THE NEIGHBORHOOD THAN THERE ARE COMPLIANCES, BY THE -FOLLOWING VOTE: AYES: Evans, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang TENTATIVE PARCEL MAP NO. 84-1202 (Cont. from 11/14/84) Applicant: Sickels/Stampley A request to revert existing Parcels 1 and 2 of Parcel Map No. 78=559 in order to permit one (1) large building on the existing two 1 -4- 11/21/84 - BZA Minutes, H. B. Board of Zoning Adjustments November 21; 1984 Page 5 (2) parcels and waiver of final parcel map. Subject property is located at the Southwest corner of Main Street and Florida Street. This request is covered by Categorical Exemption; Class 15, California Environmental Quality Act; 1970. Staff stated the request had been continued to allow the applicant time to submit full size parcel map for review. Staff would recommend approval but would defer to Les Evans. Mr. Evans said the applicant would need sidewalks; street lights; etc.; and the Board should condition approval to installation of street improvements. Bill Hossfeld, representative for Sickels/Stampley; asked about bonding for improvements: UPON MOTION BY EVANS AND SECOND BY SMITH, TENTATIVE PARCEL MAP N0. 84-1202 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: I. The proposed subdivision of two (2) parcels for purposes of commercial use in compliance with the size and shape of property necessary for that type of development. 20' The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use: 30 The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing commercial buildings was placed on the subject property. 4. The size; depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance With the State Map Act and supplemental City Subdivision Ordinance. -5- 11/21/84 - BZA Minutes, H. The Tentative Parcel Map received by the Department of Development Services on November 15, 1984, shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Main and Florida Streets shall be dedicated to City standards. 4. Water supply shall be through the -City of Huntington Beach's water system at the time said parcel(s) is/are developed. 5. All utilities shall be installed underground at the time said parcel(s) is/are developed. 6. Compliance with all applicable City Ordinances. 7. A copy of the recorded parcel map shall be filed with the Department of Development Services. 8. Vehicular rights shall be dedicated to the City of Huntington Beach except at locations approved by the Planning Commission. 9. Street improvements, including street lights, sidewalks, and elimination of cross gutters, shall be constructed prior to final occupancy or use -of the property. REVOCATION OF HOME OCCUPATION PERMIT NO. 84-1 Licensee: Norman-E.' Griest Reason: Violation of Section 9730.36(h), Huntington Beach Ordinance Code, referring to parking of commercial vehicle or equipment at 9612 Indian Wells Circle. Ms. Pierce said our office has received numerous complaints regarding oversized -vehicles being parked in the street and driveway of the property at 9612 Indian Wells -Circle, and Don Shaw would report on his findings Mr. Shaw reported that the property owner was originally notified on August 30, 1984, of the infractions involved, with follow up letters -6- 11/21/84 - BZA Minutes, H. Neighbors are also complaining of noise and odors since Mr. Griest is bring home his trucks loaded with trash and tree trimmings: Daryl Smith opened the Public Hearing and Norman E. Griest was present: Mr. Griest said his wife, Josephine J. Traynor; is the actual property owner but he is the operator of the business. Others present to speak against the operation of Mr. Griest's business in the residential area were Janet Hague; Peter Wellenstein; Kimberley First; Frank Sadar and Lynne Sorenson. Ms. Hague also presented a petition signed by several residents of the street: The Public Hearing was closed. Mr. Griest spoke in rebuttal to the statements made by neighbors. After discussion with the Board members, Mr. Griest agreed to refrain from bringing his oversized trucks into the housing tract and said they would be parked in a commercial lot. GODFREY MOVED, SECONDED BY EVANS,* THAT HOME OCCUPATION PERMIT NO. 84-1 BE REVOKED AND THE REVOCATION BE SUSPENDED FOR THIRTY (30) DAYS TO ASSURE THAT MR. GRIEST WILL ADHERE TO ALL THE REGULATIONS OF HOME OCCUPATION PERMIT; AND; IF WE GET A REPORT FROM STAFF THAT THAT IS THE CASE; THEN REVOCATION WILL BE RESCINDED; VOTE FOLLOWED THE MOTION: AYES: Evans; Godfrey; Smith, Vincent NOES: None ABSENT: Vogelsang ADMINISTRATIVE REVIEW NO. 84-82 Applicant: 'Charles'A. Lamb A request to permit a 5;577 Square Foot industrial building in M=1 Zone. Subject property is located at 17572 Griffin Lane (East side of Griffin Lane approximately 200 feet South of Slater Avenue). This request is covered by Negative Declaration No. 79-35. Ms. Pierce reported this is in a commercial business park and Staff would recommend approval. Jim Vincent called attention to the fact the trash receptacle was in a recessed area and would have to be of -7- 11/21/84 - BZA Minutes, H. B. Board of Zoning Adjustments November 21, 1984 Page 8 non-combustible material, and that security gates needed to be approved by the Fire Department UPON MOTION BY GODFREY AND SECOND BY EVANS, ADMINISTRATIVE REVIEW NO. 84-82 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL 1. The site plan, floor plans, and elevations received and dated - November 16, 1984, shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. AYES: Evans, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang SITE PLAN AMENDMENT NO. 84-26 Applicant: Rudi Van Mil A request to decrease Building "D" from 3,500 Square Feet to 2,430 Square Feet; to increase Building "C" from 5,200 Square Feet to 7,001 Square Feet, and to eliminate three (3) parking spaces at property located on the Northwest corner of Beach Boulevard and Slater Avenue. This request is covered by Negative Declaration No. 78-23. Ms; Pierce reported this is a revision to site plan approved by Use Permit No. 84=42. The rear building will match existing structures in the center; however; the proposed front building is different and will be occupied by Kentucky Fried Chicken. Board of Zoning Adjustments November 21; 1984 Page 10 Rudi Van Mil, the applicant, and Cheryl Nattress of Kentucky Fried Chicken, were present. UPON MOTION BY EVANS AND SECOND BY SMITH, SITE PLAN AMENDMENT NO. 84-26 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL 1. The building area, floor plan, and elevations received and dated November 5, 1984, shall be the approved layout for this amendment to Use Permit No. 84-42, which expires July 11, 1985. 2. The proposed restaurant shall be architecturally compatible with the existing commercial. center structures. Wall color shall be identical; window treatment and roof tile may be terra cotta red with a blue undertone with samples submitted to Department of Development Services for review before building permits are issued; and canopy style window treatment to match existing center. .3. All previous Conditions of Use Permit No. 84-42 shall be applicable (attached). -- AYES : Evans, Godfrey, Smith, Vincent NOES: None ABSENT: Vogelsang LOT LINE ADJUSTMENT NO. 84-13 Applicant: Edward B. Webb A request to adjust lot line between Lots 13 and 14. Subject property is located at 825-27 Frankfort -Avenue (North side of street South of Indianapolis Avenue). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Staff reported that in 1955, a portion of Lot 12 was dedicated to Lot 13 at back only. New owner would -like to take a portion of Lot 13 and allocate to Lot 14 and Lot 12 will remain the same. The applicant, Edward B. Webb, was present, and agreed to conditions presented. Board of Zoning Adjustments November 21, 1984 Page 11 UPON MOTION BY EVANS AND SECOND BY GODFREY- LOT LINE ADJUSTMENT NO. 84=13 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The lot line adjustment is consistent with the criteria outlined in Section 9811.3.1 of the Huntington Beach Ordinance Code. CONDITIONS'OF APPROVAL: 1. The applicant shall submit a copy of the recorded Lot Line Adjustment to the Department of Development Services. 2. A revised plat map shall be submitted to the City Engineer noting existing monuments. Additional monuments are required to show new property lines.
